بشأن تعليمات تصنيف المقاولين في إمارة أبوظبي

رئيس دائرة التخطيط العمراني والبلديات

- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،

- وعلى القانون رقم (4) لسنة 1983 في شأن تنظيم أعمال البناء وتعديلاته ولائحته التنفيذية وتعديلاتها،

- وعلى القانون رقم (5) لسنة 2018 بشأن إنشاء دائرة التخطيط العمراني والبلديات،

- وعلى المرسوم الأميري رقم (13) لسنة 2017 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي،

- وعلى قرار رئيس المجلس التنفيذي رقم (20) لسنة 2018 بشأن اختصاصات إضافية لدائرة التخطيط العمراني والبلديات،

- وعلى قرار رئيس دائرة التنمية الاقتصادية رقم (2) لسنة 2009 بشأن نظام تصنيف المقاولين في إمارة أبوظبي،

- وعلى القرار الإداري رقم (56) لسنة 2010 الصادر عن دائرة التنمية الاقتصادية، بشأن تعليمات تصنيف المقاولين،

- وعلى القرار الإداري رقم (69) لسنة 2010 بشأن تعديل جدول مخالفات المنشآت الاقتصادية في إمارة أبوظبي المرفق بالقانون رقم (2) لسنة 2009 بإنشاء دائرة التنمية الاقتصادية،

- وعلى القرار الإداري رقم (6) لسنة 2018 بشأن نظام تسجيل مكتب طرف ثالث للتدقيق والتفتيش على المشاريع الهندسية بإمارة أبوظبي،

- وعلى القرار الإداري رقم (158) لسنة 2018 بإصدار نظام قيد المهندسين في إمارة أبوظبي.

- وعلى القرار الإداري رقم (159) لسنة 2018 بإصدار تعليمات قيد المهندسين في إمارة أبوظبي.

- وعلى القرار الإداري رقم (160) لسنة 2018 بإصدار نظام تصنيف المقاولين في إمارة أبوظبي.

قرر الآتي:

المادة (1)

نطاق التطبيق

تسري أحكام هذه التعليمات على جميع شركات المقاولات التي تمارس أعمال المقاولات الهندسية في الإمارة بحسب الأنشطة ومجالات المقاولات الهندسية المعتمدة الواردة في أحكام هذا القرار.

المادة (2)

السجل

1. ينشأ في الدائرة سجل يسمى (سجل تصنيف المقاولين) يسجل فيه جميع بيانات المقاولين المرخصين والمصنفين ويحتوي على معلومات وبيانات ما يلي:

أ. المقاول المرخص.

ب. المجال والنشاط وفئة التصنيف.

ت. المؤهلات العلمية والخبرات العملية لصاحب الترخيص لكل نشاط.

ث. المؤهلات العلمية والخبرات العملية للكادر الفني.

ج. المشاريع المنجزة التي تم التصنيف بناءً عليها.

ح. الوضع المالي الذي تم التصنيف بناءً عليه.

خ. شهادات الجودة والأمن والسلامة.

د. وثائق التأمين الخاصة بالمشاريع التي يتم التصنيف بناءً عليها.

ذ. المشاريع الجاري تنفيذها.

ر. تقييم كفاءة المشاريع المنجزة.

ز. متطلبات التميز الهندسي.

2. لكل ذي مصلحة الاطلاع على السجلات وطلب شهادة بالبيانات المدونة بالسجل على أن يكون طلبه مكتوباً ومستوفياً للرسوم المقررة لذلك.

المادة (3)

فئات تصنيف المقاول

1. يصنف المقاول المحلي في الفئات: الخاصة، والأولى، والثانية، والثالثة، والرابعة، والخامسة، والسادسة.

2. يصنف فرع المقاول الأجنبي والمقاول المشارك في الفئة الخاصة فقط.

3. لا يجوز للمقاول تنفيذ أعمال المقاولات إلا في الفئة المصنف فيها والفئات الأدنى منها، وذلك بحسب أحكام نظام وتعليمات التصنيف.

المادة (4)

مرفقات طلب التصنيف

على المقاول أن يرفق بطلب التصنيف الجديد، أو طلب التجديد أو الترفيع أو التعديل، البيانات والوثائق التالية:

1. صورة من الرخصة التجارية سارية المفعول تتضمن الأنشطة المطلوب التصنيف فيها.

2. كشف صادر عن دائرة التنمية الاقتصادية موضحاً فيه الرخص التجارية المملوكة من أصحاب الترخيص للتحقق مما إذا كان طالب التصنيف مالكاً أو مشاركاً في إحدى المنشآت التي تتعارض مع ممارسة مهنة المقاولات الهندسية.

3. البيانات والوثائق الخاصة بالكادر الهندسي والفني المتخصص في أنشطة المقاولات الهندسية المطلوب مزاولته.

4. كشف مفصل بالأعمال السابقة والمشاريع التي قام بها المقاول المطلوب ترخيصه.

5. المستندات والوثائق الدالة على سنوات الخبرة العملية في مجال النشاط المطلوب.

6. صورة من عقد تأسيس الشركة أو عقد وكيل الخدمات (حسب الحالة).

7. شهادة تأسيس المقاول صادرة من الجهات المختصة في موطن المقاول الرئيسي وما يثبت مزاولته العمل في نشاط المقاولات المدة المطلوبة دون انقطاع (لفرع المقاول الأجنبي).

8. كشف العمالة الصادر من وزارة العمل، والذي لم يمر على صدوره أكثر من شهرين وتقديم مستند سكن العمال من الجهة المعنية أو من في حكمه لحالات التسجيل والتجديد (لا يشترط تقديم المستند في حال عدم وجود مشاريع).

9. نسخة طبق الأصل عن التقرير المالي السنوي المدقق مستوفياً لجميع الشروط والمعايير المهنية الدولية والمعتمدة في الدولة.

10. إقرار معتمد بتفريغ كادر محاسبي متخصص أو تعاقد مع مكتب متخصص بمراجعة السجلات المحاسبية.

11. إقرار معتمد من قبل مدقق الحسابات باستيفاء المقاول للشروط والمعايير المالية والوضع المالي المطلوب لغايات التصنيف وفقاً للتشريعات ذات العلاقة.

12. المستندات المتعلقة بالتعديلات التي طرأت على وضعية المقاول إن وجدت – خاصة فيما يتعلق بالكادر الهندسي العامل لدى المنشأة.

13. أية مستندات أو وثائق أخرى ترى الإدارة المعنية ضرورة إبرازها.

المادة (5)

ترقية التصنيف

يجوز استثناء المقاول المحلي المملوك بالكامل من مواطن، إذا تم توفير 80% من قيمة الخبرات السابقة للفئة المطلوبة من شروط الخبرة المنفذة عند التجديد، إذا حقق جميع المتطلبات للفئة الأعلى من الفئة المطلوبة، وذلك فقط للفئات الرابعة والثالثة والثانية والأولى.

