قرار إداري رقم (152) لسنة 2018

بشأن الأعمال الزراعية والتجميلية خارج حدود القسائم
السكنية في إمارة أبوظبي

رئيس دائرة التخطيط العمراني والبلديات:

- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،

- على القانون رقم (4) لسنة 1983 في شأن تنظيم أعمال البناء في إمارة أبوظبي وتعديلاته ولائحته التنفيذية،

- وعلى القانون رقم (10) لسنة 2006 في شأن إنشاء بلدية ومجلس بلدي المنطقة الغربية وتعديلاته،

- وعلى القانون رقم (10) لسنة 2007 في شأن إنشاء بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي وتعديلاته،

- وعلى القانون رقم (11) لسنة 2007 في شأن إنشاء بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي وتعديلاته،

- وعلى القانون رقم (2) لسنة 2012 بشأن الحفاظ على المظهر العام والصحة والسكينة العامة،

- وعلى القانون رقم (5) لسنة 2018 بشأن إنشاء دائرة التخطيط العمراني والبلديات،

- وعلى القرار الإداري رقم (5) لسنة 2006 بشأن ترخيص مظلات سيارات مؤقتة خارج حدود القسائم السكنية،

- وعلى القرار الإداري رقم (115) لسنة 2018 بشأن تعديل بعض أحكام القرار الإداري رقم (5) لسنة 2006 بشأن ترخيص مظلات سيارات مؤقتة خارج حدود القسائم،

- وعلى القرار الإداري رقم (138) لسنة 2018 بشأن تنظيم الأعمال خارج حدود القسائم السكنية،

- وبناء على ما تقتضيه المصلحة العامة،

تقرر ما يلي:

مادة (1)

يُستثنى ملاك القسائم السكنية من سداد رسوم تراخيص وتجديد المظلات الخارجية في حال قيامهم بالأعمال الزراعية التجميلية خارج حدود هذه القسائم وفقًا للاشتراطات والمعايير الواردة في دليل القرار الإداري رقم (138) لسنة 2018 م.

مادة (2)

ينفذ هذا القرار اعتبارًا من تاريخ صدوره ويعمم على كافة الجهات المعنية للعمل بموجبه كل فيما يخصه.

Regarding Agricultural and Landscaping Works Outside the Boundaries of Residential Plots
in the Emirate of Abu Dhabi

The Chairman of the Department of Urban Planning and Municipalities:

- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Body in the Emirate of Abu Dhabi and its amendments,

- And Law No. (4) of 1983 Regarding the Regulation of Construction Works in the Emirate of Abu Dhabi, its amendments, and its executive regulations,

- And Law No. (10) of 2006 on the Establishment of the Western Region Municipality and Municipal Council and its amendments,

- And Law No. (10) of 2007 on the Establishment of Abu Dhabi City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,

- And Law No. (11) of 2007 on the Establishment of Al Ain City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,

- And Law No. (2) of 2012 Regarding the Preservation of Public Appearance, Health, and Public Tranquility,

- And Law No. (5) of 2018 on the Establishment of the Department of Urban Planning and Municipalities,

- And Administrative Decision No. (5) of 2006 Regarding the Licensing of Temporary Car Canopies Outside the Boundaries of Residential Plots,

- And Administrative Decision No. (115) of 2018 Regarding the Amendment of Certain Provisions of Administrative Decision No. (5) of 2006 on the Licensing of Temporary Car Canopies Outside the Boundaries of Plots,

- And Administrative Decision No. (138) of 2018 Regarding the Regulation of Works Outside the Boundaries of Residential Plots,

- And based on the requirements of the public interest,

The following has been decided:

Article (1)

Owners of residential plots shall be exempted from paying the licensing and renewal fees for external canopies if they carry out cosmetic agricultural works outside the boundaries of these plots, in accordance with the requirements and standards stipulated in the guide for Administrative Decision No. (138) of 2018.

Article (2)

This decision shall be effective from the date of its issuance and shall be circulated to all concerned authorities to act upon it, each within its own jurisdiction.
