في شأن أنظمة اللائحة التنفيذية للقانون الاتحادي رقم (24) لسنة 1999
في شأن حماية البيئة وتنميتها
مجلس الوزراء
بعد الاطلاع على الدستور،
- وعلى القانون الاتحادي رقم (1) لسنة 1972م في شأن اختصاصات الوزارات وصلاحيات الوزراء والقوانين المعدلة له،
- وعلى القانون الاتحادي رقم (7) بشأن الهيئة الاتحادية للبيئة،
- وعلى القانون الاتحادي رقم (24) لسنة 1999 في شأن حماية البيئة وتنميتها،
- وعلى قرار مجلس الوزراء رقم (7) لسنة 1996 بإصدار لائحة شؤون موظفي الهيئة الاتحادية للبيئة وتعديلاته ،
- وعلى قرار مجلس الوزراء رقم (7/637) لسنة 2001 بالموافقة على أنظمة باعتبارها جزءاً من اللائحة التنفيذية للقانون الاتحادي رقم (24) لسنة 1999 في شأن حماية البيئة وتنميتها ،
- وبناءً على ما عرضه وزير الصحة - رئيس مجلس إدارة الهيئة الاتحادية للبيئة، وموافقة مجلس الوزراء،
قرر:
المادة الأولى
يعمل بأحكام الأنظمة التالية بعد المرفق نص كل منها بهذا القرار باعتبارها جزءاً من اللائحة التنفيذية للقانون الاتحادي رقم (24) لسنة 1999 في شأن حماية البيئة وتنميتها، وهي:
- نظام حماية البيئة البحرية
- نظام تداول المواد الخطرة والنفايات الخطرة والنفايات الطبية
- نظام تقييم التأثير البيئي للمنشآت
- نظام مبيدات الآفات والمصلحات الزراعية والأسمدة
المادة الثانية
ينشر هذا القرار في الجريدة الرسمية، ويعمل به من تاريخ نشره، ماعدا نظام تداول المواد الخطرة والنفايات الخطرة والنفايات الطبية، فيعمل به بعد تسعين يوماً من النشر .

المادة (1)
تعاريف
في تطبيق أحكام هذا النظام يقصد بالكلمات والعبارات التالية المعاني المبينة قرين كل منها، ما لم يقض سياق النص بغير ذلك:
| الدولة | : دولة الإمارات العربية المتحدة. |
| الهيئة | : الهيئة الاتحادية للبيئة |
| الجهات المعنية | : جميع الجهات المعنية بشؤون البيئة والتنمية داخل الدولة |
| الوحدة التنظيمية المختصة | : هي الإدارة أو الهيئة أو أي وحدة تنظيمية تنشئها الجهة المعنية لتولي إصدار التراخيص الخاصة بهذا النظام |
| البيئة | : المحيط الحيوي الذي تتجلى فيه مظاهر الحياة بأشكالها المختلفة ويتكون هذا المحيط من عنصرين: عنصر طبيعي: يضم الكائنات الحية من إنسان وحيوان ونبات، وغيرها من الكائنات الحية وموارد طبيعية من هواء وماء وتربة ومواد عضوية وغير عضوية، وكذلك الأنظمة الطبيعية. وعنصر غير طبيعي: يشمل كل ما أدخله الإنسان إلى البيئة الطبيعية من منشآت ثابتة وغير ثابتة وطرق وجسور ومطارات ووسائل نقل وما استحدثه من صناعات ومبتكرات وتقنيات. |
| تدهور البيئة | : التأثير على البيئة بما يقلل من قيمتها أو يشوه من طبيعتها البيئية أو يستنزف مواردها أو يضر بالكائنات الحية أو بالآثار. |
| تلوث البيئة | : التلوث الناجم بشكل طبيعي أو غير طبيعي عن قيام الإنسان بشكل مباشر أو غير مباشر، إرادي أو غير إرادي، بإدخال أي من المواد والعوامل الملوثة في عناصر البيئة الطبيعية . والذي ينشأ من جرائه أي خطر على صحة الإنسان أو الحياة النباتية أو الحيوانية أو أذى للموارد والنظم البيئية. |
| المواد والعوامل الملوثة | : أية مواد صلبة أو سائلة أو غازية أو أدخنة أو أبخرة أو روائح أو ضوضاء أو إشعاعات أو حرارة أو وهج الإضاءة أو اهتزازات تنتج بشكل طبيعي أو بفعل الإنسان وتؤدي بطريقة مباشرة أو غير مباشرة إلى تلوث البيئة وتدهورها أو الإضرار بالإنسان أو بالكائنات الحية. |
| تلوث الهواء | : كل تغيير في خصائص ومواصفات الهواء الخارجي وهواء أماكن العمل وهواء الأماكن العامة المغلقة وشبه المغلقة يترتب عليه خطر على صحة الإنسان والبيئة، سواء كان هذا التلوث ناتجا عن عوامل طبيعية أو نشاط إنساني. |
| التلوث المائي | : إدخال أية مواد أو طاقة في البيئة المائية بطريقة إرادية أو غير إرادية مباشرة أو غير مباشرة ينتج عنه ضرر بالموارد الحية أو غير الحية أو يهدد صحة الإنسان أو يعوق الأنشطة المائية بما في ذلك صيد الأسماك والأنشطة السياحية أو يفسد صلاحيتها للاستعمال أو ينقص من التمتع بها أو يغير من خواصها. |
| حماية البيئة | : المحافظة على مكوناتها وخواصها وتوازنها الطبيعي ومنع التلوث أو الإقلال منه أو مكافحته، والحفاظ على الموارد الطبيعية وترشيد استهلاكها وحماية الكائنات الحية التي تعيش فيها، خاصة المهددة بالانقراض، والعمل على تنمية كل تلك المكونات والارتقاء بها. |
| المواد الخطرة | : المواد الصلبة أو السائلة أو الغازية ذات الخواص الضارة بصحة الإنسان أو التي تؤثر تأثيراً ضاراً على البيئة، مثل المواد السامة أو القابلة للانفجار أو للاشتعال أو ذات الإشعاعات المؤينة. |
| المواد الضارة | : جميع المواد التي تؤدي بطريقة مباشرة أو غير مباشرة إلى الإضرار بصحة الإنسان أو البيئة، سواء كانت هذه المواد كيميائية أو بيولوجية أو مشعة. |
| النفايات | : جميع أنواع المخلفات أو الفضلات الخطرة وغير الخطرة بما فيها النفايات النووية والتي يجري التخلص منها أو المطلوب التخلص منها بناءً على أحكام القانون وتشمل: النفايات الصلبة: مثل النفايات المنزلية والصناعية والزراعية والطبية ومخلفات التشييد والبناء والهدم. النفايات السائلة: وهي الصادرة عن المساكن والمنشآت التجارية والصناعية وغيرها. النفايات الغازية والدخان والأبخرة والغبار: وهي الصادرة عن المنازل والمخابز والمحارق والمصانع والكسارات ومقالع الأحجار ومحطات الطاقة وأعمال النفط ووسائل النقل والمواصلات المختلفة. النفايات الخطرة: مخلفات الأنشطة والعمليات المختلفة أو رمادها المحتفظة بخواص المواد الخطرة. النفايات الطبية: أية نفايات تشكل كلياً أو جزئياً من نسيج بشري أو حيواني أو دم أو سوائل الجسم الأخرى أو الإفرازات أو العقاقير أو المنتجات الصيدلانية الأخرى أو الضمادات أو الحقن أو الإبر أو الأدوات الطبية الحادة أو أية نفايات اخرى معدية أو كيميائية أو مشعة ناتجة عن نشاطات طبية أو تمريض أو معالجة أو رعاية صحية أو طب أسنان أو صحة بيطرية أو ممارسات صيدلانية أو تصنيعية أو غيرها أو فحوصات أو أبحاث أو تدريس أو أخذ عينات أو تخزينها. |
| التداول والتعامل | : استيراد / نقل / تخزين / إنتاج / استخدام / اتجار / أي أنشطة أخرى. |
| إدارة النفايات | : جمع النفايات وتخزينها ونقلها وإعادة تدويرها والتخلص منها بما في ذلك العناية اللاحقة بمواقع التخلص منها. |
| تداول النفايات | : جميع العمليات التي تبدأ من وقت تولد النفايات إلى حين التخلص الآمن منها، وتشمل جمع النفايات وتخزينها ونقلها ومعالجتها وتدويرها أو التخلص منها. |
| التخلص من النفايات | : العمليات التي لا تؤدي إلى استخلاص المواد أو إعادة استخدامها، مثل الطمر في الأرض أو الحقن العميق أو المعالجة البيولوجية أو الفيزيائية/ الكيميائية أو التخزين الدائم أو التدمير أو أية طريقة تقرها الجهات المعنية. |
| إعادة تدوير النفايات | : العمليات التي تجري على النفايات بهدف استخلاص المواد أو إعادة استخدامها، مثل الاستخدام كوقود أو استخلاص المعادن والمواد العضوية أو معالجة التربة أو إعادة تكرير الزيوت. |
| المنشأة | : المنشآت الصناعية والسياحية ومنشآت إنتاج وتوليد الكهرباء والمنشآت العاملة في مجال الكشف عن الزيت واستخراجه ونقله واستخدامه وجميع مشروعات البنية الأساسية وأية منشأة أخرى. |
| الزيت | : جميع أشكال النفط الخام ومنتجاته، ويشمل ذلك أي نوع من أنواع الهيدروكربونات السائلة وزيوت التشحيم وزيوت الوقود والزيوت المكررة وزيت الأفران والقار وغيرها من المواد المستخرجة من النفط أو مشتقاته أو نفاياته. |
| التصريف | : كل تسرب أو انسكاب أو انبعاث أو تفريغ لأي نوع من المواد الملوثة أو التخلص منها في البيئة المائية أو التربة أو الهواء. |
| الإغراق | : أ. كل إلقاء متعمد في البيئة البحرية للمواد الملوثة أو الفضلات من السفن أو الطائرات أو الأرصفة أو غيرها. ب. كل إغراق متعمد في البيئة البحرية للسفن أو التركيبات الصناعية أو غيرها. |
| مركبات النقل | : الطائرات أو السيارات أو القطارات أو الجرارات أو الدراجات الآلية أو غير ذلك من الآلات المعدة للسير على الطرق. |
المادة (2)
الجهات المعنية
يحظر التداول أو التعامل بالمواد الخطرة والنفايات الخطرة والنفايات الطبية بغير ترخيص يصدر من الجهات المعنية وفقا لما هو محدد بالجدول التالي كل فيما يخصه:

المادة (3)
متطلبات عامة
يصدر الوزراء أو رؤساء أو مدراء الجهات المعنية كل في نطاق اختصاصه وبالتنسيق مع الهيئة، الإجراءات الإدارية والفنية اللازمة للتداول والتعامل بالمواد الخطرة والنفايات الخطرة والنفايات الطبية، على أن تتضمن هذه الإجراءات على الأخص ما يلي:
- إنشاء وحدة تنظيمية مختصة لإصدار تراخيص للمواد أو النفايات الخطرة الواردة في المادة (2) من هذا النظام.
