قانون رقم (21) لسنة 2005
بشأن إدارة النفايات بإمارة أبوظبي
نحن خليفة بن زايد آل نهيان، حاكم أبوظبي،
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،
- وعلى القانون رقم (2) لسنة 1971 في شأن المجلس الاستشاري الوطني وتعديلاته،
- وعلى القانون رقم (4) لسنة 1998 في شأن النفايات الطبية للمنشآت الصحية في إمارة أبوظبي،
- وعلى القانون رقم (6) لسنة 2004 بإعادة تنظيم جهاز الرقابة المالية،
- وعلى القانون رقم (16) لسنة 2005 بشأن إعادة تنظيم هيئة البيئة – أبوظبي،
- وعلى القانون الاتحادي رقم (35) لسنة 1992 بإصدار قانون الإجراءات الجزائية،
- وعلى القانون الاتحادي رقم (7) لسنة 1993 بإنشاء الهيئة الاتحادية للبيئة وتعديلاته،
- وعلى القانون الاتحادي رقم (24) لسنة 1999 في شأن حماية البيئة وتنميتها،
وبناءً على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه،
أصدرنا القانون الآتي:
الباب الأول
في التعريفات
مادة (1)
في تطبيق أحكام هذا القانون، يقصد بالكلمات والعبارات التالية المعاني الموضحة قرين كل منها ما لم يدل سياق النص على غير ذلك:
| الإمارة | : إمارة أبوظبي. |
| الحكومة | : حكومة أبوظبي. |
| السلطة المختصة | : هيئة البيئة بإمارة أبوظبي. |
| الجهات المعنية | : الجهات الحكومية أو الخاصة التي يتوفر لديها مرافق للمعالجة والتخلص من النفايات أو التي يتولد عن نشاطاتها نفايات. |
| مزاولو الخدمات البيئية | : الجهات العاملة في مجال جمع ونقل وتخزين وتدوير النفايات ومعالجتها والتخلص منها. |
| النفايات | : تشمل النفايات العادية والطبية والصناعية والخطرة وغيرها. |
الباب الثاني
في اختصاصات السلطة المختصة
مادة (2)
تتولى السلطة المختصة القيام على تحسين إدارة النفايات في الإمارة، من خلال تقليل النفايات الناتجة وتدويرها وإعادة استخدامها وتوفير حلول لمعالجة النفايات بكافة أنواعها ووضع الأولويات وأفضل الأساليب للتخلص منها، وذلك بالتنسيق مع الجهات المعنية إذا اقتضى الأمر، ولها على وجه الخصوص ما يلي:
1. الترخيص البيئي للمنشآت والنشاطات ذات العلاقة بالنفايات، والترخيص لمزاولي الخدمات البيئية.
2. مراجعة واعتماد طرق وآليات وتقنيات تداول وتخزين ومعالجة والتخلص من النفايات والتي تقترحها الجهات المعنية.
3. تقييم المنشآت القائمة لدى الجهات المعنية، وترخيص هذه المنشآت، وتعديل وضعها متى اقتضى الأمر ذلك.
4. مراجعة واعتماد خطط التشغيل والصيانة والطوارئ البيئية لمنشآت التخزين والمعالجة والتخلص من النفايات.
5. تحديد المتطلبات العامة لإدارة وتداول النفايات على مستوى الإمارة بالتنسيق مع الجهات المعنية إذا اقتضى الأمر، وتحدد السلطة النظم وأدلة الممارسة والأدلة الإرشادية التي تغطي كافة المتطلبات والإجراءات اللازمة لإدارة وتداول النفايات.
6. مراجعة واعتماد النظم وأدلة الممارسة والأدلة الإرشادية التي تعدها الجهات المعنية، والتدقيق على الالتزام بكافة النظم والأدلة.
7. مراقبة الالتزام بالقوانين واللوائح والنظم ذات العلاقة من خلال التفتيش على المنشآت والأنشطة المعنية العامة والخاصة والتدقيق على النظم والإجراءات ذات العلاقة التي تضعها الجهات المعنية.
8. متابعة تنفيذ هذا القانون بالتنسيق مع الجهات المعنية وذلك من خلال:
أ. اقتراح ومتابعة تنفيذ الضوابط اللازمة لتشجيع القطاع الخاص على تنفيذ مشاريع الإدارة النفايات.
ب. مراجعة المسائل البيئية المتعلقة بالنفايات وإيجاد الحلول المناسبة لها.
