قرار رئيس الدائرة رقم (37) لسنة 2013
بشأن ترخيص وتأجير واستعمال الدراجات المائية
رئيس الدائرة:-
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بشأن إعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي وتعديلاته؛
- وعلى القانون رقم (4) لسنة 2006 في شأن إنشاء دائرة النقل المعدل بالقانون رقم (5) لسنة 2008؛
- وعلى المرسوم الأميري رقم (15) لسنة 2010 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبو ظبي؛
- وعلى القانون رقم (7) لسنة 2006 في شأن ترخيص وتأجير واستعمال الدراجات المائية ولائحته التنفيذية؛
- وعلى قرارات المجلس التنفيذي:
- قرار رئيس المجلس التنفيذي رقم (36) لسنة 2007 بإصدار اللائحة التنفيذية للقانون رقم (7) لسنة 2006 في شأن ترخيص وتأجير واستعمال الدراجات المائية؛
- وقرار اللجنة التنفيذية رقم "3" جـ 2009/14" بشأن أماكن وضوابط استخدام الدراجات المائية؛
- وقرار لجنة البنية التحتية والبيئة رقم "ب ت 10 جـ 2009/22" بشأن تحديد أماكن استخدام الدراجات المائية وضوابط السرعة؛
- وقرار لجنة البنية التحتية والبيئة رقم "ب ت أ جـ 2010/7" بشأن تحديد مناطق إنزال واستخدام الدراجات المائية؛
وبناء على ما تقتضيه المصلحة العامة،
قررنا ما يلي:-
مادة (1)
في تطبيق أحكام هذا القرار تكون للكلمات والعبارات التالية المعاني الواردة قرين كل منها ما لم يقض سياق النص بغير ذلك:
الإمارة: إمارة أبو ظبي
الدائرة: دائرة النقل
الجهاز: جهاز حماية المنشآت الحيوية والسواحل
القانون: القانون رقم (7) لسنة 2006 في شأن ترخيص وتأجير واستعمال الدراجات المائية.
اللائحة التنفيذية: اللائحة التنفيذية للقانون رقم (7) لسنة 2006 الصادرة بموجب قرار رئيس المجلس التنفيذي رقم (36) لسنة 2007.
المنشأة: كل شخص اعتباري رخص له بمزاولة أعمال تأجير الدراجات المائية للغير وفقًا لأحكام القانون.
مستخدم الدراجة المائية: كل شخص طبيعي يقود دراجة مائية سواء كان مالكًا أو مستأجرًا لها أو مخولاً من المالك بقيادتها.
مرتادي البحر: كل شخص يرتاد أو يستخدم الشاطئ أو يدخل البحر بأية وسيلة كانت.
مادة (2)
تتولى الدائرة بالتنسيق مع الجهات المعنية تحديد أماكن استخدام وتأجير الدراجات المائية في الإمارة وضوابط السرعات والمسافات المحددة لها، ووضع معايير السلامة اللازمة لاستخدامها، وفقًا للملاحق المرفقة بهذا القرار والموضحة عناوينها أدناه:
* ملحق (أ) الأماكن المحظور استخدام الدراجات المائية فيها.
* ملحق (ب) أشكال اللوحات الإرشادية ومدلولاتها.
* ملحق (ج) جدول السرعات والمسافات.
* ملحق (د) آلية تسجيل الدراجات المائية للأفراد والمنشآت.
* ملحق (هـ) معدات السلامة الخاصة بالدراجات المائية.
* ملحق (و) جدول المخالفات.
مادة (3)
لا يجوز لأي منشأة مزاولة أعمال تأجير الدراجات إلا بتوافر الشروط المنصوص عليها في القانون ولائحته التنفيذية وكذلك المشار إليها في هذا القرار؛ ولهذا الغرض يتوجب مراعاة ما يلي:
1- الحصول على موافقة الدائرة لإصدار الرخصة التجارية من دائرة التنمية الاقتصادية.
2- الالتزام بعدد الدراجات المسموح بتأجيرها في كل موقع بحسب الدراسات المعتمدة لدى الدائرة.
