القانون الاتحادي رقم (24) لسنة 1999
في شأن حماية البيئة وتنميتها المعدل بالقانون الاتحادي رقم (11) لسنة 2006
والأنظمة البيئية المنفذة له
نحن زايد بن سلطان آل نهيان - رئيس دولة الإمارات العربية المتحدة،
بعد الاطلاع على الدستور،
- - وعلى القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات وصلاحيات الوزراء والقوانين المعدلة له،
- - وعلى القانون الاتحادي رقم (3) لسنة 1979 في شأن الدفاع المدني والقوانين المعدلة له،
- - وعلى القانون الاتحادي رقم (7) لسنة 1979 في شأن الحجر الزراعي والقوانين المعدلة له،
- - وعلى القانون الاتحادي رقم (8) لسنة 1980 في شأن تنظيم علاقات العمل والقوانين المعدلة له،
- - وعلى القانون الاتحادي رقم (21) لسنة 1981 في شأن إنشاء الهيئة العامة لإدارة موارد المياه في دولة الإمارات العربية المتحدة،
- - وعلى القانون الاتحادي رقم (26) لسنة 1981 بشأن القانون التجاري البحري والقوانين المعدلة له،
- - وعلى المرسوم بقانون رقم (9) لسنة 1983 في شأن تنظيم صيد الطيور والحيوانات،
- - وعلى قانون المعاملات المدنية الصادر بالقانون الاتحادي رقم (5) لسنة 1985 والقوانين المعدلة له،
- - وعلى قانون العقوبات الصادر بالقانون الاتحادي رقم (3) لسنة 1987،
- - وعلى قانون الإجراءات الجزائية الصادر بالقانون الاتحادي رقم (35) لسنة 1992م
- - وعلى القانون الاتحادي رقم (39) لسنة 1992 في شأن إنتاج واستيراد وتداول الأسمدة والمصلحات الزراعية،
- - وعلى القانون الاتحادي رقم (41) لسنة 1992م في شأن مبيدات الآفات الزراعية،
- - وعلى القانون الاتحادي رقم (7) لسنة 1993م بإنشاء الهيئة الاتحادية للبيئة،
- - وعلى القانون الاتحادي رقم (19) لسنة 1993 في شأن تعيين المناطق البحرية لدولة الإمارات العربية المتحدة،
- - وبناءً على ما عرضه وزير الصحة، وموافقة مجلس الوزراء والمجلس الوطني الاتحادي، وتصديق المجلس الأعلى للاتحاد،
أصدرنا القانون الآتي:
مادة (1)
تعاريف
في تطبيق أحكام هذا القانون يقصد بالكلمات والعبارات التالية المعاني المبينة قرين كل منها، ما لم يقتض السياق معنى آخر:
| الدولة | : | دولة الإمارات العربية المتحدة. |
| الهيئة | : | الهيئة الاتحادية للبيئة. |
| مجلس الإدارة | : | مجلس إدارة الهيئة. |
| رئيس مجلس الإدارة | : | رئيس مجلس إدارة الهيئة. |
| السلطات المختصة | : | السلطة المحلية المختصة في كل إمارة من إمارات الدولة. |
| الجهات المعنية | : | جميع الجهات المعنية بشؤون البيئة والتنمية داخل الدولة. |
| البيئة | : | المحيط الحيوي الذي تتجلى فيه مظاهر الحياة بأشكالها المختلفة ويتكون هذا المحيط من عنصرين: عنصر طبيعي: يضم الكائنات الحية من إنسان وحيوان ونبات، وغيرها من الكائنات الحية وموارد طبيعية من هواء وماء وتربة ومواد عضوية وغير عضوية، وكذلك الأنظمة الطبيعية. وعنصر غير طبيعي: يشمل كل ما أدخله الإنسان إلى البيئة الطبيعية من منشآت ثابتة وغير ثابتة وطرق وجسور ومطارات ووسائل نقل وما استحدثه من صناعات ومبتكرات وتقنيات. |
| البيئة البحرية | : | المياه البحرية وما بها من ثروات طبيعية ونباتات وأسماك وكائنات بحرية أخرى، وما فوقها من هواء وما هو مقام فيها من منشآت أو مشروعات ثابتة أو متحركة وتبلغ حدودها حدود المنطقة الاقتصادية الخالصة للدولة. |
| البيئة المائية | : | البيئة البحرية والمياه الداخلية بما فيها المياه الجوفية ومياه الينابيع والوديان وما بها من ثروات طبيعية ونباتات وأسماك وكائنات حية أخرى وما فوقها من هواء وما هو مقام فيها من منشآت أو مشاريع ثابتة أو متحركة. |
| الأنظمة البيئية | : | النظام الشامل الذي يضم جميع مكونات العناصر الطبيعية للبيئة التي تتكامل وتتفاعل فيما بينها. |
| الموارد الطبيعية | : | جميع الموارد التي لا دخل للإنسان في وجودها. |
| المحمية الطبيعية | : | الأرض أو المياه التي تتميز بطبيعة بيئية خاصة (طيور، حيوانات، أسماك، نباتات، أو ظواهر طبيعية ذات قيمة ثقافية أو جمالية أو بيئية ويصدر بتحديدها قرار من مجلس الوزراء بناءً على اقتراح من الهيئة أو قرار من السلطات المختصة. |
| تدهور البيئة | : | التأثير على البيئة بما يقلل من قيمتها أو يشوه من طبيعتها البيئية أو يستنزف مواردها أو يضر بالكائنات الحية أو بالآثار. |
| تلوث البيئة | : | التلوث الناجم بشكل طبيعي أو غير طبيعي ناتج عن قيام الإنسان بشكل مباشر أو غير مباشر، إرادي أو غير إرادي، بإدخال أي من المواد والعوامل الملوثة في عناصر البيئة الطبيعية، والذي ينشأ من جرائه أي خطر على صحة الإنسان أو الحياة النباتية أو الحيوانية أو أذى للموارد والنظم البيئية. |
| المواد والعوامل الملوثة | : | أية مواد صلبة أو سائلة أو غازية أو أدخنة أو أبخرة أو روائح أو ضوضاء أو إشعاعات أو حرارة أو وهج الإضاءة أو اهتزازات تنتج بشكل طبيعي أو بفعل الإنسان وتؤدي بطريقة مباشرة أو غير مباشرة إلى تلوث البيئة وتدهورها أو الإضرار بالإنسان أو بالكائنات الحية. |
| تلوث الهواء | : | كل تغيير في خصائص ومواصفات الهواء الخارجي وهواء أماكن العمل وهواء الأماكن العامة المغلقة وشبه المغلقة يترتب عليه خطر على صحة الإنسان والبيئة، سواء كان هذا التلوث ناتجًا عن عوامل طبيعية أو نشاط إنساني. |
| التلوث المائي | : | إدخال أية مواد أو طاقة في البيئة المائية بطريقة إرادية أو غير إرادية مباشرة أو غير مباشرة ينتج عنه ضرر بالمواد الحية أو غير الحية أو يهدد صحة الإنسان أو يعوق الأنشطة المائية بما في ذلك صيد الأسماك والأنشطة السياحية أو يفسد صلاحيتها للاستعمال أو ينقص من التمتع بها أو يغير من خواصها. |
| المواد الملوثة للبيئة المائية | : | أية مواد يترتب على تصريفها في البيئة المائية بطريقة مباشرة أو غير مباشرة إرادية أو غير إرادية تغيير في خصائصها على نحو يضر بالإنسان وبالكائنات الحية الأخرى أو بالموارد الطبيعية أو بالبيئة المائية أو يضر بالمناطق السياحية أو يتداخل مع الاستخدامات الأخرى المشروعة للبيئة المائية. |
| شبكات الرصد البيئي | : | وحدات العمل التي تقوم برصد مكونات وملوثات البيئة وتوفير البيانات للجهات المعنية بصفة دورية. |
| تقييم التأثير البيئي | : | دراسة وتحليل الجدوى البيئية للأنشطة التي قد تؤثر إقامتها أو ممارستها على سلامة البيئة. |
| حماية البيئة | : | المحافظة على مكوناتها وخواصها وتوازنها الطبيعي ومنع التلوث أو الإقلال منه أو مكافحته، والحفاظ على الموارد الطبيعية وترشيد استهلاكها وحماية الكائنات الحية التي تعيش فيها، خاصة المهددة بالانقراض، والعمل على تنمية كل تلك المكونات والارتقاء بها. |
| تنمية البيئة | : | السياسات والإجراءات التي تلبي احتياجات التنمية المستدامة في الدولة اجتماعيًا وثقافيًا واقتصاديًا وتحقق الأهداف والمبادئ التي من أجلها وضع هذا القانون وأهمها تحسين عناصر البيئة الطبيعية والمحافظة على التنوع البيولوجي والتراث التاريخي والأثري والطبيعي الحالي والمستقبلي بالدولة. |
| التنمية المستدامة | : | ربط الاعتبارات البيئية بسياسة التخطيط والتنمية بما يحقق احتياجات وتطلعات الحاضر دون إخلال بالقدرة على تحقيق احتياجات وتطلعات المستقبل. |
| الكارثة البيئية | : | الحادث الناجم عن عوامل طبيعية أو فعل الإنسان، والذي يترتب عليه ضرر شديد بالبيئة وتحتاج مواجهته إلى إمكانات تفوق القدرات المحلية. |
| المواد الخطرة | : | المواد الصلبة أو السائلة أو الغازية ذات الخواص الضارة بصحة الإنسان أو التي تؤثر تأثيرًا ضارًا على البيئة، مثل المواد السامة أو القابلة للانفجار أو للاشتعال أو ذات الإشعاعات المؤينة. |
| المواد الضارة | : | جميع المواد التي تؤدي بطريقة مباشرة أو غير مباشرة إلى الإضرار بصحة الإنسان أو البيئة، سواءً كانت هذه المواد كيميائية أو بيولوجية أو مشعة. |
| النفايات | : | جميع أنواع المخلفات أو الفضلات الخطرة وغير الخطرة بما فيها النفايات النووية والتي يجري التخلص منها أو المطلوب التخلص منها بناءً على أحكام القانون وتشمل: النفايات الصلبة: مثل النفايات المنزلية والصناعية والزراعية والطبية ومخلفات التشييد والبناء والهدم. النفايات السائلة: وهي الصادرة عن المساكن والمنشآت التجارية والصناعية وغيرها. النفايات الغازية والدخان والأبخرة والغبار: وهي الصادرة عن المنازل والمخابز والمحارق والمصانع والكسارات ومقالع الأحجار ومحطات الطاقة وأعمال النفط ووسائل النقل والمواصلات المختلفة. النفايات الخطرة: مخلفات الأنشطة والعمليات المختلفة أو رمادها المحتفظة بخواص المواد الخطرة. النفايات الطبية: أية نفايات تشكل كليًا أو جزئيًا من نسيج بشري أو حيواني أو دم أو سوائل الجسم الأخرى أو الإفرازات أو العقاقير أو المنتجات الصيدلانية الأخرى أو الضمادات أو الحقن أو الإبر أو الأدوات الطبية الحادة أو أية نفايات أخرى أو معدية أو كيميائية أو مشعة ناتجة عن نشاطات طبية أو تمريض أو معالجة رعاية صحية أو طب أسنان أو صحة بيطرية أو ممارسات صيدلانية أو تصنيعية أو غيرها أو فحوصات أو أبحاث أو تدريس أو أخذ عينات أو تخزينها. |
| إدارة النفايات | : | جمع النفايات وتخزينها ونقلها وإعادة تدويرها والتخلص منها بما في ذلك العناية اللاحقة بمواقع التخلص منها. |
| تداول النفايات | : | جميع العمليات التي تبدأ من وقت تولد النفايات إلى حين التخلص الآمن منها، وتشمل جمع النفايات وتخزينها ونقلها ومعالجتها وتدويرها أو التخلص منها. |
| التخلص من النفايات | : | العمليات التي لا تؤدي إلى استخلاص المواد أو إعادة استخدامها، مثل الطمر في الأرض أو الحقن العميق أو المعالجة البيولوجية أو الفيزيائية/الكيميائية أو التخزين الدائم أو التدمير أو أية طريقة تقرها السلطات المختصة. |
| إعادة تدوير النفايات | : | العمليات التي تجري على النفايات بهدف استخلاص المواد أو إعادة استخدامها، مثل الاستخدام كوقود أو استخلاص المعادن والمواد العضوية أو معالجة التربة أو إعادة تكرير الزيوت. |
| الوسائل البحرية | : | كل وسيلة تعمل أو تكون معدة للعمل في البيئة البحرية، وذلك دون اعتبار لقوتها أو حمولتها أو الغرض من ملاحتها ويشمل ذلك السفن والقوارب التي تسير على الزلاقات والمركبات التي تسير على وسادة هوائية فوق سطح الماء أو التي تعمل تحت سطح الماء والقطع العائمة والمنصات البحرية المثبتة أو العائمة والطائرات المائية. |
| وسائل نقل الزيت | : | كل ما يستعمل في تحميل الزيت أو نقله أو ضخه أو تفريغه بما في ذلك خطوط الأنابيب. |
| المنشأة | : | المنشآت الصناعية والسياحية ومنشآت إنتاج وتوليد الكهرباء والمنشآت العاملة في مجال الكشف عن الزيت واستخراجه ونقله واستخدامه وجميع مشروعات البنية الأساسية وأية منشأة أخرى. |
| الزيت | : | جميع أشكال النفط الخام ومنتجاته، ويشمل ذلك أي نوع من أنواع الهيدروكربونات السائلة وزيوت التشحيم وزيوت الوقود والزيوت المكررة وزيت الأفران والقار وغيرها من المواد المستخرجة من النفط أو مشتقاته أو نفاياته. |
| المزيج الزيتي | : | كل مزيج مائي يحتوي على كمية من الزيت تزيد على (15) جزءً في المليون. |
| مياه الاتزان غير النظيفة | : | (مياه الصابورة غير النظيفة): المياه الملقاة من صهريج السفينة إذا كانت محتوياتها من الزيت تزيد على (15) جزءً في المليون. |
| التصريف | : | كل تسرب أو انسكاب أو انبعاث أو تفريغ لأي نوع من المواد الملوثة أو التخلص منها في البيئة المائية أو الترابية أو الهواء. |
| الإغراق | : | أ. كل إلقاء متعمد في البيئة البحرية للمواد الملوثة، أو الفضلات من السفن أو الطائرات أو الأرصفة أو غيرها. ب. كل إغراق متعمد في البيئة البحرية للسفن أو التركيبات الصناعية أو غيرها. |
| مركبات النقل | : | ج. الطائرات أو السيارات أو القطارات أو الجرارات أو الدراجات الآلية أو غير ذلك من الآلات أو المعدة للسير على الطرق. |
| الضوضاء | : | جميع الأصوات أو الاهتزازات أو الذبذبات الصوتية المزعجة أو الضارة بالصحة العامة. |
| المكان العام | : | المكان المعد لاستقبال العامة أو فئة معينة من الناس لأي غرض من الأغراض. |
| المكان العام المغلق | : | المكان العام الذي له شكل البناء المتكامل الذي لا يدخله الهواء إلا من خلال منافذ معدة لذلك. ويعتبر في حكم المكان العام المغلق وسائل النقل العام. |
| المكان العام شبه المغلق | : | المكان العام الذي له شكل البناء غير المتكامل والمتصل مباشرة بالهواء الخارجي بحيث لا يمكن إغلاقه كليًا. |
مادة (2)
الأهداف والأسس العامة
يهدف هذا القانون إلى تحقيق الأغراض الآتية:
- حماية البيئة والحفاظ على نوعيتها وتوازنها الطبيعي.
