قانون رقم (10) لسنة 2007
في شأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي
نحن خليفة بن زايد آل نهيان، حاكم أبوظبي.
- - بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،
- - وعلى القانون رقم (2) لسنة 1971 في شأن المجلس الاستشاري الوطني وتعديلاته،
- - وعلى القانون رقم (4) لسنة 1983 في شأن تنظيم أعمال البناء وتعديلاته،
- - وعلى القانون رقم (2) لسنة 2000 في شأن معاشات ومكافآت التقاعد المدنية لإمارة أبوظبي وتعديلاته،
- - وعلى القانون رقم (6) لسنة 2004 بإعادة تنظيم جهاز الرقابة المالية،
- - وعلى القانون رقم (2) لسنة 2005 بإنشاء جهاز أبوظبي للرقابة الغذائية وتعديلاته،
- - وعلى القانون رقم (1) لسنة 2006 في شأن الخدمة المدنية في إمارة أبوظبي،
- - وعلى القانون رقم (9) لسنة 2007 في شأن إنشاء دائرة الشؤون البلدية،
- - وبناء على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه،
أصدرنا القانون الآتي :
الباب الأول
في
التعاريف
مادة (1)
يكون للكلمات والعبارات التالية، المعاني الواردة قرين كل منها، ما لم يدل السياق على خلاف ذلك :

الباب الثاني
في
بلدية المنطقة الوسطى
مادة (2)
تنشأ بالمنطقة الوسطى بإمارة أبوظبي بلدية خاصة بها، تسمى" بلدية مدينة أبوظبي " ذات شخصية اعتبارية مستقلة، وأهلية قانونية كاملة في حدود أغراضها، وتتبع دائرة الشؤون البلدية.
مادة (3)
مقر البلدية الرئيسي مدينة أبوظبي بالمنطقة الوسطى بالإمارة، وتمارس نشاطها في ذات المنطقة.
مادة (4)
تنقل كافة أصول وأملاك وموجودات دائرة الشؤون البلدية المخصصة للمنطقة الوسطى إلى البلدية، وفقاً لخطة يتم وضعها بالتعاون والتنسيق مع دائرة الشؤون البلدية يتم اعتمادها من المجلس التنفيذي، ويتعين إنجاز الخطة المذكورة خلال ثلاثة أشهر من تاريخ سريان هذا القانون، وتنقل الأصول والأملاك والموجودات موضوع الخطة إلى البلدية خلال فترة لا تتجاوز اثني عشر شهراً من تاريخ اعتماد الخطة.
مادة (5)
تهدف البلدية إلى تحقيق أهداف السياسة العامة لحكومة أبوظبي في تقديم المستوى اللائق من الخدمات وتهيئة الظروف المعيشية الكريمة لسكان المنطقة من إمارة أبوظبي وتعنى بالقيام بالمهام التالية:
- التنسيق مع الجهات ذات العلاقة فيما يتعلق بمخططات التطوير العمراني في المنطقة.
- تطبيق قوانين ونظم ولوائح مواصفات البناء الصادرة عن الجهات المختصة والمطبقة في الإمارة على جميع المشاريع المنفذة في المنطقة وإصدار تراخيص البناء ومراقبة تنفيذ المشاريع وفقا لتلك القوانين واللوائح .
- وضع اللوائح والتنظيمات المتعلقة بمظهر المنطقة والحفاظ على نظافتها وجمالها .
- تخطيط وتصميم وبناء وصيانة وتشغيل البنية التحتية من طرق وحدائق ومساحات خضراء ضمن صلاحيات البلدية والتنسيق مع الجهات المختصة في هذا الشأن.
- الحفاظ على النظافة العامة بالمنطقة.
- تقديم خدمات التسجيل العقاري وفقا لمتطلبات دائرة الشؤون البلدية، وبالتنسيق مع الجهات المختصة .
- تخطيط وتصميم وبناء وصيانة وتشغيل المرافق العامة الخدمية بالمنطقة .
الباب الثالث
في
موارد البلدية ونظامها الإداري
المادة (6)
تتكون موارد البلدية مما يأتي:
- الاعتمادات السنوية التي تقررها حكومة أبوظبي.
- العقارات والمنقولات التي تؤول إلى البلدية بأي من طرق كسب الملكية.
- رسوم الخدمات والتراخيص المعتمدة، وما قد يعود عليها من عوائد التصرفات، أو ما تبرمه من عقود ذات مردود مالي.
