نحن خليفة بن زايد آل نهيان - رئيس دولة الإمارات العربية المتحدة،

بعد الاطلاع على الدستور،

• - وعلى القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات وصلاحيات الوزراء والقوانين المعدلة له،
• - وعلى القانون الاتحادي رقم (3) لسنة 1979 في شأن الدفاع المدني، والقوانين المعدلة له،
• - وعلى القانون الاتحادي رقم (5) لسنة 1979 في شأن الحجر الزراعي ، والقوانين المعدلة له،
• - وعلى القانون الاتحادي رقم (8) لسنة 1980 في شأن تنظيم علاقات العمل، والقوانين المعدلة له،
• - وعلى القانون الاتحادي رقم (21) لسنة 1981 في شأن إنشاء الهيئة العامة لإدارة موارد المياه في دولة الإمارات العربية المتحدة،
• - وعلى القانون الاتحادي رقم (26) لسنة 1981 بشأن القانون التجاري البحري والقوانين المعدلة له،
• - وعلى المرسوم بقانون اتحادي رقم (9) لسنة 1983 في شأن تنظيم صيد الطيور والحيوانات،
• - وعلى قانون المعاملات المدنية الصادر بالقانون الاتحادي رقم (5) لسنة 1985 والقوانين المعدلة له،
• - وعلى قانون الإجراءات الجزائية الصادر بالقانون الاتحادي رقم (35) لسنة 1992م، والقوانين المعدلة له،
• - وعلى القانون الاتحادي رقم (39) لسنة 1992 في شأن إنتاج واستيراد وتداول الأسمدة والمصلحات الزراعية،
• - وعلى القانون الاتحادي رقم (41) لسنة 1992م في شأن مبيدات الآفات الزراعية،
• - وعلى القانون الاتحادي رقم (7) لسنة 1993م بإنشاء الهيئة الاتحادية للبيئة والقوانين المعدلة له،
• - وعلى القانون الاتحادي رقم (19) لسنة 1993 في شأن تعيين المناطق البحرية لدولة الإمارات العربية المتحدة،
• - وعلى القانون الاتحادي رقم (24) لسنة 1999 في شأن حماية البيئة وتنميتها،
• - وبناءً على ما عرضه وزير البيئة والمياه، وموافقة مجلس الوزراء، وتصديق المجلس الأعلى للاتحاد،

أصدرنا القانون الآتي:

المادة الأولى

يُستبدل بنصي المادتين (12) و(83) من القانون الاتحادي رقم (24) لسنة 1999 في شأن حماية البيئة وتنميتها النصان الآتيان:

• • مادة معدلة 12

  يحظر صيد أو قتل أو إمساك الطيور والحيوانات البرية والبحرية المحدد أنواعها في القوائم أرقام (1 ، 2 ، 3) المرفقة بهذا القانون، ويحظر حيازة هذه الطيور أو الحيوانات أو نقلها أو التجول بها أو بيعها أو عرضها للبيع حية أو ميتة إلا بعد الحصول على ترخيص من السلطات المختصة، كما يحظر إتلاف أوكار الطيور المذكورة أو إعدام بيضها. وتحدد اللائحة التنفيذية المناطق التي يجوز الترخيص بالصيد فيها وشروط الترخيص، كما تحدد وسائل الرقابة اللازمة لتنفيذ أحكام هذه المادة.

  وللوزير المختص بالتنسيق مع السلطة المختصة تعديل القوائم الثلاث المرفقة بهذا القانون بالحذف أو بالإضافة أو النقل.