- مكافحة التلوث بأشكاله المختلفة وتجنب أية أضرار أو آثار سلبية فورية أو بعيدة المدى نتيجة لخطط وبرامج التنمية الاقتصادية أو الزراعية أو الصناعية أو العمرانية أو غيرها من برامج التنمية التي تهدف إلى تحسين مستوى الحياة والتنسيق فيما بين الهيئة أوبين السلطات المختصة أو الجهات المعنية في حماية البيئة أو الحفاظ على نوعيتها وتوازنها الطبيعي أو ترسيخ الوعي البيئي أو مبادئ مكافحة التلوث.
- تنمية الموارد الطبيعية أو الحفاظ على التنوع الحيوي في إقليم الدولة واستغلاله الاستغلال الأمثل لمصلحة الأجيال الحاضرة أو القادمة.
- حماية المجتمع وصحة الإنسان والكائنات الحية الأخرى من جميع الأنشطة والأفعال المضرة بيئيًا أو التي تعيق الاستخدام المشروع للوسط البيئي.
- حماية البيئة في الدولة من التأثير الضار للأنشطة التي تتم خارج إقليم الدولة.
- تنفيذ الالتزامات التي تنظمها الاتفاقيات الدولية أو الإقليمية المتعلقة بحماية البيئة ومكافحة التلوث والمحافظة على الموارد الطبيعية التي تصادق عليها أو تنضم إليها الدولة.
الباب الأول
التنمية والبيئة
الفصل الأول
التأثير البيئي للمنشآت
مادة (3)
تضع الهيئة بالتشاور والتنسيق مع السلطات المختصة والجهات المعنية المعايير والمواصفات والأسس والضوابط اللازمة لتقييم التأثير البيئي للمشاريع والمنشآت المطلوب الترخيص بها، وتتولى على الأخص:
- تحديد فئات المشروعات التي تكون بطبيعتها قابلة لأن تحدث أضرارًا بيئية.
- تحديد المناطق والمواقع ذات الأهمية أو الحساسية البيئية الخاصة (المواقع التاريخية والأثرية، الأراضي الرطبة، الجزر المرجانية، المحميات الطبيعية، الحدائق العامة وغيرها).
- تحديد الموارد الطبيعية والمشاكل البيئية ذات الأهمية الخاصة.
مادة (4)
مع عدم الإخلال بأحكام المادة السابقة، تتولى الهيئة بالتنسيق مع السلطات المختصة والجهات المعنية الأخرى تقييم التأثير البيئي للمشروع والمنشأة المطلوب الترخيص بها. ولا يجوز للمشروع أو المنشأة مباشرة النشاط قبل الحصول على الترخيص المشار إليه في المادة السابقة متضمنًا تقييم التأثير البيئي.
مادة (5)
يلتزم طالب الترخيص بأن يرفق بطلبه بيانًا متكاملاً عن المشروع أو النشاط الذي يعتزم مباشرته يتضمن جميع البيانات المنصوص عليها في اللائحة التنفيذية ووفق النماذج الواردة فيها.
مادة (6)
تتولى الهيئة بالتنسيق مع السلطات المختصة البت في الطلبات المقدمة خلال فترة لا تتجاوز شهرًا واحدًا من تاريخ تقديم طلب الترخيص، ويخطر مقدم الطلب بالنتيجة، كما يخطر بأسباب رفض طلبه في حالة الرفض.
ويجوز مد المدة المنصوص عليها في الفقرة السابقة شهرًا واحدًا إذا اقتضت الضرورة ذلك.
مادة (7)
يلتزم أصحاب المشروعات أو المنشآت التي حصلت على الموافقة بالترخيص بإجراء تحليل دوري للنفايات ورصد مواصفات التصريف والملوثات الناتجة عن هذه المشروعات بما في ذلك المواد القابلة للتحلل وحفظ سجلات للرصد وإرسال تقارير بهذه النتائج إلى كل من الهيئة والسلطات المختصة.
مادة (8)
تحدد اللائحة التنفيذية المدة اللازمة للاحتفاظ بكل نوع من أنواع السجلات المشار إليها في المادة (7) من هذا القانون.
الفصل الثاني
البيئة والتنمية المستدامة
مادة (9)
على جميع الجهات المعنية، خاصة المنوط بها التخطيط والتنمية الاقتصادية والعمرانية، مراعاة اعتبارات حماية البيئة ومكافحة التلوث والاستغلال الرشيد للموارد الطبيعية عند وضع خطط التنمية الاقتصادية والاجتماعية وعند إنشاء المشروعات وتنفيذها.
مادة (10)
تتولى الهيئة بالتنسيق والتشاور مع السلطات المختصة والجهات المعنية إعداد وإصدار ومراجعة وتطوير وتحديث مقاييس ومعايير الحماية البيئية.
ويراعى في تحديد تلك المقاييس والمعايير تحقيق التوازن بين الإمكانات التقنية المتاحة وبين التكلفة الاقتصادية اللازمة لذلك وبما لا يخل بمتطلبات حماية البيئة ومكافحة التلوث.
مادة (11)
يجوز في الحالات الطارئة القهرية عدم التقيد بالمقاييس والمعايير التي تصدر بالتطبيق لأحكام هذا القانون إذا كان الهدف هو حماية الأرواح أو ضمان تأمين سلامة المنشأة أو منطقة العمل، ويجب في هذه الحالة إخطار الهيئة والسلطات المختصة.
مادة (12)*(معدلة)
يحظر صيد أو قتل أو إمساك الطيور والحيوانات البرية والبحرية المحدد أنواعها في القوائم أرقام (1 ، 2 ، 3) المرفقة بهذا القانون، ويحظر حيازة هذه الطيور والحيوانات أو نقلها أو التجول بها أو بيعها أو عرضها للبيع حية أو ميتة إلا بعد الحصول على ترخيص من السلطات المختصة، كما يحظر إتلاف أوكار الطيور المذكورة أو إعدام بيضها.
وتحدد اللائحة التنفيذية المناطق التي يجوز الترخيص بالصيد فيها وشروط الترخيص، كما تحدد وسائل الرقابة اللازمة لتنفيذ أحكام هذه المادة.
وللوزير المختص بالتنسيق مع السلطة المختصة تعديل القوائم الثلاث المرفقة بهذا القانون بالحذف أو الإضافة أو النقل.
الفصل الثالث
الرصد البيئي
مادة (13)
تضع الهيئة بالتنسيق مع السلطات المختصة والجهات المعنية نظامًا وطنيًا للرصد البيئي وتتولى السلطات المختصة إنشاء وتشغيل شبكات الرصد البيئي والإشراف عليها.
مادة (14)
يجب على شبكات الرصد البيئي إبلاغ الهيئة والسلطات المختصة والجهات المعنية بأي تجاوز للحدود المسموح بها لملوثات البيئة، كما تلتزم بتقديم تقارير دورية عن نتائج أعمالها وذلك وفقًا لما تحدده اللائحة التنفيذية.
الفصل الرابع
خطط الطوارئ لمواجهة الكوارث البيئية
مادة (15)
تضع الهيئة بالتنسيق مع السلطات المختصة وبالتعاون والتشاور مع الجهات المعنية بالدولة خططًا لمواجهة الطوارئ والكوارث البيئية ويصدر باعتماد تلك الخطط وميزانياتها قرار من مجلس الوزراء.
مادة (16)
على جميع الجهات والأفراد بالدولة المسارعة في تقديم جميع المساعدات والإمكانات المطلوبة لمواجهة الكوارث البيئية.
الباب الثاني
حماية البيئة المائية
الفصل الأول
نطاق الحماية البيئية
مادة (17)
تهدف حماية البيئة المائية من التلوث إلى تحقيق الأغراض التالية:
- حماية سواحل وشواطئ الدولة وموانئها من مخاطر التلوث بجميع صوره وأشكاله.
- حماية البيئة البحرية ومواردها الطبيعية الحية وغير الحية وذلك بمنع التلوث أيًا كان مصدره وخفضه والسيطرة عليه.
- حماية مياه الشرب والمياه الجوفية والعمل على تنمية مصادر موارد المياه.
مادة (18)
يحظر على الجهات المصرح لها باستكشاف أو استخراج أو استغلال حقول النفط والغاز البرية أو البحرية تصريف أية مادة ملوثة ناتجة عن عمليات الحفر أو الاستكشاف أو اختبار الآبار أو الإنتاج في البيئة المائية أو المنطقة البرية المجاورة لمباشرة الأنشطة المشار إليها في هذه المادة، ما لم يتم استخدام الوسائل الآمنة التي لا يترتب عليها الإضرار بالبيئة البرية والمائية ومعالجة ما يتم تصريفه من نفايات ومواد ملوثة طبقًا لأحدث النظم الفنية المتاحة ، وبما يتفق مع الشروط المنصوص عليها في الاتفاقيات والبروتوكولات الإقليمية والدولية المصدق عليها.
مادة (19)
تتولى الهيئة بالتنسيق مع السلطات المختصة وبالتعاون والتنسيق مع الجهات المصرح لها باستكشاف أو استخراج أو استغلال حقول النفط والغاز إعداد مواصفات إرشادية بشروط السلامة البيئية وإدارة النفايات الناتجة عن عمليات إنتاج النفط والغاز ونقلهما واستغلالهما.
مادة (20)
تقوم الهيئة بالتنسيق مع السلطات المختصة وبالتعاون والتنسيق مع الجهات المنصوص عليها في المادتين (18) و(19) من هذا القانون بإجراء رصد دوري للتأثيرات البيئية الناتجة عن عمليات استكشاف واستخراج واستغلال النفط والغاز التي تتم في حقول الإنتاج وممرات النقل البرية والبحرية.