المادة (6)

مقاول محلي للأعمال البسيطة

1. يجوز للمقاول التقدم بطلب تصنيف على الفئة السادسة لأنشطة مقاولات الأعمال البسيطة، شرط أن يستوفي شروط ومعايير التصنيف والمتطلبات الخاصة بأنشطة مجال مقاولات الأعمال البسيطة.

2. يتولى المقاول المصنف على أنشطة الأعمال البسيطة كافة المسؤوليات والمهام الخاصة بالمكتب الاستشاري من خلال المهندسين العاملين لديه المقيدين على هذا النشاط.

3. يقوم المقاول بتوفير التالي مع طلب التصنيف:

- إقرار معتمد بالقيام بتفريغ الكادر الفني الخاص المطلوب تصنيفه على هذا النشاط ليتولى المهندس المعماري مسؤولية التصميم ويتولى المهندس المدني مسؤولية الإشراف على التنفيذ.

- شهادة اعتماد من إدارة تراخيص البناء تجيز للكادر الفني المختص لدى المقاول، التقدم للقيام بالمهام الخاصة بالمكتب الاستشاري من التصميم والتدقيق والمراجعة والمتابعة ومراقبة الجودة المتعلقة بالنشاط وللوقوف على صحة معرفتهم بكامل الإجراءات المتبعة للحصول على الموافقات اللازمة من إدارة تراخيص البناء والجهات الخدمية المرتبطة بها.

4. يجوز الترخيص للمقاول في مزاولة نشاط أو أكثر من مجالات الأعمال البسيطة على أن يتم تأمين الكادر الفني المطلوب لكل نشاط.

5. يتولى العمل الهندسي لهذه الأنشطة، مهندسون مقيدون في سجل قيد المهندسين بالإمارة، وبحسب التخصصات المطلوبة للأنشطة المعتمدة، على أن يتكون الكادر الفني لأنشطة هذا المجال بحد أدنى من مهندس مدني ومهندس معماري، ويتم إضافة الكوادر الفنية بحسب متطلبات كوتا مساحة المشاريع وبموجب أحكام نظام وتعليمات التصنيف.

المادة (7)

معايير تصنيف المقاولين

يكون تقييم المقاولين لغرض تصنيفهم أول مرة أو تجديد تصنيفهم أو ترفيعهم وتثبيتهم في إحدى الفئات وفقاً للمعايير الفنية الواردة أدناه:

المادة (8)

بيانات الكادر الفني

على المقاول أن يرفق بطلب التصنيف الجديد، أو عند طلبه تجديد أو ترفيع أو تعديل التصنيف القائم مستندات وبيانات الكادر الفني وذلك على النحو التالي:

1. جدول يوضح أسماء المهندسين أصحاب الترخيص المصنف عليهم الأنشطة المطلوبة والمهندسين المقيدين المطلوب توفيرهم حسب فئة التصنيف لكل نشاط، مع البيانات المطلوبة لسنوات الخبرة الموثقة ورقم القيد وفئته، مقسماً بحسب المجال والأنشطة المراد تصنيفها، على أن تكون جميعها مسلسلة وبحسب النموذج المعتمد من الدائرة.

2. ما يفيد إقامة المهندسين أصحاب الترخيص للأنشطة المطلوب التصنيف فيها داخل الدولة إقامة معتادة تحت كفالة المقاول وتفرغه للعمل لدى المقاول.

3. تقديم نسخة إلكترونية لكافة المستندات المطلوبة.

4. أي مستندات أو بيانات تطلبها الإدارة المعنية.

المادة (9)

الخبرات المطلوبة للكوادر الفنية لأنشطة المقاولات الهندسية

1- يجب أن يتوافر لدى المقاول في الجهاز الفني لكل فئة من فئات التصنيف ولكل نشاط أساسي، عدد من المهندسين يتناسب مع عدد التخصصات المطلوب التصنيف فيها، وفقاً لما يلي:

2- لتأمين عدد الأنشطة المطلوب لكل فئة تصنيف يجب إضافة نشاط أو أكثر من الأنشطة المرتبطة بالنشاط الأساسي، ويمكن للمقاول أن يكتفي بتأمين العدد المطلوب من المهندسين أصحاب الترخيص للتخصص، ويتم تصنيف النشاط بحسب سنوات الخبرة المتوفرة لدى صاحب الترخيص.

3- يمنح نشاط مقاولات المباني مساحة طابقية تتلاءم مع فئة التصنيف. ويمكن للمقاول إضافة مساحة مشاريع إضافية لأي نشاط، بمجرد تسجيل وإضافة مهندسين مقيدين جدد على هذا النشاط. عند إضافة نشاط مرتبط بالنشاط الأساسي، يتم التصنيف باستخدام أحد المهندسين المتخصصين من الكادر الفني المتوفر. وفي حال عدم تواجد الاختصاص المطلوب، يتم إضافة مهندس صاحب اختصاص إلى الفريق ويتم تصنيفه بحسب سنوات الخبرة المتوفرة.

4- يحق للمقاول إضافة أنشطة إضافية أساسية، وأنشطة إضافية مرتبطة بها لمجال أو أكثر على أن يتم تأمين الكادر الفني المناسب لها وللفئة المراد التصنيف عليها بحسب ما ورد في البند رقم (1) والبند رقم (2) من المادة نفسها.

5- على المقاول التقدم بطلب تصنيف على جميع الأنشطة الضرورية لاستكمال الأعمال المزمع تنفيذها وتأمين الكوتا المساحية لكافة الأنشطة بما يتناسب مع طبيعة وحجم المشروع والكادر الفني المتوفر لديه، ويحق للمقاول أن يقترض من الكوتا المساحية الخاصة بمقاولي باطن بما يتناسب مع الكادر الفني والأنشطة المصنفين عليها وبحسب الحاجة، ويتم الحجز على الكوتا المساحية المقترضة من الكوتا المساحية لمقاول الباطن المقترض منه لنفس النشاط.

6- لا يسمح باقتراض كوتا مساحية إلا بعد التعاقد بالباطن وتوثيق هذا التعاقد على النظام الإلكتروني لخدمات الترخيص وبحسب الإجراءات والشروط المعتمدة بموجب نظام إدارة الكوتا المساحية للمشاريع الصادر عن الدائرة.

7- يكون المقاول مسؤولاً وحده عن التنسيق مع مهندسيه ومهندسي مقاولي الباطن لتنظيم متطلبات قيدهم وتوزيعهم على أنشطة مجالات المقاولات الهندسية المصنف عليها، ليتم تأمين كوتا لمساحات المشاريع المطلوبة.

