رقم (22) لسنة 2008
بشأن تنظيم المقابر وإجراءات تسجيل الوفيات ودفن الموتى
نحن محمد بن زايد آل نهيان، ولي العهد، رئيس المجلس التنفيذي.
- - بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.
- - وعلى القانون رقم (1) لسنة 2007 بشأن إنشاء هيئة الصحة- أبوظبي.
- - وعلى القانون الاتحادي رقم (6) لسنة 1975 في شأن تنظيم قيد المواليد والوفيات، وتعديلاته.
- - وعلى القانون الاتحادي رقم (27) لسنة 1981 في شأن الوقاية من الأمراض السارية.
- - وعلى القانون الاتحادي رقم (11) لسنة 1992 في شأن الإجراءات المدنية، وتعديلاته.
- - وعلى القانون الاتحادي رقم (35) لسنة 1992 في شأن الإجراءات الجزائية، وتعديلاته.
- - وبناء على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه.
أصدرنا القرار الآتي:
المادة (1)
يعمل بالأحكام المرفقة بهذا القرار في شأن تنظيم المقابر وإجراءات دفن الموتى.
المادة (2)
ينفذ هذا القرار من تاريخ صدوره، وينشر في الجريدة الرسمية.

الفصل الأول
في التعاريف
مادة (1)
يقصد بالكلمات والعبارات التالية المعاني الواردة قرين كل منها ما لم يدل سياق النص على خلاف ذلك.

الفصل الثاني
في إنشاء المقابر وتنظيمها والأماكن المخصصة لها
مادة (2)
يصدر بقرار من رئيس دائرة الشؤون البلدية الأحوزة العمرانية الصالحة لإنشاء مقابر جديدة عند الاقتضاء، بناء على توصية لجنة مشتركة من البلديات.
مادة (3)
لا يجوز إنشاء مقابر خاصة، أو مقابر لأتباع الديانات الأخرى، أو منشأة لحرق جثث الموتى من غير المسلمين، إلا بتصريح من البلدية المختصة بعد استيفاء كافة الشروط التنظيمية والإجراءات الصحية المقررة من قبل الهيئة والجهات المختصة.
المادة (4)
تقام أسوار موحدة الشكل حول المقابر الموجودة حاليًا سواء المستعملة أو المغلقة أو التي قد تنشأ مستقبلا، ويجرى تأمينها وحمايتها بمعرفة البلدية المختصة، بعد موافقة المجلس التنفيذي.
مادة (5)
لا يجوز إقامة أي مباني أو منشآت داخل المقابر، كما لا يجوز إقامة أي شواهد أو إضافات أخرى على القبور إلا بعد موافقة الهيئة العامة للشئون الإسلامية والأوقاف، وتحت إشراف الإدارة المختصة.
مادة (6)
تخصص البلدية المختصة أماكن لحرق جثث غير المسلمين، ويتم الحرق بمعرفة طوائفهم بعد الحصول على تصاريح الحرق اللازمة في هذا الشأن من الهيئة والإدارة المختصة.
مادة (7)
يشترط عند إقامة مقابر جديدة ما يلي:
- أن تكون بعيدة قدر المستطاع عن الحيز العمراني أو الامتداد المستقبلي للكتلة السكنية المحتملة.
- ألا يكون من شأن إقامتها تأثيرًا على مصادر الماء أو المياه الجوفية أو المساس بهما.
- أن تخصص لإقامتها الأراضي القاحلة منخفضة القيمة ما أمكن، والتي يصعب استخدامها مستقبلا في غير ما خصصت له.
- أن تتوافر في المكان شروط عدم التلوث، وألا تقام على مرمى النظر للحواجز الطبيعية أو البساتين أو التلال المنحدرة.
- أن تحاط من كل جانب بحرم لا تقام عليه أية إنشاءات أو حدائق عامة.