الفصل الثاني
حماية البيئة البحرية
القسم الأول
التلوث من الوسائل البحرية
مادة (21)
يحظر على جميع الوسائل البحرية أيا كانت جنسيتها سواء كانت مسجلة في الدولة أو غير مسجلة فيها تصريف أو إلقاء الزيت أو المزيج الزيتي في البيئة البحرية.
مادة (22)
يلتزم ربان الوسيلة البحرية أو المسؤول عنها باتخاذ الإجراءات الكافية للحماية من آثار التلوث في حالة وقوع حادث لإحدى الوسائل التي تحمل الزيت يترتب عليه أو يخشى منه تلوث البيئة البحرية للدولة، كما يلتزم بتنفيذ أوامر مفتشي الجهات الإدارية أو مأموري الضبط القضائي في هذه الحالة.
مادة (23)
في حالة وقوع حادث تصادم لناقلات الزيت أو الوسائل البحرية أو المنشآت أو ناقلات المواد الخطرة، سواء كان ذلك بفعل متعمد من المسؤول عن الوسيلة البحرية أو كان نتيجة لخطئه أو إهماله هو أو أحد تابعيه، يكون الربان هو الشخص المسؤول عن عمليات وقف التسرب ويكون المالك والناقل مسؤولين بالتضامن عن دفع جميع تكاليف الأضرار والتعويضات والمكافحة المترتبة على الانسكاب في البيئة البحرية والسواحل والشواطئ.
مادة (24)
- على مالك الوسيلة البحرية أو ربانها أو أي شخص مسؤول عنها وعلى المسؤولين عن وسائل نقل الزيت الواقعة داخل الموانئ أو البيئة البحرية للدولة وكذلك المسؤولين والجهات العاملة في استخراج الزيت أن يبادروا فورًا وطبقًا للإجراءات المنصوص عليها في اللائحة التنفيذية إلى إبلاغ هيئات الموانئ وحرس الحدود والسواحل وغيرها من السلطات المختصة عن كل حادث تسرب للزيت فور حدوثه مع بيان ظروف الحادث ونوع المادة المتسربة والإجراءات التي اتخذت لإيقاف التسرب أو الحد منه.
- وفي جميع الأحوال، يجب على هيئات الموانئ وحرس الحدود والسواحل إبلاغ الهيئة والجهات المعنية بجميع المعلومات عن الحادث المشار إليه فور حدوثه.
مادة (25)
على كل مالك أو ربان وسيلة بحرية - وطنية أو أجنبية - تنقل الزيت وتدخل البيئة البحرية للدولة أن يحتفظ في تلك الوسيلة بسجل للزيت تدون فيه جميع العمليات المتعلقة بالزيت وتحدد اللائحة التنفيذية بيانات هذا السجل.
مادة (26)
يجب على كل وسيلة بحرية تنقل الزيت وتدخل البيئة البحرية للدولة أن تكون مجهزة بالمعدات اللازمة لقيامها بعمليات المكافحة أثناء حدوث تلوث مصدره الوسيلة البحرية نفسها، وذلك طبقًا لما تحدده اللائحة التنفيذية.
مادة (27)
يُحظر على الوسائل البحرية التي تنقل المواد الخطرة إلقاء أو تصريف أية مواد ضارة أو نفايات في البيئة البحرية بطريقة مباشرة أو غير مباشرة.
كما يحظر على الوسائل البحرية التي تحمل مواد ضارة منقولة في عبوات أو حاويات شحن أو صهاريج نقالة أو عربات صهريجية برية أو حديدية التخلص منها بإلقائها في البيئة البحرية للدولة.
مادة (28)
يجب أن تزود الوسائل البحرية التي تحمل مواد خطرة بسجل يسمى (سجل الشحن) يدون فيها الربان أو المسؤول عن الوسيلة البحرية جميع العمليات المتعلقة بالشحن وتحدد اللائحة التنفيذية القواعد المنظمة لهذا السجل.
مادة (29)
يجب على ربان كل وسيلة بحرية تدخل موانئ الدولة أن يقوم بالإبلاغ عن المواد الخطرة المحمولة على الوسيلة البحرية من حيث أنواعها وكمياتها وأماكن تواجدها على الوسيلة البحرية ومصادر شحنها وجهات تفريغها.
مادة (30)
يلتزم ربان الوسيلة البحرية أو المسؤول عنها باتخاذ الإجراءات اللازمة للحماية من آثار التلوث، وذلك في حالة وقوع حادث لإحدى الوسائل البحرية التي تحمل مواد ضارة أو خطرة يخشى منه تلوث البيئة البحرية، كما يلتزم بتنفيذ أوامر مفتشي الجهات الإدارية أو مأموري الضبط القضائي في هذه الحالة.
مادة (31)
يحظر على الوسائل البحرية التي تحمل المواد الضارة إغراق النفايات الخطرة والمواد الملوثة في البيئة البحرية.
وتصدر الجهات المعنية بالتنسيق مع الهيئة جداول بالنفايات الخطرة والمواد الملوثة المشار إليها في الفقرة السابقة.
مادة (32)
يحظر على الوسائل البحرية والمنشآت البحرية التي تحددها اللائحة التنفيذية تصريف مياه الصرف الصحي في البيئة البحرية، ويجب التخلص منها طبقًا للمعايير والإجراءات التي تحددها اللائحة التنفيذية.
كما يحظر على الوسائل البحرية إلقاء النفايات في البيئة البحرية.
مادة (33)
يجب على كل وسيلة بحرية تنقل الزيت وتدخل البيئة البحرية أن تكون بحوزتها شهادة منع التلوث الدولية (I.O.P.P Certificate) سارية المفعول مرفق بها بيان يوضح مكان آخر لتفريغ محتويات صهاريج “السرتينة” وكمياتها وتاريخ تفريغها.
مادة (34)
يحظر على جميع الوسائل البحرية والمنشآت البحرية التي تقوم بأعمال استكشاف واستغلال الموارد الطبيعية والمعدنية في البيئة البحرية وكذلك الوسائل البحرية التي تستخدم موانئ الدولة إلقاء القمامة أو النفايات في البيئة البحرية، ويجب عليها تسليم القمامة بالكيفية وفي الأماكن التي تحددها السلطات المختصة. وتتولى هيئات الموانئ المختصة بالتعاون مع حرس الحدود والسواحل إعداد وتنفيذ خطط تداول القمامة أو النفايات والتأكد من أن جميع تلك الوسائل التي تستخدم موانئ الدولة تطبق الإجراءات المنصوص عليها في هذا القانون ولائحته التنفيذية.
القسم الثاني
التلوث من المصادر البرية
مادة (35)
يحظر على جميع المنشآت، بما في ذلك المحال العامة والمنشآت التجارية والصناعية والزراعية والسياحية والخدمية وغيرها، تصريف أو إلقاء أية مواد أو نفايات أو سوائل غير معالجة من شأنها إحداث تلوث في البيئة المائية بطريقة مباشرة أو غير مباشرة.
مادة (36)
يشترط للترخيص بإقامة أية منشآت أو محال على الشريط الساحلي أو قريبًا منه ينتج عنه تصريف مواد ملوثة بالمخالفة لأحكام هذا القانون والقرارات المنفذة له أن يقوم طالب الترخيص بإجراء دراسات التأثير البيئي ويلتزم بتوفير وحدات لمعالجة النفايات، كما يلتزم بأن يبدأ بتشغيلها فور بدء تشغيل تلك المنشآت.
مادة (37)
تحدد اللائحة التنفيذية المواصفات والمعايير التي تلتزم بها المنشآت الصناعية التي يصرح لها بتصريف المواد الملوثة القابلة للتحلل وذلك بعد معالجتها.
كما تحدد اللائحة التنفيذية المواد الملوثة غير القابلة للتحلل والتي يحظر على المنشآt الصناعية تصريفها في البيئة البحرية.
مادة (38)
يكون لكل من الهيئة والسلطة المختصة الحق في أخذ عينات من النفايات السائلة المعالجة حسب الطرق التي تحددها اللائحة التنفيذية وذلك للتأكد من مطابقة نتائج التحاليل مع المواصفات المعتمدة.
الفصل الثالث
حماية مياه الشرب والمياه الجوفية
مادة (39)
تقوم الجهات المعنية بالتشاور والتنسيق مع الهيئة والسلطات المختصة في جميع الأمور المتعلقة بالمياه الجوفية ومياه الشرب بما في ذلك المحافظة على مصادر موارد المياه وتنميتها.
مادة (40)
تتولى السلطات المختصة بالتنسيق مع الهيئة تحديد قواعد سلامة خزانات وتوصيلات مياه الشرب وصلاحيتها للاستعمال الآدمي طبقًا للمعايير التي تحددها اللائحة التنفيذية، والتي يجب على أصحاب المباني والمنشآt الالتزام بها.
مادة (41)
تقوم السلطات المختصة بالتنسيق مع الهيئة بإجراء فحص دوري سنوي على خزانات وتوصيلات مياه الشرب للتحقق من سلامتها وصلاحيتها، وتخطر المالك بما يجب اتباعه من إجراءات لضمان وصول المياه سليمة للقاطنين.
وفي حالة عدم تنفيذ المالك لتلك التعليمات يجوز لتلك الجهات إجراء الإصلاحات اللازمة على نفقة المالك.
وتسجل نتيجة الفحص الدوري في سجلات خاصة تحتفظ بها تلك الجهات.
الباب الثالث
حماية التربة
مادة (42)
على السلطات المختصة أن تأخذ بعين الاعتبار العوامل والمعايير البيئية التي تحددها الهيئة بالتنسيق مع السلطات المختصة والجهات المعنية وذلك عند إعداد وتنفيذ خطط استخدامات الأراضي التي يتحدد في ظلها المناطق المخصصة للبناء والمناطق الزراعية والصناعية والمناطق المحمية وغيرها.
مادة (43)
يحظر القيام بأي نشاط يساهم بطريقة مباشرة أو غير مباشرة في الإضرار بالتربة أو التأثير على خواصها الطبيعية أو تلويثها على نحو يؤثر في قدرتها الإنتاجية وذلك وفقاً لما تحدده اللائحة التنفيذية.
مادة (44)
تقوم السلطات المختصة بالتعاون والتنسيق مع الهيئة والجهات المعنية بالعمل على تنمية وتطوير موارد البيئة الصحراوية والاهتمام بالتنوع البيولوجي وزيادة الرقعة الخضراء باستخدام الأساليب والتقنيات الحديثة والإفادة من التكنولوجيا المتاحة التي تحمي المناطق الزراعية ونباتاتها، ويحظر مباشرة أي نشاط من شأنه أن يضر بكمية أو نوعية الغطاء النباتي في أية منطقة مما يؤدي إلى التصحر أو تشويه البيئة الطبيعية، ويحظر قطع أو اقتلاع أو إضرار أية شجرة أو شجيرة أو أعشاب لا بتصريح من السلطة المختصة بالتنسيق مع الهيئة.
مادة (45)
تتولى وزارة الزراعة والثروة السمكية بالتنسيق مع السلطات المختصة والهيئة والجهات المعنية الأخرى في الدولة وضع اللوائح المنظمة للمسائل الآتية:
- أنواع مبيدات الآفات والأسمدة والمصلحات الزراعية التي يجوز إنتاجها أو تصنيعها أو استيرادها أو تداولها أو استخدامها بالدولة.
- شروط ومواصفات إنتاج أو تصنيع أو استيراد أو تداول أو استخدام هذه المواد.
- إجراءات تسجيل هذه المواد أو تجديد تسجيلها.
- شروط ومواصفات أخذ العينات من هذه المواد وطرق تحليلها وتقييم نتائج التحليل.
- كيفية رصد وتقويم ومعالجة التلوث الناتج عن التداول أو الاستخدام غير الآمن أو غير الصحيح لهذه المواد.
مادة (46)
تتولى الهيئة بالتنسيق مع السلطات المختصة والجهات المعنية بالدولة وضع الضوابط والحدود المسموح بها من بقايا المبيدات على الأغذية المنتجة محلياً أو المستوردة.
مادة (47)
تقوم الهيئة بالتنسيق مع وزارة الزراعة والثروة السمكية والسلطات المختصة والجهات المعنية الأخرى بوضع الضوابط والشروط الواجب التقيد بها للتخلص من مخلفات المبيدات أو المركبات الكيميائية الداخلة في تصنيعها أو التي انتهت صلاحية استخدامها.
الباب الرابع
حماية الهواء من التلوث
مادة (48)
تلتزم المنشآت في ممارستها لأنشطتها بعدم انبعاث أو تسرب ملوثات الهواء بما يجاوز الحدود القصوى المسموح بها والتي تحددها اللائحة التنفيذية.
