بتعديل بعض أحكام القانون رقم (20) لسنة 2006
بشأن إيجار الأماكن وتنظيم العلاقة الإيجارية بين المؤجرين والمستأجرين
في إمارة أبوظبي
نحن خليفة بن زايد آل نهيان، حاكم أبوظبي
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (2) لسنة 1971 في شأن المجلس الاستشاري الوطني والقوانين المعدلة له،
- وعلى القانون رقم (20) لسنة 2006 بشأن إيجار الأماكن وتنظيم العلاقة الإيجارية بين المؤجرين والمستأجرين في إمارة أبوظبي المعدل بالقانون رقم (6) لسنة 2009،
- وعلى القانون رقم (23) لسنة 2006 بشأن دائرة القضاء في إمارة أبوظبي المعدل بالقانون رقم (11) لسنة 2008،
- وبناءً على ما عرضه رئيس دائرة القضاء، وموافقة المجلس التنفيذي عليه،
أصدرنا القانون الآتي:
المادة الأولى
يستبدل بنصوص المواد (20) و(24) و(26) و(27) و(28) و(30) و(31) من القانون رقم (20) لسنة 2006 المشار إليه، النصوص الآتية:
مادة (20)
- 1. يسري عقد الإيجار إلى نهاية المدة المحددة فيه، ويجوز تجديده لمدة أو لمدد أخرى باتفاق الطرفين.
- 2. إذا انتهت مدة العقد، وظل المستأجر منتفعًا بالعين المؤجرة مع علم المؤجر بذلك ودون اعتراض منه، يعتبر العقد مجددًا لمدة مماثلة وبذات الشروط.
- 3. إذا رغب أحد الطرفين في عدم تجديد العقد أو تعديل شروطه، يتعين عليه أن يخطر الطرف الآخر كتابة وذلك قبل شهرين من تاريخ نهاية العقد بالنسبة للأماكن المؤجرة للسكنى وقبل ثلاثة أشهر من تاريخ نهاية العقد بالنسبة للأماكن المؤجرة لغرض تجاري أو صناعي أو حرفي أو لمزاولة مهنة حرة.
- 4. مع مراعاة البنود السابقة في هذه المادة، لا يجوز للمؤجر أن يطلب من المستأجر إخلاء العين المؤجرة استنادًا لمضي المدة قبل تاريخ 9 نوفمبر 2010، ويجوز بقرار من رئيس المجلس التنفيذي تمديد هذا التاريخ وفقًا لما يراه مناسبًا.
- 5. للجنة أن تقرر إخلاء العين المؤجرة قبل التاريخ المحدد في البند (4) من هذه المادة، إذا كان استمرار المستأجر في العين المؤجرة من شأنه أن يلحق ضررا جسيمًا بالمؤجر وبشرط أن يكون المستأجر قد انتفع بالعين المؤجرة مدة لا تقل عن سنتين، وفي هذه الحالة يمنح المستأجر مهلة لا تجاوز ستة أشهر لإخلاء العين المؤجرة تبدأ من تاريخ قرار اللجنة.
- 6. تصدر بقرار من رئيس المجلس التنفيذي قواعد وإجراءات تسجيل عقود الإيجار المتعلقة بالعقارات الموجودة في الإمارة.
مادة (24)
تنشأ لجنة محلية أو أكثر، تسمى «لجنة فض المنازعات الإيجارية» تتبع دائرة القضاء في إمارة أبوظبي، وتكون برئاسة قاض، ويصدر بتشكيلها وتحديد مقارها ومكافآت أعضائها قرار من رئيس دائرة القضاء.
مادة (26)
- 1. تنشأ لجنة محلية أو أكثر، تسمى «لجنة الاستئناف» تتبع دائرة القضاء في أبوظبي، وتكون برئاسة أحد قضاة الاستئناف، ويصدر بتشكيلها وتحديد مقارها ومكافآت أعضائها قرار من رئيس دائرة القضاء.
- 2. تختص لجان الاستئناف بالفصل على وجه السرعة في الطعن على الأحكام التي تصدرها لجان فض المنازعات الإيجارية، وذلك بمراعاة المادة (28) من هذا القانون.
- 3. تنشأ لجنة عليا، تسمى لجنة النقض تتبع دائرة القضاء في أبوظبي، يكون مقرها في مدينة أبوظبي، وتكون برئاسة أحد قضاة محكمة النقض، ويصدر بتشكيلها ومكافآت أعضائها قرار من رئيس دائرة القضاء.
- 4. تختص لجنة النقض بالفصل في الطعن على الأحكام التي تصدرها لجان الاستئناف، وذلك بمراعاة المادة (28) من هذا القانون.