8- عند اكتمال إجراءات تعيين المقاول لتنفيذ مشروع، يتم الحجز على كوتا مساحية من حساب الأنشطة الأساسية بحسب طبيعة المشروع والأنشطة المصرحة له توازي مساحة المشروع أو الأعمال المزمع تنفيذها لكل نشاط أساسي. وذلك إلى حين إصدار شهادة الإنجاز حيث يتم تلقائيا الإفراج عما يوازي (70%) من الكوتا المساحية، ويتم الإفراج عما تبقى من الكوتا المساحية للمشروع بعد إصدار شهادة الإشغال للمشروع، وذلك لكل من المقاول الرئيسي ومقاولي الباطن للمشروع. وفي حال تم إلغاء الترخيص أو المشروع، يتم الإفراج عن كافة المساحات والكوتا المحجوزة بموجبه.

المادة (10)

بيانات الجودة والأمن والسلامة والتأمين المهني

على المقاول أن يرفق بطلب التصنيف الجديد، أو عند طلبه تجديد أو ترفيع أو تعديل التصنيف القائم جميع البيانات والمعلومات والمستندات المتعلقة بما يلي، بحسب متطلبات ومعايير تصنيف المقاولين، والمذكورة سابقاً في المادة رقم (7):

1. شهادة الجودة.

2. شهادة حماية البيئة.

3. شهادة الصحة والسلامة.

4. وثيقة التأمين المهني. (لمقاول الأعمال البسيطة)

المادة (11)

معيار الخبرات السابقة والقيمة التقديرية للمشاريع التي يجوز الاشتراك بها

1. يجب أن تتوفر لدى المقاول خبرات في إنجاز المشاريع خلال السنوات الـ (10) العشر السابقة لتاريخ تقديم طلب التصنيف، تتناسب من حيث النوع والحجم مع فئة التصنيف والأنشطة المطلوبة.

2. تكون القيمة التقديرية للمشاريع التي يجوز للمقاول الاشتراك فيها حسب فئة تصنيفه في مجال مقاولات البنية التحتية والبنية التحتية المتخصصة والأعمال التخصصية (وذلك كما هو مفصل في معايير تصنيف المقاولين المذكورة في المادة رقم (7)).

المادة (12)

بيانات المشاريع المنفذة

تقبل بيانات المشاريع المنفذة من قبل المقاول وفقاً لما يلي:

1. لا تقبل خبرات المشاريع المنفذة لجهات حكومية وشبه الحكومية داخل الدولة من قبل المقاول إلا إذا كانت مشفوعة بعقود وشهادات إنجاز رسمية أو شهادات الدفعات الختامية توضح نسبة العمل المنجز معتمدة من مالك المشروع.

2. يجوز قبول خبرات المشاريع المنفذة خارج الدولة بشرط أن تكون مثبتة بشهادات تنفيذ صادرة من جهات حكومية في الدولة التي نفذت بها المشاريع وموثقة بحسب الأصول المعمول بها في الإمارة.

3. يعاد تصنيف المقاول في الفئة المناسبة عند انسحاب أي من الشركاء الذين تم تصنيف المقاول بناء على خبراتهم.

4. لتصنيف فرع داخل الإمارة تقبل خبرات المشاريع المنفذة من قبل المركز الرئيسي أو أحد فروعه، شريطة تقديم شهادات رسمية موثقة بحسب الأصول المعمول بها بالإمارة، تؤكد أن الفروع مملوكة بالكامل للمركز الرئيسي مع تقديم تعهد من المركز الرئيسي بتحمل كافة المسؤوليات والالتزامات.

5. للشركة المحلية الاستفادة من خبرات الشريك الأجنبي شريطة ألا تقل حصته في رأس المال عن (30%) إذا كان شخصاً اعتبارياً واحداً وعن (20%) لكل منهما إذا كانا شخصين اعتباريين وعن (15%) لكل منهم إذا كانوا أكثر من شخصين اعتباريين.

6. للمقاول المؤسس في الإمارة الذي أسس فروعاً له في إمارات الدولة الأخرى الاستفادة من الخبرات المنفذة لهذه الفروع من أجل تصنيف المقاول في الإمارة.

7. مع عدم الإخلال بأحكام البنود السابقة لهذه المادة، تقبل خبرات المشاريع المنفذة في الدولة، من قبل مقاول مشارك مرخص في الإمارة، لدى تقديمها مرفقة لطلب تجديد أو ترفيع تصنيف مقاول محلي مؤسس أو لطلب تصنيف جديد لفرع مقاول أجنبي كان الفرع الرئيسي للمقاول الأجنبي شريكاً فيه.

8. لا يعتد بخبرة المشاريع المنفذة من الباطن والغير موثقة على النظام الإلكتروني، إلا إذا كانت مشفوعة بالآتي:

أ. كتاب اعتماد مقاول الباطن من الجهة مالكة المشروع،

ب. عقد الباطن والعقد الرئيسي،

ت. رخصة بناء للمشروع المذكور، موضحة لبيانات المقاول ولبيانات ونطاق عمل مقاول الباطن،

ث. شهادة الإنجاز من جهات تقبلها الإدارة المعنية،

ج. نسخة عن شهادة الإشغال للمباني المنجزة بعد أكثر من سنة من نفاذ أحكام نظام التصنيف.

9. على المقاول تقديم شهادة الدفعة الختامية أو ما يثبت نسبة الإنجاز للمشاريع المنفذة لصالح القطاع الخاص معتمدة من المكتب الهندسي المشرف وكشف حساب يوضح إيداع هذه الدفعة في حسابه مع عقد المقاولة وشهادة رسمية بالإنجاز وشهادة الإشغال، ويجوز للدائرة أن تطلب من المقاول أن يزودها بوثائق بديلة عما ذكر أعلاه وذلك حسب متطلبات كل حالة.

10. إذا رغب المقاول في الاستفادة من أية مشاريع تتضمن أكثر من نشاط من أجل التصنيف أو الترفيع، فعليه تقديم وثائق ومستندات توضح قيمة وطبيعة كل تخصص على حدة من خلال تقديم ملخص لجدول حساب الكميات الخاص بالمشروع على أن يكون معتمداً من المكتب الاستشاري.

11. لا يعتد بخبرات الشخص الطبيعي كخبرة مشاريع منفذة في التصنيف.

12. في حالة قيام مقاولين أو أكثر بتنفيذ مشروع أو أكثر وأراد أي منهم الاستفادة من خبراته في هذا المشروع للتصنيف، فعليه تقديم ما يفيد وجود الائتلاف بينهم وكذلك ما يفيد طبيعة الأعمال التي قام بها كل عضو من أعضاء الائتلاف ونسبة هذه الأعمال من إجمالي قيمة المشروع ويتم احتساب قيمة الأعمال المنفذة من قبل المقاول فقط وحسب نسب التنفيذ الفعلية.

13. لا يجوز استخدام أي خبرات لتصنيف المقاول أكثر من مرة في نفس التخصص.

المادة (13)

أنشطة ومجالات المقاولات الهندسية

مع عدم الإخلال باختصاص اللجنة الفنية في اعتماد تخصصات وفروع هندسية جديدة، تكون المجالات والأنشطة الواردة أدناه مخصصة لمزاولة مهنة المقاولات الهندسية:

1. مجال مقاولات تشييد المباني.