مادة (49)
لا يجوز استخدام آلات أو محركات أو مركبات ينتج عنها مخلفات احتراق تجاوز الحدود المنصوص عليها في اللائحة التنفيذية.
مادة (50)
يحظر إلقاء أو معالجة أو حرق القمامة والنفايات الصلبة إلا في الأماكن المخصصة لذلك بعيدًا عن المناطق السكنية والصناعية والزراعية والبيئة المائية وتحدد اللائحة التنفيذية المواصفات والضوابط والحد الأدنى لبعد الأماكن المخصصة لهذه الأغراض عن تلك المناطق.
مادة (51)
يحظر رش أو استخدام مبيدات الآفات أو أية مركبات كيماوية أخرى لأغراض الزراعة أو متطلبات الصحة العامة أو غير ذلك من الأغراض إلا بمراعاة الشروط والضوابط والضمانات التي تحددها اللائحة التنفيذية بما يكفل عدم تعرض الإنسان أو الحيوان أو النبات أو مجاري المياه أو أي من مكونات البيئة بصورة مباشرة أو غير مباشرة في الحال أو المستقبل للآثار الضارة لهذه المبيدات أو المركبات الكيماوية.
مادة (52)
تلتزم جميع الجهات والأفراد عند القيام بأعمال التنقيب أو الحفر أو البناء أو الهدم أو نقل ما ينتج عنها من نفايات أو أتربة باتخاذ الاحتياطات اللازمة أثناء هذه الأعمال بالإضافة إلى الاحتياطات اللازمة للتخزين أو النقل الآمن لها لمنع تطايرها وذلك على النحو الذي تبينه اللائحة التنفيذية.
مادة (53)
يجب عند إحراق أي نوع من أنواع الوقود أو غيره، سواء كان في أعمال البحث والاستكشاف والحفر واستخراج وإنتاج النفط الخام أو في أغراض الصناعة أو توليد الطاقة أو الإنشاءات أو أي غرض تجاري آخر، أن يكون الدخان والغازات والأبخرة الناتجة في الحدود المسموح بها، وعلى المسؤول عن هذا النشاط اتخاذ جميع الاحتياطات لتقليل كمية الملوثات في نواتج الاحتراق ، كما يلتزم بالاحتفاظ بسجل يدون فيه قياس الكميات الملوثة في نواتج الاحتراق المشار إليها واتخاذ جميع الاحتياطات لتقليل هذه الكميات.
وتحدد اللائحة التنفيذية الاحتياطات والحدود المسموح بها للمداخن وغيرها من وسائل التحكم في الدخان والغازات والأبخرة المنبعثة من عملية الاحتراق وكذلك الحدود المسموح بها في قياس الكميات الملوثة في نواتج الاحتراق ،والجهات المخولة بالتدقيق على القياسات المسجلة.
مادة (54)
تلتزم جميع الجهات والأفراد عند مباشرة الأنشطة الإنتاجية أو الخدمية أو غيرها وخاصةً عند تشغيل الآلات والمعدات وآلات التنبيه ومكبرات الصوت بعدم تجاوز الحدود المسموح بها للضوضاء.
وتبين اللائحة التنفيذية الحدود المسموح بها لشدة الصوت والفترة الزمنية للتعرض له.
مادة (55)
تلتزم المؤسسات والمنشآت بضمان التهوية الكافية داخل أماكن العمل واتخاذ الاحتياطات والتدابير اللازمة لعدم تسرب أو انبعاث ملوثات الهواء إلا في الحدود المسموح بها، والتي تحددها اللائحة التنفيذية، سواء كان انبعاث تلك الملوثات ناتجًا عن طبيعة ممارسة المنشآت لنشاطها أو عن خلل في الأجهزة ، وعليها أن توفر سبل الحماية اللازمة للعاملين تنفيذا لشروط السلامة والصحة المهنية بما في ذلك اختيار الآلات والمعدات والمواد وأنواع الوقود المناسبة، على أن يؤخذ في الاعتبار مدة التعرّض لهذه الملوثات.
مادة (56)
يشترط في الأماكن العامة المغلقة وشبه المغلقة أن تكون مستوفية لوسائل التهوية الكافية بما يتناسب مع حجم المكان وقدرته الاستيعابية ونوع النشاط الذي يمارس فيه بما يضمن تجدد الهواء ونقاءه واحتفاظه بدرجة مناسبة.
مادة (57)
تلتزم المنشآt العامة والسياحية باتخاذ الإجراءات الكفيلة بمنع التدخين في الأماكن العامة المغلقة إلا في الحدود المسموح بها في الترخيص الممنوح لهذه الأماكن ويراعى في هذه الحالة تخصيص حيز للمدخنين بما لا يؤثر على الهواء في الأماكن الأخرى. ويحظر التدخين في وسائل النقل العام أو المصاعد.
الباب الخامس
تداول المواد والنفايات الخطرة والنفايات الطبية
مادة (58)
يحظر التداول أو التعامل بالمواد الخطرة والنفايات الخطرة والنفايات الطبية بغير ترخيص من السلطات المختصة، وتحدد اللائحة التنفيذية شروط وإجراءات منح الترخيص.
مادة (59)
يتم التخلص من النفايات الخطرة والنفايات الطبية طبقًا للشروط والمعايير التي تحددها اللائحة التنفيذية ويحظر إقامة أية منشآت بغرض معالجة النفايات الخطرة إلا بترخيص من السلطات المختصة.
مادة (60)
تتم الرقابة على نقل النفايات الخطرة والتخلص منها عبر الحدود البرية وحدود البيئة البحرية والمجال الجوي للدولة طبقا للضوابط المنصوص عليها في اللائحة التنفيذية.
مادة (61)
على القائمين على إنتاج أو تداول المواد الخطرة، سواء كانت في حالتها الغازية أو السائلة أو الصلبة أن يتخذوا جميع الاحتياطات اللازمة لضمان عدم حدوث أية أضرار بالبيئة. وتبين اللائحة التنفيذية تلك الاحتياطات.
وعلى صاحب المنشأة التي ينتج عن نشاطها نفايات خطرة طبقًا لأحكام هذا القانون الاحتفاظ بسجل لهذه النفايات وكيفية التخلص منها وكذلك الجهات المتعاقد معها لتسلم هذه النفايات. وتبين اللائحة التنفيذية بيانات هذا السجل والجهة المختصة بمتابعته للتأكد من مطابقة البيانات للواقع.
مادة (62)
- يحظر على أية جهة عامة أو خاصة أو أي شخص طبيعي أو اعتباري استيراد أو جلب نفايات خطرة أو دفنها أو إغراقها أو تخزينها أو التخلص منها بأي شكل في بيئة الدولة.
- ويحظر على تلك الجهات والأشخاص استيراد أو جلب المواد أو النفايات النووية أو دفنها أو إغراقها أو تخزينها أو التخلص منها بأي شكل في بيئة الدولة.
- يحظر بغير تصريح كتابي من الهيئة السماح بمرور الوسائل البحرية أو الجوية أو البرية التي تحمل النفايات الخطرة أو النووية في البيئة البحرية أو الجوية أو البرية.
الباب السادس
المحميات الطبيعية
مادة (63)
تحدد بقرار من مجلس الوزراء أو من السلطات المختصة المناطق المحمية في الدولة وحدود كل منطقة، ويجوز بناءً على اقتراح الهيئة اعتبار مناطق معينة مناطق محمية.
مادة (64)
تحدد بقرار من السلطات المختصة بالتنسيق مع الهيئة الأعمال والأنشطة والتصرفات المحظورة في المناطق المحمية، والتي من شأنها إتلاف أو تدهور البيئة الطبيعية أو الإضرار بالحياة البرية أو البحرية أو المساس بقيمتها الجمالية، ويحظر على وجه الخصوص ما يأتي:
- صيد أو نقل أو قتل أو إيذاء الكائنات البرية أو البحرية أو القيام بأعمال من شأنها القضاء عليها.
- إتلاف أو تدمير التكوينات الجيولوجية أو الجغرافية أو المناطق التي تعد موطنًا لفصائل الحيوان أو النبات أو لتكاثرها.
- إدخال أجناس غريبة للمنطقة المحمية.
- تلويث تربة أو مياه أو هواء المنطقة المحمية.
- المناورات العسكرية وتدريبات الرماية.
- قطع الأشجار أو تعرية التربة.
- أعمال التسلية والترفيه أو الرياضات التي من شأنها قتل أو إيذاء أو التأثير سلبيًا على الحياة الفطرية.
- كل ما من شأنه الإخلال بالتوازن الطبيعي لتلك المحميات.
- كما يحظر إقامة المنشآت أو المباني أو شق الطرق أو تسيير المركبات أو ممارسة أية أنشطة زراعية أو صناعية أو تجارية في المناطق المحمية إلا بتصريح من السلطات المختصة.
مادة (65)
تتمتع بالحماية طبقًا لأحكام القانون الحيوانات البرية والبحرية والطيور التي تتخذ من المنطقة المحمية محطة للراحة أو التفريخ أو الاستيطان.
مادة (66)
لا يجوز ممارسة أية نشاطات أو تصرفات أو أعمال في المناطق المحيطة بمنطقة المحمية إذا كان من شأنها التأثير على بيئة المحمية أو الظواهر الطبيعية بها إلا بترخيص من السلطة المختصة بعد أخذ رأي الهيئة، وتحدد اللائحة التنفيذية قواعد تحديد المنطقة المحيطة.
مادة (67)
تتولى الهيئة بالتنسيق مع السلطات المختصة الإشراف على الأنشطة اللازمة للمحافظة على المناطق المحمية في الدولة، ولها على وجه الخصوص:
- المساهمة في إعداد البرامج والدراسات اللازمة لتنمية المناطق المحمية.
- وضع المعايير والضوابط المتعلقة برصد الظواهر البيئية وحصر الكائنات البرية والبحرية في المناطق المحمية وتسجيلها.
- تنسيق الأنشطة المتعلقة بإدارة وتنمية المناطق المحمية.
- إعلام المواطنين وتثقيفهم بأهداف وأغراض إنشاء المحميات الطبيعية.
- تبادل المعلومات والخبرات مع الدول والهيئات الدولية والجهات المعنية في الدولة في هذا المجال.
مادة (68)
على مراكز البحوث والمؤسسات العلمية والجامعات والجهات الأخرى ذات الاختصاص بالتنسيق مع الهيئة الاهتمام بموضوع التنوع البيولوجي والمحافظة على أصل الأنواع وإجراء الدراسات والأبحاث واقتراح الضوابط والأساليب الواجب الأخذ بها للمحافظة على تلك الأنواع وسبل استثمارها بما يمنع استنزافها ويحفظ للدولة حقوقها المشروعة أدبيًا واجتماعيًا واقتصاديًا.
الباب السابع
المسؤولية والتعويض عن الأضرار البيئية
الفصل الأول
سلطات الضبط القضائي
مادة (69)
يصدر وزير العدل والشؤون الإسلامية والأوقاف بالاتفاق مع وزير الصحة قرارًا بتحديد موظفي الهيئة والسلطات المختصة الذين تكون لهم صفة مأموري الضبط القضائي في مجال التفتيش على المنشآت والأماكن وغيرها للتحقق من التزامها بتطبيق أحكام هذا القانون والقرارات الصادرة تنفيذا له.
ولموظفي الهيئة والسلطات المختصة الذين تقررت لهم صفة مأموري الضبط القضائي أن يضبطوا أية مخالفة لأحكام هذا القانون وأن يحيلوا المخالف طبقًا للإجراءات المعمول بها في الدولة إلى السلطات القضائية المختصة.
مادة (70)
يكون لمأموري الضبط القضائي عند وقوع المخالفة إذا رغب ربان الوسيلة البحرية أو المسؤول عنها مغادرة الميناء على وجه عاجل تحصيل مبالغ فورية بصفة مؤقتة تحت حساب تنفيذ عقوبة الغرامة أو التعويض التي يقضى بها في الحدود المنصوص عليها في هذا القانون على ألا يقل هذا المبلغ عن الحد الأدنى المقرر للغرامة مضافًا إليه جميع النفقات والتعويضات التي تحددها السلطات المختصة بالاتفاق مع الهيئة لإزالة آثار المخالفة.
ويجوز تقديم خطاب ضمان بنكي بقيمة المبالغ المشار إليها تقبله السلطات المختصة.
الفصل الثاني
المسؤولية والتعويض عن الأضرار البيئية
مادة (71)
كل من تسبب بفعله أو إهماله في إحداث ضرر للبيئة أو للغير نتيجة مخالفة الأحكام الواردة بهذا القانون أو اللوائح أو القرارات الصادرة تنفيذًا له يكون مسؤولاً عن جميع التكاليف اللازمة لمعالجة أو إزالة هذه الأضرار، كما يلزم بأي تعويضات قد تترتب عليها.
