بشأن اعتماد دليل الضوابط والاشتراطات الفنية لاستخدام الدراجات الهوائية والكهربائية
في إمارة أبوظبي

- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في امارة أبوظبي وتعديلاته،
- وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،
- وعلى المرسوم الأميري رقم (1) لسنة 2019 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي وتعديلاته،
- وعلى قرار المجلس التنفيذي رقم (11) لسنة 2022 بشأن تنظيم استخدام الدرجات في إمارة أبوظبي،
- وعلى دليل أبوظبي الإرشادي الصادر من مجلس أبوظبي للجودة والمطابقة بشأن الاستخدام الآمن للدراجات الهوائية والكهربائية والسكوترات،
- وعلى قرار رئيس دائرة البلديات والنقل رقم (21) لسنة 2022 بشأن تنظيم استخدام الدراجات في إمارة أبوظبي،
- وبناء على ما تقتضيه مصلحة العمل
قرر ما يلي:
المادة (1)
يُعتمد "دليل الضوابط والاشتراطات الفنية لاستخدام الدراجات الهوائية والكهربائية في إمارة أبوظبي" المرفق بهذا القرار.
المادة (2)
على جميع المرخص لهم الالتزام بأحكام الدليل المشار إليه.
المادة (3)
يُنشر هذا القرار في الجريدة الرسمية ويعمل من تاريخ نشره.

الهدف:
يهدف الدليل لتقديم الإرشادات والتوجهات إلى مستخدمي الدراجات الهوائية والكهربائية في أبوظبي، من حيث الاشتراطات الفنية وأنواع الدراجات المصرح باستخدامها، وتوضيح الغرامات المتعلقة بعدم الالتزام بالتعليمات والإرشادات المتعلقة باستخدام الدراجات ومعايير ومتطلبات السلامة، والطرق والمسارات والأماكن المصرح للدراجات استخدامها، وما يترتب على ذلك من غرامات في حال عدم الالتزام بها.

التعريفات:
| الدراجات | الدراجات الهوائية أو الكهربائية ذات عجلتين أو أكثر والتي تسير بقوة دفع راكباً أو بالطاقة الكهربائية، أو أية وسائل ترفيهية تسير على الطريق أو على مسار الدراجة، ويشمل ذلك على سبيل المثال لا الحصر السكوتر وألواح التزحلق. |
| مسار الدراجات | المسار الذي يتم تحديده من قبل دائرة البلديات والنقل لسير الدراجات حصراً. |
| المسارات | المسارات المحددة من قبل دائرة البلديات والنقل بلوحات إرشادية يلزم اتباعها من قبل مستخدمي الدراجات الهوائية والكهربائية. |

أنواع الدراجات الهوائية والكهربائية غير المصرح باستخدامها في الطرق والمسارات والمناطق العامة
يوضح الجدول أدناه جميع الدراجات الكهربائية ومواصفاتها، والتي يحظر استخدامها على الأرصفة في إمارة أبوظبي، حيث إنها غير آمنة للاستخدام في ممرات المشاة والأرصفة ومن حيث المواصفات الفنية (وزن الدراجة وحجمها وسرعتها) وقد تتسبب بحوادث وأضرار للمستخدم وللمشاة.