2. مجال مقاولات البنية التحتية.

3. مجال مقاولات البنية التحتية المتخصصة.

4. مجال الأعمال التخصصية.

5. مجال مقاولات الأعمال المساندة.

6. مجال مقاولات الأعمال الفنية.

7. مجال مقاولات الأعمال البسيطة.

8. أي من المجالات والتخصصات التي تعتمدها وتصدرها اللجنة الفنية في المستقبل.

يراعى توافر تخصصات بالكادر الفني لدى المقاول، تبعاً للتخصص والفئة المصنف فيها ولمجالات وأنشطة المقاولات الهندسية الصادرة بموجب لهذا القرار.

المادة (14)

المعايير المالية والوضع المالي

1. لغايات التصنيف من الناحية المالية يجب أن تمتلك الشركة أو المؤسسة موجودات مقبولة لغايات التصنيف بقيمة تغطي القيمة الإجمالية للالتزامات بالإضافة إلى رأس المال المدفوع لكل فئة كحد أدنى للتصنيف في كل فئة وفقاً لما يلي:

2. الموجودات المقبولة لغايات التصنيف هي الموجودات المعروضة في ميزانية الشركة أو المؤسسة الحقيقية الموجودة داخل الدولة والمعززة بمؤيدات ثبوتية والمملوكة قانونياً باسم الشركة أو المؤسسة طالبة التصنيف حصراً والتي يمكن تسييلها (تحويلها إلى نقد) عند الطلب، حيث يمكن اعتبار الموجودات المبينة تالياً مقبولة لغايات التصنيف وفقاً للاشتراطات التي تحددها الدائرة وكما يلي:

أ. النقد والودائع في البنوك.

ب. العقارات.

ت. السيارات والآليات.

ث. الذمم المدينة التي تم إثبات تحصيلها بعد تاريخ الميزانية.

ج. الأعمال تحت التنفيذ في حال تم فوترتها وتحصيل قيمتها بعد تاريخ الميزانية.

ح. الذمم المدينة المصادق على صحة أرصدتها من قبل الجهات الحكومية.

خ. الذمم التجارية المدينة المصادق على صحة أرصدتها من قبل من الجهات التي لا ينطبق عليها تعريف الأطراف ذات العلاقة، على ألا يكون قد مضى أكثر من سنة على تاريخ استحقاق السداد.

د. الذمم المدينة الصادر بها أحكام تنفيذ نهائية، على ألا يزيد عمر حكم التنفيذ عن سنة من تاريخ صدوره.

ذ. التأمينات وما في حكمها.

ر. المصاريف المدفوعة مقدماً وما في حكمها.

ز. أية موجودات أخرى توافق عليها الدائرة.

3. يتم دراسة وتقييم الوضع المالي للمقاول من قبل المدقق المعتمد أو من قبل أي جهة تحددها الدائرة وفقاً للنموذج والاشتراطات التي تحددها الدائرة لهذه الغاية.

4. تحتفظ الدائرة بسجل البيانات المالية للشركات والمؤسسات ضمن برنامج إلكتروني خاص بتخزين وتحليل البيانات المالية.

5. يحدد تاريخ موحد للتقرير المالي السنوي المدقق المستخدم في تصنيف الشركات أو المؤسسات التي ينطبق عليها تعريف "الأطراف ذات العلاقة" وفق المعايير المهنية الدولية.

6. للدائرة استحداث معايير مالية أخرى مكملة أو بديلة.

7. للدائرة عدم الاعتداد بالتقييم المقدم في حال عدم استيفاء الميزانية المقدمة للمعايير المهنية أو متى استدعت الحاجة لذلك وبالاستناد إلى توصيات أصحاب الاختصاص.

المادة (15)

يُلغى كل نص يخالف أو يتعارض مع أحكام هذا القرار.

المادة (16)

يُنشر هذا القرار في الجريدة الرسمية، ويُعمل به ابتداءً من الثالث من مارس 2019.

أنشطة ومجالات المقاولات الهندسية في الإمارة

-1- مجال مقاولات تشييد المباني

يجب إختيار نشاط المقاولات العامة للمباني الخرسانية كنشاط أساسي لهذا المجال، وتوفير الحد الأدنى من المهندسين المقيدين للكادر الفني المطلوب، على أن يكون المهندس المدني هو صاحب الترخيص،

ولا يجوز تصنيف المهندس المعماري لأي نشاط آخر.

ويجوز تصنيف أحد المهندسين المقيدين المطلوب توفيرهم للدرجة الثالثة وما فوق على الاختصاص الإضافي ليكون صاحب الترخيص لذلك النشاط.

	1.1.1	مقاولات الهياكل الخرسانية	تشمل المنشآت التي تقوم بتنفيذ الهياكل الخرسانية للمباني بكافة أنواعها تجارية وسكنية واستثمارية مكاتب، مرافق عامة، صناعية، وشبرات، وفلل سكنية وملاحقها وجميع مستلزماتها.	مهندس مدني
	1.1.2	مقاولات الهياكل المعدنية	تشمل المنشآت التي تقوم بتنفيذ الهياكل المعدنية للمباني بكافة أنواعها تجارية وسكنية واستثمارية، مكاتب، مرافق عامة، صناعية، وشبرات، وفلل سكنية وملاحقها وجميع مستلزماتها.	مهندس مدني
	1.1.3	مقاولات الأعمال الميكانيكية لخدمات المباني	تشمل المنشآت التي تقوم بتنفيذ جميع الأعمال الميكانيكية لخدمات المباني مثل أعمال التكييف والتبريد وأعمال الشبك على شبكات التبريد المركزي وأنظمة جودة الهواء، والصرف الصحي وأنظمة المعالجة وتصريف مياه الأمطار، شبكات توزيع المياه وأنظمة تسخين المياه والمضخات وخزانات المياه وأنظمة التكرير، وأعمال الوقاية وشبكات وأنظمة ومعدات ومضخات مكافحة الحريق، أعمال شبكات الغاز المسال وأنظمة النفايات الصلبة وأنظمة صيانة المباني والمصاعد والسلالم الكهربائية وأنظمة ترشيد الطاقة وما شابه.	مهندس ميكانيكي
	1.1.4	مقاولات الأعمال الكهربائية لخدمات المباني	تشمل المنشآت التي تقوم بتنفيذ جميع الأعمال الكهربائية لخدمات المباني مثل التمديدات الكهربائية والشبكات الرئيسية والفرعية وشبكات الاتصالات وتقنية المعلومات وأنظمة الإنارة وأنظمة السلامة والإنذار من الحريق وأنظمة السمع بصري وأنظمة التحكم والمراقبة وأنظمة إدارة المباني وما شابه.	مهندس كهربائي
1.2		مقاولات هدم المباني وغيرها من الإنشاءات ورفع الأنقاض	تشمل المنشآت التي تقوم بتنفيذ عمليات هدم المباني والمنشآت بالطرق العلمية المختلفة ويشمل النشاط رفع الأنقاض سواء بالنقل الداخلي لأسطول الشركة أو النقل الخارجي للمخلفات.	مهندس مدني

