رئيس دائرة التخطيط العمراني والبلديات:

• - بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
• - وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي والقوانين المعدلة له،
• - وعلى القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي والقوانين المعدلة له،
• - وعلى القانون رقم (11) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي والقوانين المعدلة له،
• - وعلى القانون رقم (2) لسنة 2012 بشأن الحفاظ على المظهر العام والصحة والسكينة العامة في إمارة أبوظبي،
• - وعلى القانون رقم (5) لسنة 2018 بشأن إنشاء دائرة التخطيط العمراني والبلديات،
• - وعلى المرسوم الأميري رقم (13) لسنة 2017 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي،
• - وعلى قرار رئيس دائرة التخطيط العمراني والبلديات رقم (49) لسنة 2017 بإصدار اللائحة التنفيذية للقانون رقم (2) لسنة 2012 (الرقابة الصحية على المنشآت غير الغذائية)،
• - وعلى قرار رئيس دائرة التخطيط العمراني والبلديات رقم (50) لسنة 2017 بإصدار الدليل الإرشادي الخاص باللائحة التنفيذية للقانون رقم (2) لسنة 2012 (الرقابة الصحية على المنشآت غير الغذائية)،
• - وعلى كتاب مجلس الجودة والمطابقة رقم (م) أج م / أ ع / 144 / 2018 بتاريخ 2018/2/19 بشأن إطلاق برنامج مطابقة خدمات الأفراد العاملين في الصالونات ومراكز التجميل،
• - وبناء على ما تقتضيه المصلحة العامة

تقرر ما يلي:

مادة (1)

في تطبيق أحكام هذا القرار تكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها، ما لم يدل سياق النص على خلاف ذلك.

مادة (2)

تطبق أحكام هذا القرار على كافة مراكز التجميل والعناية الشخصية في إمارة أبوظبي.

مادة (3)

يلتزم المالك وصاحب العلاقة بتطبيق جميع ما جاء ببنود هذا القرار.

مادة (4)

على جميع العاملين لدى مراكز التجميل والعناية الشخصية الحصول على شهادة المطابقة من المجلس، وفي حال الإخلال تطبق أحكام المادة رقم (6) من القانون رقم (2) لسنة 2012 بشأن الحفاظ على المظهر العام والصحة والسكينة العامة في إمارة أبوظبي.

مادة (5)

على الأشخاص الخاضعين لأحكام هذا القرار توفيق أوضاعهم خلال سنة من تاريخ العمل بهذا القرار.

مادة (6)

يُنفذ هذا القرار اعتبارًا من تاريخ صدوره، وينشر في الجريدة الرسمية.

The Chairman of the Department of Urban Planning and Municipalities:

• - Having reviewed Law No. (1) of 1974 reorganizing the Government Apparatus in the Emirate of Abu Dhabi and its amending laws,
• - And Law No. (10) of 2006 regarding the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi and its amending laws,
• - And Law No. (10) of 2007 regarding the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi and its amending laws,
• - And Law No. (11) of 2007 regarding the Municipality and Municipal Council of Al Ain City in the Emirate of Abu Dhabi and its amending laws,
• - And Law No. (2) of 2012 regarding the preservation of Public Appearance, Health, and Public Tranquility in the Emirate of Abu Dhabi,
• - And Law No. (5) of 2018 regarding the establishment of the Department of Urban Planning and Municipalities,
• - And Emiri Decree No. (13) of 2017 regarding the reconstitution of the Executive Council of the Emirate of Abu Dhabi,
• - And the Decision of the Chairman of the Department of Urban Planning and Municipalities No. (49) of 2017 issuing the Executive Regulations of Law No. (2) of 2012 (Health Supervision of Non-Food Establishments),
• - And the Decision of the Chairman of the Department of Urban Planning and Municipalities No. (50) of 2017 issuing the Guideline Manual for the Executive Regulations of Law No. (2) of 2012 (Health Supervision of Non-Food Establishments),
• - And the letter from the Quality and Conformity Council No. (M) QCC / GA / 144 / 2018 dated 19/2/2018 regarding the launch of the conformity program for the services of individuals working in salons and beauty centers,
• - And based on what is required by the public interest

Has decided the following:

Article (1)

In the application of the provisions of this Decision, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise.

Article (2)

The provisions of this Decision shall apply to all beauty and personal care centers in the Emirate of Abu Dhabi.

Article (3)

The owner and the concerned party are obligated to implement all the clauses of this Decision.

Article (4)

All workers in beauty and personal care centers must obtain a Certificate of Conformity from the Council. In case of non-compliance, the provisions of Article (6) of Law No. (2) of 2012 regarding the preservation of Public Appearance, Health, and Public Tranquility in the Emirate of Abu Dhabi shall apply.

Article (5)

Persons subject to the provisions of this Decision must rectify their status within one year from the date this Decision comes into effect.

Article (6)

This Decision shall be effective from the date of its issuance and shall be published in the Official Gazette.