- إنشاء قواعد معلومات وطنية عن المواد الخطرة والنفايات الخطرة والنفايات الطبية.
- القيام بالتعاون مع الجهات المعنية والمنظمات الدولية بمتابعة المواد الخطرة والنفايات الخطرة المحظورة أو المقيدة دولياً واتخاذ الإجراءات اللازمة على المستوى الوطني.
- تقييم طلبات الترخيص بالأعمال والممارسات الواردة في المادة (2) من هذا النظام وإصدار الترخيص لها.
- فحص المواد الخطرة وتعيين خطورتها بواسطة المختبرات والأجهزة المختصة إذا دعت الحاجة.
- التنسيق مع الجهات المعنية داخل الدولة فيما يتعلق بالدراسات التحليلية للملوثات.
- التوعية بالمخاطر البيئية والصحية المحتملة الناتجة عن الاستخدام غير الرشيد للمواد الخطرة.
- أية ضوابط أو شروط أخرى ترى الوزارة أو البلدية أهمية إضافتها بالتنسيق مع الهيئة الاتحادية للبيئة.
المادة (4)
الترخيص
دون الإخلال بالشروط والإجراءات الخاصة بكل عملية من عمليات التداول والتعامل بالمواد الخطرة والنفايات الخطرة والنفايات الطبية وفقاً لما هو وارد في هذا النظام، على طالب الترخيص تقديم طلبه إلى الجهات المعنية المنصوص عليها في المادة (2) من هذا النظام وذلك وفقاً للإجراءات والشروط الآتية:
1. إجراءات منح الترخيص:
يصدر الترخيص بالتداول والتعامل بالمواد الخطرة والنفايات الخطرة والنفايات الطبية لمدة سنة واحدة من قبل الوحدة التنظيمية المختصة وعلى النحو التالي:
أ. يجب على أية جهة ترغب في تنفيذ أي من الممارسات أو الأعمال الواردة في المادة (2) من هذا النظام أن تقدم طلبها إلى الوحدة التنظيمية المختصة للحصول على ترخيص بالممارسة أو العمل.
ب. يجب على كل من يتقدم بطلب إلى الوحدة التنظيمية المختصة أن يرفق مع طلبه جميع البيانات والمعلومات اللازمة لتدعيم طلبه وعلى الأخص ما يلي:
- بيانات تتعلق بالقائم بتداول المواد الخطرة والنفايات الخطرة والنفايات الطبية:
- اسم المنشأة وجنسيتها
- العنوان ورقم الهاتف
- موقع المنشأة ومساحتها ( بالإضافة إلى المخازن)
- معدات الأمان المتوفرة لدى المنشأة
- برنامج رصد البيئة المحيطة بالمنشأة
- الجهة المنتجة للمواد أو النفايات الخطرة والنفايات الطبية:
- اسم المنشأة وجنسيتها
- العنوان ورقم الهاتف
- نوع التداول أو التعامل المزمع الحصول على ترخيص بشأنه.
- توصيف كامل للمواد الخطرة والنفايات الخطرة والنفايات الطبية المزمع التعامل بها وطبيعة وتركيز العناصر الخطرة بها، حسب التصنيف العالمي المتبع في الجدول رقم 1-1 من الملحق رقم 1 من هذا النظام.
- تحديد كمية المواد الخطرة والنفايات الخطرة والنفايات الطبية المزمع تداولها سنوياً ووصف أسلوب تعبئتها (برميل - صهريج - سائب .. إلخ.)
- توصيف الوسائل المزمع استخدامها لتخزين المواد الخطرة والنفايات الخطرة والنفايات الطبية وفترة التخزين لكل منها، مع تعهد بكتابة بيان واضح على العبوة للإعلام عن محتواها ومدى خطورتها وكيفية التصرف في حالة الطوارئ.
- توضيح وسائل النقل.
- بيان شامل عن الأسلوب المزمع اتباعه في معالجة وتصريف المواد الخطرة والنفايات الخطرة والنفايات الطبية المطلوب الترخيص بتداولها.
- تعهد بالاحتفاظ بسجلات تتضمن بياناً وافياً بكميات المواد الخطرة والنفايات الخطرة والنفايات الطبية ومصادرها ومعدلات وفترات تجميعها وطريقة نقلها وأسلوب معالجتها، والاحتفاظ بهذه السجلات لمدة خمسة أعوام من تاريخ بدء استخلاصها.
- شهادة بالخبرة السابقة في مجال تداول المواد الخطرة والنفايات الخطرة والنفايات الطبية.
- أن تقوم الجهة صاحبة الترخيص بإعداد خطة طوارئ لمواجهة الحوادث وتقديمها للوحدة التنظيمية المختصة لاعتمادها.
ج . يجوز للوحدة التنظيمية المختصة أن توقف العمل بالترخيص أو أن تمنع منح الترخيص أو أن تلغيه نهائيا إذا ثبت حدوث انتهاكات أو مخالفات أو عدم الالتزام بالمتطلبات الواردة في القانون الاتحادي رقم 24 لعام 1999م بشأن حماية البيئة وتنميتها أو في هذا النظام.
2. شروط منح الترخيص:
يشترط لمنح الترخيص ما يلي:
- استيفاء كافة البيانات المطلوبة.
- توافر الكوادر المدربة المرخص لها والمسؤولة عن تداول المواد الخطرة والنفايات الخطرة والنفايات الطبية.
- موافقة الهيئة الاتحادية للبيئة على صلاحية تلك الكوادر للتعامل في مجال المواد الخطرة، أو الحصول على شهادة إنجاز دورة المواد الخطرة التخصصية من معهد الدفاع المدني.
- توافر متطلبات مواجهة الأخطار التي قد تنتج عن حوادث أثناء التداول.
- أن لا ينتج عن النشاط المراد الترخيص له آثار ضارة بالبيئة والصحة العامة.
- إبراز خطة إدارة حالة الطوارئ في الموقع.
المادة (5)
استيراد المواد الكيماوية الخطرة
- لا يجوز للجهة طالبة الترخيص استيراد أي مادة خطرة من المواد الواردة في الجدول 1-1 من الملحق رقم (1) من هذا النظام بغرض الاتجار أو الاستخدام المتعدد لها إلا بعد الحصول على موافقة الوحدة التنظيمية المختصة.
- على صاحب الترخيص استيفاء البيانات الواردة بالاستمارة الخاصة بالاستيراد والمعدة بمعرفة الوحدة التنظيمية المختصة وتقديمها لها قبل 15 يوماً من إتمام عملية الاستيراد مرفقاً بها بطاقة السلامة الكيماوية (MSDS) متضمنة ما يلي:
- اسم المادة الخطرة العلمي والتجاري وتركيبها الكيماوي.
- الرقم المسلسل الخاص بالأمم المتحدة وتسلسل المادة حسب خدمات (CAS).
- الصفات الفيزيائية والكيميائية للمادة الخطرة.
- درجة خطورة المادة وتأثيراتها الصحية والبيئية.
- كمية المادة الخطرة المراد استيرادها.
- تاريخ ووقت النقل المتوقع.
- الغرض من الاستيراد.
- الطرق المثلى لتخزين المادة والتخلص منها.
- الإجراءات الواجب اتخاذها عند حدوث أي تسرب للمادة الخطرة.
- الإجراءات الواجب اتخاذها للتعامل مع الحرائق الناشئة عن المادة الخطرة.
- شهادة المنشأ والاختبار في الدول المصدرة للمادة.
- تاريخ إنتاج المادة الكيماوية ومدة صلاحيتها.
- الإسعافات الأولية للإصابات الناتجة عن التعرض للمادة عن طريق الفن أو الجلد أو الاستنشاق أو الابتلاع.
- معدات وملابس الحماية الشخصية عند التعامل مع المادة.
المادة (6)
تعبئة المواد الكيماوية الخطرة
- يجب تعبئة المواد الخطرة في عبوات ذات نوعية جيدة قابلة لتحمل كل ظروف النقل والتداول وتأثيرات الاهتزاز والتغيرات الحرارية وأن تكون محكمة الغلق.
- يجب أن تكون العبوات متوافقة لكل المواد الخطرة مع المواد التي توضع بها بحيث لا تتأثر بالمواد المعبأة أو تؤثر فيها.
- يجب أن تغلق العبوات الداخلية أو تثبت أو توضع على مادة تبطين من أجل منع كسرها أو حدوث تسرب منها ومن أجل السيطرة على حركتها ضمن العبوة الخارجية.
- يجب أن تكون العبوة بحجم يسمح بوجود مساحة كافية تلصق كل العلامات وبطاقات المعلومات المطلوبة بموجب بطاقة السلامة الكيميائية (MSDS).
- يجب أن تلصق البطاقات على كل عبوة بمادة متينة كافية لتحمل ظروف النقل العادية ولضمان أن البطاقة والمعلومات التي عليها غير قابلة للتلف أو للمحو.
المادة (7)
نقل المواد الكيماوية الخطرة
يشترط لنقل المواد الكيماوية الخطرة ما يلي:
- أن تنقل المواد بطريقة آمنة ضمن حدود السرعة المقررة.
- تثبيت لوحات معدنية على السطح الخارجي من جميع الجوانب لوحدات النقل للتحذير من محتوى الخزان ومدى خطورته، وأن تكون مطلية بطلاء عاكس باللون المطلوب وله مقاومة لظروف الطقس.
- أن يكون بناء حاويات الصهاريج الخاصة بنقل المواد الخطرة حسب القواعد الفنية المعتمدة محلياً أو دولياً.
- أن يكون سائقي المركبات المتعاملين مع المواد الخطرة مدربين ومرخصاً لهم، مع توافر خطط جاهزة للطوارئ والحوادث.
- يجب على جميع المركبات الناقلة للمواد الكيماوية الخطرة بصورة غير معبأة أن تستخدم مصباحاً أصفر متقطع الإضاءة يكون مثبتاً على مقطورة السائق، وفي حالة تشغيل موانع المدة التي تستغرقها عملية النقل.
- أن تتوفر لدى السائق وثائق تشمل المعلومات الرئيسية الضرورية للمواد الخطرة المنقولة (الاسم الكيماوي العلمي ورقم الأمم المتحدة)، ويجوز لشرطة المرور في كل الأوقات إيقاف أية مركبة وعمل الفحوصات وإجراءات التفتيش اللازمة لتحديد سلامة المركبة، ويجب أن يلتزم السائقون المتعاونون بالدولة بالشروط الواردة بهذه المادة.