ج. التوعية بالمخاطر الصحية والبيئية للنفايات والنفايات الخطرة.
د. تشكيل اللجان الفنية والإدارية اللازمة لإدارة النفايات على مستوى الإمارة.
الباب الثالث
في مسؤوليات الجهات المعنية
مادة (3)
على الجهات المعنية أن تعمل على تحسين إدارة النفايات ضمن قطاعاتها المنتجة للنفايات أو المستقبلة لها، من خلال توفير نظم وحلول ناجحة ومتكاملة لإدارة وتخزين ومعالجة والتخلص من مختلف أنواع تلك النفايات، وبما يحقق متطلبات النظم وأدلة الممارسة والأدلة الإرشادية المعتمدة، وذلك بالقيام بالمهام التالية:
1. دراسة احتياجات قطاعاتها لاختيار الطرق والتقنيات والمنشآت والمرافق المناسبة، مع إعداد دراسات الجدوى الاقتصادية إذا اقتضى الأمر.
2. توفير منشآت كافية ومناسبة للتخزين والمعالجة والتخلص، سواء من خلال إمكانياتها الذاتية أو من خلال القطاع الخاص.
3. إلزام منشآتها المنتجة للنفايات بتنفيذ الالتزامات المبينة في المادة (5) من هذا القانون.
4. إلزام المنشآت والجهات التابعة لها والقائمة بنقل النفايات، بأدلة الممارسة والأدلة الإرشادية المتعلقة بترخيص مركبات نقل النفايات وتنظيم ومراقبة عمليات النقل.
5. إلزام منشآت التخزين والمعالجة والتخلص التابعة لها بتنفيذ أحكام المادة (6) من هذا القانون.
6. قصر عقود النفايات على مزاولي الخدمات البيئية المرخصين من قبل السلطة المختصة.
7. إعداد أية نظم أو أدلة ممارسة أو أدلة إرشادية إضافية ضرورية، واعتمادها من السلطة المختصة.
8. تقديم تقارير دورية إلى السلطة المختصة حول مدى تقدم إدارة النفايات.
9. توفير الهياكل التنظيمية والقوى البشرية والإمكانيات المادية اللازمة لتحقيق إدارة سليمة للنفايات.
مادة (4)
على الجهات المعنية التنسيق مع السلطة المختصة حول المسائل المتعلقة بإدارة النفايات التي لم يرد بها نص في هذا القانون.
يجوز للجهات المعنية إنشاء نظام لإدارة النفايات معتمد وخاضع للتدقيق من السلطة المختصة.
الباب الرابع
في التزامات منتجي النفايات
مادة (5)
على منتجي النفايات الالتزام بما يلي:
1. تقليل النفايات الناتجة بتطبيق النظم والوسائل والتقنيات والبدائل المعتمدة في الإمارة لتصنيف النفايات وفرزها وإعادة استخدامها أو تدويرها.
2. تصنيف النفايات الناتجة إلى نفايات خطرة ونفايات غير خطرة، على النحو المبين في الأدلة الإرشادية المعتمدة.
3. إلزام منشآتها المنتجة للنفايات بمتطلبات الصحة والسلامة المهنية، وكافة النظم والأدلة الإرشادية وأدلة الممارسة ذات العلاقة، والالتزام بالقواعد التي تضعها السلطة المختصة في هذا الشأن.
4. في حال القيام بنقل النفايات، يجب الالتزام بأدلة الممارسة والأدلة الإرشادية المتعلقة بترخيص مركبات نقل النفايات وتنظيم ومراقبة عمليات النقل.
5. في حال إنشاء منشآت لتخزين أو معالجة أو التخلص من النفايات، يجب الالتزام بأحكام المادة (6) من هذا القانون.
6. في حال التعاقد مع القطاع الخاص لنقل أو تخزين أو معالجة أو التخلص من النفايات يجب:
أ. قصر عقود النفايات على مزاولي الخدمات البيئية المرخصين من قبل السلطة المختصة.
ب. إعلام الجهات المهتمة بالتعاقد بكافة النفايات المصنفة كنفايات خطرة، وتزويد تلك الجهات بكافة البيانات المتوفرة لديها حول توصيف وخصائص تلك النفايات.
ج. عدم تسليم النفايات الطبية والخطرة إلى أية جهة راغبة بالتعاقد ما لم تحدد تلك الجهة الطرق التي ستطبقها على تلك النفايات وتبرز موافقة السلطة المختصة.
