بشأن تنظيم مواد ناتج الحفر في بلديات إمارة أبوظبي
رئيس دائرة التخطيط العمراني والبلديات:
- - بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (11) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (5) لسنة 2018 بشأن إنشاء دائرة التخطيط العمراني والبلديات،
- - وعلى المرسوم الأميري رقم (13) لسنة 2017 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي،
- - وعلى قرار المجلس التنفيذي الموقر رقم (32/001/6/2017) بشأن التعديل على سياسة تقديم خدمات الدفان والتسوية والتكديش على مستوى دائرة الشؤون البلدية والنقل والبلديات الثلاث على ضوء قرار لجنة البنية التحتية والبيئة رقم (38ج 39/2016)،
- - وعلى التعميم الإداري رقم (18) لسنة 2015م في شأن الاستفادة من مواد ناتج الحفر في أعمال الدفان،
- - وبناءً على ما تقتضيه المصلحة العامة،
تقرر ما يلي:
المادة (1)
على كل بلدية القيام بالآتي:
- إلزام مقاولي المشاريع العمرانية، باستثناء المشاريع السكنية الفردية الخاصة بالمواطنين، بنقل مواد ناتج الحفر الفائضة عن حاجة هذه المشاريع إلى المواقع التي تحددها البلدية.
- إصدار تصاريح نقل مواد ناتج الحفر إلى المقاولين ومتابعة تنفيذ هذه التصاريح حسب الأنظمة المعمول بها.
المادة (2)
تقوم كل بلدية بالاستفادة من ناتج الحفر في تسوية وتعديل مناسيب المناطق المنخفضة وفقاً للخطة الموضوعة في هذا الشأن.
المادة (3)
ينفذ هذا القرار اعتباراً من تاريخ صدوره، ويُعمم على كافة الجهات المعنية وذلك للعمل بموجبه كل فيما يخصه.

Regarding the Regulation of Excavated Materials in the Municipalities of the Emirate of Abu Dhabi
The Chairman of the Department of Urban Planning and Municipalities:
- - Having reviewed Law No. (1) of 1974 regarding the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amending laws,
- - And Law No. (10) of 2006 concerning the Western Region Municipality and Municipal Council in the Emirate of Abu Dhabi and its amending laws,
- - And Law No. (10) of 2007 concerning the Abu Dhabi City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amending laws,
- - And Law No. (11) of 2007 concerning the Al Ain City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amending laws,
- - And Law No. (5) of 2018 regarding the establishment of the Department of Urban Planning and Municipalities,
- - And Emiri Decree No. (13) of 2017 regarding the reconstitution of the Executive Council of the Emirate of Abu Dhabi,
- - And the esteemed Executive Council Decision No. (32/001/6/2017) regarding the amendment to the policy of providing backfilling, leveling, and stockpiling services at the level of the Department of Municipal Affairs and Transport and the three municipalities, in light of the Infrastructure and Environment Committee Decision No. (38C 39/2016),
- - And Administrative Circular No. (18) of 2015 regarding the utilization of excavated materials in backfilling works,
- - And based on the requirements of the public interest,
It is decided as follows:
Article (1)
Each municipality shall undertake the following:
- Oblige contractors of urban projects, with the exception of individual residential projects for citizens, to transport surplus excavated materials from these projects to the sites specified by the municipality.
- Issue permits for transporting excavated materials to contractors and follow up on the implementation of these permits according to the applicable regulations.
Article (2)
Each municipality shall utilize excavated materials for leveling and adjusting the elevations of low-lying areas in accordance with the plan established for this purpose.
Article (3)
This decision shall be effective from the date of its issuance and shall be circulated to all concerned parties to act upon it, each within their respective jurisdiction.