3- تسجيل الدراجات قبل المباشرة بمزاولة النشاط.
مادة (4)
يشترط لاستخدام الدراجات المائية من قبل الأفراد مراعاة الاشتراطات المنصوص عليها في القانون ولائحته التنفيذية وكذلك تلك المشار إليها في هذا القرار، ولهذا الغرض يتوجب تسجيل الدراجة قبل استخدامها.
مادة (5)
1- على جميع المنشآت والأفراد مالكي الدراجات المائية قبل صدور هذا القرار توفيق أوضاعها بتسجيل دراجاتهم في موعد أقصاه 2013/10/31 للمنشآت و2013/12/31 للأفراد.
2- لا تعفي الفقرة الأولى من هذه المادة المنشآت ومستخدمي الدراجات المائية من الالتزام في جميع الأوقات باشتراطات الأمن والسلامة المعمول بها في كافة القوانين واللوائح والقرارات المرعية للإجراء وفي طليعتها عدم دخول الأماكن المحظور استخدام الدراجات المائية فيها وعدم القيادة بتهور.
مادة (6)
على جميع مرتادي البحر الالتزام باللوحات الإرشادية المدرجة في الملحق (ب) من هذا القرار.
مادة (7)
يجوز للدائرة وفي الحالات التي تراها مناسبة منح تصاريح عبور في المناطق المحظور استخدام الدراجات فيها، وعلى سائق الدراجة الذي أعطي له التصريح ألا يتجاوز سرعة (6) عقد لدى عبور تلك المناطق.
مادة (8)
يتولى مفتشو الدائرة مهمة الإشراف على تطبيق هذا القرار بالتنسيق مع الجهاز بما في ذلك مراقبة ومتابعة مستخدمي الدراجات المائية ومنشآتها، ولهم في سبيل ذلك ضبط المخالفات وفقًا للقوانين واللوائح والقرارات المنظمة لها.
مادة (9)
1- مع مراعاة العقوبات المعمول بها لدى دائرة التنمية الاقتصادية والمتعلقة بشروط الترخيص التجاري وأية عقوبة أشد ينص عليها قانون آخر، تطبق على المخالفين لأحكام هذا القرار أحكام المادة السابعة من القانون.
2- يعد مخالفًا لأحكام القانون كل من يرتكب إحدى المخالفات المدرجة في الملحق (و) من هذا القرار.
مادة (10)
ينشر هذا القرار في الجريدة الرسمية، ويعمل به من تاريخ صدوره.

الملحق (جـ)
السرعات والمسافات
على مستخدمي الدراجات المائية التقيد بما يلي:
1- عدم تجاوز حدود السرعة المسموح بها.
2- عدم تعمد الاستعراض أثناء القيادة بما يؤدي إلى تطاير الأمواج على الآخرين.
3- عدم قيادة الدراجة المائية في حال كانت الأحوال الجوية أو الرؤية سيئة ومراعاة حركة المرور في منطقة التشغيل لتحديد السرعة الآمنة.
4- تخفيف السرعة إلى (6) عقد أو أدنى والحفاظ على مسافة كافية على النحو التالي:

الملحق (د)
آلية تسجيل الدراجات المائية للأفراد والمنشآت
* يتعين على أصحاب الدراجات المائية الحضور إلى مكتب دائرة النقل المركز الموحد - منطقة الميناء) للقيام بالفحص الفني للدراجة المائية حسب المتطلبات الفنية المعتمدة بالدائرة.
* بعد اجتياز الدراجة المائية الفحص الفني بنجاح يتم تعبئة نموذج طلب التسجيل من طرف صاحب الدراجة المائية أو من ينوب عنه بتوكيل رسمي).
* يسلم نموذج طلب التسجيل بعد تعبئته إلى دائرة النقل المركز الموحد مرفقًا بالمستندات التالية:
1- بطاقة هوية سارية المفعول.
2- فاتورة شراء الدراجة (1) المائية أو أية وثيقة أخرى تثبت ملكيتها.