-2- مجال مقاولات البنية التحتية:

	2.1.2	مقاولات الجسور والأنفاق والتقاطعات	وتشمل الجسور الخرسانية والجاهزة والمعدنية وجسور المشاة والأنفاق الأرضية وما يتعلق بها من أعمال.	مهندس مدني
2.2		مقاولات السدود	وتشمل السدود الترابية والخرسانية والخزانات الخرسانية والأعمال المتعلقة فيها.	مهندس مدني	نشاط أساسي
2.3		مقاولات مآخذ المياه	وتشمل الأعمال المتعلقة ببناء مداخل قنوات التغذية من مياه البحر أو النهر وأعمال الوقاية من تلوث المياه.	مهندس مدني	نشاط أساسي
2.4		مقاولات شبكات ومحطات نقل المياه	وتشمل تمديد أنابيب الإسمنت والبلاستك والحديد (500) مم فأكثر والصمامات والخزانات ومحطات الضخ اللازمة لإنشاءات شبكات نقل مياه الشرب.	مهندس مدني	نشاط أساسي
	2.4.1	مقاولات شبكات ومحطات توزيع المياه	وتشمل تمديد أنابيب الإسمنت والبلاستك (500) مم فأقل والصمامات ومحطات التوزيع اللازمة لإنشاء شبكات توزيع مياه الشرب وإطفاء الحريق والأعمال المتعلقة فيها وتوصيلات المنازل.	مهندس مدني
2.5		مقاولات شبكات الصرف الصحي الرئيسية	وتشمل شبكات الصرف الصحي الرئيسية والأعمال المتعلقة فيها لبناء غرف التفتيش ومحطات ضخ رئيسية أو فرعية لأعماق تزيد عن (6) متر وأقطار تزيد عن (0.50) متر.	مهندس مدني	نشاط أساسي
	2.5.1	مقاولات شبكات الصرف الصحي الفرعية	وتشمل شبكات الصرف الصحي الفرعية والأعمال المتعلقة لبناء غرف التفتيش ومحطات لأعمال أقل من (6) متر وأقطار أقل من (0.50) متر وأعمال توصيلات المنازل لشبكات الصرف الصحي الفرعية.	مهندس مدني
2.6		مقاولات حفر الممرات المائية وتعميقها	يشمل عمليات حفر الممرات والمجاري المائية - وشق القنوات وتعميقها - وكذلك عمليات تعميق الجرف البحري وأحواض الموانئ والبحيرات الاصطناعية والدفان البحري واستصلاح الجزر وتشمل هذه العمليات إزالة الصخور والرمال من تحت الماء وتنفيذ الأعمال اللازمة للقيام بعمليات الحفر كالتفجير والتطهير وإزالة العوائق البحرية ونقل المواد الناتجة وغيرها.	مهندس مدني أو مهندس جيولوجي	ومتخصص بحماية البيئة
2.7		مقاولات حفر قنوات التمديدات الخدمية	يشمل المنشآت التي تعمل في مجال مقاولات وأنشطة الحفر والدفان لتمديد خطوط الخدمات كخطوط الطاقة الكهربائية والاتصالات والمياه والمجاري أو غيرها من التمديدات وذلك بالأساليب التقليدية أو بأساليب الحفر الآلية تحت باطن الأرض.	مهندس مدني
2.8		مقاولات شبكات الاتصال	وتشمل أعمال شبكات التلفونات والتلكس والتلفزيون ومحطات الإذاعة وكل ما له علاقة بذلك في التركيبات الإلكترونية.	مهندس كهربائي أو مهندس إلكتروني أو مهندس اتصالات
2.9		مقاولات شبكات الري	وتشمل كافة منشآت الري ووسائل الري التقليدية والقنوات والهدارات والري بالرش والتنقيط.	مهندس زراعي أو مهندس ميكانيكي أو مهندس مدني	نشاط أساسي
	2.9.1	مقاولات حفر آبار المياه	وتشمل حفر آبار مياه الشرب والأعمال المتعلقة فيها لاستغلال المياه الجوفية.	مهندس مدني أو مهندس زراعي أو مهندس ميكانيكي أو مهندس جيولوجي أو مهندس بترول
	2.9.2	مقاولات التشجير	وتشمل الغابات والحدائق ومعدات الرياح والزراعة التجميلية وأعمال الزينة وتنسيق الموقع وأعمال إنتاج الخضراوات والفاكهة وخدمات استصلاح الأراضي والمزارع ومشاتل الزهور.	مهندس زراعي أو مهندس مدني

3- مجال مقاولات البنية التحتية المتخصصة

عند إختيار أي من الأنشطة الاساسية الخاصة بمجال مقاولات البنية التحتية المتخصصة، يتوجب إضافة نشاط مقاولات تشييد المباني كنشاط مترابط له، بالإضافة الى أي من الأنشطة الأخرى الضرورية لتمكين المقاول من إستكمال الأعمال الخاصة بمشاريعه:

3.3		مقاولات الموانئ	وتشمل تجهيز المواقع وأعمال الردم وإقامة الأرصفة وبناء المكاتب والمستودعات والأحواض والتجهيزات المماثلة وحواجز الأمواج، والمرافق البحرية على أنواعها وكافة الأعمال المتعلقة بها.	مهندس مدني	نشاط أساسي ويتطلب نشاط رقم (1.1)، ورقم (2.7)
3.4		مقاولات الأعمال المدنية لمحطات توليد الطاقة وتحلية المياه	وتشمل الأعمال المدنية اللازمة لمحطات توليد الطاقة والتجهيز للتركيبات الميكانيكية والكهربائية وكل ما يتعلق بذلك.	مهندس مدني	نشاط أساسي ويتطلب نشاط رقم (1.1)
	3.4.1	مقاولات محطات تحلية وتنقية المياه	وتشمل مراحل التحلية والمعالجة والتعقيم في محطات توزيع المياه والأعمال المتعلقة فيها.	مهندس مدني
3.5		مقاولات شبكات ومحطات نقل الطاقة	وتشمل تمديد الكابلات الهوائية والأرضية وإقامة المحطات الرئيسية والفرعية والمحولات جهد (132) ك.ف فأكثر وكل ما له علاقة بذلك.	مهندس كهربائي
	3.5.1	مقاولات شبكات ومحطات توزيع الطاقة	وتشمل تمديد الكابلات الهوائية والأرضية وإقامة المحطات الفرعية والمحولات جهد (33) ك.ف فأقل وأعمال إنارة الشوارع وكل ما له علاقة بذلك.	مهندس كهربائي	يتطلب نشاط رقم (1.1)
3.6		مقاولات محطات معالجة الصرف الصحي	وتشمل محطات المعالجة ومراحلها المختلفة والتعقيم وما يتبع ذلك من أعمال مماثلة.	مهندس مدني	نشاط أساسي ويتطلب نشاط رقم (1.1)
3.7		مقاولات إنشاء معامل التكرير البترولية	وتشمل أعمال إنشاء المعامل ومصافي تكرير البترول.	مهندس مدني
3.8		مقاولات إنشاء المعامل الكيميائية	وتشمل أعمال إنشاء المعامل الكيميائية.	مهندس مدني	نشاط أساسي ويتطلب نشاط رقم (1.1)
3.9		مقاولات بناء المرافق لحقول النفط والغاز	يشمل المنشآت المتخصصة في إنشاء وتنفيذ المرافق الخاصة بحقول النفط البرية ويشمل ذلك جميع العمليات الخاصة بالإنشاءات مثل المباني.	مهندس مدني	نشاط أساسي ويتطلب نشاط رقم (1.1)