- عوائد بيع أموالها العقارية أو المنقولة، أو التصرف فيها بأي من أوجه التصرف القانونية بعد موافقة المجلس التنفيذي بالنسبة للأموال العقارية.
- عوائد إدارة أصولها وموجوداتها بشكل مباشر أو عن طريق الغير.
- التبرعات والهبات والوصايا بكافة أنواعها والتي يوافق عليها المجلس.
مادة (7)
يدير البلدية جهاز إداري يشكل من عدد من الإدارات والأقسام المتخصصة برئاسة مدير عام البلدية وفقاً للهيكل التنظيمي المعتمد من المجلس.
ويكون الجهاز مسؤولاً عن تقديم خدمات البلدية لأهالي المنطقة، وتنفيذ قرارات المجلس البلدي وكافة اللوائح الداخلية الصادرة عنه.
مادة (8)
يصدر بتعيين المدير العام مرسوم أميري. وتحدد صلاحياته بقرار من رئيس المجلس التنفيذي .
مادة (9)
يقدم المدير العام إلى المجلس الحساب الختامي للبلدية والتقرير السنوي عن أعمالها، وذلك خلال شهرين على الأكثر من انتهاء السنة المالية للبلدية، كما يقدم كافة التقارير والبيانات المالية إلى المجلس كلما طلب منه ذلك.
مادة (10)
يُمارس المدير العام جميع الصلاحيات والاختصاصات المخولة للمجلس بموجب أحكام هذا القانون ولحين تشكيل المجلس.
الباب الرابع
في
المجلس البلدي
مادة (11)
يكون للبلدية مجلس بلدي يتم اختيار أعضائه من مواطني المنطقة المشهود لهم بالكفاءة والخبرة وحسن السمعة، ويصدر بتعيينهم وتحديد مكافآتهم قرار من المجلس التنفيذي، ولا يجوز إعادة تعيينهم لأكثر من ثلاث دورات متتالية.
مادة (12)
مدة عضوية المجلس سنتان ميلاديتان تبدأ من تاريخ تعيينه، ويقوم رئيس المجلس بدعوة الأعضاء للاجتماع التأسيسي الأول خلال ثلاثين يوماً من تاريخ تعيينهم.
مادة (13)
يؤدي رئيس وأعضاء المجلس والمدير العام، وقبل مباشرتهم لعملهم أمام رئيس المجلس التنفيذي، اليمين التالية:
"أقسم بالله العظيم أن أحترم القانون، وأن أرعى المصلحة العامة، وأن أؤدي عملي بالذمة والصدق.
مادة (14)
تحدد اللائحة الداخلية للمجلس كيفية اجتماعاته وطريقة التصويت على قراراته .
مادة (15)
يتلقى رئيس دائرة الشؤون البلدية التقارير السنوية عن أعمال البلدية، وذلك لرفعها إلى المجلس التنفيذي مشفوعة بتقييمه لرئيس وأعضاء المجلس، وإنجازاته.
كما يتولى عرض كافة أموره ومتطلباته على المجلس التنفيذي.
مادة (16)
تسقط عضوية المجلس لأحد الأسباب الآتية:
- الوفاة.
- الاستقالة من تاريخ قبولها.
- التغيب عن حضور الجلسات مدداً متصلة أو منفصلة تحددها اللائحة الداخلية للمجلس.
- إدانته بحكم نهائي في جريمة مخلة بالشرف أو الأمانة، أو بعقوبة مقيدة للحرية لمدة لا تقل عن ستة أشهر.
- إعفائه من مهامه بقرار من المجلس التنفيذي.
وفي جميع الأحوال إذا شغرت العضوية لأي سبب، يعين المجلس التنفيذي من يكمل العضوية لحين انتهاء دورة المجلس.
الباب الخامس
في
أهداف المجلس وصلاحياته
مادة (17)
يختص المجلس بكل ما من شأنه الارتقاء بمستوى تقديم الخدمات في المنطقة، وتحديد أسلوب قيام البلدية بأعمالها ودعمها في ذلك، كما يعمل على تفعيل دور منظمات المجتمع المدني المحلي بالنهوض بالبنية التحتية والخدمية للمنطقة، وله على وجه الخصوص ما يلي:
- اقتراح مشروعات القوانين ذات الصلة باختصاصاته.
- اعتماد الخطط والمشروعات والموازنات المقدمة من اللجان.
- تعيين أعضاء اللجان الدائمة وتحديد صلاحياتها ومراقبة أعمالها.
- تحديد اختصاصات ومهام الموظفين الإداريين.