3- نسخة طبق الأصل من شهادة التخليص الجمركي للدراجات (2) المائية في حال استيرادها من خارج الدولة.
4- وثيقة تأمين شاملة للمنشآت وضد الغير للأفراد صالحة لمدة 13 شهرًا وصادرة من إحدى شركات التأمين المرخصة.
5- شهادة اجتياز الدراجة المائية للفحص الفني.
6- نسخة من الرخصة التجارية سارية المفعول في حال كانت الدراجة ملك لشركة أو لمؤسسة).
7 - أية مستندات أو متطلبات أخرى ترى الدائرة ضرورة توفيرها لتسجيل وترخيص الدراجة المائية.
* بعد استيفاء كافة المستندات المطلوبة، تصدر دائرة النقل رخصة الدراجة المائية وصلاحيتها سنة واحدة من تاريخ الإصدار.
* في حالة التسجيل لأول مرة، يتم تثبيت الرقم التعريفي على الدراجة المائية وفقًا للمتطلبات المعمول بها في الدائرة.
الملحق (هـ)
معدات السلامة الخاصة بالدراجات المائية
* يتوجب على مستخدمي الدراجات المائية تأمين معدات السلامة التالية:

| 3- الصفارة: تستخدم لطلب الاستغاثة أو تنبيه الآخرين. |
| 4- النظارة: لحماية العينين من رذاذ الماء. |
| 5- الخوذة الواقية: لحماية مستخدم الدراجة من الصدمات. |
جداول المخالفات
تعتبر مخالفة لأحكام القانون رقم (7) لسنة 2006 في شأن ترخيص وتأجير واستعمال الدراجات المائية ولائحته التنفيذية ما يلي:
1- المخالفات الخاصة بتأجير الدراجات

| 5 | عدم وضع اللوحة الإعلانية للاسم التجاري بالشكل المطلوب |
| 6 | عدم توفير مساحة كافية للدراجات |
| 7 | عدم توفير مستلزمات الإسعافات الأولية والإنقاذ السريع |
| 8 | استخدام المحل كليًا أو جزئيًا للسكن |
| 9 | عدم المحافظة على النظافة |
| 10 | عدم توفير قارب نجاة لاستخدامه عند الضرورة |
| 11 | عدم الالتزام بأوقات العمل المصرح بها من جهة الترخيص |
| 12 | الامتناع دون مبرر عن إبراز صورة الترخيص التجاري ووثائق ترخيص الدراجات أو أية وثائق أخرى ذات صلة |
| 13 | عدم إعداد السجلات المطلوبة للعاملين والدراجات والمستأجرين والاحتفاظ بها على الدوام |
| 14 | عدم توفير أجهزة ومعدات الرقابة والسلامة والإسعافات الأولية في مواقع التأجير |

3- المخالفات المشتركة بين المؤجرين والمستخدمين
| 1 | استعمال أو تأجير دراجة غير مهيئة فنيًا وميكانيكيًّا وفق المتطلبات المنصوص عليها في المادة (15) من اللائحة التنفيذية |
| 2 | تسريب أو إلقاء أي زيوت أو فضلات أخرى سائلة أو صلبة في المناطق البحرية |
| 3 | تزويد الدراجات بالوقود داخل البحر |
تحال جميع المخالفات المتصلة بترخيص المنشآت إلى دائرة التنمية الاقتصادية لاتخاذ ما يلزم بشأنها وتطبيق الغرامات المعمول بها لديها.
ولهذا الغرض تعتبر من مخالفات الترخيص على سبيل المثال لا الحصر ما يلي:
1- مزاولة نشاط تأجير الدراجات المائية دون ترخيص.
2- مزاولة نشاط آخر دون ترخيص أو بدون الحصول على الترخيص اللازم.
3- العمل لساعات إضافية بدون تصريح.