الاستثناءات الواردة على بعض أنواع الدراجات
الاستخدام على الأرصفة فقط:
تستثنى الدراجات الكهربائية الخاصة بالفئات التالية من الشروط والمتطلبات المتعلقة بأنواع الدراجات الهوائية والكهربائية المصرح باستخدامها من قبل كبار السن، أصحاب الحالات الصحية الخاصة وأصحاب الهمم.
يصرح الجهاز بحسب الحالة ومتطلبات الاستخدام فيما يخص كبار السن ويسمح بالمواصفات التالية:
- بأن تكون ذو 3-4 عجلات.
- أن لا يزيد العرض عن 165 سنتيمتر
- ان تكون السرعة لا تتعدى 15كم في الساعة.
- يسمح بوجود سلة في حال كانت ضمن مواصفات التصنيع.
المخالفات المتعلقة بعدم التقيد بالتعليمات والإرشادات ومعايير السلامة:
عدم التزام المستخدم بالإرشادات ومعايير السلامة الواردة تفصيلاً أدناه، يدخل تحت بند المخالفة رقم (2) الواردة من ضمن جدول المخالفات الإدارية على المستخدم، بموجب قرار معالي رئيس الدائرة رقم (21) لسنة 2022 بشأن تنظيم استخدام الدراجات في إمارة أبوظبي، والتي تحددت غرامتها بمبلغ 200 درهم على كل مخالفة. ويتضمن ذلك:
- السير على نهر الطريق.
- عدم اتباع التعليمات الواردة في اللوحات المرورية والإرشادية.
- عدم ارتداء خوذة واقية أثناء استخدام الدراجة.
- عدم ارتداء سترة أو ملابس عاكسة للضوء عند السير في الأماكن المظلمة.
- عدم إيقاف الدراجة في الأماكن المخصصة لها، وتركها بصورة تعيق حركة المركبات أو المشاة.
- تثبيت الدراجة على أعمدة الشواخص المرورية أو أعمدة الإنارة.
- عدم منح أولوية المرور للمشاة عند التقاطعات والأرصفة.
- عدم خفض السرعة عند ممرات عبور المشاة.
- عدم النزول من الدراجة عند عبور الطريق من معبر المشاة.
- عدم مراعاة ظروف المكان والطقس وغيرها من متطلبات السلامة.
- الإمساك بأي مركبة أو مقطورة متحركة أثناء استخدام للدراجة.
- استخدام الدراجات الهوائية والكهربائية على المسارات المخصصة لرياضة المشي والجري.
- حمل راكب ما لم تكن الدراجة مزودة بكافة المعدات المخصصة لذلك.
- حمل أي شيء يؤدي إلى اختلال توازن الدراجة.
- استعمال آلة التنبيه أو مسجل الدراجة بطريقة تسبب ضجيج أو إزعاج للآخرين.
- ارتداء السماعات الثنائية التي تعزل الأصوات المحيطة به عند قيادة الدراجة.
- عدم تركيب مصباح أبيض رئيسي أمامي ومصباح أحمر قابل للإضاءة ليلاً وعاكس للضوء باللون الأحمر وإنارة حمراء خلفية مرتبطة بالمكابح في الدراجة.
- عدم تركيب جهاز تنبيه مثبت على مقود الدراجة.
- عدم توفير مكابح على الإطارات الخلفية للدراجة.
- استخدام إطارات غير صالحة للسير وغير محكمة التثبيت في الدراجة.
- عدم تثبيت وشد أسلاك وعجلات وأجزاء الدراجة.
- عدم التوقف على مسافة لا تقل عن خمسة أمتار من الحافلات المدرسية في حالة توقفها.
أنواع المخالفات المتعلقة بالطرق والأماكن التي لا يجوز استخدام الدراجات فيها والغرامات المترتبة عليها:
عدم التزام المستخدم بالطرق والأماكن التي لا يجوز استخدام الدراجات الهوائية والكهربائية فيها الواردة تفصيلاً أدناه، يدخل تحت بند المخالفة رقم (4) الواردة من ضمن جدول المخالفات الإدارية على المستخدم، بموجب قرار معالي رئيس الدائرة رقم (21) لسنة 2022 بشأن تنظيم استخدام الدراجات في إمارة أبوظبي، والتي تحددت غرامها بمبلغ 500 درهم على كل مخالفة.
لا يجوز استخدام الدراجات الهوائية والكهربائية في الأماكن التالية:
- نهر الطريق (الشارع العام المستخدم للمركبات).
- المسارات المخصصة للمشي والجري فقط.
- الأرصفة ما لم يتم السماح باستخدامها من قبل مركز النقل المتكامل.
- الطرق السريعة (سرعة الطريق 60 كم/ ساعة وأكثر).
يصرح باستخدام الدراجات الهوائية والكهربائية في الأماكن التالية:
- المسارات المخصصة للدراجات الهوائية والكهربائية فقط.
- المسارات المشتركة للمشاة والدراجات الهوائية والكهربائية.
- الطرق الداخلية والفرعية - على كتف الطريق (سرعة الطرق 40 كم / ساعة وأقل).
- الأماكن المغلقة مثل الحدائق العامة.
- الأرصفة ذات المساحات الشاسعة للاستخدام والمحددة من قبل مركز النقل المتكامل (مثال: ممرات مشاة شارع السلام ممرات مشاة جزيرة الريم وغيرها ويتم تميزها عبر اللوحات الإرشادية).
Administrative Decision No. (87) of 2022
Regarding the Approval of the Manual of Technical Regulations and Requirements for the Use of Bicycles and Electric Bikes
in the Emirate of Abu Dhabi

