بشأن دليل تنظيم الجلسات الخارجية وإشغال الأرصفة

رئيس دائرة البلديات والنقل:

بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،

- وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي وتعديلاته،

- وعلى القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة أبو ظبي بإمارة أبوظبي وتعديلاته،

- وعلى القانون رقم (11) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي وتعديلاته،

- وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،

- وعلى القانون رقم (2) لسنة 2012 بشأن الحفاظ على المظهر العام والصحة والسكينة العامة في إمارة أبوظبي وتعديلاته ولوائحه التنفيذية،

- وعلى قرار المجلس التنفيذي رقم (79) لسنة 2024 بشأن رسوم إشغال أرصفة الطرق والمساحات الخارجية أمام المباني والمنشآت التجارية،

- وعلى قرار رئيس الدائرة رقم (209) لسنة 2016 بشأن إصدار اللائحة التنفيذية المعدلة لتنظيم مواقف المركبات في إمارة أبوظبي وتعديلاته،

- وعلى القرار الإداري رقم (135) لسنة 2022 بشأن دليل تنظيم الجلسات الخارجية وإشغال الأرصفة في إمارة أبوظبي – الإصدار الثالث،

- وبناءً على ما تقتضيه المصلحة العامة،

قرر ما يلي:

المادة (1)

يُعتمد دليل تنظيم الجلسات الخارجية وإشغال الأرصفة في إمارة أبوظبي (الإصدار الرابع) المرفق بهذا القرار.

المادة (2)

يُنفذ هذا القرار ويعمل به اعتباراً من تاريخ صدوره، ويُلغى كل ما يخالفه، ويُنشر في الجريدة الرسمية.

Administrative Decision No. (263) of 2024

Concerning the Guideline for Organizing Outdoor Seating and Occupancy of Sidewalks

The Chairman of the Department of Municipalities and Transport:

Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi, and its amendments,

- And Law No. (10) of 2006 regarding the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi, and its amendments,

- And Law No. (10) of 2007 regarding the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi, and its amendments,

- And Law No. (11) of 2007 regarding the Municipality and Municipal Council of Al Ain City in the Emirate of Abu Dhabi, and its amendments,

- And Law No. (30) of 2019 regarding the establishment of the Department of Municipalities and Transport,

- And Law No. (2) of 2012 concerning the preservation of the public appearance, health, and public tranquility in the Emirate of Abu Dhabi, and its amendments and executive regulations,

- And Executive Council Resolution No. (79) of 2024 concerning the fees for occupying road sidewalks and external spaces in front of commercial buildings and establishments,

- And the Chairman of the Department's Resolution No. (209) of 2016 regarding the issuance of the amended executive regulations for organizing vehicle parking in the Emirate of Abu Dhabi, and its amendments,

- And Administrative Decision No. (135) of 2022 concerning the Guideline for Organizing Outdoor Seating and Occupancy of Sidewalks in the Emirate of Abu Dhabi - Third Edition,

- And based on the requirements of the public interest,

Has decided the following:

Article (1)

The Guideline for Organizing Outdoor Seating and Occupancy of Sidewalks in the Emirate of Abu Dhabi (Fourth Edition), attached to this decision, is hereby approved.

Article (2)

This decision shall be implemented and effective from the date of its issuance, shall supersede any conflicting provisions, and shall be published in the Official Gazette.