- تتولى الهيئة والجهات المعنية التنسيق مع الإدارات المختصة بوزارة الداخلية في تنفيذ أحكام هذه المادة.
المادة (8)
تخزين المواد الكيماوية الخطرة
على صاحب المخزن المخصص له الالتزام بما يلي:
- تصميم المخزن بشكل يحد من خطر الحريق والانسكاب والإصابات.
- توفير مخارج للطوارئ سهلة الفتح في الظلام أو في حالات الدخان الكثيف.
- توفير التهوية المناسبة الكافية.
- أن تكون أرضيات المخزن منفذة للسوائل، وأن تكون ناعمة غير زلقة وخالية من التشققات للسماح بالتنظيف السهل وأن تصمم بحيث تحوي التسرب ومياه مقاومة الحريق.
- استخدام آلات وأجهزة صامدة للاستعمال عند تخزين مذيبات ذات نقطة وميض منخفضة أو الكيماويات التي تولد بخاراً دفيناً.
- توفير ترتيبات التخزين وتوفير أرضيات مناسبة وأسقف أو أغطية للحماية من الشمس والمطر عند تخزين المواد الخطرة في الهواء الطلق.
- توفير أجهزة الإطفاء المناسبة في مواقع يسهل الوصول إليها مع وجود نظام إنذar للحريق وضرورة الفحص الدوري للتأكد من الصلاحية.
- رص المواد بطريقة لا تعيق حركة الرافعات الشوكية ومعدات المناولة أو معدات الطوارئ.
- فصل المواد الخطرة حسب نظام تصنيف الأمم المتحدة والمتطلبات الواردة في الجدول رقم (1-3) من الملحق رقم (1) من هذا النظام.
- أن يتاح تخزين المواد الكيماوية الخطرة ضمن المنشآت الصناعية، وأن تكون هناك مسافة فصل بواقع 3 أمتار عن أي مرفق إنتاج للمواد غير القابلة للاشتعال و10 أمتار بين المواد القابلة للاشتعال وأي مصدر احتراق.
- الاحتفاظ بسجلات كاملة عن المواد الخطرة الموجودة في المخازن والاحتفاظ بنسخة منها في المكتب الرئيسي.
- التعامل مع الانسكاب والتسرب بعد الرجوع إلى بيانات بطاقة السلامة الكيماوية (MSDS) الملائمة.
- وضع خطة لإدارة حالات الطوارئ في الموقع.
- التخلص السليم من كل العبوات التالفة مع المحافظة على نظافة المنطقة بشكل مستمر.
- رصد حالات الطوارئ والاحتفاظ بسجلات للحوادث مع بيان طرق التعامل معها والخطوات التي تتخذ لمنع تكرارها.
المادة (9)
مناولة المواد الكيماوية الخطرة
يجب التقيد بدقة بتعليمات المناولة التي تحددها الجهة المنتجة وفقاً لطبيعة كل مادة، بما في ذلك أية احتياطات خاصة لحماية العاملين والبيئة.
المادة (10)
القواعد والإجراءات العامة لإدارة النفايات الخطرة
1. تولد النفايات الخطرة
تلتزم الجهة التي يتولد لديها نفايات خطرة بالآتي:
- العمل على خفض معدل تولد هذه النفايات كمّاً ونوعاً وذلك بتطوير التكنولوجيا المستخدمة واتباع مبدأ الإنتاج النظيف واختيار بدائل للمنتج أو المواد الأولية تكون أقل ضرراً على البيئة.
- توصيف النفايات المتولدة كماً ونوعاً وتسجيلها.
- إنشاء وتشغيل وحدات لمعالجة النفايات عند المصدر بشرط موافقة الجهة المعنية على أسلوب المعالجة وعلى المواصفات الفنية لهذه الوحدات وبرامج التشغيل. وعند تعذر المعالجة أو التخلص من النفايات الخطرة عند مصدر تولدها، تلتزم الجهة التي يتولد لديها هذه النفايات بجمعها ونقلها إلى أماكن التخلص المعدة لذلك، والتي تحددها الجهة المعنية.
2. تجميع وتخزين النفايات الخطرة
تلتزم الجهة التي يتولد لديها نفايات خطرة بالآتي:
- تحديد أماكن معينة لتخزين النفايات الخطرة، تتوفر بها شروط الأمان التي تحول دون حدوث أية أضرار عامة.
- تخزين النفايات الخطرة في حاويات خاصة مصنوعة من مادة صماء وخالية من الثقوب لا تتسرب منها السوائل والأبخرة ومزودة بغطاء محكم وتتناسب سعتها مع كمية النفايات الخطرة.
- توضع العلامة التحذيرية الدولية الخاصة بما تحويه حاويات تخزين النفايات الخطرة، وتعرف بالأخطار التي قد تنجم عند التعامل معها بطريقة غير صحيحة.
- يوضع برنامج زمني لتجميع النفايات الخطرة بحيث لا تترك فترة طويلة في حاويات التخزين.
- يلتزم مولد النفايات الخطرة في حالة استخدام الحاويات المتنقلة بعد موضعها في الأماكن العامة أو الإضرار بالبيئة.
3. نقل النفايات الخطرة
يحظر نقل النفايات الخطرة بغير وسائل النقل التابعة للجهات المرخصة لها بإدارة النفايات الخطرة، ويجب أن تتوفر في هذه الوسائل الاشتراطات التالية:
- أن تكون مركبات النقل مجهزة بكافة وسائل الأمان.
- أن تكون مركبات نقل النفايات الخطرة قادرة على احتواء النفايات الخطرة دون حدوث تسرب.
- أن تكون سعة مركبات النقل مناسبة لكميات النفايات الخطرة.
- أن يتولى قيادة هذه المركبات نوعية مدربة من السائقين المرخص لهم قادرة على حسن التصرف خاصة في الحالات الطارئة.
- أن توضع على المركبات علامة واضحة تحدد مدى خطورة حمولتها ، والأسلوب الأمثل للتصرف في حالة الطوارئ.
- تحديد خطوط سير مركبات نقل النفايات الخطرة، وإخطار سلطات الدفاع المدني فوراً بأي تغير يطرأ عليها بما يسمح لها بالتصرف السريع والسليم في حالة الطوارئ.
4. معالجة وتصريف النفايات الخطرة
- تلتزم الجهة المرخص لها بالتنسيق مع الجهات المعنية باختيار مواقع مرافق معالجة وتصريف النفايات الخطرة في منطقة تبعد عن التجمعات السكانية والعمرانية بمسافة لا تقل عن 5 كيلومترات مع الأخذ بعين الاعتبار الظروف البيئية لمنطقة الموقع المختار، ويجب أن تتوفر بها الاشتراطات والمعدات والمنشآت التالية:
- تتناسب مساحة الموقع وكمية النفايات الخطرة المتوقع تجميعها.
- يحاط الموقع بسور من الطابوق بارتفاع لا يقل عن 2.5 متر.
- يزود الموقع بأكثر من باب ذي سعة مناسبة تسمح بدخول مركبات نقل النفايات الخطرة بسهولة.
- يزود الموقع بمصدر مائي ودورات مياه وخط هاتف.
- يزود الموقع بكافة المعدات الميكانيكية التي تيسر حركة العمل به.
- يزود الموقع بمخازن مجهزة لحفظ النفايات الخطرة لحين معالجتها وتصريفها.
- يزود المرفق بمحرقة لترميد النفايات الخطرة بمختلف أنواعها.
- يزود المرفق بالمعدات والمنشآت اللازمة لفرز وتصنيف بعض النفايات الخطرة بغية إعادة استخدامها وتدويرها.
- يزود الموقع بحفرة للردم الصحي بسعة مناسبة لدفن مخلفات الحرق.
- تجري عملية معالجة النفايات الخطرة المعاملة لإعادة الاستخدام والتدوير في الإطار التالي:
- إعادة استخدام بعض النفايات الخطرة كوقود لتوليد الطاقة.
- استرجاع المذيبات العضوية وإعادة استخدامها في عمليات الاستخلاص.
- تدوير وإعادة استخدام بعض المواد العضوية من النفايات الخطرة.
- إعادة استخدام المعادن الحديدية وغير الحديدية ومركباتها.
- تدوير وإعادة استخدام بعض المواد غير العضوية من النفايات الخطرة.
- استرجاع وتدوير الأحماض أو القواعد.
- استرجاع الزيوت المستعملة وإعادة استخدامها بعد تكريرها.
- تجري عمليات معالجة النفايات الخطرة غير القابلة لإعادة الاستخدام والتدوير في الإطار التالي:
- ردم النفايات الخطرة في حفر ردم خاصة مجهزة ومعزولة عن باقي عناصر البيئة.
- معالجة النفايات الخطرة فيزيائياً أو كيميائياً.
- الترميد في محارق خاصة مجهزة بحيث لا تسمح بانبعاث الغازات والأبخرة بشكل يضر بالبيئة المحيطة.
- التخزين الدائم (مثل وضع حاويات النفايات الخطرة في باطن الأرض).
- اتخاذ كافة الإجراءات التي تكفل الحد والإقلال من تولد النفايات الخطرة من خلال:
- تطوير التكنولوجيا النظيفة وتعميم استخدامها.
- تطوير نظم مناسبة لإدارة النفايات الخطرة.
- التوسع في إعادة استخدام النفايات الخطرة بعد معالجتها كلما أمكن ذلك.
- وضع برنامج دوري لرصد مخلفات النفايات الخطرة وتواجدها أو تواجد آثارها في عناصر النظام البيئي في مواقع ومرافق معالجة وتصريف النفايات الخطرة وما يحيطها.
- أن تكون الجهات المرخص لها بتداول وإدارة المواد الخطرة والنفايات الخطرة مسؤولة عن الأضرار التي تلحق بالغير من جراء عدم مراعاة هذا النظام.
المادة (11)
- يحظر إقامة أي منشآت بغرض معالجة النفايات الخطرة إلا بترخيص من الجهة المعنية وذلك بالتنسيق مع الهيئة الاتحادية للبيئة وفق ما هو منصوص عليه في المادة (2) من هذا النظام وبما يضمن استيفاء المنشأة لكافة الشروط التي تضمن سلامة البيئة والعاملين فيها.
- ويكون التخلص من النفايات الخطرة طبقا للشروط والمعايير المنصوص عليها في المادة (10) من هذا النظام.
- وتحدد الجهة المعنية وبالتنسيق مع الهيئة الاتحادية للبيئة أماكن وشروط الترخيص للتخلص من النفايات الخطرة.
