قرار رئيس المجلس التنفيذي رقم (56) لسنة 2010
بشأن عقود إيجار الأماكن
نحن محمد بن زايد آل نهيان، ولي العهد رئيس المجلس التنفيذي
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (20) لسنة 2006 بشأن إيجار الأماكن وتنظيم العلاقة الإيجارية بين المؤجرين والمستأجرين في إمارة أبوظبي والقوانين المعدلة له،
- وعلى قرار رئيس المجلس التنفيذي رقم (76) لسنة 2009 بشأن تشكيل لجنة لدراسة الأبعاد الاقتصادية والاجتماعية للتنظيم القانوني لعقود الإيجار،
- وبناءً على ما عُرض على المجلس التنفيذي، وموافقة المجلس عليه.
أصدرنا القرار الآتي:
المادة الأولى
لا يجوز أن تزيد نسبة الزيادة السنوية في الأجرة المحددة في العقد، والواردة في المادة (16) من القانون رقم (20) لسنة 2006 المشار إليه، على خمسة في المائة (5%).
تُمدد المهلة المنصوص عليها في البند (4) من المادة (20) من القانون رقم (20) لسنة 2006 المشار إليه، لتصبح 9 نوفمبر 2011.
المادة الثانية
تُلغى اللجنة المشكلة بقرار رئيس المجلس التنفيذي رقم (76) لسنة 2009 المشار إليه.
المادة الثالثة
يُنفذ هذا القرار من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

Executive Council Chairman's Resolution No. (56) of 2010
Concerning Premises Lease Contracts
We, Mohamed bin Zayed Al Nahyan, Crown Prince and Chairman of the Executive Council
- Having reviewed Law No. (1) of 1974 regarding the reorganization of the governmental apparatus in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (20) of 2006 concerning the lease of premises and the regulation of the rental relationship between lessors and lessees in the Emirate of Abu Dhabi and its amending laws,
- And the Executive Council Chairman's Resolution No. (76) of 2009 regarding the formation of a committee to study the economic and social dimensions of the legal regulation of lease contracts,
- And based on what was presented to the Executive Council, and its approval thereof.
Have issued the following resolution:
Article One
The annual increase in the rent specified in the contract, as mentioned in Article (16) of the aforementioned Law No. (20) of 2006, shall not exceed five percent (5%).
The period stipulated in Clause (4) of Article (20) of the aforementioned Law No. (20) of 2006 shall be extended to November 9, 2011.
Article Two
The committee formed by the Executive Council Chairman's Resolution No. (76) of 2009, as mentioned above, is hereby abolished.
Article Three
This resolution shall be implemented from the date of its issuance and shall be published in the Official Gazette.
