قانون رقم (11) لسنة 2020
بشأن تنظيم الرعي في إمارة أبوظبي
نحن خليفة بن زايد آل نهيان، حاكم أبوظبي.
- - بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.
- - وعلى القانون رقم (2) لسنة 1971 في شأن المجلس الاستشاري الوطني وتعديلاته.
- - وعلى القانون رقم (13) لسنة 2005 بشأن تنظيم الرعي بإمارة أبوظبي وتعديلاته.
- - وعلى القانون رقم (16) لسنة 2005 بشأن إعادة تنظيم هيئة البيئة - أبوظبي وتعديلاته.
- - وعلى القانون رقم (7) لسنة 2019 بإنشاء هيئة أبوظبي للزراعة والسلامة الغذائية.
- - وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل.
- - وعلى القانون الاتحادي رقم (24) لسنة 1999 في شأن حماية البيئة وتنميتها وتعديلاته.
- - وعلى قرار رئيس المجلس التنفيذي رقم (73) لسنة 2015 بشأن تنظيم شؤون العزب.
- - وبناءً على ما عُرض على المجلس التنفيذي، وموافقة المجلس عليه.
أصدرنا القانون الآتي:
مادة (1)
في تطبيق أحكام هذا القانون، يكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها، ما لم يدل سياق النص على خلاف ذلك:

مادة (2)
- • يسمح بالرعي بعد الحصول على الترخيص وذلك وفقًا لما يحدده هذا القانون ولائحته التنفيذية.
- • لا يجوز التنازل عن الترخيص إلا بعد الحصول على موافقة الهيئة.
مادة (3)
- • تحدد الهيئة مواسم الرعي بناء على الدراسات التقييمية لحالة الغطاء النباتي، وأية معايير أخرى تراها ضرورية.
- • تحدد الهيئة مناطق الرعي بناء على المعايير الآتية:
- أن تكون مناطق الرعي خارج نطاق (2) كيلومتر من المحميات الطبيعية.
- أن تكون مناطق الرعي خارج نطاق الموائل الطبيعية الحرجة وأي مناطق أخرى تحددها الهيئة.
مادة (4)
- • يشترط في طالب ترخيص الرعي ما يلي:
- أن يكون من مواطني دولة الإمارات العربية المتحدة، وألا يقل عمره عن واحد وعشرين سنة ميلادية.
- أن يكون حاصلاً على شهادة معتمدة وسارية المفعول تفيد ملكيته للثروة الحيوانية من الجهات المعنية.
- أن يكون حائزًا على شهادة تفيد بأن ثروته الحيوانية مسجلة في نظام تعريف وتسجيل الحيوانات بالإمارة لدى الجهات المعنية.
- أن يكون حاصلاً على ترخيص عزبة رعي صادر من الجهات المعنية.
- • لطالب الترخيص التظلم من قرار رفض طلبه لدى الهيئة خلال (30) يومًا من تاريخ تبليغه بقرار الرفض وفقًا للإجراءات المحددة في اللائحة التنفيذية لهذا القانون.
- • تمنح رخصة الرعي لمدة سنة واحدة قابلة للتجديد، وتحدد اللائحة التنفيذية لهذا القانون المستندات والمدد والإجراءات اللازمة لتقديم طلب الترخيص أو تجديده.
- • تحدد اللائحة التنفيذية لهذا القانون الاشتراطات البيئية للرعي.
مادة (5)
يُحظر القيام بالآتي:
- الرعي دون الحصول على الترخيص.
- الرعي خارج مناطق الرعي.
- استخدام الدراجات أو السيارات أو أي نوع من المركبات أو الآليات في مناطق الرعي بغرض التسلية.
- بناء مبنى دائم أو مؤقت أو أي جزء منه داخل مناطق الرعي.
- الرعي في غير مواسم الرعي.
- وضع أسيجة أو أدوات أو مخلفات في مناطق الرعي.
- ترك الثروة الحيوانية ترعى دون مرافقة.
- عدم المحافظة على النظافة العامة في مناطق الرعي.