مادة (72)
يشمل التعويض عن الضرر البيئي المشار إليه في المادة (71) من هذا القانون الأضرار التي تصيب البيئة ذاتها وتمنع أو تقلل من الاستخدام المشروع لها ، سواء كان ذلك بصفة مؤقتة أو دائمة أو تضر بقيمتها الاقتصادية والجمالية ، وكذلك تكلفة إعادة تأهيل البيئة.
الباب الثامن
العقوبات
مادة (73)
- - يعاقب بالسجن وبالغرامة التي لا تقل عن مائة وخمسين ألف درهم ولا تزيد على مليون درهم كل من خالف أحكام المواد (21) و (27) و(31) و(62/ بند1) و(62/ بند3) من هذا القانون.
- - وتكون العقوبة الإعدام أو السجن المؤبد والغرامة التي لا تقل عن مليون درهم ولا تزيد على عشرة ملايين درهم على كل من خالف حكم المادة (62/ بند2) من هذا القانون.
- - كما يلتزم كل من خالف أحكام البندين (1) و (2) من المادة (62) بإعادة تصدير النفايات الخطرة والنووية محل الجريمة على نفقته الخاصة.
- - وتكون العقوبة الحبس مدة لا تقل عن سنتين ولا تزيد على خمس سنوات والغرامة التي لا تقل عن مائتي ألف درهم ولا تزيد على خمسمائة ألف درهم أو إحدى هاتين العقوبتين لكل من خالف أحكام المادتين (18) و (58) من هذا القانون.
- - وتكون العقوبة الحبس والغرامة أو إحدى هاتين العقوبتين إذا ما ارتكبت الجرائم المشار إليه في المادة (21) زوارق الصيد التي لا يزيد طولها على سبعين قدمًا.
مادة (74)
يعاقب بالحبس لمدة لا تقل عن سنة وبغرامة لا تقل عن مائة ألف درهم ولا تزيد على خمسمائة ألف درهم كل من خالف أحكام المادتين (24) و (26) من هذا القانون.
مادة (75)
يعاقب بالحبس مدة لا تقل عن سنة ولا تزيد على سنتين، وبالغرامة التي لا تقل عن عشرة آلاف درهم ولا تزيد على مائتي ألف درهم أو بإحدى هاتين العقوبتين كل من خالف أحكام المواد (25) و (28) و (32) و(33) و (34) من هذا القانون.
مادة (76)
يعاقب بالحبس مدة لا تقل عن ستة أشهر ولا تزيد على سنة وبغرامة لا تقل عن ألفي درهم ولا تزيد على عشرة آلاف درهم أو بإحدى هاتين العقوبتين كل من خالف أحكام المادتين (22) و (30) من هذا القانون.
مادة (77)
يعاقب بالحبس مدة لا تقل عن سنة وبالغرامة التي لا تقل عن خمسة آلاف درهم ولا تزيد على مائة ألف درهم كل من تسبب في تلويث مياه الشرب أو المياه الجوفية.
مادة (78)
يعاقب بالحبس مدة لا تقل عن سنة وبالغرامة التي لا تقل عن عشرة آلاف درهم ولا تزيد على عشرين ألف درهم أو بإحدى هاتين العقوبتين كل من خالف أحكام المواد (59) و (60) و (61) من هذا القانون.
مادة (79)
يعاقب بغرامة لا تقل عن ألف درهم كل من خالف حكم المادة (49) من هذا القانون.
مادة (80)
يعاقب بغرامة لا تقل عن عشرة آلاف درهم ولا تزيد على خمسين ألف درهم كل من خالف حكم المادة (51) من هذا القانون.
مادة (81)
يعاقب بغرامة لا تقل عن عشرة آلاف درهم ولا تزيد على مائة ألف درهم كل من خالف حكم المادة (35) من هذا القانون.
مادة (82)
يعاقب بغرامة لا تقل عن ألفي درهم ولا تزيد على عشرين ألف درهم كل من خالف أحكام المواد (48) و(50) و(53) و(54) و(55) من هذا القانون.
مادة(83)*(مُعدلة)
يعاقب كل من يخالف أحكام المادة (12) والبند (1) من المادة (64) من هذا القانون بالإضافة إلى مصادرة الطيور والحيوانات المضبوطة بالآتي:
- الحبس مدة لا تقل عن ستة أشهر وبغرامة لا تقل عن عشرين ألف درهم، إذا وقعت الجريمة من أي نوع من الأنواع المدرجة بالقائمة الأولى المرفقة بهذا القانون.
- الحبس مدة لا تقل عن ثلاثة أشهر وبغرامة لا تقل عن عشرة آلاف درهم أو بإحدى هاتين العقوبتين، إذا وقعت الجريمة على أي نوع من الأنواع المدرجة بالقائمة الثانية المرفقة بهذا القانون.
- الحبس مدة لا تقل عن شهر واحد وغرامة لا تقل عن خمسة آلاف درهم أو بإحدى هاتين العقوبتين، إذا وقعت الجريمة على نوع من الأنواع المدرجة بالقائمة الثالثة المرفقة بهذا القانون.
مادة (84)
يعاقب بغرامة لا تقل عن ألف درهم ولا تزيد على عشرين ألف درهم كل من خالف حكم المادة (43) من هذا القانون.
مادة (85)
يعاقب بغرامة لا تقل عن خمسة آلاف درهم ولا تزيد على عشرين ألف درهم كل من خالف حكم المادة (66) من هذا القانون.
مادة (86)
كل مخالفة أخرى لأحكام هذا القانون يعاقب مرتكبها بالغرامة التي لا تقل عن خمسمائة درهم ولا تزيد على عشرة آلاف درهم.
مادة (87)
لا يخل تطبيق العقوبات المنصوص عليها في هذا القانون بأية عقوبات أشد ينص عليها قانون آخر.
مادة (88)
تضاعف العقوبات المقررة للجرائم المنصوص عليها في هذا القانون في حالة العود.
مادة (89)
لا تسري العقوبات المنصوص عليها في هذا القانون على حالات التلوث الناجمة عن:
- تأمين سلامة الوسيلة البحرية أو سلامة الأرواح عليها.
- التفريغ الناتج عن عطب بالوسيلة البحرية أو أحد أجهزتها بشرط ألا يكون قد تم بمعرفة الربان أو المسؤول عنها بهدف تعطيلها أو إتلافها أو عن إهمال ويشترط في جميع الأحوال أن يكون ربان الوسيلة البحرية أو المسؤول عنها قد اتخذ قبل وبعد وقوع العطب جميع الاحتياطات الكافية لمنع أو تقليل آثار التلوث وقام على الفور بإخطار هيئات الموانئ.
- كسر مفاجئ في خط أنابيب يحمل الزيت أو المزيج الزيتي أثناء عمليات التشغيل أو أثناء الحفر أو استكشاف أو اختبار الآبار، بدون إهمال في رقابة الخطوط أو صيانتها، وعلى أن تتخذ الاحتياطات الكافية لرقابة تشغيل الخطوط الحمراء والسيطرة على التلوث ومصادره فور حدوثه.
مادة (90)
تختص بالفصل في الجرائم المنصوص عليها في هذا القانون المحكمة التي تقع في دائرتها الجريمة وذلك إذا وقعت من أي من الوسائل البحرية على اختلاف جنسياتها وأنواعها داخل البيئة البحرية للدولة، وتفصل المحكمة في الدعوى على وجه السرعة.
وتختص المحاكم الجزائية في العاصمة بالفصل في الجرائم التي ترتكبها الوسيلة البحرية التي ترفع علم الدولة خارج البيئة البحرية للدولة.
الباب التاسع
أحكام ختامية
مادة (91)
لا يجوز أن يزيد مستوى النشاط الإشعاعي أو تركيز المواد المشعة في الهواء والماء والغذاء والتربة عن الحدود المسموح بها، والتي تحددها الجهات المعنية بالتشاور والتنسيق مع الهيئة ويبين ذلك في اللائحة التنفيذية.
مادة (92)
للهيئة طلب معاونة هيئات الموانئ والقوات المسلحة ووزارة الداخلية ووزارة النفط والثروة المعدنية أو أية جهة أخرى وذلك في سبيل تنفيذ أحكام هذا القانون، وعلى تلك الجهات تقديم العون بالسرعة الممكنة متى طلب منها ذلك.
مادة (93)
تقدم الهيئة لمختلف الجهات كل ما يتوفر لديها من معلومات وبيانات عن المستحدث والهام من الضوابط البيئية فيما يتصل بأنشطة تلك الجهات ووفق الأولويات التي يحددها مجلس الإدارة.
مادة (94)
لا تسري أحكام المواد (4) و(6) و(7) و(38) و(58) من هذا القانون على أنشطة الجهات التي تطبق نظماً وبرامج متكاملة لحماية وتنمية البيئة تكفي لتحقيق أهداف هذا القانون.
كما تعفى تلك الجهات من الرجوع إلى الهيئة لدى إصدار التراخيص للمنشآت والأنشطة التي تخضع لولايتها أو لإشرافها.
ويصدر بتحديد الجهة ومدى كفاية النظام أو البرنامج قرار من مجلس الإدارة.
مادة (95)
يصدر مجلس الوزراء بناءً على موافقة مجلس الإدارة بعد التنسيق مع السلطات المختصة قراراً بتحديد الرسوم المقررة على الأنشطة والإجراءات والتراخيص الممنوحة طبقًا لأحكام هذا القانون.
مادة (96)
تضع الهيئة بالتنسيق مع السلطات المختصة نظامًا للحوافز التي تقدم للمؤسسات والهيئات والمنشآt والأفراد ممن يقومون بأعمال أو مشروعات من شأنها حماية البيئة في الدولة وتنميتها، ويصدر هذا النظام بقرار من مجلس الإدارة.
مادة (97)
على أصحاب المشروعات والمنشآت القائمة في تاريخ العمل بهذا القانون والتي تحددها اللائحة التنفيذية، أن يقدموا إلى الهيئة خلال مدة أقصاها سنة من تاريخ العمل باللائحة التنفيذية بيانا متكاملا عن أنشطتهم ويجب أن يتضمن البيان اقتراحاتهم بشأن التدابير والإجراءات الواجب اتخاذها لكي تتوافق عمليات المشروع والمنشأة مع المعايير البيئية المطلوبة.
وعلى الهيئة أن تقرر خلال مدة لا تتجاوز ستة أشهر التدابير والإجراءات الواجب اتخاذها من قبل صاحب المشروع أو المنشأة.
مادة (98)
يجب على المشروع والمنشآt القائمة عند العمل بهذا القانون توفيق أوضاعها طبقا لأحكامه وأحكام اللائحة التنفيذية خلال فترة لا تتجاوز سنة من تاريخ العمل باللائحة التنفيذية.
ويجوز لمجلس الإدارة مد هذه الفترة لمدة لا تجاوز عامًا آخر إذا دعت الضرورة إلى ذلك، أو كان للمد مبرر يقبله المجلس.
وتخضع أية توسعات أو تجديدات في المنشآت القائمة للأحكام المنصوص عليها في هذا القانون.
مادة (99)
يصدر مجلس الوزراء بالتشاور والتنسيق مع السلطات المختصة اللائحة التنفيذية لهذا القانون.
مادة (100)
يلغى كل حكم يخالف أو يتعارض مع أحكام هذا القانون.
مادة (101)
ينشر هذا القانون في الجريدة الرسمية، ويُعمل به بعد ثلاثة أشهر من تاريخ نشره.