- أن يكون لها مداخل ومخارج متعددة، وألا تبعد عن الكتلة السكنية بمسافة تستغرق أكثر من خمسة وأربعين دقيقة بالسيارة.
- أن توافق الهيئة على صلاحية المكان والتربة للدفن.
مادة (8)
تخصص أماكن في المقابر لدفن الأعضاء التي يتم بترها من الإنسان، ولا يجوز دفن أي عضو من أعضاء جسم الإنسان تم بتره لسبب طبي إلا بتصريح من الهيئة، وإذا كان البتر بسبب جنائي لا يجوز إصدار تصريح الدفن إلا بعد صدور قرار من النيابة العامة بذلك، على أن تتَّبع نفس إجراءات الدفن التي تتبع مع الجثث.
الفصل الثالث
في إجراءات استخدام المقابر
مادة (9)
تنشأ قاعدة بيانات للمتوفين في كل من الهيئة والإدارة المختصة ويتم ربطهما معًا إلكترونيًا، وتضم جميع البيانات الشخصية للمتوفى، وتاريخ الوفاة ورقم وتاريخ تصريح الدفن وجهة صدوره، ورقم القيد وأية بيانات أخرى تكون مفيدة في ذلك، مع ربط هاتين القاعدتين بقاعدة بيانات هيئة الإمارات للهوية ولا يجوز تغيير أو تبديل أية بيانات للمتوفى إلا بعد موافقة اللجنة المشكلة بحكم المادة (37) من القرار.
مادة (10)
تخطط المقابر - خاصة الجديدة منها بنظام الخطوط واللحود المرقمة لسهولة الاستدلال على ذويها.
مادة (11)
تخصص في المقابر أماكن خاصة لدفن الموتى بأمراض سارية على أن تحدد الشروط الفنية لهذه المقابر بواسطة الهيئة.
مادة (12)
لا يجوز دفن الموتى بأمراض سارية في المقابر المخصصة لذلك إلا بتصريح خاص من الهيئة وتحت إشرافها.
مادة (13)
تحدد الأمراض السارية وفقًا لأحكام القوانين والقرارات الصادرة في هذا الشأن.
مادة (14)
تحدد الهيئة أماكن غُسل الموتى وتكفينهم وإعدادهم للدفن، على أن تزود بكافة المستلزمات والأدوات المطلوبة لهذا الغرض.
مادة (15)
يدفن في مقابر الإمارة ما يأتي:
- المواطنون، ما لم يطلب ذووهم دفنهم في الإمارة التي ينتمون إليها.
- رعايا دول مجلس التعاون الخليجي، ما لم يطلب ذووهم دفنهم في الدولة التي ينتمون إليها.
- الوافدون، ما لم يطلب ذووهم دفنهم في الدولة التي ينتمون إليها.
- مجهولو الهوية. مع مراعاة أن يكون الدفن في المقابر المخصصة لديانة المتوفى.
الفصل الرابع
في الإبلاغ وتسجيل الوفيات
مادة (16)
- يتعين إبلاغ الشرطة بكافة حالات الوفاة التي تحدث خارج المنشآت العلاجية الحكومية والخاصة.
- يتعين إبلاغ الهيئة بكافة حالات الوفاة التي تحدث داخل المنشآت العلاجية الحكومية والخاصة.
- على أن يكون التبليغ خلال اثنين وسبعين ساعة من تاريخ حدوث الوفاة أو من تاريخ ولادة المولود الميت، على أن يتم التبليغ من المكلفين بذلك وهم:
- - أحد والدي المتوفى.
- - من يقطن - من الأشخاص البالغين - في سكن واحد مع المتوفى.
- - من حضر الوفاة من الأقارب البالغين.
- - صاحب العمل أو الشخص القائم بإدارته أو المدير المسئول في الفندق أو المنشأة العقابية أو أي محل آخر إذا حدثت الوفاة في أي منها.
