Administrative Decision No. (100) of 2018
Regarding Housing for Low-Income Individuals
The Chairman of the Department of Urban Planning and Municipalities:
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Government Apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (4) of 1983 regarding the Regulation of Construction Works and its amending laws,
- And Law No. (3) of 2005 regarding the Regulation of Real Estate Registration in the Emirate of Abu Dhabi,
- And Law No. (19) of 2005 on Real Estate Property and its amendments,
- And Law No. (10) of 2006 on the Establishment of the Western Region Municipality and Municipal Council and its amendments,
- And Law No. (20) of 2006 regarding the Tenancy of Premises and the Regulation of the Landlord-Tenant Relationship in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (10) of 2007 on the Establishment of the Abu Dhabi City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (11) of 2007 on the Establishment of the Al Ain City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (1) of 2011 regarding the Regulation of Occupancy of Residential Units and the Use of Properties Allocated to Citizens in the Emirate of Abu Dhabi,
- And Law No. (2) of 2012 regarding the Preservation of Public Appearance, Health, and Public Tranquility,
- And Law No. (5) of 2018 on the Establishment of the Department of Urban Planning and Municipalities,
- And Administrative Decision No. (182) of 2017 on the Executive Regulations of Law No. (4) of 1983 regarding the Regulation of Construction Works in the Emirate of Abu Dhabi,
- And Executive Committee Decision (4) C-2010/18) on the policy of allocating housing for middle-income individuals in developmental housing projects,
- And Executive Committee Decision No. (ECAS/685) dated April 16, 2017, regarding the documentation of Directive No. (2) of 2016 concerning the Low-Income Housing Program,
- And Infrastructure and Environment Committee Decision No. (ECAS/914) dated April 13, 2016, regarding housing for low-income individuals,
- And based on the requirements of the public interest,
The following has been decided:
Article (1)
Definitions
For the purposes of implementing the provisions of this Decision, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:

: Department of Urban Planning and Municipalities |
| The Municipality |
: Abu Dhabi City Municipality, Al Ain City Municipality, Al Dhafra Region Municipality, or any other municipality that may be established in the future in the Emirate. |
| The Law |
: Law No. (1) of 2011 regarding the Regulation of Occupancy of Residential Units and the Use of Properties Allocated to Citizens in the Emirate of Abu Dhabi and its Executive Regulations. |
| Low-Income Housing |
: Residential units designated for housing low-income individuals. |
| Low-Income Individuals |
: Workers in the service sector with a low annual income and housing allowance, or without allowances. |
| The Residential Unit |
: The property prepared for rent or any part thereof, designated for use as housing for low-income individuals. |
| The Occupant |
: Any natural person from low-income individuals who resides in the residential unit on a temporary basis. |
| The Lessor |
: The property owner or their representative, or any person associated with the owner by a written contract authorizing them to invest in or manage the property on their behalf. |
| The Lessee |
: The owner of the establishment or commercial shop, or their representative, who is bound with the lessor by a lease contract for one or more residential units for the purpose of housing their low-income employees. |
| The Service Sector |
: The sector concerned with commercial, tourism, health, educational, and other services in the Emirate. |
Article (2)
Objective of this Decision
This Decision aims to ensure the implementation of housing for low-income individuals within the mechanisms and regulations of the Municipality followed in the Emirate.
Article (3)
Scope of Application
The provisions of this Decision shall apply to all owners, lessors, lessees, and occupants of properties and residential units registered as housing for low-income individuals in the Emirate of Abu Dhabi.
Article (4)
Registration of Units
The property owner shall be obliged to register the project and units as housing for low-income individuals in accordance with the regulations in force at the Municipality if they wish to utilize the property as housing for low-income individuals.
Article (5)
Unit Specifications and Number of Occupants
1. The number of occupants of a residential unit shall be determined in proportion to its area, and the space allocated for each occupant of that unit must not be less than 8.3 square meters of the total area of the residential unit.
2. The number of occupants in a single room within the residential unit may not exceed 3 persons.
3. It is prohibited for more than one family to share occupancy of a single residential unit.
4. It is prohibited for a family to share with persons with whom they have no kinship.
5. It is prohibited to use or lease halls and corridors in the residential unit as bedrooms.
Article (6)
Rental Cost
The rental value is set at a maximum of 35% of the individual's income, and the number of occupants shall be taken into account when determining the rental value of the residential unit as follows:
• Family housing: 35% of the total income of the family members, represented by the husband and wife.
• Bachelor housing: 35% of the total income of the individuals.
Article (7)
Stipulations and Standards
The stipulations and standards for housing low-income individuals attached to this Decision shall be applied.
Article (8)
Administration and Regulation
Each municipality shall undertake the following tasks:
1. Follow up on projects for housing low-income individuals and monitor their operation.
2. Submit periodic reports to the Department on the extent of compliance by property owners or lessees with the stipulations and standards for housing low-income individuals.
Article (9)
This Decision shall be effective from the date of its issuance and shall be published in the Official Gazette.