المادة (12)
فيما يختص بالنفايات الخطرة المنتجة محليا فإن الرقابة على نقلها والتخلص منها عبر الحدود البرية وحدود البيئة البحرية والمجال الجوي تتم وفق الضوابط والقواعد والإجراءات الواردة باتفاقية بازل وبالتنسيق مع الهيئة الاتحادية للبيئة.
المادة (13)
على القائمين على إنتاج أو تداول النفايات الخطرة، سواء كانت في حالتها الغازية أو السائلة أو الصلبة أن يتخذوا جميع الاحتياطات اللازمة لضمان عدم حدوث أي أضرار بيئية، وعليهم بوجه خاص مراعاة ما يلي:
- اختبار الموقع الذي يتم فيه إنتاج أو تخزين هذه المواد طبقاً للشروط اللازمة حسب نوعية وكمية هذه المواد.
- أن تكون الأبنية التي يتم داخلها إنتاج أو تخزين تلك المواد مصممة وفق الأصول الهندسية الواجب مراعاتها لكل نوع من تلك المواد، وتخضع تلك الأبنية للتفتيش الدوري عن طريق الوحدة التنظيمية المختصة.
- أن تكون التكنولوجيا المستخدمة لإنتاج تلك المواد وكذلك التجهيزات والأجهزة المناسبة لا يترتب عليها إضرار بالمنشآت أو البيئة أو العاملين.
- أن يتوفر بالأبنية نظم وأجهزة الأمان والإنذار والوقاية والمكافحة، والإسعافات الأولية بالكميات والأعداد المناسبة وذلك بالتنسيق مع وزارة الصحة وإدارة الدفاع المدني والوحدة التنظيمية المختصة.
- أن تتوفر خطة طوارئ لمواجهة أي حادث متوقع أثناء إنتاج أو تخزين أو نقل أو تداول تلك المواد، على أن يتم اعتماد هذه الخطة من قبل الوحدة التنظيمية المختصة.
- أن يخضع العاملون في هذه الجهات المداولة للمواد الخطرة والنفايات الخطرة للكشف الطبي الدوري، على أن تحفظ نتائج هذا الكشف في ملف كل من العاملين، وأن يتم علاجهم من الأمراض المهنية وفق القوانين والنظم والقواعد المرعية في دولة الإمارات العربية المتحدة.
المادة (14)
على صاحب المنشأة التي ينتج عن نشاطها نفايات خطرة طبقاً لأحكام هذا النظام الاحتفاظ بسجل لهذه النفايات بحيث يشمل:
- - توصيف كامل للنفايات يوضح مرتبة خطورتها وخواصها الفيزيائية والكيميائية.
- - كمياتها.
- - مصادرها.
- - معدلات وفترات تجميعها.
- - طريقة نقلها.
- - أسلوب معالجتها.
- - اسم الجهة المتعاقد معها لتسلم هذه النفايات.
المادة (15)
القواعد والإجراءات العامة لإدارة النفايات الطبية:
- يحظر على المنشآت الصحية العامة والخاصة أياً كان نوعها أن تتخلص من النفايات الطبية الواردة في الجدول رقم 2-1 من الملحق رقم (2) من هذا النظام خارج الحاويات المعدة لها طبقاً للإرشادات التي تضعها وزارة الصحة والبلديات.
- تلتزم كل منشأة صحية بفصل نفاياتها الطبية عن نفاياتها الأخرى وعدم الخلط بينها.
- تلتزم كل منشأة صحية بفرز نفاياتها الطبية وفقاً لجدول التصنيف الوارد في الجدول رقم 2-1 في الملحق رقم 2 من هذا النظام.
- يتم تعبئة مجموعات النفايات المنصوص عليها في الفقرة السابقة في عبوات أو حاويات على النحو الوارد في الجدول رقم 2-2 في الملحق رقم (2) من هذا النظام.
- يتم التخلص من النفايات الطبية على النحو التالي:
- داخل المنشآت الصحية وذلك باستخدام الوسائل والمعدات السليمة بيئياً (الحرق أو غيره.)
- في الموقع المعد لهذا الغرض وذلك بالتنسيق مع الجهات المعنية والمزودة بالمعدات المخصصة للمعالجة (الحرق أو غيره.)
- تلتزم المنشأة الصحية أو المسؤولون عن نقل النفايات الطبية بتعبئة ونقل وتخزين هذه النفايات على النحو الوارد في الجدول رقم 2-3 في الملحق رقم (2) من هذا النظام، ويجب على من يقوم بتعبئة ونقل وتخزين النفايات أن يكون من المختصين المؤهلين والمرخص لهم بهذا العمل.
أحكام ختامية:
المادة (16)
لا تسري أحكام هذا النظام على عمليات تخزين ونقل وتداول المواد والنفايات المشعة.
المادة (17)
على الجهات التي تطبق نظماً وبرامج متكاملة لحماية وتنمية البيئة تكفي لتحقيق أهداف هذا النظام أن تتقدم للهيئة بهذه النظم والبرامج لاعتمادها من مجلس إدارة الهيئة، وتعفى الجهة التي يصدر باعتماد نظمها وبرامجها قرار من مجلس إدارة الهيئة من تطبيق أحكام هذا النظام.
المادة (18)
تسري الأحكام الواردة بنظام مبيدات الآفات والأسمدة والمصلحات الزراعية على المواد والنفايات الخطرة الزراعية ومخلفاتها.
المادة (19)
يعتبر هذا النظام جزءاً من اللائحة التنفيذية للقانون الاتحادي رقم (24) لعام 1999م. بشأن حماية البيئة وتنميتها ولموظف الهيئة والسلطات المختصة الذين تقررت لهم صفة مأموري الضبط القضائي أن يضبطوا أية مخالفة لأحكامه وأن يحيلوا المخالفات طبقاً للإجراءات المعمول بها في الدولة إلى السلطات القضائية المختصة لتطبيق العقوبات المقررة قانوناً.

تصنيف المواد الخطرة
تصنف المواد الخطرة التي يشملها هذا النظام إلى الآتي مع مراعاة الرجوع إلى التوجيهات الحالية للأمم المتحدة:

جدول 1-2
تصنيف النفايات الخطرة
أ. النفايات المتدفقة باستمرار:
- النفايات المتخلفة عن صنع المواد الكيميائية الواقية للأخشاب وتجهيزها واستخدامها.
- النفايات المتخلفة عن إنتاج المذيبات العضوية وتجهيزها واستخدامها.
- النفايات المتخلفة عن المعالجة الحرارية وعمليات التطبيع المحتوية على السيانيد.
- النفايات من الزيوت المعدنية غير الصالحة للاستعمال المستهدف منها أصلاً.
- النفايات من الزيوت المياه ومزائج الهيدركربونات / المياه والمستحلبات.
- النفايات من المواد والمركبات المحتوية على ثنائيات الفنيل ذات الروابط الكلورية المتعددة (PCBs) و/أو ثنائيات الفنيل ذات الروابط البرومية المتعددة (PBBs).
- النفايات من الرواسب القطرانية الناجمة عن التكرير والتقطير وأي معالجة بالتحليل الحراري.
- النفايات المتخلفة عن إنتاج الأحبار والأصباغ والمواد الملونة والدهانات والطلاءات والورنيش وعن تجهيزها واستخدامها.
- النفايات المتخلفة عن إنتاج الراتينجات ومستحلبات الأصماغ والملدنات والغراء / المواد اللاصقة وعن تجهيزها واستخدامها.
- النفايات من المواد الكيميائية الناجمة عن أنشطة البحث والتطوير أو عن أنشطة تعليمية غير محددة التصنيف و/أو جديدة وتعرف آثارها على الإنسان أو البيئة.
- النفايات ذات الطبيعة الانفجارية التي لا تخضع لتشريع آخر.
- النفايات المتخلفة عن إنتاج المواد الكيميائية ومواد المعالجة الفوتوغرافية وعن تجهيزها واستخدامها.
- النفايات الناتجة عن المعالجة السطحية للمعادن واللدائن.
- الرواسب الناجمة عن عمليات التخلص من النفايات الصناعية.
ب. النفايات التي يدخل في تركيبها التالي:
- الكربونيلات المعدنية.
- البريليوم – مركبات البريليوم.
- مركبات الكروم سداسية التكافؤ.
- مركبات النحاس.
- مركبات الزنك.
- الزرنيخ - مركبات الزرنيخ.
- السلنيوم – مركبات السلنيوم.
- الكادميوم – مركبات الكادميوم.
- الأنتيمون - مركبات الأنتيمون.
- التلوريوم – مركبات التلوريوم.
- الزئبق - مركبات الزئبق.
- الثاليوم – مركبات الثاليوم.
- الرصاص - مركبات الرصاص.
- مركبات الفلور غير العضوية فيما عدا فلوريد الكالسيوم.
- مركبات السيانيد غير العضوية.
- المحاليل الحمضية أو الأحماض في الحالة الصلبة.
- المحاليل القلوية أو القلويات في الحالة الصلبة.
- الإسبستوس (غبار وألياف).
- مركبات الفسفور العضوية.
- مركبات السيانيد العضوية.
- الفينول - مركبات الفينول بما في ذلك الكلوروفينول.
- مركبات الأثير.
- المذيبات العضوية المهلجنة.
- المذيبات العضوية فيما عدا المذيبات المهلجنة.
- أي مادة مماثلة للفوران ثنائي البنزين ذي الروابط الكلورية المتعددة.
- أي مادة مماثلة للديوكسين - ثنائي البنزين ذو الروابط الكلورية المتعددة.
- مركبات الهالوجين العضوية عدا المواد المشار اليها في هذا الجدول.

ملاحظة:
يتم تحديد الفصل بين فئتين مختلفتين من المواد الخطرة باستخدام الرمز الموضوع عند تقاطع الخط العمودي الذي يمثل الفئة الأولى والخط الأفقي الذي يمثل الفئة الأخرى.
- يجب أن يكون الفصل على بعد 3م على الأقل.
- يجب أن يكون الفصل على بعد 5م على الأقل.
- يمنع تخزينها في نفس الغرفة أو المساحة، على أن تكون أقل مسافة فصل بين مناطق التخزين 10م.

جدول 2-1
تصنيف النفايات الطبية
1. نفايات المجموعة أ:
الضمادات والأربطة والفرش المتسخة وغيرها من النفايات الملوثة مثل الأقمشة - بخلاف الملابس والبياضات – الناجمة عن معالجة الأمراض المعدية، وكل الأنسجة البشرية (الملوثة وغير الملوثة)، والبقايا الحيوانية، وكل ما تفترشه الحيوانات أو يستخدم للحيوانات من أقمشة أو مواد سواء كانت ملوثة أو يحتمل أن تكون ملوثة، وكل ما يتعلق بذلك من خرق أو ضمادات وغيرها.