4- مجال مقاولات الأعمال التخصصية:

4.2		مقاولات أعمال الغاز المسال	ويعني فيها جميع الأعمال الخاصة بأعمال الغاز المسيل وأنظمة النفايات الصلبة وأنظمة صيانة المباني والمصاعد والسلالم الكهربائية وما شابه.	مهندس ميكانيكي
4.3		مقاولات أعمال الوقاية ومكافحة الحريق	ويعني فيها جميع الأعمال الخاصة بأعمال الوقاية والإنذار المبكر وأنظمة ومعدات مكافحة الحريق والمضخات، وما شابه.	مهندس ميكانيكي
4.4		مقاولات أعمال شبكات الاتصال	ويعني فيها جميع أعمال شبكات الاتصالات وتقنية المعلومات وما شابه.	مهندس كهربائي أو مهندس اتصالات
4.5		مقاولات أعمال أنظمة التحكم والمراقبة وإدارة المباني	ويعني فيها جميع أعمال السمع بصري وأنظمة التحكم والمراقبة وإدارة المباني وما شابه.	مهندس كهربائي
4.6		مقاولات الأعمال المعدنية التخصصية	وتشمل الأعمال المعدنية التخصصية	مهندس مدني
	4.6.1	مقاولات الرافعات البرجية	وتشمل الأعمال المعدنية التخصصية الخاصة لرافعات البرجية ورافعات الأفراد ومعدات ومصاعد العمال وأعمال الأساسات الضرورية	مهندس مدني
	4.6.2	مقاولات السقالات	وتشمل أعمال السقالات على أنواعها	مهندس مدني
4.7		مقاولات أعمال تركيب أنظمة ترشيد الطاقة	وتشمل أعمال تركيب أنظمة ترشيد الطاقة	مهندس ميكانيكي أو كهربائي

5- مجال مقاولات الأعمال الفنية:

5.1		مقاولات الصيانة العامة للمباني	تشمل المنشآت التي تقوم بتنفيذ أعمال الصيانة العامة للمباني على أنواعها وتشمل أعمال الصباغ الداخلي والخارجي والتبليط والتكسية والأسقف المستعارة والألمنيوم والزجاج وإضافة أدوات أو معدات أو أجهزة أو أعمال ديكور والتشطيبات الداخلية وأعمال الطابوق أو أعمال الإنارة على واجهات المبنى بدون تعديلات إنشائية مثل مداخن المطاعم، المظلات، أجهزة المكيفات، أطباق لاقطة ولوحات إعلانية وتشمل التسوير المؤقت للمبنى والأعمال التحضيرية للمواقع الإنشائية والتخلص من مخلفات الأعمال.	مهندس مدني
	5.1.1	مقاولات الديكور	تشمل المنشآت التي تقوم بتنفيذ أعمال الديكور الداخلي للمباني والأعمال الخشبية والزجاجية والقواطع الداخلية والجص وأعمال الصباغ	مهندس معماري أو تصميم داخلي
	5.1.2	مقاولات أعمال الصيانة الدورية للمباني	تشمل المنشآت التي تقوم بتنفيذ أعمال الصيانة الدورية للمباني على أنواعها بدون القيام بأية تعديلات إنشائية ومدنية أو أي من الإضافات على الواجهات الخارجية وتشمل أعمال الصباغ الداخلي وصيانة المظلات وأحواض السباحة وغرف وأنظمة تجميع النفايات الصلبة والمصاعد والسلالم الكهربائية وأنظمة صيانة المباني والأنظمة والمعدات الميكانيكية والكهربائية ومستلزماتها.	مهندس مدني أو مهندس معماري
5.2		فحص التربة والأعمال الجيوفيزيائية	ويعني فيها جميع أعمال فحص التربة والأعمال الجيوفيزيائية وما شابه.	مهندس مدني أو مهندس تربة

Regarding Instructions for the Classification of Contractors in the Emirate of Abu Dhabi

The Chairman of the Department of Urban Planning and Municipalities

- After reviewing Law No. (1) of 1974 concerning the reorganization of the governmental apparatus in the Emirate of Abu Dhabi and its amendments,

- And Law No. (4) of 1983 concerning the regulation of construction works and its amendments, and its executive regulations and their amendments,

- And Law No. (5) of 2018 concerning the establishment of the Department of Urban Planning and Municipalities,

- And Emiri Decree No. (13) of 2017 concerning the reformation of the Executive Council of the Emirate of Abu Dhabi,

- And the decision of the Chairman of the Executive Council No. (20) of 2018 concerning additional competencies for the Department of Urban Planning and Municipalities,

- And the decision of the Chairman of the Department of Economic Development No. (2) of 2009 concerning the contractor classification system in the Emirate of Abu Dhabi,

- And Administrative Decision No. (56) of 2010 issued by the Department of Economic Development, concerning instructions for the classification of contractors,

- And Administrative Decision No. (69) of 2010 concerning the amendment of the schedule of violations of economic establishments in the Emirate of Abu Dhabi attached to Law No. (2) of 2009 on the establishment of the Department of Economic Development,

- And Administrative Decision No. (6) of 2018 concerning the registration system for a third-party office for auditing and inspection of engineering projects in the Emirate of Abu Dhabi,

- And Administrative Decision No. (158) of 2018 issuing the engineer registration system in the Emirate of Abu Dhabi.

- And Administrative Decision No. (159) of 2018 issuing instructions for the registration of engineers in the Emirate of Abu Dhabi.

- And Administrative Decision No. (160) of 2018 issuing the contractor classification system in the Emirate of Abu Dhabi.

Has decided the following:

Article (1)

Scope of Application

The provisions of these instructions shall apply to all contracting companies that practice engineering contracting works in the Emirate according to the approved activities and fields of engineering contracting mentioned in the provisions of this decision.

Article (2)

The Register

1. A register shall be established in the Department called the (Contractors Classification Register) in which all data of licensed and classified contractors shall be recorded, and it shall contain the following information and data:

a. The licensed contractor.

b. The field, activity, and classification category.

c. The scientific qualifications and practical experience of the license holder for each activity.

d. The scientific qualifications and practical experience of the technical staff.

e. The completed projects based on which the classification was made.

f. The financial status based on which the classification was made.

g. Quality, security, and safety certificates.

h. Insurance documents for the projects based on which the classification is made.

i. Projects currently under execution.

j. Efficiency evaluation of completed projects.

k. Engineering excellence requirements.