د. إتمام تسليم ونقل النفايات حسب النظم والأدلة المعتمدة.
الباب الخامس
في مسؤوليات منشآت التخزين والمعالجة والتخلص
مادة (6)
1. على الجهات المعنية والخاصة الراغبة في توفير منشآت لمعالجة النفايات والتخلص منها الالتزام بما يلي:
أ. الحصول من السلطة المختصة على موافقة مبدئية على الطرق والمنشآت والمرافق.
ب. إعداد تقرير لكل منشأة جديدة أو منشأة قائمة يتم تعديلها أو إغلاقها، بحيث يغطي التقرير كافة جوانب التصميم ومدى توفيره لاشتراطات القوانين ذات العلاقة، ويتم الحصول على موافقة السلطة المختصة عليه.
ج. تقديم دراسة لتقييم الأثر البيئي للمنشآت والمرافق الجديدة والحصول على ترخيص بيئي لها بما في ذلك موافقة السلطة المختصة على المواقع المختارة للإنشاء.
2. على منشآت التخزين والمعالجة والتخلص الالتزام بالنظم وأدلة الممارسة والأدلة الإرشادية المعتمدة.
3. لا يجوز لمنشآت التخزين والمعالجة والتخلص استلام أي شحنة نفايات خطرة إلا بعد الحصول على موافقة السلطة المختصة على الموقع والطرق التي ستستخدم في ذلك.
4. يجوز للسلطة المختصة إصدار موافقة سنوية للتخلص من شحنات متكررة من نفس النوع من النفايات الخطرة، من خلال ضوابط تضعها لهذا الغرض.
5. يجوز للجهات التي لديها نظم بيئية معتمدة من السلطة المختصة أن تتولى تنفيذ البندين (3) و(4) من هذه المادة شرط تزويد السلطة المختصة بتقارير دورية عن هذه النشاطات.
الباب السادس
في مسؤوليات مزاولي الخدمات البيئية
مادة (7)
على مزاولي الخدمات البيئية في إمارة أبوظبي الالتزام بما يلي:
1. الحصول على ترخيص من السلطة قبل مزاولة هذا النشاط.
2. عدم التعامل بأي نوع من النفايات قبل الحصول على ترخيص بذلك.
3. توفير الإمكانيات المادية والقوى البشرية اللازمة للتعامل بطريقة صحيحة مع النفايات المرخص بها.
4. العمل على تقليل النفايات الناتجة وإيجاد نظم ووسائل وتقنيات لفرز النفايات وإعادة استخدامها أو تدويرها، ورصد التقدم في هذا المجال.
5. الالتزام في جمع ونقل النفايات بأدلة الممارسة والأدلة الإرشادية المتعلقة بترخيص مركبات نقل النفايات وتنظيم ومراقبة عمليات النقل.
6. وضع وتطبيق خطط لتوفير متطلبات الصحة والسلامة المهنية، ومواجهة حالات التلوث والانسكاب والحوادث والطوارئ البيئية.
7. تدريب العاملين على التعامل الصحيح مع النفايات خاصة في حالات الطوارئ.
8. في حال إنشاء منشآت لتخزين أو معالجة أو التخلص من النفايات، يجب الالتزام بأحكام المادة (6) من هذا القانون.
9. الاحتفاظ بسجلات تبين أنواع النفايات التي يتم التعامل معها، ومصدرها، وكمياتها، وأية معالجة خضعت لها ونتائج التحليل قبل وبعد المعالجة، والجهات المستقبلة للنفايات للتخلص منها، وتزويد السلطة المختصة بتقارير دورية.
10. الالتزام بمتطلبات الأدلة الإرشادية وأدلة الممارسة ذات العلاقة.
الباب السابع
في الرقابة والتفتيش والعقوبات
مادة (8)
1. يصدر وزير العدل بالاتفاق مع رئيس مجلس إدارة السلطة المختصة أو نائبه قرارًا بتحديد موظفي السلطة ممن لهم صفة مأموري الضبط القضائي في مجال التفتيش على المنشآت والأماكن والمشاريع وغيرها، للتحقق من التزامها بأحكام القوانين.