2. نفايات المجموعة ب:
المحاقن والإبر المستخدمة والمعدات الجراحية ومختلف أوعية الأدوية والمواد الطبية والزجاج المكسور، وكل الأدوات والمعدات والمواد الحادة الأخرى.
3. نفايات المجموعة ج:
نفايات مختبرات الدم والأنسجة والميكروبيولوجي وغيرها وحجرات حفظ الموتى التي لم تدرج تحت المجموعة (أ) أو المجموعة (ب)
4. نفايات المجموعة د:
النفايات الصيدلانية والنفايات الكيميائية التي تنطبق عليها مواصفات النفايات الطبية.
5. نفايات المجموعة هـ:
البطانات المستخدمة في أسرّة المرضى لتغطية الأوعية التي تتلقى إفرازاتهم والتي تستخدم لمرة واحدة ثم يتم التخلص منها، وأغطية الزجاجات والأوعية المستقبلة والمخزنة للبول، ولبادات امتصاص البول أو الغائط أو تنظيفه ، وأكياس أو أوعية استقبال الفضلات المعوية، وما شابه ذلك.
6. نفايات المجموعة و:
النفايات الناتجة عن العلاج بالمواد المشعة والنفايات الناتجة عن جميع العمليات المتعلقة بالنظائر المشعة يتبع فيها التصنيف حسب الأصول العالمية.
الجدول 2-2
تحديد العبوات والحاويات
1. بالنسبة لنفايات المجموعة أ:
يجب استخدام أكياس قوية التحمل جداً من البولي إثيلين ( عيار (400) حمراء اللون مكتوب عليها بوضوح «نفايات معدية - للإحراق فقط» وذلك لتعبئة كل النفايات الواردة في المجموعة (أ) والمجموعة (هـ) من الجدول رقم 2-1 في الملحق رقم (2).
2. بالنسبة لنفايات المجموعة ب:
يجب استخدام علب بلاستيكية من مادة البولي إثيلين تكون قوية جداً ذات سمك كبير صفراء اللون والمعروفة عالميا باسم (صناديق المواد الحادة) يكتب عليها «مواد حادة - للإحراق فقط» الواردة في المجموعة (ب) من الجدول رقم 2-1 في الملحق رقم (2). ويجب أن تكون الصناديق المذكورة والمستخدمة لحفظ هذه النفايات مغلقة بإحكام بسدادة أو قفل أو غيرها بطريقة لا يمكن فتحها ، وألا تتم تعبئتها بأكثر من 75% من طاقتها الاستيعابية.
3. بالنسبة لنفايات المجموعة ج:
1/3. النفايات التي يجب تعقيمها قبل التخلص منها:
وهي كل ما ينتج من مخلفات المختبرات مثل الملابس أو الأغطية أو المفروشات الملوثة أو القفازات والصحاف أو الأطباق البترية (أطباق مزارع مختبرات البكتريولوجي والأطباق البلاستيكية الأخرى) والأوعية المستخدمة في التعامل مع الأنسجة الحيوية والدم والبكتيريا وغيرها، ويجب أن توضع في أكياس شفافة زرقاء اللون مصنوعة من مواد خاصة ومكتوب عليها «نفايات طبية – تعقم قبل التخلص منها» ويجب ربط هذه الأكياس عند عنقها بوسيلة إقفال مؤقتة، كما يجب عدم تعبئتها بأكثر من 65% من طاقتها الاستيعابية.
2/3. النفايات التي يتطلب الأمر معالجتها:
وتشمل هذه النفايات بقية نفايات المجموعة (ج) التي لا تندرج تحت تلك المذكورة في الفقرة السابقة، والتي يجب وضعها في أكياس من البولي إثيلين متوسطة التحمل ( عيار (200) صفراء اللون مكتوب عليها «نفايات طبية – للإحراق فقط»، ويجب عدم تعبئتها بأكثر من 65% من طاقتها الاستيعابية، وأن يتم ربطها من العنق وتخزينها انتظاراً لجمعها والتخلص منها بالإحراق وفقاً لأحكام هذا النظام.
4. بالنسبة لنفايات المجموعة د:
1/4. النفايات الصيدلانية:
يجب إعادة كل المواد الصيدلانية المغلفة أو المعبأة المستخدمة جزئياً أو التي انتهت صلاحيتها إلى الصيدلية ليتم إعادتها إلى حاويتها الأصلية ثم تخزينها في أكياس من البولي إثيلين تكون متوسطة التحمل (عيار (300) صفراء اللون مكتوب عليها «نفايات طبية - للإحراق فقط»، ويجب ربط هذه الأكياس عند عنقها وألا تتم تعبئتها بأكثر من طاقتها الاستيعابية، ثم يتم تخزينها إلى حين جمعها والتخلص منها.
2/4. النفايات السامة:
يجب إعادة كل المواد الخلوية أو السامة إلى نقطة تكون محددة سلفا داخل الصيدلية التي تم إعداد هذه المواد فيها أو أخذها منها ويجب وضع كل الأدوية الخلوية السامة وغيرها من المواد الملوثة بالأدوية والعقاقير الخلوية السامة ( عدا الإبر التي تستخدم تحت الجلد وغيرها من «المواد الحادة» التي تندرج تحت نفايات (المجموعة (ب)) في أكياس بولي إثيلين شديدة التحمل ( عيار (400)) صفراء اللون مكتوب عليها «نفايات خلوية سامة للإحراق فقط» ويجب عدم ملء هذه الأكياس بأكثر من 65% من طاقتها الاستيعابية، وأن يتم ربطها عند العنق بعد وضع تلك النفايات فيها وتخزينها لحين جمعها والتخلص منها بإحراقها.
3/4. النفايات الكيميائية:
يجب إعادة كل النفايات الكيميائية التي تطبق عليها مواصفات النفايات الطبية مثل المذيبات الصناعية وغيرها من المواد السائلة التي تستخدم في الاختبارات التشخيصية، بالإضافة إلى كل المواد الكيميائية المتبقية إلى نقطة تكون محددة سلفاً في الصيدلية أو مخزن المختبر المركزي، حيث يتم وضع العلامات الدالة على كل نوع منها بوضوح، وذلك إما باستخدام علامات لاصقة ، أو علامات يتم ربطها عليها، ويجب أن توضح العلامة التي توضع على كل عبوة تركيبتها وأخطارها ويتم بعد ذلك تخزينها لحين جمعها والتخلص منها.
5. بالنسبة لنفايات المجموعة هـ:
يجب وضع كل المواد السريرية المستخدمة من بطانات تغطية أوعية تتلقى إفرازات المرضى والفضلات المعوية وغيرها (ما عدا تلك التي كانت تستخدم لمرضى يعانون من أمراض معدية أو سريعة الانتقال والمدرجة تحت نفايات المجموعة (أ)) في أكياس من البولي اثيلين متوسطة التحمل (عيار (300)) صفراء اللون، ويجب عدم تعبئة هذه الأكياس بأكثر من 65% من طاقتها الاستيعابية وأن يتم ربطها عند العنق بعد وضع النفايات فيها، ويعلق عند عنق كل كيس بطاقة تبين بوضوح أن المحتويات عبارة عن «نفايات طبية من المجموعة هـ »ويجب عزل هذه الأكياس في مكان منفصل عن النفايات الطبية الأخرى إن لم يكن سيتم إحراقها في نفس موقع إنتاجها.
6. نفايات المجموعة و:
يجب أن توضع في حاويات خاصة وتحفظ في أماكن آمنة مخصصة لتخزين هذا النوع من النفايات حتى يتم التخلص منها وفقاً للأصول العالمية.
الجدول 2-3
تحديد وسائل تعبئة ونقل وتخزين النفايات الطبية
1. الحاويات:
يجب أن تكون الأكياس التي تستخدم لحفظ النفايات الطبية ذات كثافة لا تقل عن متر واحد مكعب، وتصنع الأكياس التي تستخدم في التعقيم من مادة خاصة يتم اختيارها بدقة لهذا الغرض، وتحمل عليها ما يشير بوضوح إلى ما إذا كانت محتوياتها قد تمت معالجتها أم أنها لم تعالج (شريط تعقيم على سبيل المثال). ويجب أن يتم تثبيت علامة على كل كيس من أكياس النفايات الطبية عند إغلاقه بهدف التخلص منه موضحاً عليها المكان الذي تم فيه إنتاج النفايات والمكان الذي سيتم التخلص منها فيه.
2. النقل داخل الموقع:
عند نقل أي كيس أو حاوية للنفايات إلى المكان الذي سيتم تخزينها فيه داخل الموقع نفسه أو إلى المكان الذي سيتم التخلص منها داخل الموقع - في عربات مؤمنة، مكتوب عليها «نفايات طبية» يمنع أي شخص غير مصرح له أو غير مرخص له من الوصول إليها أو ركوبها، وأن تكون مجهزة بحيث لا تسقط أكياس أو عبوات أو حاويات النفايات منها، ويجب أن تكون العربات التي تستخدم لنقل النفايات من نقطة إلى أخرى داخل الموقع مؤمنة ضد تسرب أو رشح أي شيء منها أو أن تثبت حولها لفافات من الأقمشة التي تمتص أية مواد سائلة قد تتسرب أو ترشح من الأكياس أو العبوات التي تحملها، ويجب أن تكون هذه الأقمشة إما من النوع الذي يتم التخلص منه بعد استخدامه لمرة واحدة ليتم التخلص منها عقب استخدامها في نقل النفايات في كل مرة، وإما أن تكون مصنوعة من مواد صالحة للتعقيم ويتم بالفعل تعقيمها بعد كل مرة تستخدم فيها لاستخدامها مرة أخرى.
3. التخزين داخل الموقع:
يجب عند تخزين النفايات داخل الموقع أن يتم ذلك في أقرب نقطة ممكنة إلى النقطة التي يتم النقل منها، وأن تكون موضوعة داخل عبوات أو حاويات ملائمة لنوعية النفايات حسب التصنيف المحدد لمجموعات النفايات الطبية ومخصصة لذلك، ويجب أن يكون المكان الذي توضع فيه هذه العبوات أو الحاويات مكاناً ذا درجة حرارة مناسبة لمنع تكاثر الجراثيم لا يصل إليه المرضى أو عامة الناس أو الحيوانات السائبة، إلا إذا كان هذا المكان خاضعاً دائماً لرقابة موظفين مؤهلين تماما وأكفاء في مجال الرعاية الطبية، ويجب أن يتم إغلاق العبوات أو الحاويات بإحكام وربطها أو تأمينها بحيث لا يسهل فتحها.
