قرار إداري رقم (195) لسنة 2018
بشأن دمج العزب المتجاورة لنفس المستأجر
في إمارة أبوظبي

بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (11) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (5) لسنة 2018 بشأن إنشاء دائرة التخطيط العمراني والبلديات،
- - وعلى المرسوم الأميري رقم (13) لسنة 2017 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي،
- - وعلى قرار رئيس المجلس التنفيذي رقم (73) لسنة 2015 بشأن تنظيم شؤون العزب،
- - وعلى القرار الإداري رقم (33) لسنة 2018 بشأن اعتماد الدليل الإرشادي لطلبات عزب التربية الجديدة،
- - وعلى التعميم رقم (17) لسنة 2018 بشأن تأجيل تحصيل التأمين على جميع فئات العزب،
وبناء على ما تقتضيه مصلحة العمل،
تقرر ما يلي:
المادة (1)
- على البلدية القيام بدمج العزب المتجاورة لنفس المستأجر شريطة عدم وجود موانع تخطيطية، على أن يصدر لهما عقد إيجار وعقد إدارة نفايات، باعتبارها في حكم العزبة الواحدة.
- للبلدية إعادة العزب المدمجة إلى ما كانت عليه قبل الدمج إذا اقتضى الأمر، ولا يترتب على ذلك أية تعويضات للمستأجر.
المادة (2)
يُنفذ هذا القرار اعتبارًا من تاريخ صدوره، ويُلغي كل ما يخالفه، وينشر في الجريدة الرسمية.

Regarding the Merger of Adjacent 'Ezbas for the Same Tenant
in the Emirate of Abu Dhabi

Having reviewed Law No. (1) of 1974 regarding the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amendments,
- - And Law No. (10) of 2006 concerning the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi and its amendments,
- - And Law No. (10) of 2007 concerning the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi and its amendments,
- - And Law No. (11) of 2007 concerning the Municipality and Municipal Council of Al Ain City in the Emirate of Abu Dhabi and its amendments,
- - And Law No. (5) of 2018 concerning the establishment of the Department of Urban Planning and Municipalities,
- - And Emiri Decree No. (13) of 2017 regarding the reconstitution of the Executive Council of the Emirate of Abu Dhabi,
- - And the Chairman of the Executive Council's Decision No. (73) of 2015 regarding the regulation of 'Ezbas affairs,
- - And Administrative Decision No. (33) of 2018 regarding the adoption of the guideline for new breeding 'Ezbas applications,
- - And Circular No. (17) of 2018 regarding the postponement of insurance collection for all categories of 'Ezbas,
And based on the public interest,
The following has been decided:
Article (1)
- The municipality shall merge adjacent 'Ezbas belonging to the same tenant, provided there are no planning impediments. A single lease contract and a single waste management contract shall be issued for them, treating them as one 'Ezba.
- The municipality may revert the merged 'Ezbas to their pre-merger status if necessary, and this shall not result in any compensation for the tenant.
Article (2)
This decision shall be effective from the date of its issuance, shall repeal any conflicting provisions, and shall be published in the Official Gazette.