- - الطبيب أو المندوب الصحي الذي أثبت الوفاة
- تكون مسئولية التبليغ على الترتيب المتقدم، ولا يقبل التبليغ من غير المكلفين به.
مادة (17)
في حالة وفاة أحد مواطني الإمارة أثناء السفر خارج الدولة تبلغ البعثة القنصلية في الدولة التي حدثت فيها الوفاة في موعد لا يتجاوز ستين يومًا من تاريخ الوفاة، أو بطريق البريد إذا كانت الجهة التي حدثت فيها الوفاة لا تدخل في اختصاص البعثة القنصلية، ويكون التبليغ مصدقًا فيه على توقيع المبلغ من جهة رسمية أو مصحوبًا بشهادة الوفاة أو مستخرج رسمي عنها من السلطة المختصة بالجهة التي حدثت فيها الوفاة.
مادة (18)
تنقل كافة الوفيات إلى مقر المشرحة المركزية التي تقع في دائرتها الوفاة أو الأماكن التي تحددها الهيئة لذلك.
مادة (19)
يكون التبليغ عن الوفاة كتابيًا أو شفويًا، ويشتمل على البيانات الآتية:
- يوم الوفاة وتاريخه الهجري والميلادي بالأرقام والحروف مع بيان ساعة ومحل الوفاة.
- جنس المتوفى واسمه ثلاثيًا ولقبه وجنسيته وديانته وسنه ومهنته ومحل إقامته.
- اسم والدي المتوفى إذا كانا معروفين ولقبهما وجنسيتهما وديانتهما ومحل إقامتهما.
- سبب الوفاة.
- اسم المبلغ ولقبه وسنه وجنسيته ومهنته وصفته وتوقيعه.
- عدد الأشهر الرحمية إذا كان التبليغ عن مولود ميت.
على أن يتم التبليغ وفق النماذج التي تعدها الهيئة في هذا الشأن.
الفصل الخامس
تحديد أسباب الوفاة وتصاريح الدفن
مادة (20)
على الهيئة وضع آلية لتسجيل الوفيات والمستندات والنماذج الخاصة بذلك.
مادة (21)
لا يجوز دفن أية جثة متوفى إلا بعد توقيع الكشف الطبي عليها بمعرفة أطباء الهيئة لتحديد أسباب الوفاة وذلك بالنسبة لحالات الوفاة العادية، أما حالات الوفاة الجنائية والحوادث ومجهولي الهوية يتم الكشف الطبي عليها بمعرفة الجهة التي تحددها الشرطة أو النيابة العامة حسب الاختصاص، ويتم الكشف الطبي على الجثة في المشرحة التي تقع الوفاة في دائرتها أو في الأماكن التي تخصص لذلك بمعرفة الهيئة.
مادة (22)
تصدر الهيئة تصاريح الدفن في حالة الوفاة العادية، أما في حالات الوفاة الجنائية أو الحوادث أو كان المتوفى مجهول الهوية، فلا يصدر تصريح الدفن إلا بعد الموافقة الكتابية للشرطة أو النيابة العامة حسب الاختصاص، كما تصدر الهيئة شهادة تحنيط للجثة.
مادة (23)
تصدر الهيئة أو أحد فروعها شهادة الوفاة خلال أسبوع من تاريخ التبليغ عن الوفاة، على أن تسلم إلى أهل المتوفى، ويجوز لكل ذي شأن أن يحصل في أي وقت على نسخة إضافية منها.
الفصل السابع
في إجراءات دفن الموتى
مادة (24)
يحظر دفن أو نقل جثة المتوفى أو حرقها داخل الإمارة، إلا بعد الحصول على تصريح بذلك من الهيئة والإدارة المختصة، ووفق أحكام هذا القرار.
مادة (25)
يجوز التصريح بدفن أو حرق جثة أي متوفى من غير المقيمين بالإمارة في الحالات الآتية:
- أ. إذا كان المتوفى يحمل تأشيرة زيارة أو تأشيرة مهمة صادرة من الإمارة.