- 5. تستعين اللجان المذكورة بلجنة استشارية من الخبراء والمختصين في الأمور العقارية والإيجاري. ويصدر بتشكيل هذه اللجنة وحالات الاستعانة بها قرار من رئيس دائرة القضاء.
مادة (27)
- 1. يصدر قرار من رئيس دائرة القضاء بناءً على اقتراح مجلس القضاء بالأنظمة واللوائح الداخلية والهيكل الإداري والوظيفي والمالي الخاص بلجان فض المنازعات الإيجارية ولجان الاستئناف ولجنة النقض، والإجراءات الواجب إتباعها أمام هذه اللجان، وكيفية تنفيذ أحكامها، والرسوم الواجب تحصيلها عن الطلبات المقدمة أمامها.
- 2. تؤول كافة الرسوم لصالح دائرة المالية في حكومة أبوظبي.
- 3. تستثنى الجهات الحكومية من سداد رسوم الطلبات.
- 4. يقوم وكيل دائرة القضاء برفع الميزانية السنوية الخاصة بلجان فض المنازعات ولجان الاستئناف ولجنة النقض لرئيس دائرة القضاء لاعتمادها.
مادة (28)
- 1. يكون الحكم الصادر من اللجنة نهائيًا، إذا لم تتجاوز قيمة المنازعة مائة ألف درهم.
- 2. تكون أحكام اللجنة فيما جاوز ذلك قابلة للاستئناف أمام لجنة الاستئناف، خلال خمسة عشر يوما تبدأ من اليوم التالي لصدور الحكم إذا كان حضوريًا، واعتبارًا من تاريخ اليوم التالي لإعلان المحكوم ضده، أو علمه اليقيني إذا كان الحكم غيابيًا.
- 3. يجوز الطعن بالنقض في الأحكام الصادرة من لجنة الاستئناف، إذا جاوزت قيمة المنازعة خمسمائة ألف درهم خلال ثلاثين يوما تبدأ من اليوم التالي لصدور الحكم الحضوري المستأنف، واعتبارًا من تاريخ اليوم التالي لإعلان المحكوم ضده، أو علمه اليقيني إذا كان الحكم غيابيًا.
مادة (30)
يتبع في إجراءات نظر المنازعات والحكم فيها، أمام لجان فض المنازعات الإيجارية ولجان الاستئناف ولجنة النقض، والإجراءات السارية وقت صدور هذا القانون، وذلك لحين صدور قرار رئيس دائرة القضاء في هذا الشأن.
مادة (31)
- 1. تحال جميع المنازعات الإيجارية المتداولة إلى اللجان المشكلة بموجب هذا القانون، ما لم يكن قد تم حجزها للحكم.
2. تنظر محكمة النقض المنازعات الإيجارية التي طعن فيها أمامها قبل صدور هذا القانون.
المادة الثانية
يضاف إلى أحكام القانون رقم (20) لسنة 2006 المشار إليه، مادتان جديدتان برقمي 33 مكررًا (1) و 33 مكررًا (2)، يكون نصهما الآتي:
مادة (33) مكررًا (1):
ينقل جميع موظفي ومستخدمي لجان فض المنازعات الإيجارية إلى دائرة القضاء، وذلك دون المساس بحقوقهم وامتيازاتهم، وتحول كافة المخصصات المالية اللازمة لهم إلى دائرة القضاء.
مادة (33) مكررًا (2):
تنقل كافة الإيداعات والاعتمادات المالية المتعلقة بلجان فض المنازعات الإيجارية من الأمانة العامة للمجلس التنفيذي إلى دائرة القضاء.
المادة الثالثة
يُنفذ هذا القانون من تاريخ صدوره، وينشر في الجريدة الرسمية.

Law No. (4) of 2010
Amending certain provisions of Law No. (20) of 2006
Concerning the Lease of Premises and the Regulation of the Landlord-Tenant Relationship
in the Emirate of Abu Dhabi
We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi,
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (2) of 1971 concerning the National Consultative Council and its amending laws,
- And Law No. (20) of 2006 concerning the Lease of Premises and the Regulation of the Landlord-Tenant Relationship in the Emirate of Abu Dhabi, as amended by Law No. (6) of 2009,
- And Law No. (23) of 2006 concerning the Judicial Department in the Emirate of Abu Dhabi, as amended by Law No. (11) of 2008,
- And based on the proposal of the Chairman of the Judicial Department, and the approval of the Executive Council,
Have issued the following Law:
Article One
The texts of Articles (20), (24), (26), (27), (28), (30), and (31) of the aforementioned Law No. (20) of 2006 shall be replaced by the following texts:
Article (20)
- 1. The lease contract shall be valid until the end of the term specified therein, and it may be renewed for another term or terms by agreement of the two parties.
- 2. If the contract term expires, and the tenant continues to occupy the leased property with the landlord's knowledge and without objection, the contract shall be considered renewed for a similar term and under the same conditions.