2. لمفتشي السلطة المختصة ممن لهم صفة مأموري الضبط القضائي حق دخول كافة مواقع ومنشآت إنتاج وتداول ومعالجة والتخلص من النفايات بجميع أنواعها في أي وقت وتحرير محاضر بالتفتيش وضبط المخالفات، وعلى صاحب المنشأة التعاون مع المفتشين وتمكينهم من الوصول لكافة أجزاء الموقع أو المنشأة، وتزويدهم بكافة المعلومات المطلوبة.
3. للجهات المعنية التي يتوفر لديها نظام بيئي معتمد وخاضع للتدقيق من السلطة المختصة القيام بالتفتيش على مواقع ومنشآت إنتاج وتداول ومعالجة والتخلص من النفايات والنفايات الخطرة التابعة لها.
4. لمفتشي السلطة المختصة وقف نشاط أي منشأة أو منع استعمال أية مادة أو أداة أو آلة إذا كان استمرار النشاط أو الاستعمال يشكل خطرًا على صحة وسلامة الإنسان والبيئة.
مادة (9)
1. مع عدم الإخلال بأية عقوبة أشد ينص عليها قانون آخر، يعاقب كل من يخالف أحكام هذا القانون بالحبس والغرامة التي لا تقل عن خمسة آلاف درهم ولا تزيد على عشرة آلاف درهم، أو بإحدى هاتين العقوبتين، ويجوز الحكم بمصادرة المواد والأدوات والآلات المخالفة المنصوص عليها في المادة (8) من هذا القانون، وتضاعف العقوبة في حالة العود.
2. وفي جميع الأحوال يلتزم المخالف بإزالة آثار المخالفة في الموعد الذي تحدده السلطة المختصة، فإذا لم يقم بذلك قامت السلطة بإزالتها على نفقته.
3. كل من تسبب بفعله أو إهماله في إحداث ضرر بالبيئة يتحمل كافة التكاليف اللازمة لمعالجة هذا الضرر.
الباب الثامن
في أحكام ختامية
مادة (10)
1. يقوم رئيس مجلس إدارة السلطة المختصة أو نائبه بإصدار اللوائح والنظم والأدلة الإرشادية وأدلة الممارسة والقرارات التنفيذية اللازمة لتطبيق هذا القانون.
2. تقوم السلطة المختصة باقتراح جدول بالرسوم المفروضة على النشاطات الخاضعة لهذا القانون ورفع الرسوم إلى المجلس التنفيذي لاعتمادها.
مادة (11)
يُلغى القانون رقم (4) لسنة 1998 في شأن النفايات الطبية للمنشآت الصحية في إمارة أبوظبي، كما يُلغى كل حكم يخالف أحكام هذا القانون.
مادة (12)
يُنشر هذا القانون في الجريدة الرسمية، ويُعمل به من تاريخ نشره.

Concerning Waste Management in the Emirate of Abu Dhabi
We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi,
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (2) of 1971 concerning the National Consultative Council and its amendments,
- And Law No. (4) of 1998 concerning Medical Waste from Health Facilities in the Emirate of Abu Dhabi,
- And Law No. (6) of 2004 on the Reorganization of the Financial Audit Authority,
- And Law No. (16) of 2005 on the Reorganization of the Environment Agency – Abu Dhabi,
- And Federal Law No. (35) of 1992 promulgating the Criminal Procedure Law,
- And Federal Law No. (7) of 1993 establishing the Federal Environment Agency and its amendments,
- And Federal Law No. (24) of 1999 on the Protection and Development of the Environment,
And based on what was presented to the Executive Council, and the Council's approval thereof,
We have issued the following Law:
Chapter One
Definitions
Article (1)
In the application of the provisions of this Law, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:
| The Emirate | : The Emirate of Abu Dhabi. |
| The Government | : The Government of Abu Dhabi. |
| The Competent Authority | : The Environment Agency of the Emirate of Abu Dhabi. |
| The Concerned Entities | : Governmental or private entities that have facilities for the treatment and disposal of waste or whose activities generate waste. |
| Environmental Service Providers | : Entities working in the field of collecting, transporting, storing, recycling, treating, and disposing of waste. |
| Waste | : Includes ordinary, medical, industrial, hazardous, and other types of waste. |
Chapter Two
Competencies of the Competent Authority
Article (2)
The Competent Authority shall undertake the improvement of waste management in the Emirate by reducing, recycling, and reusing generated waste, providing solutions for treating all types of waste, and setting priorities and best methods for its disposal, in coordination with the concerned entities as required. It shall, in particular, have the following responsibilities:
1. Issuing environmental permits for facilities and activities related to waste, and licensing environmental service providers.
