بشأن تطبيق كودات أبو ظبي الدولية للبناء
(المجموعة الأولى)

- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي والقوانين المعدلة له.

- وعلى القانون رقم (4) لسنة 1983 في شأن تنظيم أعمال البناء والقوانين المعدلة له، واللوائح التنفيذية المطبقة في بلديات الإمارة.

- وعلى القرار الإداري الصادر من رئيس دائرة بلدية أبو ظبي وتخطيط المدن رقم (94/30) بشأن اللائحة التنفيذية الخاصة بمدينة أبو ظبي للقانون رقم (4) لسنة 1983م في شأن أعمال البناء بالإمارة وتعديلاته.

- وعلى قرار اللجنة التنفيذية 7 جـ 2013/26 بشأن كودات أبو ظبي الدولية للبناء (المجموعة الأولى).

- وبناءً على ما تقتضيه المصلحة العامة.

تقرر ما يلي:

المادة (1)

تطبق كودات أبو ظبي الدولية للبناء (المجموعة الأولى) التالية:

- كود أبو ظبي الدولي للبناء (ADIBC)

- كود أبو ظبي الدولي للأعمال الميكانيكية (ADIM)

- كود أبو ظبي الدولي لترشيد استهلاك الطاقة (ADIECC)

- كود أبو ظبي الدولي لغاز الوقود (ADIFGC)

- كود أبو ظبي الدولي لصيانة العقارات (ADIPMC)

- كود أبو ظبي الدولي للصرف الصحي الخاص (ADIPSDC)

وذلك على النحو الآتي:

1. يكون التطبيق إلزاميًا على جميع المشاريع الحكومية وما في حكمها من المباني ذات الاستخدام العام وذلك من تاريخ 2014/10/1.

2. يكون التطبيق إلزاميًا على المشاريع غير الحكومية، وذلك بقرار من رئيس الدائرة.

3. يكون الاستشاري ملزمًا بالتصميم وفق كودات أبو ظبي الدولية للبناء في المباني غير الحكومية في حال رغبة المالك في ذلك.

4. تعتبر كودات أبو ظبي الدولية للبناء جزءًا لا يتجزأ من اللائحة التنفيذية الموحدة للقانون رقم (4) لسنة 1983 في شأن تنظيم أعمال البناء.

5. مع مراعاة البنود الواردة أعلاه، يعمل بالأحكام الواردة في كودات أبو ظبي الدولية للبناء، في الفترة الانتقالية ولحين التطبيق الإلزامي للكودات، في تصميم وتنفيذ أعمال البناء والإنشاء التي لا تتوفر لها أحكام منظمة حاليًا.

المادة (2)

يلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القرار.

المادة (3)

ينشر هذا القرار في الجريدة الرسمية، ويعمل به من اليوم التالي لتاريخ نشره.

Decision of the Chairman of the Department of Municipal Affairs No. (71) of 2014
Regarding the Application of Abu Dhabi International Building Codes
(Group One)

The Chairman of the Department of Municipal Affairs

- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amending laws.

- And Law No. (4) of 1983 concerning the Regulation of Construction Works and its amending laws, and the executive regulations applied in the municipalities of the Emirate.

- And the Administrative Decision issued by the Chairman of the Abu Dhabi Municipality and Town Planning Department No. (94/30) regarding the Executive Regulation for Abu Dhabi City of Law No. (4) of 1983 concerning construction works in the Emirate and its amendments.

- And the Executive Committee Decision 7 C 2013/26 concerning the Abu Dhabi International Building Codes (Group One).

- And based on the requirements of the public interest.

Has decided the following:

Article (1)

The following Abu Dhabi International Building Codes (Group One) shall be applied:

- Abu Dhabi International Building Code (ADIBC)

- Abu Dhabi International Mechanical Code (ADIM)

- Abu Dhabi International Energy Conservation Code (ADIECC)

- Abu Dhabi International Fuel Gas Code (ADIFGC)

- Abu Dhabi International Property Maintenance Code (ADIPMC)

- Abu Dhabi International Private Sewage Disposal Code (ADIPSDC)

As follows:

1. The application shall be mandatory for all governmental projects and similar public use buildings, effective from 10/1/2014.

2. The application shall be mandatory for non-governmental projects, by a decision from the Chairman of the Department.

3. The consultant shall be obligated to design in accordance with the Abu Dhabi International Building Codes for non-governmental buildings if the owner so desires.

4. The Abu Dhabi International Building Codes are considered an integral part of the unified Executive Regulation of Law No. (4) of 1983 concerning the Regulation of Construction Works.

5. Without prejudice to the above clauses, the provisions of the Abu Dhabi International Building Codes shall be applied during the transitional period and until the mandatory application of the codes, for the design and execution of building and construction works for which there are currently no regulating provisions.

Article (2)

Any text or provision that contradicts or conflicts with the provisions of this decision shall be repealed.

Article (3)

This decision shall be published in the Official Gazette and shall come into effect on the day following its publication.
