قرار إداري رقم (267) لسنة 2014
بشأن عقد المساطحة النموذجي في إمارة أبوظبي
رئيس دائرة الشؤون البلدية:
- بعد الاطلاع على القانون رقم (1) لسنة 1974م بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.
- بعد الاطلاع على القانون رقم (3) لسنة 2005 في شأن تنظيم التسجيل العقاري بإمارة أبوظبي ولائحته التنفيذية.
- وعلى القانون رقم (19) لسنة 2005 في الملكية العقارية وتعديلاته.
- وعلى القانون رقم (10) لسنة 2006م في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي.
- وعلى القانون رقم (9) لسنة 2007م في شأن إنشاء دائرة الشؤون البلدية.
- وعلى القانون رقم (10) لسنة 2007م في شأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي.
- وعلى القانون رقم (11) لسنة 2007م في شأن بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي.
- وعلى قرار رئيس المجلس التنفيذي رقم (64) لسنة 2010 بشأن أحكام الملكية العقارية.
- وعلى تعميم المجلس التنفيذي رقم (11) لسنة 2014 بشأن عقد المساطحة النموذجي.
- وبموجب الصلاحيات والاختصاصات المقررة لرئيس الدائرة وما تقتضيه المصلحة العامة.
قرر ما يلي:
مادة (1)
على بلديات إمارة أبوظبي الالتزام بعقد المساطحة النموذجي المرفق والعمل بما تضمنه من شروط وأحكام كحد أدنى.
مادة (2)
على قطاع الأراضي والعقارات في دائرة الشؤون البلدية الإشراف على آلية متابعة تنفيذ هذا القرار ورفع تقرير إلينا خلال ثلاثة أشهر من تاريخ نفاذه.
مادة (3)
ينفذ هذا القرار اعتبارا من تاريخ صدوره، وينشر في الجريدة الرسمية

Administrative Decision No. (267) of 2014
Concerning the Model Musataha Contract in the Emirate of Abu Dhabi
The Chairman of the Department of Municipal Affairs:
- Having reviewed Law No. (1) of 1974 regarding the reorganization of the governmental apparatus in the Emirate of Abu Dhabi and its amendments.
- Having reviewed Law No. (3) of 2005 concerning the regulation of real estate registration in the Emirate of Abu Dhabi and its executive regulations.
- And Law No. (19) of 2005 on Real Estate Property and its amendments.
- And Law No. (10) of 2006 concerning the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi.
- And Law No. (9) of 2007 concerning the establishment of the Department of Municipal Affairs.
- And Law No. (10) of 2007 concerning the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi.
- And Law No. (11) of 2007 concerning the Municipality and Municipal Council of Al Ain City in the Emirate of Abu Dhabi.
- And the decision of the Chairman of the Executive Council No. (64) of 2010 concerning the provisions of real estate property.
- And the Executive Council Circular No. (11) of 2014 concerning the Model Musataha Contract.
- And pursuant to the powers and competencies vested in the Chairman of the Department and as required by the public interest.
Has decided the following:
Article (1)
The municipalities of the Emirate of Abu Dhabi shall adhere to the attached Model Musataha Contract and act in accordance with its terms and conditions as a minimum requirement.
Article (2)
The Lands and Real Estate Sector at the Department of Municipal Affairs shall supervise the mechanism for following up the implementation of this decision and submit a report to us within three months from its effective date.
Article (3)
This decision shall be effective from the date of its issuance and shall be published in the Official Gazette.