- ب. إذا وجد المتوفى على متن طائرة هبطت اضطراريًا في الإمارة وتأخر إقلاعها.
- ج. إذا انتهت مدة إقامة أو زيارة المتوفى.
- د. إذا كان المتوفى مجهول الهوية أو لا يحمل وثائق ثبوتية.
- هـ. إذا تعذر نقل جثة المتوفى إلى خارج الإمارة لأسباب تتعلق بالصحة العامة.
- و. أي حالة أخرى ترى الهيئة ومدير الإدارة المختصة دفن المتوفى في مقابر الإمارة.
مادة (26)
يتم غسل وتكفين وتجهيز المتوفى من المسلمين وفقًا لأحكام الشريعة الإسلامية في الأماكن التي تحددها الهيئة خلال ثلاثة أيام من تاريخ استيفاء الإجراءات وجاهزيتها للدفن، ويجوز بموافقة الهيئة والإدارة المختصة - بناء على طلب ذويه - تجهيزه بالمنزل والصلاة عليه به أو بأحد المساجد.
مادة (27)
يتولى ذوو المتوفى من غير المسلمين تجهيزه ودفنه أو حرقه وفقًا لطقوسهم الخاصة خلال اسبوع من تاريخ استيفاء الإجراءات وجاهزية الجثة وتحت إشراف الهيئة والجهة المختصة.
مادة (28)
لا يتم التحفظ على أية جثة أو الاحتفاظ بها داخل المشرحة لأي سبب، إلا بإذن من النيابة العامة.
مادة (29)
يتم تحنيط الجثة وفق الإجراءات الطبية والوقائية المقررة لذلك والتي تحددها الهيئة.
مادة (30)
يكون نقل جثمان المتوفى إلى إمارة أخرى بعد موافقة السلطة المختصة بالإمارة التي سينقل إليها الجثمان، وإذا كان النقل إلى خارج الدولة يشترط موافقة سفارة الدولة أو السلطة المختصة في الدولة التي سوف ينقل إليها الجثمان على أن تشترك سفارة هذه الدولة في إعداد وتجهيز وتسفير المتوفى طبقًا للإجراءات المعتمدة لديها.
الفصل الثامن
في الرسوم
مادة (31)
تحصل الهيئة الرسوم التالية:
- - خمسون درهما مقابل استخراج شهادة الوفاة، أو بدل فاقد منها، أو نسخة إضافية.
- - ألف درهم مقابل تجهيز الجثة للسفر (تحنيط/ تكفين/ صندوق).
- - خمسون درهما عن كل يوم تأخير في استلام الجثة بعد صدور قرار تسليمها من الجهة المختصة بشرط أن يتم إعلام ذويهم كتابيًا بذلك.
- - مائة درهم مقابل استعمال سيارة الإسعاف لنقل جثة المتوفى من المستشفى إلى المقبرة أو إلى المطار.
- - ويجوز - بقرار من رئيس الهيئة - الإعفاء من بعض الرسوم أو تخفيضها في الحالات الإنسانية.
الفصل التاسع
في الأحكام العامة
مادة (32)
تغلق المقابر القديمة المتخللة داخل المناطق السكنية، ولا يتم الدفن فيها ويتم إحاطتها بالأسوار الموحدة الشكل، وزراعتها بالأشجار، وحراستها وتأمينها من العبث.
مادة (33)
يلتزم ذوو المتوفى أو الكفلاء أو السفارة التابع لها المتوفى على الترتيب، باستلام جثة المتوفى التابع لهم، بعد صدور قرار تسليمها من الجهات المختصة، وإذا لم يتقدم أحد لاستلام جثة المتوفى من أماكن حفظها، رغم إخطارهم بجاهزية الجثة للدفن كتابيًا بذلك لمدة تزيد على (30) يومًا، على الإدارة المختصة بالاشتراك مع الهيئة اتخاذ إجراءات دفنها وفقًا لأحكام هذا القرار.