2. Any interested party may view the registers and request a certificate of the data recorded in the register, provided that their request is in writing and the prescribed fees are paid.

Article (3)

Contractor Classification Categories

1. A local contractor shall be classified in the following categories: Special, First, Second, Third, Fourth, Fifth, and Sixth.

2. A branch of a foreign contractor and a joint venture contractor shall be classified in the Special category only.

3. A contractor may not execute contracting works except in the category in which it is classified and the lower categories, in accordance with the provisions of the classification system and instructions.

Article (4)

Attachments for the Classification Application

The contractor must attach the following data and documents to the new classification application, or the renewal, upgrade, or modification application:

1. A copy of a valid commercial license that includes the activities for which classification is requested.

2. A statement issued by the Department of Economic Development showing the commercial licenses owned by the license holders to verify whether the classification applicant owns or participates in any establishments that conflict with the practice of the engineering contracting profession.

3. Data and documents related to the engineering and technical staff specialized in the engineering contracting activities to be practiced.

4. A detailed statement of previous works and projects carried out by the contractor for whom the license is requested.

5. Documents and records proving the years of practical experience in the field of the requested activity.

6. A copy of the company's memorandum of association or the service agent contract (as applicable).

7. A certificate of incorporation of the contractor issued by the competent authorities in the contractor's home country and proof of practicing work in the contracting activity for the required period without interruption (for a branch of a foreign contractor).

8. A labor statement issued by the Ministry of Labour, which is not more than two months old, and the submission of a labor accommodation document from the concerned authority or its equivalent for registration and renewal cases (the document is not required if there are no projects).

9. A certified copy of the audited annual financial report that meets all international professional standards and criteria approved in the state.

10. A certified declaration of assigning a specialized accounting staff or contracting with a specialized office to review the accounting records.

11. A certified declaration by the auditor that the contractor meets the financial conditions, criteria, and the required financial status for classification purposes in accordance with the relevant legislation.

12. Documents related to amendments that have occurred to the contractor's status, if any - especially with regard to the engineering staff working at the establishment.

13. Any other documents or records that the concerned administration deems necessary to present.

Article (5)

Classification Upgrade

An exception may be made for a local contractor fully owned by a citizen, if 80% of the value of the previous experience for the required category is provided from the executed experience requirements upon renewal, if it meets all the requirements for the category higher than the required one, and this is only for the Fourth, Third, Second, and First categories.

Article (6)

Local Contractor for Simple Works

1. The contractor may apply for classification in the Sixth category for simple works contracting activities, provided that it meets the classification conditions and criteria and the special requirements for the simple works contracting activities.

2. The contractor classified for simple works activities shall assume all responsibilities and tasks of the consulting office through its employed engineers registered for this activity.

3. The contractor shall provide the following with the classification application:

- A certified declaration of assigning the special technical staff required to be classified for this activity, so that the architect is responsible for the design and the civil engineer is responsible for supervising the execution.

- A certificate of accreditation from the Building Permits Department authorizing the contractor's specialized technical staff to undertake the tasks of the consulting office, including design, auditing, review, follow-up, and quality control related to the activity, and to verify their full knowledge of the procedures followed to obtain the necessary approvals from the Building Permits Department and related service authorities.

4. The contractor may be licensed to practice one or more simple works activities, provided that the required technical staff is provided for each activity.

5. The engineering work for these activities shall be undertaken by engineers registered in the Engineers' Register in the Emirate, according to the required specializations for the approved activities, provided that the technical staff for the activities in this field consists of at least one civil engineer and one architect, and technical staff are added according to the project area quota requirements and in accordance with the provisions of the classification system and instructions.

Article (7)

Contractor Classification Criteria

The evaluation of contractors for the purpose of their initial classification, renewal of classification, upgrading, or fixing them in one of the categories shall be in accordance with the technical criteria mentioned below:

Article (8)

Technical Staff Data

The contractor must attach the technical staff documents and data to the new classification application, or when requesting to renew, upgrade, or amend the existing classification, as follows:

1. A table showing the names of the license-holding engineers for whom the required activities are classified and the registered engineers required according to the classification category for each activity, with the required data for documented years of experience, registration number, and category, divided according to the field and activities to be classified, all of which must be serialized and according to the form approved by the Department.

2. Proof of the residency of the license-holding engineers for the activities to be classified within the country, under the contractor's sponsorship, and their full-time employment with the contractor.

3. Submission of an electronic copy of all required documents.

4. Any documents or data requested by the concerned administration.

Article (9)

Required Experience for Technical Staff for Engineering Contracting Activities

1- The contractor must have in its technical team for each classification category and for each main activity, a number of engineers proportional to the number of specializations to be classified, as follows:

2- To secure the required number of activities for each classification category, one or more activities related to the main activity must be added. The contractor may be satisfied with providing the required number of license-holding engineers for the specialization, and the activity will be classified according to the years of experience available to the license holder.

3- The building contracting activity is granted a floor area that corresponds to the classification category. The contractor can add additional project area for any activity by registering and adding new registered engineers to that activity. When adding an activity related to the main activity, the classification is done using one of the specialized engineers from the available technical staff. If the required specialization is not available, a specialist engineer is added to the team and is classified according to their available years of experience.

4- The contractor has the right to add additional main activities and related activities for one or more domains, provided that the appropriate technical staff is provided for them and for the category to be classified, as stated in clause (1) and clause (2) of the same article.

5- The contractor must apply for classification for all necessary activities to complete the intended works and secure the area quota for all activities in proportion to the nature and size of the project and the available technical staff. The contractor has the right to borrow from the area quota of subcontractors in proportion to their technical staff and classified activities as needed. The borrowed area quota will be reserved from the area quota of the lending subcontractor for the same activity.

6- Borrowing an area quota is not permitted except after subcontracting and documenting this subcontract on the electronic system for licensing services and according to the approved procedures and conditions under the Project Area Quota Management System issued by the Department.

7- The contractor is solely responsible for coordinating with their engineers and the engineers of subcontractors to organize the requirements for their registration and distribution among the classified engineering contracting domain activities, in order to secure the quota for the required project areas.

8- Upon completion of the contractor's appointment procedures to execute a project, an area quota will be reserved from the account of the main activities according to the nature of the project and its authorized activities, equivalent to the project area or the works to be executed for each main activity. This will be until the issuance of the completion certificate, at which point (70%) of the area quota will be automatically released. The remaining project area quota will be released after the issuance of the project's occupancy certificate, for both the main contractor and subcontractors of the project. If the license or the project is canceled, all reserved areas and quotas under it will be released.