ولأغراض تطبيق هذه اللائحة، تطبق الغرامات المنصوص عليها في القانون وذلك على النحو التالي:
1- ألف درهم وتضاعف في حال التكرار على المنشآت التي تقوم بتأجير الدراجات خلافًا لأحكام القانون ولائحته التنفيذية والقرارات الأخرى ذات الصلة والصادرة عن دائرة النقل.
2- خمسمائة درهم وتضاعف في حال التكرار على مستخدمي ومستأجري الدراجات المائية بالمخالفة لأحكام القانون ولائحته التنفيذية والقرارات الأخرى ذات الصلة والصادرة عن دائرة النقل.
Decision of the Chairman of the Department No. (37) of 2013
Concerning the Licensing, Rental, and Use of Jet Skis
The Chairman of the Department:-
- Having reviewed Law No. (1) of 1974 Regarding the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments;
- And Law No. (4) of 2006 Concerning the Establishment of the Department of Transport, as amended by Law No. (5) of 2008;
- And Emiri Decree No. (15) of 2010 Concerning the Restructuring of the Executive Council of the Emirate of Abu Dhabi;
- And Law No. (7) of 2006 Concerning the Licensing, Rental, and Use of Jet Skis and its Executive Regulation;
- And the resolutions of the Executive Council:
- Resolution of the Chairman of the Executive Council No. (36) of 2007 Issuing the Executive Regulation for Law No. (7) of 2006 Concerning the Licensing, Rental, and Use of Jet Skis;
- And Resolution of the Executive Committee No. "3" C 2009/14" Regarding the Locations and Controls for the Use of Jet Skis;
- And Resolution of the Infrastructure and Environment Committee No. "BT 10 C 2009/22" Regarding the Determination of Locations for the Use of Jet Skis and Speed Controls;
- And Resolution of the Infrastructure and Environment Committee No. "BT A C 2010/7" Regarding the Determination of Areas for Launching and Using Jet Skis;
And based on what is required by the public interest,
We have decided the following:-
Article (1)
In the application of the provisions of this Decision, the following words and phrases shall have the meanings assigned to each of them, unless the context requires otherwise:
The Emirate: The Emirate of Abu Dhabi
The Department: The Department of Transport
The Authority: Critical Infrastructure and Coastal Protection Authority
The Law: Law No. (7) of 2006 Concerning the Licensing, Rental, and Use of Jet Skis.
The Executive Regulation: The Executive Regulation for Law No. (7) of 2006, issued by Resolution of the Chairman of the Executive Council No. (36) of 2007.
The Establishment: Any legal person licensed to engage in the business of renting jet skis to others in accordance with the provisions of the Law.
Jet Ski User: Any natural person who operates a jet ski, whether as an owner, renter, or authorized by the owner to operate it.
Sea-goers: Any person who frequents or uses the beach or enters the sea by any means.
Article (2)
The Department, in coordination with the concerned authorities, shall determine the locations for the use and rental of jet skis in the Emirate, the speed limits and distances specified for them, and establish the necessary safety standards for their use, according to the appendices attached to this Decision, whose titles are shown below:
* Appendix (A) Areas where the use of jet skis is prohibited.
* Appendix (B) Forms and meanings of instructional signs.
* Appendix (C) Table of speeds and distances.
* Appendix (D) Mechanism for registering jet skis for individuals and establishments.
* Appendix (E) Safety equipment for jet skis.
* Appendix (F) Schedule of violations.
Article (3)
No establishment may engage in the business of renting jet skis unless the conditions stipulated in the Law and its Executive Regulation, as well as those referred to in this Decision, are met; for this purpose, the following must be observed:
1- Obtaining the Department's approval to issue the commercial license from the Department of Economic Development.
2- Adhering to the number of jet skis permitted for rental at each location according to the studies approved by the Department.
3- Registering the jet skis before commencing the activity.
Article (4)
For the use of jet skis by individuals, it is required to observe the conditions stipulated in the Law and its Executive Regulation, as well as those referred to in this Decision, and for this purpose, the jet ski must be registered before use.