مادة (34)
لا يجوز إخراج أية جثة تم دفنها، لنقلها إلى أي مكان آخر سواءً داخل الدولة أو خارجها إلا بعد مضي ستة أشهر على الدفن، وبتصريح من اللجنة المشكلة بالمادة (37)، ما لم تكن الوفاة بسبب إحدى الأمراض السارية فلا يسمح نهائيًا بإخراج الجثة إلا بإذن من كل من الهيئة واللجنة ووفق الإجراءات الوقائية وإجراءات الحجر الصحي المقررة لذلك.
مادة (35)
في حالات الوفاة التي تتم تنفيذا لأحكام قضائية، تتم كافة الإجراءات المقررة لتغسيل وتكفين ونقل وتسفير الجثة بالتنسيق مع الشرطة.
مادة (36)
تنشأ في كل من الهيئة والبلدية المختصة إدارة مستقلة تعنى بتطبيق أحكام هذا القرار على أن يتم التنسيق بينهما في ممارسة مهامها، وكذلك التنسيق مع كافة الجهات المعنية في الإمارة.
مادة (37)
تشكل لجنة في إمارة أبوظبي بقرار من دائرة القضاء ويمثل فيها كل من:
- دائرة القضاء - أبوظبي.
- هيئة الصحة - أبوظبي.
- شرطة أبوظبي.
- بلدية أبوظبي.
وتختص اللجنة بإصدار تصاريح نقل الجثث بعد دفنها وتصحيح أو إضافة أية بيانات على شهادات الوفاة السابق إصدارها.
مادة (38)
تحدد السلطات المختصة في الإمارة منافذ تسفير الجثث إلى خارج الدولة، ولا يجوز تسفير أية جثة إلا عن طريق هذه المنافذ.
مادة (39)
تقوم الشرطة بالمرور على المقابر، وتتابع الحراسات الموجودة عليها، وضبط أية مخالفات تقع فيها.
مادة (40)
يتم توحيد النماذج والشهادات والسجلات المتعلقة بالأحكام الواردة في هذا القرار.

Regarding the Regulation of Cemeteries and Procedures for Registering Deaths and Burying the Deceased
We, Mohamed bin Zayed Al Nahyan, Crown Prince, Chairman of the Executive Council.
- - Having reviewed Law No. (1) of 1974 on the Reorganization of the Government Apparatus in the Emirate of Abu Dhabi and its amendments.
- - And Law No. (1) of 2007 on the Establishment of the Health Authority - Abu Dhabi.
- - And Federal Law No. (6) of 1975 on the Regulation of Birth and Death Registration, and its amendments.
- - And Federal Law No. (27) of 1981 on the Prevention of Communicable Diseases.
- - And Federal Law No. (11) of 1992 on Civil Procedures, and its amendments.
- - And Federal Law No. (35) of 1992 on Criminal Procedures, and its amendments.
- - And based on what was presented to the Executive Council and its approval.
We have issued the following Resolution:
Article (1)
The provisions attached to this Resolution regarding the regulation of cemeteries and procedures for burying the deceased shall be enforced.
Article (2)
This Resolution shall be effective from the date of its issuance and shall be published in the Official Gazette.

Regulation of Cemeteries and Procedures for Burying the Deceased
Chapter One
Definitions
Article (1)
The following words and phrases shall have the meanings assigned to each of them unless the context indicates otherwise.
| The State | : The United Arab Emirates. |
| The Emirate | : The Emirate of Abu Dhabi. |
| The Executive Council | : The Executive Council of the Emirate. |
| The Authority | : Health Authority - Abu Dhabi. |
| The Competent Municipality | : The municipality within whose spatial jurisdiction the cemeteries are located. |
| The Competent Department | : The department concerned with cemeteries in the municipality. |
| Citizens | : Citizens of the United Arab Emirates residing in the Emirate of Abu Dhabi. |
Chapter Two
Establishment, Regulation, and Designated Locations of Cemeteries
Article (2)
By a resolution from the Chairman of the Department of Municipal Affairs, suitable urban areas for establishing new cemeteries shall be designated when necessary, based on a recommendation from a joint committee of the municipalities.