We have issued the following law:
Article (1)
Definitions
In the application of the provisions of this law, the following words and phrases shall have the meanings assigned to each of them, unless the context requires otherwise:
| The State | : | The United Arab Emirates. |
| The Agency | : | The Federal Environmental Agency. |
| The Board | : | The Agency's Board of Directors. |
| The Chairman | : | The Chairman of the Agency's Board. |
| The Competent Authorities | : | The competent local authority in each emirate of the State. |
| The Concerned Parties | : | All parties concerned with environmental and development affairs within the State. |
| Environment | : | The biosphere in which life manifests in its various forms. This sphere consists of two elements: A natural element: comprising living organisms such as humans, animals, plants, and other living beings, and natural resources such as air, water, soil, organic and inorganic materials, as well as natural systems. And an artificial element: including everything man has introduced into the natural environment, such as fixed and non-fixed installations, roads, bridges, airports, means of transport, and the industries, innovations, and technologies he has created. |
| Marine Environment | : | The marine waters and the natural resources, plants, fish, and other marine organisms they contain, the air above them, and any fixed or mobile installations or projects located therein. Its boundaries extend to the limits of the State's exclusive economic zone. |
| Aquatic Environment | : | The marine environment and inland waters, including groundwater, spring water, and valleys, along with the natural resources, plants, fish, and other living organisms they contain, the air above them, and any fixed or mobile installations or projects located therein. |
| Ecosystems | : | The comprehensive system that includes all components of the natural elements of the environment that integrate and interact with each other. |
| Natural Resources | : | All resources in whose existence man has no part. |
| Nature Reserve | : | Land or water characterized by a special environmental nature (birds, animals, fish, plants, or natural phenomena of cultural, aesthetic, or environmental value), designated by a decision of the Council of Ministers based on a proposal from the Agency or a decision from the competent authorities. |
| Environmental Degradation | : | Affecting the environment in a way that reduces its value, distorts its ecological nature, depletes its resources, or harms living organisms or monuments. |
| Environmental Pollution | : | Pollution arising naturally or unnaturally, resulting from man's direct or indirect, intentional or unintentional introduction of any polluting materials and factors into the elements of the natural environment, which creates any risk to human health, plant or animal life, or harm to resources and ecosystems. |
| Polluting Substances and Factors | : | Any solid, liquid, or gaseous substances, smoke, vapors, odors, noise, radiation, heat, light glare, or vibrations produced naturally or by human action, which lead directly or indirectly to environmental pollution and degradation, or harm to humans or living organisms. |
| Air Pollution | : | Any change in the characteristics and specifications of outdoor air, workplace air, and the air of enclosed and semi-enclosed public places that results in a risk to human health and the environment, whether this pollution is caused by natural factors or human activity. |
| Water Pollution | : | The introduction of any substances or energy into the aquatic environment, intentionally or unintentionally, directly or indirectly, resulting in harm to living or non-living materials, threatening human health, or impeding aquatic activities including fishing and tourism, or spoiling its suitability for use, or diminishing its enjoyment, or altering its properties. |
| Substances Polluting the Aquatic Environment | : | Any substances whose discharge into the aquatic environment, directly or indirectly, intentionally or unintentionally, results in a change in its characteristics in a manner that harms humans, other living organisms, natural resources, or the aquatic environment, or harms tourist areas, or interferes with other legitimate uses of the aquatic environment. |
| Environmental Monitoring Networks | : | Work units that monitor environmental components and pollutants and provide data to the concerned parties periodically. |
| Environmental Impact Assessment | : | The study and analysis of the environmental feasibility of activities whose establishment or practice may affect the integrity of the environment. |
| Environmental Protection | : | Preserving its components, properties, and natural balance, preventing, reducing, or combating pollution, conserving natural resources and rationalizing their consumption, and protecting the living organisms that inhabit it, especially those threatened with extinction, and working to develop and enhance all these components. |
| Environmental Development | : | The policies and procedures that meet the needs of sustainable development in the State socially, culturally, and economically, and achieve the objectives and principles for which this law was enacted, most importantly improving the elements of the natural environment and preserving biodiversity and the historical, archaeological, and natural heritage of the State, present and future. |
| Sustainable Development | : | Linking environmental considerations with planning and development policy in a way that meets the needs and aspirations of the present without compromising the ability to meet the needs and aspirations of the future. |
| Environmental Disaster | : | An incident caused by natural factors or human action, resulting in severe damage to the environment and requiring a response with capabilities beyond local capacities. |
| Hazardous Substances | : | Solid, liquid, or gaseous substances with properties harmful to human health or that have a harmful effect on the environment, such as toxic, explosive, flammable, or ionizing radiation materials. |
| Harmful Substances | : | All substances that, directly or indirectly, lead to harm to human health or the environment, whether these substances are chemical, biological, or radioactive. |
| Waste | : | All types of hazardous and non-hazardous residues or refuse, including nuclear waste, which are disposed of or required to be disposed of based on the provisions of the law. It includes: Solid Waste: Such as domestic, industrial, agricultural, and medical waste, and construction and demolition debris. Liquid Waste: Originating from residences, commercial and industrial establishments, and others. Gaseous Waste, Smoke, Vapors, and Dust: Originating from homes, bakeries, incinerators, factories, crushers, quarries, power plants, oil operations, and various means of transport and communication. Hazardous Waste: Residues from various activities and processes or their ashes that retain the properties of hazardous materials. Medical Waste: Any waste consisting wholly or partly of human or animal tissue, blood or other body fluids, secretions, drugs or other pharmaceutical products, dressings, syringes, needles, sharp medical instruments, or any other waste that is infectious, chemical, or radioactive resulting from medical, nursing, treatment, healthcare, dental, veterinary, pharmaceutical, manufacturing, or other practices, or from examination, research, teaching, sampling, or storage. |
| Waste Management | : | The collection, storage, transport, recycling, and disposal of waste, including the after-care of disposal sites. |
| Waste Handling | : | All processes from the time of waste generation until its safe disposal, including waste collection, storage, transport, treatment, recycling, or disposal. |
| Waste Disposal | : | Processes that do not lead to the recovery of materials or their reuse, such as landfilling, deep injection, biological or physical/chemical treatment, permanent storage, destruction, or any other method approved by the competent authorities. |
| Waste Recycling | : | Processes carried out on waste with the aim of recovering materials or reusing them, such as use as fuel, extraction of metals and organic materials, soil treatment, or oil re-refining. |
| Marine Vessels | : | Any means that operates or is prepared to operate in the marine environment, regardless of its power, tonnage, or purpose of navigation. This includes ships, hydrofoils, air-cushion vehicles operating on the water surface or underwater, floating platforms, fixed or floating offshore platforms, and seaplanes. |
| Means of Oil Transport | : | Everything used for loading, transporting, pumping, or discharging oil, including pipelines. |
| Facility | : | Industrial and tourist facilities, electricity production and generation facilities, facilities operating in the field of oil exploration, extraction, transport, and use, all infrastructure projects, and any other facility. |
| Oil | : | All forms of crude oil and its products, including any type of liquid hydrocarbons, lubricating oils, fuel oils, refined oils, furnace oil, bitumen, and other materials extracted from petroleum or its derivatives or waste. |
| Oily Mixture | : | Any aqueous mixture containing an amount of oil exceeding (15) parts per million. |
| Unclean Ballast Water | : | Water discharged from a ship's tank if its oil content exceeds (15) parts per million. |
| Discharge | : | Any leakage, spillage, emission, or discharge of any type of polluting substances or their disposal into the aquatic, soil, or air environment. |
| Dumping | : | a. Any deliberate disposal into the marine environment of polluting substances or waste from ships, aircraft, platforms, or others. b. Any deliberate sinking in the marine environment of ships, industrial installations, or others. |
| Transport Vehicles | : | c. Aircraft, cars, trains, tractors, motorcycles, or other machinery or equipment intended for use on roads. |
| Noise | : | All sounds, vibrations, or acoustic oscillations that are annoying or harmful to public health. |
| Public Place | : | A place prepared to receive the public or a specific category of people for any purpose. |
| Enclosed Public Place | : | A public place that has the form of an integrated building into which air enters only through designated openings. Public transport is considered an enclosed public place. |
| Semi-Enclosed Public Place | : | A public place that has the form of an incomplete building and is directly connected to the outside air, so it cannot be completely closed. |
Article (2)
Objectives and General Principles
This law aims to achieve the following purposes:
- Protecting the environment, preserving its quality and natural balance.
- Combating pollution in its various forms and avoiding any immediate or long-term damages or negative effects resulting from economic, agricultural, industrial, urban, or other development plans and programs aimed at improving the standard of living, and coordinating between the Agency and the competent authorities or concerned parties in protecting the environment, preserving its quality and natural balance, consolidating environmental awareness, or the principles of combating pollution.
- Developing natural resources, preserving biodiversity within the State's territory, and making optimal use of it for the benefit of present and future generations.
- Protecting society, human health, and other living organisms from all environmentally harmful activities and actions or those that impede the legitimate use of the environment.
- Protecting the environment in the State from the harmful effects of activities carried out outside its territory.
- Implementing the obligations regulated by international or regional agreements related to environmental protection, pollution control, and the conservation of natural resources to which the State is a party or to which it accedes.
Part One
Development and the Environment
Chapter One
Environmental Impact of Facilities
Article (3)
The Agency, in consultation and coordination with the competent authorities and concerned parties, shall establish the necessary standards, specifications, principles, and controls for assessing the environmental impact of projects and facilities requiring a license, and shall specifically undertake:
- Identifying categories of projects that, by their nature, are likely to cause environmental damage.
- Identifying areas and sites of special environmental importance or sensitivity (historical and archaeological sites, wetlands, coral islands, nature reserves, public parks, etc.).
- Identifying natural resources and environmental problems of special importance.
Article (4)
Without prejudice to the provisions of the preceding article, the Agency, in coordination with the competent authorities and other concerned parties, shall assess the environmental impact of the project and facility for which a license is sought. The project or facility may not commence its activity before obtaining the license referred to in the preceding article, including the environmental impact assessment.
Article (5)
The license applicant shall attach to his application a comprehensive statement about the project or activity he intends to carry out, which includes all the data stipulated in the Executive Regulations and according to the forms contained therein.
Article (6)
The Agency, in coordination with the competent authorities, shall decide on the submitted applications within a period not exceeding one month from the date of submitting the license application, and the applicant shall be notified of the result, as well as the reasons for refusal in case of rejection.
The period specified in the preceding paragraph may be extended for one month if necessary.
Article (7)
The owners of projects or facilities that have obtained license approval are obligated to conduct periodic analysis of waste, monitor the specifications of discharges and pollutants resulting from these projects, including biodegradable materials, maintain monitoring records, and send reports of these results to both the Agency and the competent authorities.
Article (8)
The Executive Regulations shall specify the necessary period for retaining each type of record referred to in Article (7) of this law.
Chapter Two
Environment and Sustainable Development
Article (9)
All concerned parties, especially those responsible for economic and urban planning and development, must take into account considerations of environmental protection, pollution control, and the rational use of natural resources when preparing economic and social development plans and when establishing and implementing projects.
Article (10)
The Agency, in coordination and consultation with the competent authorities and concerned parties, shall prepare, issue, review, develop, and update environmental protection measures and standards.
In determining these measures and standards, a balance shall be struck between the available technical capabilities and the necessary economic cost, without prejudice to the requirements of environmental protection and pollution control.
Article (11)
In emergency force majeure cases, the measures and standards issued in application of the provisions of this law may not be adhered to if the objective is to protect lives or ensure the safety of the facility or work area. In this case, the Agency and the competent authorities must be notified.
Article (12)*(Amended)
It is prohibited to hunt, kill, or capture wild and marine birds and animals of the types specified in lists Nos. (1, 2, 3) attached to this law. It is also prohibited to possess, transport, move, sell, or offer for sale these birds and animals, live or dead, except after obtaining a license from the competent authorities. It is also prohibited to destroy the nests of the mentioned birds or their eggs.
The Executive Regulations shall specify the areas in which hunting may be licensed and the conditions for the license, as well as the necessary control measures for the implementation of the provisions of this article.
The competent Minister, in coordination with the competent authority, may amend the three lists attached to this law by deletion, addition, or transfer.
Chapter Three
Environmental Monitoring
Article (13)
The Agency, in coordination with the competent authorities and concerned parties, shall establish a national environmental monitoring system, and the competent authorities shall establish, operate, and supervise environmental monitoring networks.
Article (14)
Environmental monitoring networks must inform the Agency, the competent authorities, and the concerned parties of any excess of the permissible limits for environmental pollutants. They must also submit periodic reports on the results of their work, as specified by the Executive Regulations.
Chapter Four
Emergency Plans for Environmental Disasters
Article (15)
The Agency, in coordination with the competent authorities and in cooperation and consultation with the concerned parties in the State, shall prepare plans to confront environmental emergencies and disasters. A decision from the Council of Ministers shall be issued for the approval of these plans and their budgets.
Article (16)
All authorities and individuals in the State must promptly provide all required assistance and capabilities to confront environmental disasters.
Part Two
Protection of the Aquatic Environment
Chapter One
Scope of Environmental Protection
Article (17)
The protection of the aquatic environment from pollution aims to achieve the following purposes:
- Protecting the coasts, beaches, and ports of the State from the risks of pollution in all its forms and shapes.
- Protecting the marine environment and its living and non-living natural resources by preventing, reducing, and controlling pollution, whatever its source.
- Protecting drinking water and groundwater and working to develop water resources sources.
Article (18)
It is prohibited for parties authorized to explore, extract, or exploit onshore or offshore oil and gas fields to discharge any polluting substance resulting from drilling, exploration, well testing, or production operations into the aquatic environment or the adjacent land area where the activities mentioned in this article are carried out, unless safe means are used that do not result in harm to the land and aquatic environment, and the discharged waste and polluting materials are treated according to the latest available technical systems, and in accordance with the conditions stipulated in the ratified regional and international agreements and protocols.