4. نقل النفايات خارج الموقع:
يجب أن تكون كل المركبات أو الوسائل أو الحاويات التي تستخدم لنقل النفايات الطبية على الطرق العامة مصنوعة ومجهزة أو أن يتم إعدادها وتهيئتها وتعديلها بحيث تكون ملائمة لنقل النفايات الطبية بطريقة آمنة ، ويجب أن تكون مانعة لتسرب أو رشح أي من المواد التي تحملها، وأن تتحمل الأوزان الكبيرة الصدمات القوية دون أن تنفجر أو تتحطم لضمان عدم تسرب ما تحمله من نفايات، كما يجب أن تكون مزودة بأجهزة إغلاق متينة وآمنة ويجب أن تظل المركبات أو أية وسائل أو حاويات أخرى تستخدم للنقل محكمة الإغلاق بما يمنع أي تسرب أو رشح.
5. التخلص من النفايات في الموقع:
يتم التخلص من النفايات في الموقع المحدد من قبل دائرة البلدية والمعد والمجهز بالأدوات اللازمة للتخلص منها سواء بالحرق أو بغير ذلك وفقاً لما تحدده وزارة الصحة.

- And Federal Law No. (1) of 1972 concerning the competencies of ministries and the powers of ministers, and its amending laws,
- And Federal Law No. (7) concerning the Federal Environment Agency,
- And Federal Law No. (24) of 1999 concerning the Protection and Development of the Environment,
- And Cabinet Decision No. (7) of 1996 issuing the Staff Affairs Regulations of the Federal Environment Agency and its amendments,
- And Cabinet Decision No. (7/637) of 2001 approving regulations as part of the Executive Bylaw of Federal Law No. (24) of 1999 concerning the Protection and Development of the Environment,
- And based on the proposal of the Minister of Health - Chairman of the Board of the Federal Environment Agency, and the approval of the Cabinet,
Has decided:
Article (1)
The provisions of the following regulations, the text of each of which is attached to this decision, shall be enacted as part of the Executive Bylaw of Federal Law No. (24) of 1999 concerning the Protection and Development of the Environment, which are:
- Marine Environment Protection System
- System for Handling Hazardous Materials, Hazardous Waste, and Medical Waste
- Environmental Impact Assessment System for Establishments
- Pesticides, Agricultural Conditioners, and Fertilizers System
Article (2)
This decision shall be published in the Official Gazette and shall come into force from the date of its publication, except for the System for Handling Hazardous Materials, Hazardous Waste, and Medical Waste, which shall come into force ninety days after publication.

Article (1)
Definitions
In the application of the provisions of this system, the following words and phrases shall have the meanings assigned to them, unless the context requires otherwise:
| The State | : The United Arab Emirates. |
| The Agency | : The Federal Environment Agency. |
| Concerned Authorities | : All authorities concerned with environmental and development affairs within the state. |
| The Competent Regulatory Unit | : The department, authority, or any regulatory unit established by the concerned authority to issue licenses related to this system. |
| Environment | : The biosphere in which life manifests in its various forms. This sphere consists of two elements: Natural element: Includes living organisms such as humans, animals, plants, and other living beings, and natural resources such as air, water, soil, organic and inorganic materials, as well as natural systems. And a non-natural element: Includes everything man-made introduced into the natural environment, such as fixed and non-fixed installations, roads, bridges, airports, means of transport, and the industries, innovations, and technologies he has developed. |
| Environmental Degradation | : The impact on the environment that reduces its value, distorts its ecological nature, depletes its resources, or harms living organisms or monuments. |
| Environmental Pollution | : Pollution resulting naturally or unnaturally from human actions, directly or indirectly, voluntarily or involuntarily, by introducing any polluting materials and factors into the elements of the natural environment, which results in any danger to human health, plant or animal life, or harm to resources and ecosystems. |
| Polluting Materials and Factors | : Any solid, liquid, or gaseous materials, smoke, vapors, odors, noise, radiation, heat, light glare, or vibrations produced naturally or by human action that lead directly or indirectly to environmental pollution and degradation or harm to humans or living organisms. |
| Air Pollution | : Any change in the characteristics and specifications of outdoor air, workplace air, and enclosed and semi-enclosed public places air that results in a danger to human health and the environment, whether this pollution is caused by natural factors or human activity. |
| Water Pollution | : The introduction of any materials or energy into the aquatic environment, voluntarily or involuntarily, directly or indirectly, resulting in harm to living or non-living resources, threatening human health, or impeding aquatic activities including fishing and tourism, or spoiling its suitability for use, or diminishing its enjoyment, or changing its properties. |
| Environmental Protection | : Preserving its components, properties, and natural balance, preventing, reducing, or combating pollution, conserving natural resources and rationalizing their consumption, and protecting the living organisms that inhabit it, especially those threatened with extinction, and working to develop and enhance all these components. |
| Hazardous Materials | : Solid, liquid, or gaseous materials with properties harmful to human health or that have a detrimental effect on the environment, such as toxic, explosive, flammable, or ionizing radiation materials. |
| Harmful Substances | : All substances that directly or indirectly cause harm to human health or the environment, whether these substances are chemical, biological, or radioactive. |
| Waste | : All types of hazardous and non-hazardous residues or refuse, including nuclear waste, that are disposed of or required to be disposed of according to the provisions of the law, and include: Solid waste: such as household, industrial, agricultural, and medical waste, and construction and demolition debris. Liquid waste: originating from residences, commercial and industrial establishments, and others. Gaseous waste, smoke, vapors, and dust: originating from homes, bakeries, incinerators, factories, crushers, quarries, power stations, oil operations, and various means of transport and communication. Hazardous waste: residues from various activities and processes or their ash that retain the properties of hazardous materials. Medical waste: any waste consisting wholly or partly of human or animal tissue, blood or other body fluids, secretions, drugs or other pharmaceutical products, dressings, syringes, needles, sharp medical instruments, or any other infectious, chemical, or radioactive waste resulting from medical, nursing, treatment, healthcare, dental, veterinary, pharmaceutical, manufacturing, or other practices, or from examination, research, teaching, sampling, or storage. |
| Handling and Dealing | : Import/transport/storage/production/use/trade/any other activities. |
| Waste Management | : The collection, storage, transport, recycling, and disposal of waste, including the aftercare of disposal sites. |
| Waste Handling | : All processes from the time of waste generation until its safe disposal, including waste collection, storage, transport, treatment, recycling, or disposal. |
| Waste Disposal | : Processes that do not lead to the recovery of materials or their reuse, such as landfilling, deep injection, biological or physical/chemical treatment, permanent storage, destruction, or any other method approved by the concerned authorities. |
| Waste Recycling | : Processes carried out on waste for the purpose of recovering materials or reusing them, such as use as fuel, recovery of metals and organic materials, soil treatment, or oil re-refining. |
| Establishment | : Industrial and tourism establishments, electricity production and generation establishments, establishments working in the field of oil exploration, extraction, transport, and use, and all infrastructure projects and any other establishment. |
| Oil | : All forms of crude oil and its products, including any type of liquid hydrocarbons, lubricating oils, fuel oils, refined oils, furnace oil, bitumen, and other materials extracted from petroleum or its derivatives or waste. |
| Discharge | : Any leak, spill, emission, or discharge of any type of polluting material or its disposal into the aquatic environment, soil, or air. |
| Dumping | a. Any deliberate disposal into the marine environment of polluting materials or waste from ships, aircraft, platforms, or other sources. b. Any deliberate sinking in the marine environment of ships, industrial installations, or others. |
| Transport Vehicles | : Aircraft, cars, trains, tractors, motorcycles, or other machines designed for road use. |
Article (2)
Concerned Authorities
It is prohibited to handle or deal with hazardous materials, hazardous waste, and medical waste without a license issued by the concerned authorities as specified in the following table, each within its jurisdiction:

Article (3)
General Requirements
The ministers, heads, or directors of the concerned authorities, each within their scope of competence and in coordination with the Agency, shall issue the necessary administrative and technical procedures for the handling and dealing with hazardous materials, hazardous waste, and medical waste, provided that these procedures include, in particular, the following:
- Establish a competent regulatory unit to issue licenses for the hazardous materials or waste mentioned in Article (2) of this system.
- Establish national databases on hazardous materials, hazardous waste, and medical waste.
- In cooperation with the concerned authorities and international organizations, monitor hazardous materials and waste that are internationally banned or restricted and take the necessary measures at the national level.
- Evaluate license applications for the activities and practices mentioned in Article (2) of this system and issue licenses for them.
- Examine hazardous materials and determine their hazard level through specialized laboratories and equipment if necessary.
- Coordinate with the concerned authorities within the state regarding analytical studies of pollutants.
- Raise awareness of the potential environmental and health risks resulting from the irrational use of hazardous materials.
- Any other controls or conditions that the Ministry or Municipality deems important to add in coordination with the Federal Environment Agency.
Article (4)
Licensing
Without prejudice to the special conditions and procedures for each operation of handling and dealing with hazardous materials, hazardous waste, and medical waste as stated in this system, the license applicant must submit his application to the concerned authorities stipulated in Article (2) of this system in accordance with the following procedures and conditions:
1. Licensing Procedures:
The license for handling and dealing with hazardous materials, hazardous waste, and medical waste shall be issued for a period of one year by the competent regulatory unit as follows:
a. Any entity wishing to carry out any of the practices or activities mentioned in Article (2) of this system must submit its application to the competent regulatory unit to obtain a license for the practice or activity.
b. Anyone who submits an application to the competent regulatory unit must attach with his application all the necessary data and information to support his application, in particular the following:
- Data related to the person handling hazardous materials, hazardous waste, and medical waste:
- Name and nationality of the establishment
- Address and phone number
- Location and area of the establishment (in addition to warehouses)
- Safety equipment available at the establishment
- Environmental monitoring program for the establishment's surroundings
- The entity producing the hazardous materials, waste, or medical waste:
- Name and nationality of the establishment
- Address and phone number
- The type of handling or dealing for which a license is sought.
- A full description of the hazardous materials, hazardous waste, and medical waste to be handled, and the nature and concentration of the hazardous elements therein, according to the international classification followed in Table 1-1 of Annex 1 of this system.
- Specify the quantity of hazardous materials, hazardous waste, and medical waste to be handled annually and describe the packaging method (drum - tanker - bulk ... etc.).
- A description of the means intended to be used for storing hazardous materials, hazardous waste, and medical waste and the storage period for each, with a commitment to write a clear statement on the packaging to inform about its contents, the extent of its danger, and how to act in case of emergency.
- Clarification of the means of transport.
- A comprehensive statement about the method to be followed in treating and disposing of the hazardous materials, hazardous waste, and medical waste for which the license is requested.
- A commitment to keep records that include a detailed statement of the quantities of hazardous materials, hazardous waste, and medical waste, their sources, collection rates and periods, method of transport, and method of treatment, and to keep these records for a period of five years from the date of their extraction.