Article (5)
1- All establishments and individuals who own jet skis before the issuance of this Decision must regularize their status by registering their jet skis no later than 31/10/2013 for establishments and 31/12/2013 for individuals.
2- The first paragraph of this Article does not exempt establishments and jet ski users from adhering at all times to the security and safety requirements in force in all applicable laws, regulations, and decisions, foremost among which is not entering areas where the use of jet skis is prohibited and not driving recklessly.
Article (6)
All sea-goers must adhere to the instructional signs listed in Appendix (B) of this Decision.
Article (7)
The Department may, in cases it deems appropriate, grant transit permits in areas where the use of jet skis is prohibited, and the driver of the jet ski who has been given the permit shall not exceed a speed of (6) knots when transiting those areas.
Article (8)
The Department's inspectors shall be responsible for supervising the implementation of this Decision in coordination with the Authority, including monitoring and following up on jet ski users and their establishments, and for this purpose, they may record violations in accordance with the laws, regulations, and decisions that regulate them.
Article (9)
1- Without prejudice to the penalties in force with the Department of Economic Development related to commercial licensing conditions and any more severe penalty provided for by another law, the provisions of Article Seven of the Law shall apply to violators of the provisions of this Decision.
2- Anyone who commits one of the violations listed in Appendix (F) of this Decision shall be considered a violator of the provisions of the Law.
Article (10)
This Decision shall be published in the Official Gazette and shall come into effect from the date of its issuance.

Appendix (C)
Speeds and Distances
Jet ski users must adhere to the following:
1- Do not exceed the permitted speed limit.
2- Do not deliberately perform stunts while driving that cause waves to splash on others.
3- Do not operate the jet ski if weather conditions or visibility are poor, and take into account the traffic in the operating area to determine a safe speed.
4- Reduce speed to (6) knots or lower and maintain a sufficient distance as follows:

Appendix (D)
Mechanism for Registering Jet Skis for Individuals and Establishments
* Jet ski owners must come to the Department of Transport's Unified Central Office - Mina (Port) Area to conduct a technical inspection of the jet ski according to the technical requirements approved by the Department.
* After the jet ski successfully passes the technical inspection, the registration application form is filled out by the jet ski owner (or their representative with an official power of attorney).
* The completed registration application form is submitted to the Department of Transport's Unified Central Office along with the following documents:
1- Valid ID card.
2- Purchase invoice for the jet ski (1) or any other document proving ownership.
3- A true copy of the customs clearance certificate for the jet ski (2) if imported from outside the country.
4- Comprehensive insurance policy for establishments and third-party liability for individuals, valid for 13 months and issued by a licensed insurance company.
5- Certificate of passing the technical inspection for the jet ski.
6- A copy of the valid commercial license if the jet ski is owned by a company or institution.
7- Any other documents or requirements that the Department deems necessary for the registration and licensing of the jet ski.
* After all required documents are fulfilled, the Department of Transport issues the jet ski license, valid for one year from the date of issuance.
* For first-time registration, the identification number will be affixed to the jet ski in accordance with the requirements in force at the Department.
