Law No. (8) of 2000
Concerning Cattle and Livestock Farms and Poultry and Ostrich Breeding Farms
We, Khalifa bin Zayed Al Nahyan - Deputy Ruler of Abu Dhabi,
- Pursuant to the powers vested in us by the Ruler of Abu Dhabi,
- And having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Body in the Emirate of Abu Dhabi and its amendments,
- And Law No. (2) of 1971 concerning the National Consultative Council and its amendments,
- And Law No. (11) of 1979 concerning Land Registration and its amendments,
- And Federal Law No. (3) of 1987 promulgating the Penal Code,
- And based on the proposal of the Chairman of the Abu Dhabi Municipality and Town Planning Department, and the approval of the Executive Council,
Have enacted the following Law:
Article One
The decision to allocate farms shall be issued to UAE citizens ordinarily residing within the jurisdiction of the concerned Department.
Article Two
The Department shall act on behalf of the Government of Abu Dhabi in signing farm lease contracts, and the area shall be set at 400m x 500m for each farm.
Article Three
The lease term for a farm shall be (20) twenty years, renewable for a similar term. The lease contract shall specify the purpose for which the farm is allocated. The lease contract shall be registered with the Land Registrar at the Department.
Article Four
The annual rent for farms shall be five fils per square meter, payable upon signing the contract.
Article Five
Farms may not be used for purposes other than those for which they were allocated. In case of changing the farm's activity from cattle and livestock breeding to poultry and ostrich breeding, or vice versa, the approval of the concerned Department must be obtained. The activity for which the farm is allocated must be practiced within a maximum period of one and a half years from the date of allocation; otherwise, the contract shall be considered automatically terminated, and the allocation decision shall be canceled.
Article Six
It is not permissible to sublet the farm in whole or in part, or all or part of the buildings constructed thereon, to third parties. It is also not permissible to sell the farms or establish any real rights thereon.
Article Seven
Abu Dhabi city farms shall be allocated in the area designated for this purpose by the Department outside the city. Al Ain city farms shall be allocated in the area designated for them by the Al Ain Municipality Department, between Al Ain city and Sweihan.
Article Eight
Buildings may be constructed for the farm's establishment and for the residence of guards, supervisors, veterinarians, and workers on the farms, provided that they are within the farm's boundaries, with an area not exceeding (200) two hundred square meters, and located at the edge of the farm, in accordance with the building conditions specified by the Department.
Article Nine
The concerned Department shall specify the constructional and health conditions that must be met in the farms for the establishment of facilities and for practicing animal breeding activities therein.
Article Ten
In the event of the lease contract's expiration or any renewed term and the Government's unwillingness to renew it, or in the event the lessee notifies the Government of their unwillingness to continue using the farm, the land and the buildings thereon shall revert to the Government, and the lessee shall be compensated only for the value of the buildings at the prevailing price at the time of the farm's reversion to the Government.
Article Eleven
In the event the farm is used for a purpose other than that for which it was allocated, or in the event the farm, in whole or in part, or the buildings thereon, in whole or in part, are sublet to third parties, or in the event of permanent cessation of the activity, or in the event of a delay in paying the rent for more than six months from its due date, the lessee shall be notified of the violation. If it is not rectified within a reasonable period determined by the Department, the contract shall be considered terminated, and the land and the buildings thereon shall revert to the Government without compensating the lessee for the buildings constructed thereon.
Article Twelve
Anyone who violates the provisions of this Law shall be punished with a fine not exceeding (3,000) three thousand dirhams and imprisonment for a term not exceeding (3) three months, or one of these two penalties.
Article Thirteen
The Chairman of the Department shall issue the necessary decisions to implement the provisions of this Law.
Article Fourteen
Any provision that contradicts the provisions of this Law is hereby repealed.
Article Fifteen
This Law shall be published in the Official Gazette and shall come into force from the date of its publication.