- عدم إبراز ترخيص الرعي و/أو صورة عنه عند طلبه من قبل موظفي الهيئة.
مادة (6)
يعاقب بالحبس مدة لا تزيد على الشهر، وبغرامة لا تتجاوز مائة ألف درهم، أو بإحدى هاتين العقوبتين، كل من يخالف أي حكم من أحكام المادة (5) من هذا القانون، وتضاعف العقوبة في حالة العود.
مادة (7)
يصدر رئيس دائرة القضاء - أبوظبي بالاتفاق مع رئيس مجلس إدارة الهيئة قرارًا بتحديد موظفي الهيئة الذين تكون لهم صفة مأموري الضبط القضائي بالنسبة للجرائم أو المخالفات التي تقع في دائرة اختصاصاتهم ويكون لهم حق التفتيش والرقابة للتحقق من الالتزام بأحكام هذا القانون واللوائح والقرارات والتعاميم الصادرة تنفيذاً له.
مادة (8)
- • للهيئة الحق في اتخاذ أي من الجزاءات الإدارية الآتية:
- لفت النظر.
- الإنذار.
- تعليق الترخيص مؤقتًا.
- إلغاء الترخيص.
- • يجوز التظلم من الجزاء الإداري أمام الهيئة خلال ستين يومًا من تاريخ تبليغ الجزاء الإداري للمتظلم وذلك وفقًا للإجراءات المحددة في اللائحة التنفيذية لهذا القانون.
مادة (9)
على المخاطبين بأحكام هذا القانون، توفيق أوضاعهم وفقًا لأحكامه خلال فترة لا تتجاوز ستة أشهر من تاريخ نشره في الجريدة الرسمية.
مادة (10)
- • يصدر رئيس مجلس إدارة الهيئة بعد موافقة المجلس التنفيذي اللائحة التنفيذية لهذا القانون.
- • يستمر العمل بالسياسات واللوائح والقرارات والتعاميم السارية بما لا يتعارض مع أحكام هذا القانون.
- • يصدر رئيس مجلس إدارة الهيئة السياسات والقرارات والتعاميم اللازمة لتنفيذ أحكام هذا القانون.
مادة (11)
- • يُلغى القانون رقم (13) لسنة 2005 المشار إليه.
- • يُلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القانون.
مادة (12)
يُنشر هذا القانون في الجريدة الرسمية، ويُعمل به من تاريخ نشره.

Regarding the Regulation of Grazing in the Emirate of Abu Dhabi
We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi.
- - Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments.
- - And Law No. (2) of 1971 Concerning the National Consultative Council and its amendments.
- - And Law No. (13) of 2005 Regarding the Regulation of Grazing in the Emirate of Abu Dhabi and its amendments.
- - And Law No. (16) of 2005 on the Reorganization of the Environment Agency - Abu Dhabi and its amendments.
- - And Law No. (7) of 2019 Establishing the Abu Dhabi Agriculture and Food Safety Authority.
- - And Law No. (30) of 2019 Establishing the Department of Municipalities and Transport.
- - And Federal Law No. (24) of 1999 Concerning the Protection and Development of the Environment and its amendments.
- - And the Decision of the Chairman of the Executive Council No. (73) of 2015 Regarding the Regulation of 'Azab' (livestock farms).
- - And based on what was presented to the Executive Council, and its approval.
Have issued the following Law:
Article (1)
In the application of the provisions of this Law, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:

Feeding livestock on natural grasses and wild plants in grazing areas. |
| Grazing Areas |
: |
Lands specified by the Agency in coordination with the concerned authorities where there are natural grasses or plants with annual or perennial life cycles, or forage shrubs and trees, where grazing is permitted. |
| Grazing Season |
: |
The period determined by the Agency in coordination with the concerned authorities during which license holders are permitted to graze. |
| The License |
: |
A document issued by the Agency under which grazing is permitted. |
| Grazing 'Azab' |
: |
An area of land designated and leased by the Department of Municipalities and Transport for the purpose of enclosing livestock in grazing areas. |
| Critical Natural Habitats |
: |
A type of ecosystem with high biodiversity value, including habitats of major importance for critically endangered and/or endangered species, and/or habitats that support high densities of migratory species and/or species that congregate in large numbers globally, and highly threatened ecosystems and/or unique biological systems. |
Article (2)
- • Grazing is permitted after obtaining a license in accordance with the provisions of this Law and its executive regulations.