Appendix (E)
Safety Equipment for Jet Skis
* Jet ski users must provide the following safety equipment:

| 2- Engine kill switch lanyard: Attached to the user's wrist to stop the engine if they fall off the jet ski. |
| 3- Whistle: Used to call for help or alert others. |

| 5- Protective helmet: To protect the user from impacts. |
Schedules of Violations
The following are considered a violation of the provisions of Law No. (7) of 2006 Concerning the Licensing, Rental, and Use of Jet Skis and its Executive Regulation:
1- Violations related to jet ski rental
| 1 | Failure to adhere to the locations authorized for conducting the rental activity |
| 2 | Renting an unlicensed or expired-license jet ski |
| 3 | Failure to provide a supervisor with marine rescue skills and a specialized instructor for jet ski use |
| 4 | Failure to comply with the required shop space |
| 5 | Failure to display the trade name sign in the required manner |
| 6 | Failure to provide sufficient space for jet skis |
| 7 | Failure to provide first aid and rapid rescue supplies |
| 8 | Using the shop, in whole or in part, for accommodation |
| 9 | Failure to maintain cleanliness |
| 10 | Failure to provide a lifeboat for use when necessary |
| 11 | Failure to adhere to the working hours authorized by the licensing authority |
| 12 | Refusing without justification to show a copy of the commercial license, jet ski license documents, or any other relevant documents |
| 13 | Failure to prepare and always maintain the required records for employees, jet skis, and renters |
| 14 | Failure to provide monitoring, safety, and first aid equipment and devices at rental sites |
| 15 | Failure to require the jet ski renter to wear a life jacket |
| 16 | Failure to provide jet ski renters with the necessary information on how to use them and the areas where jet ski use is permitted or prohibited |
| 17 | Failure to prepare a form with the terms of use for the jet ski and require the renter to sign it before receiving it |
| 18 | Failure to comply with the fuel storage conditions approved by the Civil Defense Department |
| 19 | Failure to provide a sufficient number of seats for users and install umbrellas to protect them from the sun |
| 20 | Renting a jet ski to someone under fourteen without a specialized instructor or a supervisor over 18 years of age, or with an engine exceeding 1200 cc |
| 21 | Renting a jet ski to a person between the ages of fourteen and seventeen without the presence of a legal guardian |
| 22 | Renting a jet ski to a person showing signs indicating unfitness to operate it (mental or physical impairments) |
| 23 | Failure to verify that the renter can swim |
| 24 | Renting a jet ski with expired insurance |
| 25 | Renting jet skis that do not meet safety conditions or may pose a danger to their users |
2- Violations by jet ski users
| 1 | Operating a jet ski without a license or with an expired license |
| 2 | Operating a jet ski by a person under the age of (14) without a specialized instructor or a companion over 18 years of age, or with an engine exceeding 1200 cc |
| 3 | Using jet skis in areas other than those authorized |
| 4 | Using jet skis before sunrise or after sunset |
| 5 | Launching the jet ski in areas not designated for that purpose |
| 6 | Failure to exercise caution and care when launching and returning |
| 7 | Loading the jet ski with more people than authorized |
| 8 | Not wearing a life jacket |
| 9 | Failure to attach the jet ski's ignition key to the driver's wrist, clothing, or life jacket |
| 10 | Failure to stay away from the shore while driving by a distance of no less than (500) feet towards the open sea and not exceeding one nautical mile in length from the launch site |
| 11 | Using the jet ski near public places or areas populated by beachgoers, or disturbing them |
| 12 | Reckless driving |
| 13 | Failure to comply with maritime navigation laws and endangering boats and various marine facilities |
| 14 | Absence of numbers on the jet ski, or concealing or modifying the numbers without referring to the competent authority |
| 15 | Failure to comply with the orders of security authority personnel or fleeing from them |
| 16 | Failure to report or provide information about a collision accident |
| 17 | Damage to the jet ski's registration certificate |
3- Joint violations by renters and users
| 1 | Using or renting a jet ski that is not technically and mechanically prepared according to the requirements stipulated in Article (15) of the Executive Regulation |
| 2 | Leaking or discharging any oils or other liquid or solid waste into marine areas |
| 3 | Refueling jet skis in the sea |
All violations related to the licensing of establishments shall be referred to the Department of Economic Development to take necessary action and apply the fines in force with them.
For this purpose, the following are considered licensing violations, for example, but not limited to:
1- Engaging in the activity of renting jet skis without a license.
2- Engaging in another activity without a license or without obtaining the necessary license.
3- Working overtime without a permit.
For the purposes of applying this regulation, the fines stipulated in the Law shall be applied as follows:
1- One thousand dirhams, doubled in case of repetition, for establishments that rent jet skis in violation of the provisions of the Law, its Executive Regulation, and other relevant decisions issued by the Department of Transport.
2- Five hundred dirhams, doubled in case of repetition, for users and renters of jet skis in violation of the provisions of the Law, its Executive Regulation, and other relevant decisions issued by the Department of Transport.
