بشأن خدمات أعمال الدفان والتسوية في إمارة أبوظبي
رئيس دائرة التخطيط العمراني والبلديات:
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (11) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (5) لسنة 2018 بشأن إنشاء دائرة التخطيط العمراني والبلديات،
- وعلى المرسوم الأميري رقم (13) لسنة 2017 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي،
- وعلى قرار المجلس التنفيذي الموقر رقم (2017/6/001/32) بشأن التعديل على سياسة تقديم خدمات الدفان والتسوية والتكديش على مستوى دائرة الشؤون البلدية والنقل والبلديات الثلاث على ضوء قرار لجنة البنية التحتية والبيئة رقم ( 38جـ 2016/39)،
- وعلى القرار الإداري رقم (79) لسنة 2017 بشأن سياسة تقديم خدمات أعمال الدفان والتسوية والتكديش والطوارئ وإدارة المحاجر وتنظيم مواد ناتج الحفر،
- وبناءً على ما تقتضيه المصلحة العامة،
تقرر ما يلي:
المادة (1)
تقدم البلديات خدمات أعمال الدفان والتسوية في إمارة أبوظبي وفقاً لهذا القرار والجدول المرفق به.
المادة (2)
- يقتصر تقديم أعمال الدفان والتسوية للأراضي السكنية غير المبنية فقط.
- تقوم إدارة إجراءات تراخيص البناء في الدائرة بإضافة خانة خاصة لطلبات أعمال الدفان وتسوية الأراضي السكنية غير المبنية في نظام تراخيص البناء. وفي حال رغب مالك المشروع أو من ينوب عنه في إصدار ترخيص البناء قبل تنفيذ هذه الأعمال، يتم التوقيع على إقرار بهذا الشأن.
- استثناء لما ذكر في البند (1) أعلاه، تقدم أعمال الدفان والتسوية للأراضي السكنية قيد الإنشاء الصادر لها ترخيص بناء قبل صدور هذا القرار.
المادة (3)
- يشترط استكمال أعمال الدفان والتسوية قبل تأجير العزب النظامية المستحدثة، وفي حال رغب المستأجر في استلام العزبة قبل اكتمال هذه الأعمال يتم دراسة الطلب من قبل البلدية المعنية والبت فيه.
- يمنع تقديم خدمات أعمال الدفان والتسوية داخل العزب الواقعة خارج مجمعات العزب النظامية المستحدثة.
المادة (4)
مع مراعاة ما جاء أعلاه، تقدم خدمات أعمال الدفان والتسوية للأراضي (السكنية، الصناعية، التجارية، الاستثمارية) والعزب ومزارع المواطنين النظامية الجديدة، والمزارع المعاد تسليمها لمستفيدين جدد والتي بحاجة إلى أعمال دفان وتسوية، والمزارع المسورة التي لم يسبق للبلدية تنفيذ أعمال الدفان والتسوية فيها، وذلك لمرة واحدة فقط في حال كانت عائدة لذات المستفيد.
المادة (5)
تكون الأولوية في تنفيذ أعمال الدفان والتسوية على النحو التالي:
- الأراضي السكنية.
- الأراضي الزراعية.
- طلبات الجهات الحكومية وردم المستنقعات وطوارئ الأمطار.
- العزب.
- الاستراحات البحرية.
- الأخرى.
المادة (6)
تنفذ أعمال الدفان والتسوية في حدود التكلفة المالية المعتادة، وفي حال وجود اختلافات بالمناسيب عن مناسيب الخدمات المجاورة بتكلفة مالية تتجاوز ميزانية العمل، تتم دراسة كل حالة ورفعها إلى مدير عام البلدية المعنية لاتخاذ القرار بشأنها.
المادة (7)
تقوم كل بلدية بتقديم أعمال الدفان والتسوية للطلبات المقدمة قبل صدور هذا القرار والمشمولة ضمن بنود القرار الإداري رقم (79) لسنة 2017 بشأن سياسة تقديم خدمات أعمال الدفان والتسوية والطوارئ وإدارة المحاجر وتنظيم مواد ناتج الحفر.
المادة (8)
يلغى القرار الإداري رقم (79) لسنة 2017 بشأن سياسة تقديم خدمات أعمال الدفان والتسوية والتكديش والطوارئ وإدارة المحاجر وتنظيم مواد ناتج الحفر.
المادة (9)
ينفذ هذا القرار اعتباراً من تاريخ صدوره، ويُعمم على كافة الجهات المعنية وذلك للعمل بموجبه كل فيما يخصه.