- تحديد مقاييس تقييم أداء البلدية لمهامها، ومراقبة مستوى تنفيذ الخطط وإنجاز المشروعات.
مادة (18)
للمجلس في سبيل تنفيذ وتحقيق مهامه وأهدافه، تشكيل اللجان الدائمة المتخصصة التالية :
- - اللجنة التنفيذية .
- - لجنة التدقيق
- - لجنة خدمات المدن وضواحيها
- - لجنة الأشغال العامة والبنية التحتية
- - لجنة التراخيص وتخطيط المدن .
تشكل كل لجنة من أربعة أو خمسة من أعضاء المجلس، وفقاً للأنظمة الداخلية للبلدية .
ويتعين أن يشترك جميع أعضاء المجلس في اللجان وبحد أقصى لجنتان.
تحدد اللوائح الداخلية للمجلس صلاحيات ومهام وآلية تنظيم أعمال اللجان الدائمة، وعقد اجتماعاتها وتعيين أعضائها.
استثناء مما تقدم يكون للمدير العام صلاحية تشكيل اللجان الدائمة المشار إليها وأية لجان مؤقتة أو فرعية يراها لازمة من بين موظفي البلدية وأن يرأسها وأن يحدد صلاحياتها واختصاصاتها بموافقة رئيس دائرة الشؤون البلدية، وذلك لحين تشكيل المجلس.
الباب السادس
في
اختصاصات رئيس المجلس البلدي
مادة (19)
يختص رئيس المجلس بما يلي :
- رئاسة اجتماعات المجلس دون أن يكون له الحق في التصويت على قراراته إلا في حالة تساوي الأصوات يؤخذ برأيه.
- رئاسة اجتماعات اللجنة التنفيذية والمشاركة في أعمالها والتصويت على قرارتها طبقاً لأحكام اللوائح الداخلية للمجلس.
- تمثيل المجلس لدى مختلف الفعاليات الرسمية والخاصة .
الباب السابع
في
الأحكام الختامية
مادة (20)
للبلدية ميزانية مستقلة يرفعها المجلس مشفوعة بأسانيدها إلى رئيس دائرة الشؤون البلدية، لعرضها على المجلس التنفيذي لاعتمادها.
مادة (21)
تبدأ السنة المالية للبلدية في أول يناير وتنتهي في آخر ديسمبر من كل عام، فيما عدا السنة المالية الأولى فتبدأ من تاريخ العمل بهذا القانون، وتنتهي آخر ديسمبر من العام التالي.
مادة (22)
يحدد المجلس مصرفاً أو أكثر من المصارف الوطنية العاملة في الإمارة لإيداع مخصصات وأموال البلدية فيه، وتحدد اللوائح المالية والإدارية للبلدية قواعد الإيداع والصرف ونظام السلف وأنواعها ومقدارها.
مادة (23)
يعين المجلس مدققاً حسابياً أو أكثر لمراجعة وتدقيق حسابات البلدية ويحدد مكافآتهم.
مادة (24)
يخضع موظفو البلدية ومستخدموها لقانون الخدمة المدنية، ويطبق على الموظفين من المواطنين قانون معاشات ومكافآت التقاعد المدنية لإمارة أبوظبي.
مادة (25)
تعفى البلدية والمنشآت التابعة أو المملوكة لها من جميع الضرائب والرسوم المحلية .
مادة (26)
- - يصدر المجلس اللوائح والأنظمة الداخلية والقرارات اللازمة لتنفيذ أحكام هذا القانون.
- - يقترح المجلس نظاماً خاصاً للمناقصات والمزايدات والمشتريات الخاصة بالبلدية، ويرفعه لرئيس دائرة الشؤون البلدية تمهيداً لعرضه على المجلس التنفيذي لاعتماده .
مادة (27)
ينشر هذا القانون في الجريدة الرسمية، ويعمل به اعتباراً من تاريخ صدوره.

Concerning the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi
We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi.