- A certificate of previous experience in the field of handling hazardous materials, hazardous waste, and medical waste.
- The licensee must prepare an emergency plan to deal with accidents and submit it to the competent regulatory unit for approval.
c. The competent regulatory unit may suspend the license, refuse to grant the license, or cancel it permanently if violations, infractions, or non-compliance with the requirements contained in Federal Law No. 24 of 1999 concerning the Protection and Development of the Environment or in this system are proven.
2. Conditions for Granting a License:
The following are required for granting a license:
- Fulfillment of all required data.
- Availability of trained and licensed personnel responsible for handling hazardous materials, hazardous waste, and medical waste.
- Approval from the Federal Environment Agency on the competence of these personnel to work in the field of hazardous materials, or obtaining a certificate of completion of the specialized hazardous materials course from the Civil Defense Institute.
- Availability of requirements to face the dangers that may result from accidents during handling.
- The activity to be licensed must not result in harmful effects on the environment and public health.
- Display the emergency management plan at the site.
Article (5)
Importing Hazardous Chemical Materials
- The license applicant may not import any hazardous material listed in Table 1-1 of Annex (1) of this system for the purpose of trade or multiple uses without obtaining the approval of the competent regulatory unit.
- The licensee must complete the data in the import form prepared by the competent regulatory unit and submit it 15 days before the completion of the import process, attached with the Material Safety Data Sheet (MSDS) including the following:
- The scientific and commercial name of the hazardous material and its chemical composition.
- The United Nations serial number and the material's sequence according to CAS services.
- The physical and chemical properties of the hazardous material.
- The degree of hazard of the material and its health and environmental effects.
- The quantity of the hazardous material to be imported.
- The expected date and time of transport.
- The purpose of the import.
- The optimal methods for storing and disposing of the material.
- The measures to be taken in the event of any leakage of the hazardous material.
- The measures to be taken to deal with fires arising from the hazardous material.
- Certificate of origin and testing in the exporting countries of the material.
- The production date of the chemical material and its validity period.
- First aid for injuries resulting from exposure to the material through the mouth, skin, inhalation, or ingestion.
- Personal protective equipment and clothing when handling the material.
Article (6)
Packaging of Hazardous Chemical Materials
- Hazardous materials must be packed in good quality containers capable of withstanding all conditions of transport and handling, the effects of vibration, and temperature changes, and they must be tightly sealed.
- The containers must be compatible with all hazardous materials placed in them so that they are not affected by or affect the packaged materials.
- Internal containers must be sealed, secured, or placed on a cushioning material to prevent breakage or leakage and to control their movement within the outer packaging.
- The package must be of a size that allows sufficient space to affix all labels and information cards required by the Material Safety Data Sheet (MSDS).
- Labels must be affixed to each package with a durable material sufficient to withstand normal transport conditions and to ensure that the label and the information on it are not damaged or erased.
Article (7)
Transport of Hazardous Chemical Materials
The transport of hazardous chemical materials is subject to the following conditions:
- The materials must be transported safely within the prescribed speed limits.
- Metal plates must be fixed on the outer surface of all sides of the transport units to warn of the tank's contents and the extent of its danger, and they must be painted with a reflective paint of the required color and have resistance to weather conditions.
- The construction of tanker containers for the transport of hazardous materials must be in accordance with locally or internationally approved technical rules.
- Drivers of vehicles dealing with hazardous materials must be trained and licensed, with ready plans for emergencies and accidents.
- All vehicles transporting unpackaged hazardous chemical materials must use a yellow flashing light mounted on the driver's cab, for the duration of the transport operation.
- The driver must have documents that include the main necessary information for the transported hazardous materials (scientific chemical name and UN number). The traffic police may at any time stop any vehicle and conduct the necessary checks and inspections to determine the safety of the vehicle. Drivers cooperating in the state must comply with the conditions contained in this article.
- The Agency and the concerned authorities shall coordinate with the competent departments of the Ministry of Interior in the implementation of the provisions of this article.
Article (8)
Storage of Hazardous Chemical Materials
The owner of the designated warehouse must comply with the following:
- Design the warehouse in a way that limits the risk of fire, spillage, and injuries.
- Provide emergency exits that are easy to open in the dark or in cases of heavy smoke.
- Provide adequate and sufficient ventilation.
- The warehouse floors must be impervious to liquids, and must be smooth, non-slip, and free of cracks to allow for easy cleaning and designed to contain spills and firefighting water.
- Use explosion-proof machinery and equipment when storing solvents with a low flash point or chemicals that generate flammable vapor.
- Provide storage arrangements and suitable flooring and roofs or covers for protection from sun and rain when storing hazardous materials outdoors.
- Provide appropriate fire extinguishers in easily accessible locations with a fire alarm system and the necessity of periodic inspection to ensure their serviceability.
- Stack materials in a way that does not obstruct the movement of forklifts, handling equipment, or emergency equipment.
- Separate hazardous materials according to the United Nations classification system and the requirements contained in Table (1-3) of Annex (1) of this system.
- Hazardous chemical materials may be stored within industrial facilities, provided there is a separation distance of 3 meters from any production facility for non-flammable materials and 10 meters between flammable materials and any source of ignition.
- Maintain complete records of the hazardous materials in the warehouses and keep a copy in the main office.
- Deal with spills and leaks after referring to the appropriate Material Safety Data Sheet (MSDS) data.
- Develop an on-site emergency management plan.
- Properly dispose of all damaged containers while keeping the area continuously clean.
- Monitor emergencies and maintain records of accidents, stating the methods of dealing with them and the steps taken to prevent their recurrence.
Article (9)
Handling of Hazardous Chemical Materials
The handling instructions specified by the producing entity according to the nature of each material must be strictly followed, including any special precautions to protect workers and the environment.
Article (10)
General Rules and Procedures for Hazardous Waste Management
1. Generation of Hazardous Waste
The entity where hazardous waste is generated shall comply with the following:
- Work to reduce the rate of generation of this waste in terms of quantity and type by developing the technology used, following the principle of clean production, and choosing alternatives for the product or raw materials that are less harmful to the environment.
- Characterize the generated waste in terms of quantity and type and record it.
- Establish and operate waste treatment units at the source, provided that the concerned authority approves the treatment method and the technical specifications of these units and operating programs. If treatment or disposal of hazardous waste at the source of generation is not possible, the entity that generates this waste is obliged to collect and transport it to the designated disposal sites determined by the concerned authority.
2. Collection and Storage of Hazardous Waste
The entity where hazardous waste is generated shall comply with the following:
- Designate specific areas for storing hazardous waste that meet safety conditions to prevent any public harm.
- Store hazardous waste in special containers made of an impermeable, hole-free material from which liquids and vapors cannot leak, equipped with a tight lid, and with a capacity appropriate to the amount of hazardous waste.
- The international warning sign for the contents of hazardous waste storage containers shall be displayed, identifying the dangers that may arise from incorrect handling.
- A schedule for collecting hazardous waste shall be established so that it is not left for a long period in storage containers.
- In the case of using mobile containers, the generator of hazardous waste is obliged not to place them in public places or harm the environment.
3. Transport of Hazardous Waste
It is prohibited to transport hazardous waste except by means of transport belonging to entities licensed for hazardous waste management. These means must meet the following requirements:
- The transport vehicles must be equipped with all safety measures.
- The vehicles for transporting hazardous waste must be able to contain the hazardous waste without leakage.
- The capacity of the transport vehicles must be suitable for the quantities of hazardous waste.
- These vehicles must be driven by a trained type of licensed drivers who are able to act appropriately, especially in emergencies.
- A clear sign must be placed on the vehicles indicating the degree of danger of their cargo and the optimal way to act in case of emergency.
- The routes for vehicles transporting hazardous waste shall be determined, and the civil defense authorities shall be immediately notified of any changes that occur to them, allowing for quick and proper action in emergencies.
4. Treatment and Disposal of Hazardous Waste
- The licensed entity, in coordination with the concerned authorities, is obliged to select the sites for hazardous waste treatment and disposal facilities in an area at least 5 kilometers away from residential and urban areas, taking into account the environmental conditions of the selected site area. The site must have the following requirements, equipment, and facilities:
- The area of the site should be proportional to the expected amount of hazardous waste to be collected.
- The site should be surrounded by a brick wall with a height of not less than 2.5 meters.
- The site should be equipped with more than one gate of a suitable capacity to allow easy entry for hazardous waste transport vehicles.
- The site should be equipped with a water source, toilets, and a telephone line.
- The site should be equipped with all mechanical equipment that facilitates work flow.
- The site should be equipped with equipped warehouses for storing hazardous waste until it is treated and disposed of.
- The facility should be equipped with an incinerator for incinerating various types of hazardous waste.
- The facility should be equipped with the necessary equipment and facilities for sorting and classifying some hazardous waste for reuse and recycling.
- The site should be equipped with a sanitary landfill pit of a suitable capacity for burying incineration residues.
- The treatment of hazardous waste for reuse and recycling shall be carried out within the following framework:
- Reuse of some hazardous waste as fuel for energy generation.
- Recovery of organic solvents and their reuse in extraction processes.
- Recycling and reuse of some organic materials from hazardous waste.
- Reuse of ferrous and non-ferrous metals and their compounds.
- Recycling and reuse of some inorganic materials from hazardous waste.
- Recovery and recycling of acids or bases.
- Recovery of used oils and their reuse after refining.
- The treatment of hazardous waste that is not reusable or recyclable shall be carried out within the following framework:
- Landfilling of hazardous waste in special landfill pits that are equipped and isolated from other environmental elements.
- Physical or chemical treatment of hazardous waste.
- Incineration in special incinerators equipped so as not to allow the emission of gases and vapors in a way that harms the surrounding environment.
- Permanent storage (such as placing hazardous waste containers underground).
- Take all measures to ensure the reduction and minimization of hazardous waste generation through:
- Developing clean technology and promoting its use.
- Developing appropriate systems for hazardous waste management.
- Expanding the reuse of hazardous waste after treatment whenever possible.
- Establish a periodic program for monitoring hazardous waste residues and their presence or the presence of their traces in the ecosystem elements at the sites and facilities for hazardous waste treatment and disposal and their surroundings.
- The entities licensed to handle and manage hazardous materials and waste shall be responsible for damages caused to third parties as a result of non-compliance with this system.
Article (11)
- It is prohibited to establish any facilities for the purpose of treating hazardous waste except with a license from the concerned authority, in coordination with the Federal Environment Agency, as stipulated in Article (2) of this system, ensuring that the facility meets all the conditions that guarantee the safety of the environment and the workers therein.
- The disposal of hazardous waste shall be in accordance with the conditions and standards stipulated in Article (10) of this system.