Article (19)
The Agency, in coordination with the competent authorities and in cooperation and coordination with the parties authorized to explore, extract, or exploit oil and gas fields, shall prepare indicative specifications for environmental safety conditions and the management of waste resulting from oil and gas production, transport, and exploitation operations.
Article (20)
The Agency, in coordination with the competent authorities and in cooperation and coordination with the parties stipulated in Articles (18) and (19) of this law, shall conduct periodic monitoring of the environmental impacts resulting from oil and gas exploration, extraction, and exploitation operations that take place in production fields and land and sea transport corridors.
Chapter Two
Protection of the Marine Environment
Section One
Pollution from Marine Vessels
Article (21)
It is prohibited for all marine vessels, regardless of their nationality, whether registered in the State or not, to discharge or dump oil or oily mixture into the marine environment.
Article (22)
The captain or person in charge of a marine vessel is obligated to take adequate measures to protect against the effects of pollution in the event of an accident involving a vessel carrying oil that results in or is feared to result in pollution of the State's marine environment. He is also obligated to comply with the orders of inspectors from administrative authorities or judicial officers in this case.
Article (23)
In the event of a collision involving oil tankers, marine vessels, facilities, or carriers of hazardous materials, whether due to a deliberate act by the person in charge of the marine vessel or as a result of his or his subordinates' error or negligence, the captain shall be the person responsible for stopping the leak, and the owner and the carrier shall be jointly and severally liable for paying all costs of damages, compensation, and control resulting from the spill in the marine environment, coasts, and beaches.
Article (24)
- The owner, captain, or any person in charge of a marine vessel, and those in charge of oil transport means located within the ports or the marine environment of the State, as well as the officials and entities working in oil extraction, must immediately, and according to the procedures stipulated in the Executive Regulations, report to the port authorities, border and coast guards, and other competent authorities about any oil spill incident as soon as it occurs, stating the circumstances of the incident, the type of spilled substance, and the measures taken to stop or limit the spill.
- In all cases, the port authorities and border and coast guards must inform the Agency and the concerned parties of all information about the said incident as soon as it occurs.
Article (25)
Every owner or captain of a national or foreign marine vessel that transports oil and enters the State's marine environment must keep an oil record book on that vessel, in which all operations related to oil are recorded. The Executive Regulations shall specify the data of this record.
Article (26)
Every marine vessel that transports oil and enters the State's marine environment must be equipped with the necessary equipment to carry out control operations during pollution incidents originating from the vessel itself, as specified by the Executive Regulations.
Article (27)
It is prohibited for marine vessels transporting hazardous materials to dump or discharge any harmful substances or waste into the marine environment, directly or indirectly.
It is also prohibited for marine vessels carrying harmful substances transported in packages, shipping containers, portable tanks, or road or rail tank wagons to dispose of them by dumping them in the State's marine environment.
Article (28)
Marine vessels carrying hazardous materials must be provided with a record called the "Cargo Record Book," in which the captain or person in charge of the vessel records all operations related to the cargo. The Executive Regulations shall specify the rules governing this record.
Article (29)
The captain of every marine vessel entering the State's ports must report the hazardous materials carried on the vessel, including their types, quantities, locations on the vessel, sources of loading, and destinations for unloading.
Article (30)
The captain or person in charge of a marine vessel is obligated to take the necessary measures to protect against the effects of pollution in the event of an accident involving a marine vessel carrying harmful or hazardous materials that is feared to pollute the marine environment. He is also obligated to comply with the orders of inspectors from administrative authorities or judicial officers in this case.
Article (31)
It is prohibited for marine vessels carrying harmful substances to dump hazardous waste and polluting materials into the marine environment.
The concerned authorities, in coordination with the Agency, shall issue schedules of the hazardous waste and polluting materials referred to in the preceding paragraph.
Article (32)
It is prohibited for marine vessels and marine installations specified by the Executive Regulations to discharge sewage into the marine environment, and it must be disposed of according to the standards and procedures specified by the Executive Regulations.
It is also prohibited for marine vessels to dump waste into the marine environment.
Article (33)
Every marine vessel that transports oil and enters the marine environment must be in possession of a valid International Oil Pollution Prevention Certificate (I.O.P.P. Certificate), attached with a statement indicating the last place of discharge of the "slop" tank contents, their quantities, and the date of discharge.
Article (34)
It is prohibited for all marine vessels and marine installations engaged in the exploration and exploitation of natural and mineral resources in the marine environment, as well as marine vessels using the State's ports, to dump garbage or waste into the marine environment. They must deliver the garbage in the manner and at the locations specified by the competent authorities. The competent port authorities, in cooperation with the border and coast guards, shall prepare and implement garbage or waste handling plans and ensure that all such vessels using the State's ports apply the procedures stipulated in this law and its Executive Regulations.
Section Two
Pollution from Land-Based Sources
Article (35)
It is prohibited for all facilities, including public establishments, commercial, industrial, agricultural, tourist, and service facilities, and others, to discharge or dump any untreated materials, waste, or liquids that would cause pollution in the aquatic environment, directly or indirectly.
Article (36)
For a license to be granted for the establishment of any facilities or establishments on or near the coastal strip that would result in the discharge of polluting materials in violation of the provisions of this law and its implementing decisions, the license applicant must conduct environmental impact studies and is obligated to provide waste treatment units, and must begin operating them as soon as those facilities begin operation.
Article (37)
The Executive Regulations shall specify the specifications and standards that industrial facilities, which are permitted to discharge biodegradable polluting materials after treatment, must adhere to.
The Executive Regulations shall also specify the non-biodegradable polluting materials that industrial facilities are prohibited from discharging into the marine environment.
Article (38)
Both the Agency and the competent authority have the right to take samples of treated liquid waste according to the methods specified by the Executive Regulations, to ensure that the analysis results conform to the approved specifications.
Chapter Three
Protection of Drinking Water and Groundwater
Article (39)
The concerned parties shall consult and coordinate with the Agency and the competent authorities on all matters related to groundwater and drinking water, including the preservation and development of water resources sources.
Article (40)
The competent authorities, in coordination with the Agency, shall determine the safety rules for drinking water tanks and connections and their fitness for human use according to the standards specified by the Executive Regulations, which owners of buildings and facilities must adhere to.
Article (41)
The competent authorities, in coordination with the Agency, shall conduct an annual periodic inspection of drinking water tanks and connections to verify their safety and fitness, and shall notify the owner of the procedures to be followed to ensure the safe delivery of water to the residents.
In the event the owner fails to implement these instructions, those authorities may carry out the necessary repairs at the owner's expense.
The result of the periodic inspection shall be recorded in special records kept by those authorities.
Part Three
Soil Protection
Article (42)
The competent authorities must take into account the environmental factors and standards determined by the Agency in coordination with the competent authorities and concerned parties when preparing and implementing land use plans under which areas designated for construction, agricultural and industrial areas, protected areas, and others are determined.
Article (43)
It is prohibited to carry out any activity that contributes directly or indirectly to harming the soil, affecting its natural properties, or polluting it in a way that affects its productive capacity, as specified by the Executive Regulations.
Article (44)
The competent authorities, in cooperation and coordination with the Agency and concerned parties, shall work to develop and enhance the resources of the desert environment, pay attention to biodiversity, and increase the green area using modern methods and techniques and benefiting from available technology that protects agricultural areas and their plants. It is prohibited to carry out any activity that would harm the quantity or quality of vegetation in any area, leading to desertification or distortion of the natural environment. It is prohibited to cut, uproot, or harm any tree, shrub, or herb without a permit from the competent authority in coordination with the Agency.
Article (45)
The Ministry of Agriculture and Fisheries, in coordination with the competent authorities, the Agency, and other concerned parties in the State, shall establish regulations governing the following matters:
- The types of pesticides, fertilizers, and agricultural conditioners that may be produced, manufactured, imported, traded, or used in the State.
- The conditions and specifications for the production, manufacture, import, trade, or use of these materials.
- The procedures for registering these materials or renewing their registration.
- The conditions and specifications for taking samples of these materials, methods of their analysis, and evaluation of the analysis results.
- How to monitor, evaluate, and treat pollution resulting from the unsafe or incorrect handling or use of these materials.
Article (46)
The Agency, in coordination with the competent authorities and concerned parties in the State, shall establish the controls and permissible limits for pesticide residues on locally produced or imported foods.
Article (47)
The Agency, in coordination with the Ministry of Agriculture and Fisheries, the competent authorities, and other concerned parties, shall establish the controls and conditions to be adhered to for the disposal of pesticide residues or chemical compounds used in their manufacture or whose use has expired.
Part Four
Protection of Air from Pollution
Article (48)
Facilities, in the practice of their activities, are obligated not to emit or leak air pollutants exceeding the maximum permissible limits specified by the Executive Regulations.
Article (49)
It is not permissible to use machines, engines, or vehicles that produce combustion waste exceeding the limits stipulated in the Executive Regulations.
Article (50)
It is prohibited to dump, treat, or burn garbage and solid waste except in designated places far from residential, industrial, and agricultural areas and the aquatic environment. The Executive Regulations shall specify the specifications, controls, and minimum distance of designated places for these purposes from those areas.
Article (51)
Spraying or using pesticides or any other chemical compounds for agricultural purposes, public health requirements, or other purposes is prohibited except in compliance with the conditions, controls, and guarantees specified by the Executive Regulations, ensuring that humans, animals, plants, watercourses, or any of the environmental components are not exposed, directly or indirectly, now or in the future, to the harmful effects of these pesticides or chemical compounds.
Article (52)
All authorities and individuals, when carrying out excavation, drilling, construction, demolition, or transporting the resulting waste or dust, must take the necessary precautions during these works, in addition to the necessary precautions for their safe storage or transport to prevent them from becoming airborne, as specified by the Executive Regulations.
Article (53)
When burning any type of fuel or other material, whether in research, exploration, drilling, extraction, and production of crude oil, or for industrial purposes, power generation, construction, or any other commercial purpose, the resulting smoke, gases, and vapors must be within the permissible limits. The person responsible for this activity must take all precautions to reduce the amount of pollutants in the combustion products, and is also obligated to keep a record in which the measurement of the quantities of pollutants in the said combustion products is recorded and to take all precautions to reduce these quantities.
The Executive Regulations shall specify the precautions and permissible limits for chimneys and other means of controlling smoke, gases, and vapors emitted from the combustion process, as well as the permissible limits in measuring the quantities of pollutants in the combustion products, and the authorities authorized to audit the recorded measurements.
Article (54)
All authorities and individuals, when carrying out production, service, or other activities, especially when operating machinery, equipment, alarms, and loudspeakers, must not exceed the permissible limits for noise.
The Executive Regulations shall specify the permissible limits for sound intensity and the duration of exposure to it.
Article (55)
Institutions and facilities are obligated to ensure adequate ventilation inside workplaces and to take the necessary precautions and measures to prevent the leakage or emission of air pollutants except within the permissible limits specified by the Executive Regulations, whether the emission of these pollutants is due to the nature of the facilities' practice of their activity or a malfunction in the equipment. They must provide the necessary means of protection for workers in implementation of occupational safety and health conditions, including the selection of appropriate machines, equipment, materials, and types of fuel, taking into account the duration of exposure to these pollutants.
Article (56)
Enclosed and semi-enclosed public places must be equipped with adequate means of ventilation commensurate with the size of the place, its capacity, and the type of activity practiced therein, to ensure air renewal and purity and to maintain it at a suitable temperature.
Article (57)
Public and tourist establishments are obligated to take measures to prevent smoking in enclosed public places except within the limits permitted by the license granted to these places. In this case, a designated area for smokers must be allocated in a way that does not affect the air in other areas. Smoking is prohibited in public transport and elevators.
Part Five
Handling of Hazardous Substances, Hazardous Waste, and Medical Waste
Article (58)
Handling or dealing with hazardous substances, hazardous waste, and medical waste is prohibited without a license from the competent authorities. The Executive Regulations shall specify the conditions and procedures for granting the license.
Article (59)
Hazardous waste and medical waste shall be disposed of according to the conditions and standards specified by the Executive Regulations. It is prohibited to establish any facilities for the purpose of treating hazardous waste except with a license from the competent authorities.
Article (60)
The transport and disposal of hazardous waste across the land borders, marine environment boundaries, and airspace of the State shall be controlled according to the regulations stipulated in the Executive Regulations.
Article (61)
Those involved in the production or handling of hazardous substances, whether in their gaseous, liquid, or solid state, must take all necessary precautions to ensure that no damage occurs to the environment. The Executive Regulations shall specify these precautions.