• • مادة معدلة (83)

  يعاقب كل من يخالف أحكام المادة (12) والبند (1) من المادة (64) من هذا القانون بالإضافة إلى مصادرة الطيور والحيوانات المضبوطة بالآتي:

1. الحبس مدة لا تقل عن ستة أشهر وبغرامة لا تقل عن عشرين ألف درهم، إذا وقعت الجريمة على أي نوع من الأنواع المدرجة بالقائمة الأولى المرفقة بهذا القانون.
2. الحبس مدة لا تقل عن ثلاثة أشهر وبغرامة لا تقل عن عشرة آلاف درهم أو بإحدى هاتين العقوبتين، إذا وقعت الجريمة على أي نوع من الأنواع المدرجة بالقائمة الثانية المرفقة بهذا القانون.
3. الحبس مدة لا تقل عن شهر واحد وبغرامة لا تقل عن خمسة آلاف درهم أو بإحدى هاتين العقوبتين، إذا وقعت الجريمة على أي نوع من الأنواع المدرجة بالقائمة الثالثة المرفقة بهذا القانون.

المادة الثانية

يُنشر هذا القانون في الجريدة الرسمية، ويُعمل به اعتبارا من تاريخ نشره.

Having reviewed the Constitution,

• - And Federal Law No. (1) of 1972 concerning the competencies of ministries and the powers of ministers and its amending laws,
• - And Federal Law No. (3) of 1979 concerning Civil Defense and its amending laws,
• - And Federal Law No. (5) of 1979 concerning Agricultural Quarantine and its amending laws,
• - And Federal Law No. (8) of 1980 concerning the regulation of labor relations and its amending laws,
• - And Federal Law No. (21) of 1981 concerning the establishment of the General Authority for Water Resources Management in the United Arab Emirates,
• - And Federal Law No. (26) of 1981 concerning the Maritime Commercial Law and its amending laws,
• - And Federal Law by Decree No. (9) of 1983 concerning the regulation of hunting birds and animals,
• - And the Civil Transactions Law issued by Federal Law No. (5) of 1985 and its amending laws,
• - And the Criminal Procedure Law issued by Federal Law No. (35) of 1992 and its amending laws,
• - And Federal Law No. (39) of 1992 concerning the production, import, and circulation of fertilizers and agricultural conditioners,
• - And Federal Law No. (41) of 1992 concerning agricultural pesticides,
• - And Federal Law No. (7) of 1993 establishing the Federal Environmental Agency and its amending laws,
• - And Federal Law No. (19) of 1993 concerning the designation of the maritime zones of the United Arab Emirates,
• - And Federal Law No. (24) of 1999 concerning the protection and development of the environment,
• - And based on the proposal of the Minister of Environment and Water, the approval of the Council of Ministers, and the ratification of the Federal Supreme Council,

We have issued the following Law:

Article One

The texts of Articles (12) and (83) of Federal Law No. (24) of 1999 concerning the protection and development of the environment shall be replaced by the following texts:

• • Amended Article 12

  It is prohibited to hunt, kill, or capture wild and marine birds and animals of the species specified in Lists Nos. (1, 2, 3) attached to this Law. It is also prohibited to possess, transport, move, sell, or offer for sale these birds or animals, whether alive or dead, except after obtaining a permit from the competent authorities. It is also prohibited to destroy the nests of the mentioned birds or destroy their eggs. The Executive Regulations shall specify the areas where hunting may be permitted and the conditions for such permits, and shall also specify the necessary control measures for the implementation of the provisions of this Article.

  The competent Minister, in coordination with the competent authority, may amend the three lists attached to this Law by deletion, addition, or transfer.

• • Amended Article (83)

  Anyone who violates the provisions of Article (12) and Clause (1) of Article (64) of this Law shall be punished, in addition to the confiscation of the seized birds and animals, with the following:

1. Imprisonment for a period of not less than six months and a fine of not less than twenty thousand dirhams, if the crime is committed against any species listed in the first list attached to this Law.
2. Imprisonment for a period of not less than three months and a fine of not less than ten thousand dirhams, or one of these two penalties, if the crime is committed against any species listed in the second list attached to this Law.
3. Imprisonment for a period of not less than one month and a fine of not less than five thousand dirhams, or one of these two penalties, if the crime is committed against any species listed in the third list attached to this Law.

Article Two

This Law shall be published in the Official Gazette and shall come into force from the date of its publication.