- • The license may not be assigned without obtaining the approval of the Agency.
Article (3)
- • The Agency shall determine grazing seasons based on assessment studies of the vegetation cover condition and any other criteria it deems necessary.
- • The Agency shall determine grazing areas based on the following criteria:
- Grazing areas must be outside a (2) kilometer radius of natural reserves.
- Grazing areas must be outside the scope of critical natural habitats and any other areas specified by the Agency.
Article (4)
- • An applicant for a grazing license must meet the following conditions:
- Be a citizen of the United Arab Emirates and not less than twenty-one Gregorian years of age.
- Hold a valid, certified certificate from the concerned authorities proving ownership of the livestock.
- Hold a certificate stating that his livestock is registered in the Emirate's animal identification and registration system with the concerned authorities.
- Hold a grazing 'Azab' license issued by the concerned authorities.
- • The applicant may appeal a decision to reject their application to the Agency within (30) days from the date of notification of the rejection decision, in accordance with the procedures specified in the executive regulations of this Law.
- • The grazing license is granted for a period of one year, renewable. The executive regulations of this Law shall specify the documents, periods, and procedures necessary for submitting the license application or its renewal.
- • The executive regulations of this Law shall specify the environmental requirements for grazing.
Article (5)
The following are prohibited:
- Grazing without obtaining a license.
- Grazing outside of the designated grazing areas.
- Using motorcycles, cars, or any type of vehicle or machinery in grazing areas for recreational purposes.
- Constructing a permanent or temporary building or any part thereof within grazing areas.
- Grazing outside of the designated grazing seasons.
- Placing fences, tools, or waste in grazing areas.
- Leaving livestock to graze unattended.
- Failing to maintain public cleanliness in grazing areas.
- Failing to present the grazing license and/or a copy thereof when requested by Agency employees.
Article (6)
Anyone who violates any of the provisions of Article (5) of this Law shall be punished by imprisonment for a period not exceeding one month, and a fine not exceeding one hundred thousand dirhams, or by one of these two penalties. The penalty shall be doubled in the case of a repeat offense.
Article (7)
The Chairman of the Abu Dhabi Judicial Department, in agreement with the Chairman of the Agency's Board of Directors, shall issue a decision identifying the Agency's employees who shall have the capacity of judicial enforcement officers with respect to crimes or violations that occur within their jurisdiction. They shall have the right to inspect and monitor to verify compliance with the provisions of this Law and the regulations, decisions, and circulars issued in its implementation.
Article (8)
- • The Agency has the right to take any of the following administrative penalties:
- Notice.
- Warning.
- Temporary suspension of the license.
- Revocation of the license.
- • An appeal against an administrative penalty may be filed with the Agency within sixty days from the date the penalty is communicated to the appellant, in accordance with the procedures specified in the executive regulations of this Law.
Article (9)
Those addressed by the provisions of this Law must regularize their status in accordance with its provisions within a period not exceeding six months from the date of its publication in the Official Gazette.
Article (10)
- • The Chairman of the Agency's Board of Directors, after the approval of the Executive Council, shall issue the executive regulations for this Law.
- • Existing policies, regulations, decisions, and circulars shall remain in force insofar as they do not conflict with the provisions of this Law.
- • The Chairman of the Agency's Board of Directors shall issue the policies, decisions, and circulars necessary for the implementation of the provisions of this Law.
Article (11)
- • The aforementioned Law No. (13) of 2005 is hereby repealed.
- • Any text or provision that contradicts or conflicts with the provisions of this Law is hereby repealed.
Article (12)
This Law shall be published in the Official Gazette and shall come into force from the date of its publication.