The owner of a facility whose activity generates hazardous waste according to the provisions of this law must keep a record of this waste and the method of its disposal, as well as the parties contracted to receive this waste. The Executive Regulations shall specify the data of this record and the authority responsible for monitoring it to ensure that the data corresponds to reality.
Article (62)
- It is prohibited for any public or private entity, or any natural or legal person, to import or bring in hazardous waste, or to bury, dump, store, or dispose of it in any form within the environment of the State.
- It is prohibited for these entities and persons to import or bring in nuclear materials or waste, or to bury, dump, store, or dispose of it in any form within the environment of the State.
- It is prohibited, without a written permit from the Agency, to allow the passage of marine, air, or land vessels carrying hazardous or nuclear waste through the marine, air, or land environment.
Part Six
Nature Reserves
Article (63)
The protected areas in the State and the boundaries of each area shall be determined by a decision of the Council of Ministers or the competent authorities. Certain areas may be considered protected areas based on a proposal from the Agency.
Article (64)
The prohibited actions, activities, and behaviors in protected areas, which would damage or degrade the natural environment, harm wildlife or marine life, or detract from its aesthetic value, shall be determined by a decision of the competent authorities in coordination with the Agency. The following are specifically prohibited:
- Hunting, transporting, killing, or harming wild or marine organisms, or carrying out actions that would eliminate them.
- Damaging or destroying geological or geographical formations or areas that are habitats for animal or plant species or for their reproduction.
- Introducing alien species into the protected area.
- Polluting the soil, water, or air of the protected area.
- Military maneuvers and shooting exercises.
- Cutting trees or clearing the soil.
- Recreational, entertainment, or sporting activities that would kill, harm, or negatively affect wildlife.
- Anything that would disturb the natural balance of these reserves.
- It is also prohibited to establish facilities or buildings, construct roads, operate vehicles, or practice any agricultural, industrial, or commercial activities in protected areas without a permit from the competent authorities.
Article (65)
Wild and marine animals and birds that use the protected area as a resting, breeding, or settlement station shall enjoy protection according to the provisions of the law.
Article (66)
No activities, behaviors, or actions may be practiced in the areas surrounding a protected area if they would affect the environment of the reserve or its natural phenomena, except with a license from the competent authority after obtaining the opinion of the Agency. The Executive Regulations shall specify the rules for determining the surrounding area.
Article (67)
The Agency, in coordination with the competent authorities, shall supervise the activities necessary for the conservation of protected areas in the State, and may specifically:
- Contribute to the preparation of programs and studies necessary for the development of protected areas.
- Establish standards and controls related to monitoring environmental phenomena, surveying and registering wild and marine organisms in protected areas.
- Coordinate activities related to the management and development of protected areas.
- Inform and educate citizens about the goals and purposes of establishing nature reserves.
- Exchange information and expertise with countries, international bodies, and concerned parties in the State in this field.
Article (68)
Research centers, scientific institutions, universities, and other competent bodies, in coordination with the Agency, shall pay attention to the subject of biodiversity, the conservation of the origin of species, conduct studies and research, and propose controls and methods to be adopted for the conservation of these species and ways to invest in them in a manner that prevents their depletion and preserves the legitimate literary, social, and economic rights of the State.
Part Seven
Liability and Compensation for Environmental Damages
Chapter One
Judicial Enforcement Authorities
Article (69)
The Minister of Justice, Islamic Affairs and Endowments, in agreement with the Minister of Health, shall issue a decision specifying the employees of the Agency and the competent authorities who shall have the capacity of judicial enforcement officers in the field of inspecting facilities, places, and others to verify their compliance with the application of the provisions of this law and the decisions issued in its implementation.
The employees of the Agency and the competent authorities who have been granted the capacity of judicial enforcement officers may seize any violation of the provisions of this law and refer the violator, according to the procedures in force in the State, to the competent judicial authorities.
Article (70)
Judicial enforcement officers, upon the occurrence of a violation, if the captain or person in charge of the marine vessel wishes to leave the port urgently, may collect immediate sums on a temporary basis against the execution of the fine or compensation penalty that may be imposed, within the limits stipulated in this law, provided that this amount is not less than the minimum prescribed fine plus all expenses and compensations determined by the competent authorities in agreement with the Agency to remove the effects of the violation.
A bank guarantee letter for the value of the said amounts, acceptable to the competent authorities, may be submitted.
Chapter Two
Liability and Compensation for Environmental Damages
Article (71)
Anyone who, by his action or negligence, causes damage to the environment or to others as a result of violating the provisions contained in this law or the regulations or decisions issued in its implementation, shall be responsible for all costs necessary to treat or remove these damages, and shall also be obligated to pay any compensation that may result therefrom.
Article (72)
Compensation for environmental damage referred to in Article (71) of this law includes damages that affect the environment itself and prevent or reduce its legitimate use, whether temporarily or permanently, or harm its economic and aesthetic value, as well as the cost of environmental rehabilitation.
Part Eight
Penalties
Article (73)
- - Whoever violates the provisions of Articles (21), (27), (31), (62/clause 1), and (62/clause 3) of this law shall be punished by imprisonment and a fine of not less than one hundred fifty thousand dirhams and not more than one million dirhams.
- - The penalty shall be death or life imprisonment and a fine of not less than one million dirhams and not more than ten million dirhams for anyone who violates the provision of Article (62/clause 2) of this law.
- - Anyone who violates the provisions of clauses (1) and (2) of Article (62) shall also be obligated to re-export the hazardous and nuclear waste subject of the crime at his own expense.
- - The penalty shall be imprisonment for a term of not less than two years and not more than five years and a fine of not less than two hundred thousand dirhams and not more than five hundred thousand dirhams, or one of these two penalties, for anyone who violates the provisions of Articles (18) and (58) of this law.
- - The penalty shall be imprisonment and a fine, or one of these two penalties, if the crimes referred to in Article (21) are committed by fishing boats not exceeding seventy feet in length.
Article (74)
Whoever violates the provisions of Articles (24) and (26) of this law shall be punished by imprisonment for a term of not less than one year and a fine of not less than one hundred thousand dirhams and not more than five hundred thousand dirhams.
Article (75)
Whoever violates the provisions of Articles (25), (28), (32), (33), and (34) of this law shall be punished by imprisonment for a term of not less than one year and not more than two years, and a fine of not less than ten thousand dirhams and not more than two hundred thousand dirhams, or one of these two penalties.
Article (76)
Whoever violates the provisions of Articles (22) and (30) of this law shall be punished by imprisonment for a term of not less than six months and not more than one year and a fine of not less than two thousand dirhams and not more than ten thousand dirhams, or one of these two penalties.
Article (77)
Whoever causes the pollution of drinking water or groundwater shall be punished by imprisonment for a term of not less than one year and a fine of not less than five thousand dirhams and not more than one hundred thousand dirhams.
Article (78)
Whoever violates the provisions of Articles (59), (60), and (61) of this law shall be punished by imprisonment for a term of not less than one year and a fine of not less than ten thousand dirhams and not more than twenty thousand dirhams, or one of these two penalties.
Article (79)
Whoever violates the provision of Article (49) of this law shall be punished by a fine of not less than one thousand dirhams.
Article (80)
Whoever violates the provision of Article (51) of this law shall be punished by a fine of not less than ten thousand dirhams and not more than fifty thousand dirhams.
Article (81)
Whoever violates the provision of Article (35) of this law shall be punished by a fine of not less than ten thousand dirhams and not more than one hundred thousand dirhams.
Article (82)
Whoever violates the provisions of Articles (48), (50), (53), (54), and (55) of this law shall be punished by a fine of not less than two thousand dirhams and not more than twenty thousand dirhams.
Article (83)*(Amended)
Anyone who violates the provisions of Article (12) and clause (1) of Article (64) of this law, in addition to the confiscation of the seized birds and animals, shall be punished as follows:
- Imprisonment for a term of not less than six months and a fine of not less than twenty thousand dirhams, if the crime involves any of the species listed in the first list attached to this law.
- Imprisonment for a term of not less than three months and a fine of not less than ten thousand dirhams, or one of these two penalties, if the crime involves any of the species listed in the second list attached to this law.
- Imprisonment for a term of not less than one month and a fine of not less than five thousand dirhams, or one of these two penalties, if the crime involves a species listed in the third list attached to this law.
Article (84)
Whoever violates the provision of Article (43) of this law shall be punished by a fine of not less than one thousand dirhams and not more than twenty thousand dirhams.
Article (85)
Whoever violates the provision of Article (66) of this law shall be punished by a fine of not less than five thousand dirhams and not more than twenty thousand dirhams.
Article (86)
Any other violation of the provisions of this law shall be punished by a fine of not less than five hundred dirhams and not more than ten thousand dirhams.
Article (87)
The application of the penalties stipulated in this law shall not prejudice any more severe penalties provided for in any other law.
Article (88)
The penalties prescribed for the crimes stipulated in this law shall be doubled in case of recidivism.
Article (89)
The penalties stipulated in this law shall not apply to cases of pollution resulting from:
- Ensuring the safety of the marine vessel or the lives on board.
- Discharge resulting from damage to the marine vessel or one of its devices, provided that it was not done by the captain or the person in charge with the intent of disabling or damaging it, or due to negligence, and provided that in all cases the captain or the person in charge of the marine vessel has taken, before and after the damage occurred, all sufficient precautions to prevent or reduce the effects of pollution and has immediately notified the port authorities.
- A sudden break in a pipeline carrying oil or oily mixture during operations or during drilling, exploration, or well testing, without negligence in the supervision or maintenance of the lines, provided that sufficient precautions are taken to control the operation of the red lines and control pollution and its sources as soon as it occurs.
Article (90)
The court in whose jurisdiction the crime occurs shall have jurisdiction to adjudicate the crimes stipulated in this law if committed by any marine vessel of different nationalities and types within the marine environment of the State, and the court shall decide the case expeditiously.
The criminal courts in the capital shall have jurisdiction to adjudicate crimes committed by a marine vessel flying the flag of the State outside the marine environment of the State.
Part Nine
Final Provisions
Article (91)
The level of radioactive activity or the concentration of radioactive materials in air, water, food, and soil shall not exceed the permissible limits determined by the concerned parties in consultation and coordination with the Agency, and this shall be specified in the Executive Regulations.
Article (92)
The Agency may request the assistance of port authorities, the armed forces, the Ministry of Interior, the Ministry of Petroleum and Mineral Resources, or any other entity for the implementation of the provisions of this law, and these entities must provide assistance as quickly as possible when requested.
Article (93)
The Agency shall provide to various entities all available information and data on new and important environmental controls related to the activities of those entities and according to the priorities determined by the Board of Directors.
Article (94)
The provisions of Articles (4), (6), (7), (38), and (58) of this law shall not apply to the activities of entities that apply integrated systems and programs for environmental protection and development sufficient to achieve the objectives of this law.
These entities shall also be exempt from referring to the Agency when issuing licenses for facilities and activities subject to their jurisdiction or supervision.
A decision shall be issued by the Board of Directors specifying the entity and the extent of the adequacy of the system or program.
Article (95)
The Council of Ministers, based on the approval of the Board of Directors after coordination with the competent authorities, shall issue a decision specifying the fees prescribed for the activities, procedures, and licenses granted according to the provisions of this law.
Article (96)
The Agency, in coordination with the competent authorities, shall establish a system of incentives to be provided to institutions, bodies, facilities, and individuals who carry out works or projects that would protect and develop the environment in the State, and this system shall be issued by a decision of the Board of Directors.
Article (97)
The owners of projects and facilities existing on the date of entry into force of this law, as specified by the Executive Regulations, must submit to the Agency, within a period not exceeding one year from the date of entry into force of the Executive Regulations, a comprehensive statement about their activities. The statement must include their proposals regarding the measures and procedures to be taken for the project and facility operations to comply with the required environmental standards.
The Agency shall decide, within a period not exceeding six months, the measures and procedures to be taken by the owner of the project or facility.
Article (98)
Existing projects and facilities at the time this law comes into force must regularize their status according to its provisions and the provisions of the Executive Regulations within a period not exceeding one year from the date the Executive Regulations come into force.
The Board of Directors may extend this period for a period not exceeding another year if necessity so requires, or if the extension has a justification acceptable to the Board.
Any expansions or renovations in existing facilities shall be subject to the provisions stipulated in this law.
Article (99)
The Council of Ministers, in consultation and coordination with the competent authorities, shall issue the Executive Regulations of this law.
Article (100)
Any provision that violates or contradicts the provisions of this law is hereby repealed.
Article (101)
This law shall be published in the Official Gazette and shall come into force three months after the date of its publication.