تنفذ الطلبات وفقاً للآتي:
• تسوية كامل مساحة المزرعة.
• تنفيذ طريق بمواد مستعارة حول سور المزرعة بعرض (6)م.
• تنفيذ طريق بمواد مستعارة في منتصف المزرعة بعرض (6)م يصل البوابة بآخر المزرعة.
• تنفيذ ساحة بمواد مستعارة بأبعاد 10x30 أمتار. |

• تنفيذ طريق بمواد مستعارة حول سور العزبة بعرض (3)م متى ما دعت الحاجة إلى ذلك.
• تنفيذ ساحة بمواد مستعارة بنسبة 10% من النسبة الكلية للعزبة. |

Regarding Backfilling and Levelling Works Services in the Emirate of Abu Dhabi
The Chairman of the Department of Urban Planning and Municipalities:
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (10) of 2006 concerning the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (10) of 2007 concerning the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (11) of 2007 concerning the Municipality and Municipal Council of Al Ain City in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (5) of 2018 on the establishment of the Department of Urban Planning and Municipalities,
- And Emiri Decree No. (13) of 2017 on the restructuring of the Executive Council of the Emirate of Abu Dhabi,
- And the esteemed Executive Council's Decision No. (2017/6/001/32) regarding the amendment to the policy of providing backfilling, levelling, and stockpiling services at the level of the Department of Municipal Affairs and Transport and the three municipalities in light of the Infrastructure and Environment Committee's Decision No. (38C 2016/39),
- And Administrative Decision No. (79) of 2017 regarding the policy of providing backfilling, levelling, stockpiling, emergency services, quarry management, and regulation of excavation materials,
- And based on the requirements of the public interest,
The following has been decided:
Article (1)
Municipalities shall provide backfilling and levelling works services in the Emirate of Abu Dhabi in accordance with this Decision and its attached schedule.
Article (2)
- The provision of backfilling and levelling works is restricted to undeveloped residential lands only.
- The Building Permits Procedures Department in the Department shall add a special field for requests for backfilling and levelling of undeveloped residential lands in the building permit system. If the project owner or their representative wishes to obtain a building permit before these works are executed, a declaration to this effect shall be signed.
- Notwithstanding what is stated in clause (1) above, backfilling and levelling works shall be provided for residential lands under construction for which a building permit was issued before the issuance of this Decision.
Article (3)
- It is required to complete backfilling and levelling works before leasing newly established official farmsteads. If the lessee wishes to receive the farmstead before the completion of these works, the request shall be studied and decided upon by the concerned municipality.
- The provision of backfilling and levelling works services inside farmsteads located outside the newly established official farmstead complexes is prohibited.
Article (4)
Taking into consideration the above, backfilling and levelling works services shall be provided for lands (residential, industrial, commercial, investment), farmsteads, new official citizen farms, farms re-delivered to new beneficiaries that require backfilling and levelling works, and fenced farms where the municipality has not previously executed backfilling and levelling works, for one time only if it belongs to the same beneficiary.
Article (5)
The priority for executing backfilling and levelling works shall be as follows:
- Residential lands.
- Agricultural lands.
- Governmental entities' requests, swamp backfilling, and rain emergencies.
- Farmsteads.
- Marine rest houses.
- Others.
Article (6)
Backfilling and levelling works shall be executed within the usual financial cost limits. In the event of level differences from the levels of adjacent services with a financial cost exceeding the work budget, each case shall be studied and submitted to the Director-General of the concerned municipality to make a decision thereon.
Article (7)
Each municipality shall provide backfilling and levelling works for requests submitted before the issuance of this Decision and included within the provisions of Administrative Decision No. (79) of 2017 regarding the policy of providing backfilling, levelling, emergency services, quarry management, and regulation of excavation materials.
Article (8)
Administrative Decision No. (79) of 2017 regarding the policy of providing backfilling, levelling, stockpiling, emergency services, quarry management, and regulation of excavation materials is hereby repealed.
Article (9)
This Decision shall be effective from the date of its issuance and shall be circulated to all concerned parties to act accordingly, each within its jurisdiction.

Regarding the Schedule for Providing Backfilling and Levelling Works Services in the Emirate of Abu Dhabi

• Levelling the entire farmstead area.

• Constructing a yard with borrowed materials covering 10% of the total farmstead area. |