2. Reviewing and approving the methods, mechanisms, and technologies for handling, storing, treating, and disposing of waste proposed by the concerned entities.
3. Evaluating existing facilities of the concerned entities, licensing these facilities, and modifying their status when necessary.
4. Reviewing and approving the operation, maintenance, and environmental emergency plans for waste storage, treatment, and disposal facilities.
5. Determining the general requirements for waste management and handling at the Emirate level in coordination with the concerned entities as required. The Authority shall specify the systems, codes of practice, and guidelines covering all necessary requirements and procedures for waste management and handling.
6. Reviewing and approving the systems, codes of practice, and guidelines prepared by the concerned entities, and auditing compliance with all systems and guides.
7. Monitoring compliance with relevant laws, regulations, and systems through inspection of public and private facilities and concerned activities, and auditing the relevant systems and procedures established by the concerned entities.
8. Following up on the implementation of this Law in coordination with the concerned entities through:
a. Proposing and following up on the implementation of the necessary controls to encourage the private sector to implement waste management projects.
b. Reviewing environmental issues related to waste and finding appropriate solutions for them.
c. Raising awareness of the health and environmental risks of waste and hazardous waste.
d. Forming the necessary technical and administrative committees for waste management at the Emirate level.
Chapter Three
Responsibilities of the Concerned Entities
Article (3)
The concerned entities shall work to improve waste management within their waste-producing or waste-receiving sectors by providing successful and integrated systems and solutions for the management, storage, treatment, and disposal of various types of waste, in a manner that meets the requirements of the approved systems, codes of practice, and guidelines, by undertaking the following tasks:
1. Studying the needs of their sectors to select appropriate methods, technologies, facilities, and utilities, with the preparation of economic feasibility studies if necessary.
2. Providing sufficient and appropriate facilities for storage, treatment, and disposal, either through their own capabilities or through the private sector.
3. Obliging their waste-producing facilities to implement the obligations set out in Article (5) of this Law.
4. Obliging their affiliated facilities and entities involved in waste transportation to adhere to the codes of practice and guidelines related to the licensing of waste transport vehicles and the regulation and monitoring of transport operations.
5. Obliging their affiliated storage, treatment, and disposal facilities to implement the provisions of Article (6) of this Law.
6. Restricting waste contracts to environmental service providers licensed by the Competent Authority.
7. Preparing any necessary additional systems, codes of practice, or guidelines, and having them approved by the Competent Authority.
8. Submitting periodic reports to the Competent Authority on the progress of waste management.
9. Providing the organizational structures, human resources, and material capabilities necessary to achieve sound waste management.
Article (4)
The concerned entities shall coordinate with the Competent Authority on matters related to waste management that are not addressed in this Law.
The concerned entities may establish a waste management system that is approved and subject to audit by the Competent Authority.
Chapter Four
Obligations of Waste Producers
Article (5)
Waste producers shall adhere to the following:
1. Reducing generated waste by applying the systems, means, technologies, and alternatives approved in the Emirate for waste classification, sorting, reuse, or recycling.
2. Classifying generated waste into hazardous and non-hazardous waste, as specified in the approved guidelines.
3. Obliging their waste-producing facilities to comply with occupational health and safety requirements, and all relevant systems, guidelines, and codes of practice, and to adhere to the rules established by the Competent Authority in this regard.
4. In the case of transporting waste, they must adhere to the codes of practice and guidelines related to the licensing of waste transport vehicles and the regulation and monitoring of transport operations.
5. In the case of establishing facilities for the storage, treatment, or disposal of waste, they must adhere to the provisions of Article (6) of this Law.
6. In the case of contracting with the private sector for the transport, storage, treatment, or disposal of waste, they must:
a. Restrict waste contracts to environmental service providers licensed by the Competent Authority.
b. Inform the entities interested in contracting of all waste classified as hazardous, and provide them with all available data on the description and characteristics of such waste.
c. Not hand over medical and hazardous waste to any contracting party unless that party specifies the methods it will apply to such waste and presents the approval of the Competent Authority.
d. Complete the delivery and transport of waste according to the approved systems and guidelines.