- After reviewing Law No. (1) of 1974 on the Reorganization of the Government Apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (30) of 2019 on the Establishment of the Department of Municipalities and Transport,
- And Emiri Decree No. (1) of 2019 on the Reconstitution of the Executive Council of the Emirate of Abu Dhabi and its amendments,
- And Executive Council Resolution No. (11) of 2022 on Regulating the Use of Bicycles in the Emirate of Abu Dhabi,
- And the Abu Dhabi Guideline issued by the Abu Dhabi Quality and Conformity Council on the Safe Use of Bicycles, Electric Bikes, and Scooters,
- And the Chairman of the Department of Municipalities and Transport's Decision No. (21) of 2022 on Regulating the Use of Bicycles in the Emirate of Abu Dhabi,
- And based on the requirements of the public interest,
It is decided as follows:
Article (1)
The 'Manual of Technical Regulations and Requirements for the Use of Bicycles and Electric Bikes in the Emirate of Abu Dhabi', attached to this decision, is hereby approved.
Article (2)
All licensees must comply with the provisions of the aforementioned manual.
Article (3)
This decision shall be published in the Official Gazette and shall come into force from the date of its publication.

Objective:
The manual aims to provide guidance and direction to users of bicycles and electric bikes in Abu Dhabi regarding technical requirements and permitted types of bicycles. It clarifies the fines for non-compliance with instructions and guidelines for bicycle use, safety standards and requirements, and the roads, tracks, and places where bicycles are permitted, along with the resulting fines for non-compliance.

Definitions:
| Bicycles | Bicycles or electric bikes with two or more wheels that are propelled by a rider's pedaling or by electric power, or any recreational devices that operate on the road or a bicycle path, including but not limited to scooters and skateboards. |
| Bicycle Path | The path designated exclusively for bicycle use by the Department of Municipalities and Transport. |
| Tracks | The tracks designated by the Department of Municipalities and Transport with instructional signs that must be followed by users of bicycles and electric bikes. |
| Road | Any way open to public traffic without special permission, and any public place that accommodates the passage of vehicles and is accessible to the public, whether with or without permission or a license from a competent authority, and whether its use is for a fee or free of charge. |
| Carriageway | The part of the road where vehicles are permitted to travel. |
| Permitted Areas | The path designated by the Department of Municipalities and Transport with instructional signs that must be followed. |

The table below shows the bicycles and electric bikes permitted for use in the Emirate of Abu Dhabi in accordance with the requirements and standards approved under the Abu Dhabi Guideline for the Safe Use of Bicycles, Electric Bikes, and Scooters.

Types of Bicycles and Electric Bikes Not Permitted for Use on Roads, Tracks, and in Public Areas
The table below shows all electric bikes and their specifications, which are prohibited from use on sidewalks in the Emirate of Abu Dhabi, as they are unsafe for use on pedestrian walkways and sidewalks in terms of technical specifications (bike weight, size, and speed) and may cause accidents and harm to the user and pedestrians.