- The concerned authority, in coordination with the Federal Environment Agency, shall determine the locations and conditions for licensing the disposal of hazardous waste.
Article (12)
With respect to locally produced hazardous waste, the control over its transport and disposal across land borders, marine environment boundaries, and airspace shall be in accordance with the controls, rules, and procedures contained in the Basel Convention and in coordination with the Federal Environment Agency.
Article (13)
Those involved in the production or handling of hazardous waste, whether in its gaseous, liquid, or solid state, must take all necessary precautions to ensure that no environmental damage occurs, and they must in particular observe the following:
- The site where these materials are produced or stored must be tested according to the necessary conditions for the type and quantity of these materials.
- The buildings in which these materials are produced or stored must be designed according to the engineering principles that must be observed for each type of these materials, and these buildings are subject to periodic inspection by the competent regulatory unit.
- The technology used for the production of these materials, as well as the appropriate equipment and devices, must not cause damage to the facilities, the environment, or the workers.
- The buildings must be equipped with safety, alarm, prevention, and control systems, and first aid in appropriate quantities and numbers, in coordination with the Ministry of Health, the Civil Defense Administration, and the competent regulatory unit.
- An emergency plan must be available to deal with any expected accident during the production, storage, transport, or handling of these materials, and this plan must be approved by the competent regulatory unit.
- Workers in these entities dealing with hazardous materials and waste must undergo periodic medical examinations, and the results of these examinations must be kept in the file of each worker, and they must be treated for occupational diseases according to the laws, regulations, and rules in force in the United Arab Emirates.
Article (14)
The owner of an establishment whose activity results in hazardous waste according to the provisions of this system must keep a register of this waste, which shall include:
- - A full description of the waste, indicating its hazard level and its physical and chemical properties.
- - Its quantities.
- - Its sources.
- - Collection rates and periods.
- - Method of transport.
- - Method of treatment.
- - The name of the entity contracted to receive this waste.
Article (15)
General Rules and Procedures for Medical Waste Management:
- Public and private health facilities of any kind are prohibited from disposing of the medical waste listed in Table No. 2-1 of Annex No. (2) of this system outside the containers designated for it, in accordance with the guidelines set by the Ministry of Health and the municipalities.
- Every health facility is obliged to separate its medical waste from its other waste and not to mix them.
- Every health facility is obliged to sort its medical waste according to the classification table in Table No. 2-1 in Annex No. 2 of this system.
- The waste groups stipulated in the previous paragraph shall be packed in packages or containers as stated in Table No. 2-2 in Annex No. (2) of this system.
- Medical waste shall be disposed of as follows:
- Inside health facilities using environmentally sound means and equipment (incineration or other).
- At the site designated for this purpose in coordination with the concerned authorities equipped with the equipment designated for treatment (incineration or other).
- The health facility or those responsible for transporting medical waste are obliged to pack, transport, and store this waste as stated in Table No. 2-3 in Annex No. (2) of this system, and those who pack, transport, and store the waste must be qualified specialists licensed for this work.
Concluding Provisions:
Article (16)
The provisions of this system shall not apply to the storage, transport, and handling of radioactive materials and waste.
Article (17)
Entities that apply integrated systems and programs for environmental protection and development sufficient to achieve the objectives of this system must submit these systems and programs to the Agency for approval by the Agency's Board of Directors. The entity whose systems and programs are approved by a decision of the Agency's Board of Directors shall be exempted from applying the provisions of this system.
Article (18)
The provisions contained in the system of pesticides, fertilizers, and agricultural conditioners shall apply to agricultural hazardous materials and waste and their residues.
Article (19)
This system is considered part of the Executive Bylaw of Federal Law No. (24) of 1999 concerning the Protection and Development of the Environment. The employees of the Agency and the competent authorities who have been granted the capacity of judicial officers may record any violation of its provisions and refer the violations according to the procedures in force in the state to the competent judicial authorities to apply the penalties prescribed by law.

Table 2-1
Classification of Medical Waste
1. Group A Waste:
Soiled dressings, bandages, swabs, and other contaminated waste such as cloths - other than clothing and linens - resulting from the treatment of infectious diseases, all human tissues (contaminated and non-contaminated), animal remains, all animal bedding or materials used for animals whether contaminated or likely to be contaminated, and all related rags, dressings, etc.
2. Group B Waste:
Used syringes, needles, surgical equipment, various containers for medicines and medical materials, broken glass, and all other sharp tools, equipment, and materials.
3. Group C Waste:
Waste from blood, tissue, and microbiology laboratories, and mortuaries that are not included under Group (A) or Group (B).
4. Group D Waste:
Pharmaceutical waste and chemical waste that meet the specifications of medical waste.
5. Group E Waste:
Liners used in patient beds to cover containers receiving their secretions, which are used once and then disposed of, caps of bottles and containers for receiving and storing urine, pads for absorbing or cleaning urine or feces, bags or containers for receiving intestinal waste, and the like.
6. Group F Waste:
Waste resulting from treatment with radioactive materials and waste resulting from all operations related to radioactive isotopes are classified according to international standards.
Table 2-2
Specification of Packages and Containers
1. For Group A Waste:
Very heavy-duty polyethylene bags (400 gauge), red in color, clearly labeled "Infectious Waste - For Incineration Only" must be used to pack all waste listed in Group (A) and Group (E) of Table 2-1 in Annex (2).
2. For Group B Waste:
Very strong, thick-walled plastic boxes made of polyethylene, yellow in color, internationally known as (Sharps Bins), must be used. They should be labeled "Sharps - For Incineration Only" for the waste listed in Group (B) of Table 2-1 in Annex (2). The said boxes used for storing this waste must be tightly closed with a plug, lock, or other means in a way that they cannot be opened, and they should not be filled to more than 75% of their capacity.
3. For Group C Waste:
3/1. Waste that must be sterilized before disposal:
This includes all laboratory waste such as contaminated clothing, covers, or furnishings, gloves, and Petri dishes (bacteriology lab culture dishes and other plastic dishes), and containers used in handling biological tissues, blood, bacteria, etc. It must be placed in transparent blue bags made of special materials and labeled "Medical Waste - Sterilize Before Disposal." These bags must be tied at the neck with a temporary closure, and they should not be filled to more than 65% of their capacity.
3/2. Waste that requires treatment:
This waste includes the rest of Group (C) waste not mentioned in the previous paragraph, which must be placed in medium-duty polyethylene bags (200 gauge), yellow in color, labeled "Medical Waste - For Incineration Only." They should not be filled to more than 65% of their capacity, tied at the neck, and stored pending collection and disposal by incineration according to the provisions of this system.
4. For Group D Waste:
4/1. Pharmaceutical Waste:
All partially used or expired packaged or bottled pharmaceutical materials must be returned to the pharmacy to be returned to their original container, then stored in medium-duty polyethylene bags (300 gauge), yellow in color, labeled "Medical Waste - For Incineration Only." These bags must be tied at the neck and not filled beyond their capacity, then stored until collection and disposal.
4/2. Cytotoxic Waste:
All cytotoxic materials must be returned to a predetermined point within the pharmacy where these materials were prepared or taken from. All cytotoxic drugs and other materials contaminated with cytotoxic drugs (except for hypodermic needles and other "sharps" that fall under Group (B) waste) must be placed in heavy-duty polyethylene bags (400 gauge), yellow in color, labeled "Cytotoxic Waste - For Incineration Only." These bags should not be filled to more than 65% of their capacity, tied at the neck after placing the waste in them, and stored until collected and disposed of by incineration.
4/3. Chemical Waste:
All chemical waste that meets the specifications of medical waste, such as industrial solvents and other liquid materials used in diagnostic tests, in addition to all remaining chemical materials, must be returned to a predetermined point in the pharmacy or the central laboratory store, where each type is clearly marked, either using adhesive labels or tags tied to them. The label on each container must indicate its composition and hazards, and then it is stored until collected and disposed of.
5. For Group E Waste:
All used clinical materials from liners covering containers for patient secretions, intestinal waste, and others (except those used for patients with infectious or highly transmissible diseases listed under Group (A) waste) must be placed in medium-duty polyethylene bags (300 gauge), yellow in color. These bags should not be filled to more than 65% of their capacity and must be tied at the neck after placing the waste in them. A tag should be attached at the neck of each bag clearly indicating that the contents are "Medical Waste from Group E." These bags must be isolated in a separate place from other medical waste if they are not to be incinerated at the same site of production.
6. Group F Waste:
Must be placed in special containers and kept in secure places designated for storing this type of waste until it is disposed of according to international standards.
Table 2-3
Specification of Means for Packing, Transporting, and Storing Medical Waste
1. Containers:
The bags used for storing medical waste must have a density of not less than one cubic meter. Bags used for sterilization are made of a special material carefully selected for this purpose, and they must have a clear indication of whether their contents have been treated or not (e.g., a sterilization strip). A label must be affixed to each bag of medical waste when it is closed for disposal, indicating the place where the waste was produced and the place where it will be disposed of.
2. On-site Transport:
When transporting any bag or container of waste to the place where it will be stored on-site or to the place where it will be disposed of on-site - in secured carts, labeled "Medical Waste," any unauthorized or unlicensed person is prohibited from accessing or riding them. They must be equipped so that bags, packages, or containers of waste do not fall from them. The carts used for transporting waste from one point to another on-site must be secured against leakage or spillage of anything from them, or have absorbent fabric wraps around them to absorb any liquid that may leak or seep from the bags or containers they carry. These fabrics must either be of the disposable type to be disposed of after each use in transporting waste, or they must be made of sterilizable materials and actually sterilized after each use for reuse.
3. On-site Storage:
When storing waste on-site, it must be done at the closest possible point to the point of transport, and it must be placed inside packages or containers suitable for the type of waste according to the classification specified for medical waste groups and designated for that purpose. The place where these packages or containers are placed must be at a suitable temperature to prevent the proliferation of germs, and inaccessible to patients, the general public, or stray animals, unless this place is always under the supervision of fully qualified and competent medical care staff. The packages or containers must be tightly closed, tied, or secured so that they are not easily opened.
4. Off-site Transport of Waste:
All vehicles, means, or containers used for transporting medical waste on public roads must be manufactured and equipped or prepared, adapted, and modified to be suitable for transporting medical waste safely. They must be leak-proof and able to withstand large weights and strong impacts without bursting or breaking to ensure that the waste they carry does not leak. They must also be equipped with strong and secure locking devices, and the vehicles or any other means or containers used for transport must remain tightly closed to prevent any leakage or spillage.
5. On-site Waste Disposal:
Waste is disposed of at the site designated by the Municipality Department, which is prepared and equipped with the necessary tools for disposal, whether by incineration or otherwise, as determined by the Ministry of Health.