Chapter Five
Responsibilities of Storage, Treatment, and Disposal Facilities
Article (6)
1. Concerned and private entities wishing to provide facilities for waste treatment and disposal must adhere to the following:
a. Obtain initial approval from the Competent Authority for the methods, facilities, and utilities.
b. Prepare a report for each new facility or for any existing facility that is to be modified or closed, such that the report covers all aspects of the design and its compliance with the requirements of relevant laws, and obtain the approval of the Competent Authority for it.
c. Submit an environmental impact assessment study for new facilities and utilities and obtain an environmental permit for them, including the approval of the Competent Authority on the selected construction sites.
2. Storage, treatment, and disposal facilities must adhere to the approved systems, codes of practice, and guidelines.
3. Storage, treatment, and disposal facilities may not receive any shipment of hazardous waste without first obtaining the approval of the Competent Authority for the site and the methods to be used.
4. The Competent Authority may issue an annual approval for the disposal of recurring shipments of the same type of hazardous waste, through controls it establishes for this purpose.
5. Entities with environmental systems approved by the Competent Authority may undertake the implementation of clauses (3) and (4) of this Article, provided they supply the Competent Authority with periodic reports on these activities.
Chapter Six
Responsibilities of Environmental Service Providers
Article (7)
Environmental service providers in the Emirate of Abu Dhabi must adhere to the following:
1. Obtain a license from the Authority before practicing this activity.
2. Not deal with any type of waste before obtaining a license to do so.
3. Provide the necessary material capabilities and human resources to handle the licensed waste correctly.
4. Work to reduce generated waste and establish systems, means, and technologies for sorting, reusing, or recycling waste, and monitor progress in this area.
5. Adhere, in the collection and transport of waste, to the codes of practice and guidelines related to the licensing of waste transport vehicles and the regulation and monitoring of transport operations.
6. Develop and implement plans to meet occupational health and safety requirements, and to address cases of pollution, spills, accidents, and environmental emergencies.
7. Train workers on the correct handling of waste, especially in emergency situations.
8. In the case of establishing facilities for the storage, treatment, or disposal of waste, they must adhere to the provisions of Article (6) of this Law.
9. Maintain records showing the types of waste handled, their source, quantities, any treatment they have undergone and the analysis results before and after treatment, and the entities receiving the waste for disposal, and provide the Competent Authority with periodic reports.
10. Adhere to the requirements of the relevant guidelines and codes of practice.
Chapter Seven
Supervision, Inspection, and Penalties
Article (8)
1. The Minister of Justice, in agreement with the Chairman of the Board of the Competent Authority or his deputy, shall issue a decision identifying the employees of the Authority who have the capacity of judicial officers in the field of inspecting facilities, places, projects, and others, to verify their compliance with the provisions of the laws.
2. Inspectors of the Competent Authority who have the capacity of judicial officers have the right to enter all sites and facilities for the production, handling, treatment, and disposal of all types of waste at any time, to write inspection reports, and to record violations. The owner of the facility must cooperate with the inspectors, enable them to access all parts of the site or facility, and provide them with all required information.
3. Concerned entities that have an approved environmental system subject to audit by the Competent Authority may conduct inspections of their own sites and facilities for the production, handling, treatment, and disposal of waste and hazardous waste.
4. Inspectors of the Competent Authority may stop the activity of any facility or prohibit the use of any material, tool, or machine if the continuation of the activity or use poses a danger to human health and safety and the environment.
Article (9)
1. Without prejudice to any more severe penalty stipulated by another law, anyone who violates the provisions of this Law shall be punished with imprisonment and a fine of not less than five thousand dirhams and not more than ten thousand dirhams, or one of these two penalties. The court may order the confiscation of the offending materials, tools, and machines stipulated in Article (8) of this Law, and the penalty shall be doubled in case of recurrence.
2. In all cases, the violator is obliged to remove the effects of the violation by the date set by the Competent Authority. If they fail to do so, the Authority will remove them at the violator's expense.
3. Anyone who, by their action or negligence, causes damage to the environment shall bear all costs necessary to remedy this damage.
Chapter Eight
Final Provisions
Article (10)
1. The Chairman of the Board of the Competent Authority or his deputy shall issue the regulations, systems, guidelines, codes of practice, and executive decisions necessary for the application of this Law.
2. The Competent Authority shall propose a schedule of fees imposed on activities subject to this Law and submit the fees to the Executive Council for approval.
Article (11)
Law No. (4) of 1998 concerning Medical Waste from Health Facilities in the Emirate of Abu Dhabi is hereby repealed, as is any provision that contradicts the provisions of this Law.
Article (12)
This Law shall be published in the Official Gazette and shall come into force from the date of its publication.