Article (10)

Data on Quality, Security, Safety, and Professional Insurance

The contractor must attach to the new classification application, or when requesting to renew, upgrade, or amend the existing classification, all data, information, and documents related to the following, according to the contractor classification requirements and criteria mentioned earlier in Article (7):

1. Quality certificate.

2. Environmental protection certificate.

3. Health and safety certificate.

4. Professional insurance policy. (for Simple Works Contractor)

Article (11)

Criterion of Previous Experience and Estimated Value of Projects for Participation

1. The contractor must have experience in completing projects during the (10) ten years prior to the date of submitting the classification application, which is appropriate in type and size to the classification category and the required activities.

2. The estimated value of projects in which the contractor may participate according to its classification category in the field of infrastructure contracting, specialized infrastructure, and specialized works shall be (as detailed in the contractor classification criteria mentioned in Article (7)).

Article (12)

Data of Executed Projects

Data of projects executed by the contractor are accepted as follows:

1. Experience of projects executed for governmental and semi-governmental entities within the country by the contractor will not be accepted unless it is accompanied by official contracts and completion certificates or final payment certificates showing the percentage of work completed, certified by the project owner.

2. Experience of projects executed outside the country may be accepted provided it is proven by execution certificates issued by governmental authorities in the country where the projects were executed and authenticated according to the procedures applicable in the Emirate.

3. The contractor will be reclassified in the appropriate category upon the withdrawal of any of the partners based on whose experience the contractor was classified.

4. For the classification of a branch within the Emirate, the experience of projects executed by the head office or one of its branches is accepted, provided that official certificates authenticated according to the procedures applicable in the Emirate are submitted, confirming that the branches are fully owned by the head office, along with a pledge from the head office to bear all responsibilities and obligations.

5. A local company may benefit from the experience of a foreign partner provided that its share in the capital is not less than (30%) if it is a single legal entity, not less than (20%) for each if they are two legal entities, and not less than (15%) for each if they are more than two legal entities.

6. A contractor established in the Emirate who has established branches in other emirates of the country may benefit from the experiences executed by these branches for the purpose of classifying the contractor in the Emirate.

7. Without prejudice to the provisions of the preceding clauses of this article, experience of projects executed in the country by a joint venture contractor licensed in the Emirate will be accepted when submitted with an application for renewal or upgrading the classification of an established local contractor or for a new classification application for a branch of a foreign contractor where the main branch of the foreign contractor was a partner.

8. Experience of projects executed as a subcontractor and not documented on the electronic system will not be considered unless accompanied by the following:

a. A letter of approval of the subcontractor from the project-owning entity,

b. The subcontract and the main contract,

c. A building permit for the said project, specifying the contractor's data and the subcontractor's data and scope of work,

d. A completion certificate from authorities accepted by the concerned administration,

e. A copy of the occupancy certificate for buildings completed more than one year after the enforcement of the classification system's provisions.

9. The contractor must submit the final payment certificate or proof of the completion percentage for projects executed for the private sector, certified by the supervising engineering office, and a bank statement showing the deposit of this payment in its account, along with the contracting agreement, an official completion certificate, and the occupancy certificate. The Department may request the contractor to provide alternative documents to the above, depending on the requirements of each case.

10. If the contractor wishes to benefit from any projects that include more than one activity for classification or upgrading, they must submit documents and records that clarify the value and nature of each specialization separately by providing a summary of the bill of quantities for the project, certified by the consulting office.

11. The experience of a natural person is not considered as experience of executed projects in the classification.

12. If two or more contractors execute a project or more and any of them wishes to benefit from their experience in this project for classification, they must provide proof of the joint venture between them, as well as the nature of the work performed by each member of the joint venture and the percentage of this work from the total project value. The value of the work executed by the contractor only will be calculated according to the actual execution percentages.

13. No experience may be used to classify a contractor more than once in the same specialization.

Article (13)

Engineering Contracting Activities and Domains

Without prejudice to the competence of the Technical Committee in approving new engineering specializations and branches, the following domains and activities shall be allocated for practicing the profession of engineering contracting:

1. Building Construction Contracting Domain.

2. Infrastructure Contracting Domain.

3. Specialized Infrastructure Contracting Domain.

4. Specialized Works Domain.

5. Support Works Contracting Domain.

6. Technical Works Contracting Domain.

7. Simple Works Contracting Domain.

8. Any domains and specializations approved and issued by the Technical Committee in the future.

The availability of specializations in the contractor's technical staff must be taken into account, according to the specialization and category in which it is classified and for the engineering contracting domains and activities issued under this decision.

Article (14)

Financial Criteria and Financial Status

1. For classification purposes from a financial perspective, the company or establishment must possess acceptable assets for classification purposes with a value that covers the total value of liabilities in addition to the paid-up capital for each category as a minimum for classification in each category, as follows:

The company or establishment must maintain accounting records and issue audited annual financial statements in accordance with international professional standards and relevant legislation.

2. Acceptable assets for classification purposes are the assets presented in the company's or establishment's actual balance sheet, located within the country, supported by documentary evidence, and legally owned exclusively by the classification-requesting company or establishment, which can be liquidated (converted to cash) upon request. The following assets can be considered acceptable for classification purposes according to the conditions set by the Department, as follows:

a. Cash and bank deposits.

b. Real estate.

c. Vehicles and machinery.

d. Accounts receivable that have been proven to be collected after the balance sheet date.

e. Work in progress if it has been invoiced and its value collected after the balance sheet date.

f. Accounts receivable with confirmed balances by government entities.

g. Trade receivables with confirmed balances from parties that do not fall under the definition of related parties, provided that no more than one year has passed since the due date for payment.

h. Accounts receivable with final enforcement judgments issued, provided that the enforcement judgment is not more than one year old from its issuance date.

i. Guarantees and the like.

j. Prepaid expenses and the like.

k. Any other assets approved by the Department.

3. The contractor's financial status is studied and evaluated by the approved auditor or by any entity specified by the Department according to the form and requirements determined by the Department for this purpose.

4. The Department maintains a register of financial data for companies and establishments within a special electronic program for storing and analyzing financial data.

5. A unified date is set for the audited annual financial report used in the classification of companies or establishments that fall under the definition of "related parties" according to international professional standards.

6. The Department may introduce other supplementary or alternative financial criteria.

7. The Department may disregard the provided assessment if the submitted balance sheet does not meet professional standards or when necessary, based on the recommendations of specialists.

Article (15)

Any provision that contradicts or conflicts with the provisions of this decision is hereby repealed.

Article (16)

This decision shall be published in the Official Gazette and shall come into effect starting from the third of March 2019.

Engineering Contracting Activities and Domains in the Emirate

-1- Building Construction Contracting Domain

The activity of General Contracting for Concrete Buildings must be chosen as the main activity for this domain, and the minimum required number of registered engineers for the technical staff must be provided, with the Civil Engineer being the license holder.

An Architect may not be classified for any other activity.

One of the registered engineers required for the third category and above may be classified for an additional specialization to be the license holder for that activity.