- - Having reviewed Law No. (1) of 1974 regarding the Reorganization of the Governmental Body in the Emirate of Abu Dhabi and its amendments,
- - And Law No. (2) of 1971 concerning the National Consultative Council and its amendments,
- - And Law No. (4) of 1983 concerning the Regulation of Construction Works and its amendments,
- - And Law No. (2) of 2000 concerning Civil Retirement Pensions and Benefits for the Emirate of Abu Dhabi and its amendments,
- - And Law No. (6) of 2004 regarding the Reorganization of the Financial Audit Authority,
- - And Law No. (2) of 2005 establishing the Abu Dhabi Food Control Authority and its amendments,
- - And Law No. (1) of 2006 concerning Civil Service in the Emirate of Abu Dhabi,
- - And Law No. (9) of 2007 establishing the Department of Municipal Affairs,
- - And based on what was presented to the Executive Council and its approval,
Have issued the following Law:
Chapter One
On
Definitions
Article (1)
The following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:
| The Emirate | : The Emirate of Abu Dhabi. |
| The Executive Council | : The Executive Council of the Emirate of Abu Dhabi. |
| The Municipality | : Abu Dhabi City Municipality. |
| The Council | : The Municipal Council of Abu Dhabi Municipality. |
| The Director General | : Director General of the Municipality. |
| The Region | : The Central Region. |
Chapter Two
On
The Municipality of the Central Region
Article (2)
A special municipality shall be established in the Central Region of the Emirate of Abu Dhabi, to be named "Abu Dhabi City Municipality," with an independent legal personality and full legal capacity within the limits of its objectives, and it shall be affiliated with the Department of Municipal Affairs.
Article (3)
The main headquarters of the Municipality shall be in Abu Dhabi City in the Central Region of the Emirate, and it shall conduct its activities within the same region.
Article (4)
All assets, properties, and holdings of the Department of Municipal Affairs allocated to the Central Region shall be transferred to the Municipality, according to a plan developed in cooperation and coordination with the Department of Municipal Affairs and approved by the Executive Council. The said plan must be completed within three months from the date this Law comes into effect, and the assets, properties, and holdings subject to the plan shall be transferred to the Municipality within a period not exceeding twelve months from the date of the plan's approval.
Article (5)
The Municipality aims to achieve the objectives of the general policy of the Abu Dhabi Government in providing a decent level of services and creating dignified living conditions for the residents of the region in the Emirate of Abu Dhabi. It is concerned with undertaking the following tasks:
- Coordinating with relevant authorities regarding urban development plans in the region.
- Applying the laws, regulations, and specifications for construction issued by the competent authorities and applicable in the Emirate to all projects implemented in the region, issuing building permits, and monitoring the implementation of projects in accordance with those laws and regulations.
- Establishing regulations and rules related to the appearance of the region and maintaining its cleanliness and beauty.
- Planning, designing, constructing, maintaining, and operating infrastructure such as roads, parks, and green spaces within the Municipality's powers, and coordinating with the competent authorities in this regard.
- Maintaining public cleanliness in the region.
- Providing real estate registration services in accordance with the requirements of the Department of Municipal Affairs, and in coordination with the competent authorities.
- Planning, designing, constructing, maintaining, and operating public service facilities in the region.
Chapter Three
On
The Municipality's Resources and Administrative System
Article (6)
The resources of the Municipality shall consist of the following:
- Annual appropriations approved by the Abu Dhabi Government.
- Real estate and movable properties that devolve to the Municipality by any means of acquiring ownership.
- Approved service and license fees, and any returns from disposals or contracts with financial returns.
- Proceeds from the sale of its real or movable properties, or their disposal by any legal means, after the approval of the Executive Council for real estate.
- Returns from the management of its assets and holdings, either directly or through third parties.
- Donations, grants, and bequests of all kinds approved by the Council.
Article (7)
The Municipality shall be managed by an administrative body composed of a number of specialized departments and sections, headed by the Director General of the Municipality, in accordance with the organizational structure approved by the Council.
The body shall be responsible for providing the Municipality's services to the people of the region, implementing the decisions of the Municipal Council, and all internal regulations issued by it.
Article (8)
The Director General shall be appointed by an Emiri Decree. His powers shall be determined by a decision from the Chairman of the Executive Council.
Article (9)
The Director General shall submit to the Council the final account of the Municipality and the annual report on its activities, within a maximum of two months from the end of the Municipality's fiscal year. He shall also submit all reports and financial statements to the Council whenever requested.
Article (10)
The Director General shall exercise all the powers and competencies vested in the Council under the provisions of this Law until the Council is formed.
Chapter Four
On
The Municipal Council
Article (11)
The Municipality shall have a Municipal Council whose members are selected from citizens of the region known for their competence, experience, and good reputation. A decision by the Executive Council shall be issued for their appointment and the determination of their remuneration. They may not be reappointed for more than three consecutive terms.
Article (12)
The term of membership in the Council is two calendar years, starting from the date of appointment. The Chairman of the Council shall call the members for the first constituent meeting within thirty days from the date of their appointment.