Exemptions for Certain Types of Bicycles
Use on Sidewalks Only:
Electric bikes for the following categories are exempt from the conditions and requirements related to the types of bicycles and electric bikes permitted for use: senior citizens, individuals with special health conditions, and people of determination.
The authority permits the following specifications for senior citizens, depending on the case and usage requirements:
- Must have 3-4 wheels.
- The width must not exceed 165 cm.
- The speed must not exceed 15 km/h.
- A basket is permitted if it is part of the manufacturing specifications.
Violations Related to Non-Compliance with Instructions, Guidelines, and Safety Standards:
Non-compliance by the user with the guidelines and safety standards detailed below falls under violation No. (2) listed in the table of administrative violations for users, pursuant to the Decision of His Excellency the Chairman of the Department No. (21) of 2022 on regulating the use of bicycles in the Emirate of Abu Dhabi, for which the fine is set at AED 200 for each violation. This includes:
- Riding on the carriageway.
- Not following the instructions on traffic and instructional signs.
- Not wearing a protective helmet while using the bicycle.
- Not wearing a reflective vest or clothing when riding in dark places.
- Not parking the bicycle in designated areas, and leaving it in a way that obstructs the movement of vehicles or pedestrians.
- Securing the bicycle to traffic sign poles or light poles.
- Not giving priority to pedestrians at intersections and on sidewalks.
- Not reducing speed at pedestrian crossings.
- Not dismounting from the bicycle when crossing the road at a pedestrian crossing.
- Not taking into account site conditions, weather, and other safety requirements.
- Holding onto any moving vehicle or trailer while using the bicycle.
- Using bicycles and electric bikes on tracks designated for walking and jogging.
- Carrying a passenger unless the bicycle is equipped with all the necessary equipment for it.
- Carrying anything that leads to the imbalance of the bicycle.
- Using the bicycle's horn or sound device in a way that causes noise or disturbance to others.
- Wearing dual headphones that isolate surrounding sounds while riding the bicycle.
- Not installing a main white front light, a red light that can be illuminated at night, a red reflector, and a rear red light connected to the brakes on the bicycle.
- Not installing an alarm device (bell/horn) on the bicycle's handlebars.
- Not having brakes on the rear tires of the bicycle.
- Using tires that are not roadworthy or are not securely fastened to the bicycle.
- Failure to secure and tighten the bicycle's wires, wheels, and parts.
- Failure to stop at a distance of no less than five meters from a stopped school bus.
Types of Violations Related to Roads and Places Where Bicycles Are Not Permitted and Their Corresponding Fines:
Non-compliance by the user with the rules for roads and places where bicycles and electric bikes are not permitted, as detailed below, falls under violation No. (4) listed in the table of administrative violations for users, pursuant to the Decision of His Excellency the Chairman of the Department No. (21) of 2022 on regulating the use of bicycles in the Emirate of Abu Dhabi, for which the fine is set at AED 500 for each violation.
Bicycles and electric bikes are not permitted in the following places:
- The carriageway (public street used by vehicles).
- Tracks designated for walking and jogging only.
- Sidewalks, unless their use is permitted by the Integrated Transport Centre.
- Highways (road speed 60 km/h and more).
Bicycles and electric bikes are permitted in the following places:
- Tracks designated for bicycles and electric bikes only.
- Shared paths for pedestrians, bicycles, and electric bikes.
- Internal and sub-main roads - on the road shoulder (road speed 40 km/h and less).
- Enclosed areas such as public parks.
- Sidewalks with vast areas for use, as specified by the Integrated Transport Centre (e.g., Al Salam Street pedestrian walkways, Al Reem Island pedestrian walkways, etc., and are distinguished by instructional signs).