- 3. If either party wishes not to renew the contract or to amend its terms, they must notify the other party in writing two months before the end of the contract for residential properties and three months before the end of the contract for properties leased for commercial, industrial, professional, or craft purposes.
- 4. Subject to the preceding clauses of this Article, the landlord may not request the tenant to vacate the leased property based on the expiration of the term before November 9, 2010, and the Chairman of the Executive Council may, by a decision, extend this date as deemed appropriate.
- 5. The Committee may decide to evict the tenant from the leased property before the date specified in Clause (4) of this Article if the tenant's continued occupancy would cause serious harm to the landlord, provided that the tenant has occupied the leased property for a period of not less than two years. In this case, the tenant shall be granted a grace period not exceeding six months to vacate the leased property, starting from the date of the Committee's decision.
- 6. The rules and procedures for registering lease contracts related to properties in the Emirate shall be issued by a decision of the Chairman of the Executive Council.
Article (24)
One or more local committees, called the "Rent Dispute Settlement Committee," shall be established under the Judicial Department in the Emirate of Abu Dhabi, presided over by a judge. A decision on its formation, headquarters, and member remuneration shall be issued by the Chairman of the Judicial Department.
Article (26)
- 1. One or more local committees, called the "Appeals Committee," shall be established under the Judicial Department in Abu Dhabi, presided over by an appellate judge. A decision on its formation, headquarters, and member remuneration shall be issued by the Chairman of the Judicial Department.
- 2. The Appeals Committees shall have the jurisdiction to rule expeditiously on appeals against judgments issued by the Rent Dispute Settlement Committees, in accordance with Article (28) of this Law.
- 3. A higher committee, called the "Cassation Committee," shall be established under the Judicial Department in Abu Dhabi, with its headquarters in the city of Abu Dhabi, presided over by a judge of the Court of Cassation. A decision on its formation and member remuneration shall be issued by the Chairman of the Judicial Department.
- 4. The Cassation Committee shall have the jurisdiction to rule on appeals against judgments issued by the Appeals Committees, in accordance with Article (28) of this Law.
- 5. The aforementioned committees shall be assisted by an advisory committee of experts and specialists in real estate and rental matters. A decision on the formation of this committee and the cases in which it may be consulted shall be issued by the Chairman of the Judicial Department.
Article (27)
- 1. A decision shall be issued by the Chairman of the Judicial Department, based on a proposal from the Judicial Council, regarding the internal regulations, administrative, functional, and financial structure of the Rent Dispute Settlement Committees, Appeals Committees, and Cassation Committee, the procedures to be followed before these committees, the manner of executing their judgments, and the fees to be collected for applications submitted to them.
- 2. All fees shall be transferred to the Department of Finance in the Government of Abu Dhabi.
- 3. Government entities shall be exempt from paying application fees.
- 4. The Undersecretary of the Judicial Department shall submit the annual budget for the Dispute Settlement Committees, Appeals Committees, and Cassation Committee to the Chairman of the Judicial Department for approval.
Article (28)
- 1. The judgment issued by the Committee shall be final if the value of the dispute does not exceed one hundred thousand dirhams.
- 2. Judgments of the Committee exceeding this amount shall be appealable before the Appeals Committee within fifteen days from the day following the issuance of the judgment if it was in personam, or from the day following the notification to the defendant or their certain knowledge if the judgment was in absentia.
- 3. Judgments issued by the Appeals Committee may be appealed before the Cassation Committee if the value of the dispute exceeds five hundred thousand dirhams, within thirty days from the day following the issuance of the appealed in personam judgment, or from the day following the notification to the defendant or their certain knowledge if the judgment was in absentia.
Article (30)
The procedures in effect at the time of the issuance of this Law shall be followed for hearing and ruling on disputes before the Rent Dispute Settlement Committees, Appeals Committees, and Cassation Committee, until a decision is issued by the Chairman of the Judicial Department in this regard.
Article (31)
- 1. All pending rental disputes shall be transferred to the committees formed under this Law, unless they have been reserved for judgment.
2. The Court of Cassation shall hear rental disputes that were appealed before it prior to the issuance of this Law.
Article Two
Two new articles, numbered 33 bis (1) and 33 bis (2), shall be added to the provisions of the aforementioned Law No. (20) of 2006, with the following text:
Article (33) bis (1):
All employees and staff of the Rent Dispute Settlement Committees shall be transferred to the Judicial Department, without prejudice to their rights and privileges, and all necessary financial allocations for them shall be transferred to the Judicial Department.
Article (33) bis (2):
All deposits and financial appropriations related to the Rent Dispute Settlement Committees shall be transferred from the General Secretariat of the Executive Council to the Judicial Department.
Article Three
This Law shall come into force from the date of its issuance and shall be published in the Official Gazette.