Article (13)
The Chairman and members of the Council, and the Director General, shall, before commencing their work, take the following oath before the Chairman of the Executive Council:
"I swear by Almighty God to respect the law, to care for the public interest, and to perform my work with integrity and honesty."
Article (14)
The internal regulations of the Council shall determine the manner of its meetings and the method of voting on its decisions.
Article (15)
The Chairman of the Department of Municipal Affairs shall receive the annual reports on the Municipality's activities to submit them to the Executive Council, accompanied by his evaluation of the Council's chairman, members, and its achievements.
He shall also present all its affairs and requirements to the Executive Council.
Article (16)
Membership of the Council shall be forfeited for one of the following reasons:
- Death.
- Resignation from the date of its acceptance.
- Absence from sessions for consecutive or non-consecutive periods as specified by the internal regulations of the Council.
- Conviction by a final judgment in a crime involving moral turpitude or dishonesty, or by a penalty restricting freedom for a period of not less than six months.
- Relief from duties by a decision of the Executive Council.
In all cases, if a membership becomes vacant for any reason, the Executive Council shall appoint someone to complete the membership until the end of the Council's term.
Chapter Five
On
The Council's Objectives and Powers
Article (17)
The Council is responsible for everything that would elevate the level of service provision in the region, defining the method for the Municipality to carry out its work and supporting it in that. It also works to activate the role of local civil society organizations in advancing the infrastructure and services of the region. In particular, it has the following powers:
- Proposing draft laws related to its competencies.
- Approving plans, projects, and budgets submitted by the committees.
- Appointing members of permanent committees, defining their powers, and monitoring their work.
- Defining the competencies and tasks of administrative staff.
- Setting performance evaluation standards for the Municipality, and monitoring the level of plan implementation and project completion.
Article (18)
To implement and achieve its tasks and objectives, the Council may form the following specialized permanent committees:
- - The Executive Committee.
- - The Audit Committee.
- - The City and Suburbs Services Committee.
- - The Public Works and Infrastructure Committee.
- - The Licensing and Urban Planning Committee.
Each committee shall be formed of four or five members of the Council, in accordance with the Municipality's internal regulations.
All members of the Council must participate in the committees, with a maximum of two committees per member.
The internal regulations of the Council shall specify the powers, tasks, and mechanism for organizing the work of the permanent committees, holding their meetings, and appointing their members.
Notwithstanding the foregoing, the Director General shall have the authority to form the aforementioned permanent committees and any temporary or sub-committees he deems necessary from among the Municipality's employees, to chair them, and to define their powers and competencies with the approval of the Chairman of the Department of Municipal Affairs, until the Council is formed.
Chapter Six
On
The Competencies of the Municipal Council Chairman
Article (19)
The Chairman of the Council is responsible for the following:
- Presiding over Council meetings without having the right to vote on its decisions, except in the case of a tie, where his opinion shall be taken.
- Presiding over the meetings of the Executive Committee, participating in its work, and voting on its decisions in accordance with the provisions of the Council's internal regulations.
- Representing the Council at various official and private events.
Chapter Seven
On
Final Provisions
Article (20)
The Municipality shall have an independent budget, which the Council shall submit, along with its supporting documents, to the Chairman of the Department of Municipal Affairs for presentation to the Executive Council for approval.
Article (21)
The fiscal year of the Municipality begins on the first of January and ends on the last of December of each year, except for the first fiscal year, which shall begin from the date this Law comes into effect and end on the last of December of the following year.
Article (22)
The Council shall designate one or more national banks operating in the Emirate to deposit the Municipality's allocations and funds. The financial and administrative regulations of the Municipality shall specify the rules for deposit and withdrawal, and the system, types, and amounts of advances.
Article (23)
The Council shall appoint one or more auditors to review and audit the Municipality's accounts and shall determine their remuneration.
Article (24)
The employees and staff of the Municipality shall be subject to the Civil Service Law, and the Law on Civil Retirement Pensions and Benefits for the Emirate of Abu Dhabi shall apply to citizen employees.
Article (25)
The Municipality and its affiliated or owned establishments shall be exempt from all local taxes and fees.
Article (26)
- - The Council shall issue the internal regulations, systems, and decisions necessary for the implementation of the provisions of this Law.
- - The Council shall propose a special system for tenders, auctions, and procurement for the Municipality, and submit it to the Chairman of the Department of Municipal Affairs for presentation to the Executive Council for approval.
Article (27)
This Law shall be published in the Official Gazette and shall come into effect from the date of its issuance.