Article (3)
Private cemeteries, cemeteries for followers of other religions, or facilities for cremating the bodies of non-Muslim deceased may not be established except with a permit from the competent municipality after fulfilling all regulatory conditions and health procedures prescribed by the Authority and competent entities.
Article (4)
Uniformly designed walls shall be erected around currently existing cemeteries, whether in use or closed, or those that may be established in the future. They shall be secured and protected by the competent municipality, after the approval of the Executive Council.
Article (5)
No buildings or structures may be erected inside cemeteries, nor may any tombstones or other additions be placed on graves except with the approval of the General Authority of Islamic Affairs and Endowments, and under the supervision of the Competent Department.
Article (6)
The competent municipality shall allocate places for the cremation of the bodies of non-Muslims. Cremation shall be carried out by their respective communities after obtaining the necessary cremation permits from the Authority and the Competent Department.
Article (7)
The following conditions are required when establishing new cemeteries:
- They should be as far as possible from urban areas or the future expansion of potential residential blocks.
- Their establishment should not affect or interfere with water sources or groundwater.
- Arid lands of low value, which are difficult to use for other purposes in the future, should be allocated for them as much as possible.
- The location must meet non-pollution conditions and should not be located within sight of natural barriers, orchards, or sloping hills.
- They should be surrounded on all sides by a buffer zone where no structures or public parks are established.
- They should have multiple entrances and exits, and not be located more than a forty-five-minute drive from the residential block.
- The Authority must approve the suitability of the location and soil for burial.
Article (8)
Places in cemeteries shall be allocated for the burial of amputated human limbs. No human body part amputated for a medical reason may be buried except with a permit from the Authority. If the amputation is due to a criminal act, a burial permit may not be issued except after a decision from the Public Prosecution, and the same burial procedures followed for bodies must be followed.
Chapter Three
Procedures for Using Cemeteries
Article (9)
A database of the deceased shall be established at both the Authority and the Competent Department and electronically linked together. It shall include all personal data of the deceased, the date of death, the number and date of the burial permit and its issuing authority, the registration number, and any other useful data. These two databases shall be linked with the Emirates Identity Authority database. No data of the deceased may be changed or altered except with the approval of the committee formed under Article (37) of the Resolution.
Article (10)
Cemeteries, especially new ones, shall be planned with a system of numbered rows and graves to facilitate identification by relatives.
Article (11)
Special places in cemeteries shall be allocated for burying those who died of communicable diseases, with the technical specifications for these graves to be determined by the Authority.
Article (12)
The deceased who died of communicable diseases may not be buried in the designated cemeteries except with a special permit from and under the supervision of the Authority.
Article (13)
Communicable diseases shall be determined in accordance with the provisions of the laws and resolutions issued in this regard.
Article (14)
The Authority shall specify the places for washing, shrouding, and preparing the deceased for burial, which shall be equipped with all necessary supplies and tools for this purpose.
Article (15)
The following shall be buried in the Emirate's cemeteries:
- Citizens, unless their relatives request their burial in the Emirate to which they belong.
- Nationals of the Gulf Cooperation Council (GCC) countries, unless their relatives request their burial in the country to which they belong.
- Expatriates, unless their relatives request their burial in the country to which they belong.
- Unidentified persons. Taking into account that the burial should be in the cemeteries designated for the religion of the deceased.
Chapter Four
Reporting and Registering Deaths
Article (16)
- The police must be notified of all deaths that occur outside public and private medical facilities.
- The Authority must be notified of all deaths that occur inside public and private medical facilities.
- The notification must be made within seventy-two hours from the date of death or from the date of birth of a stillborn baby, and the notification must be made by the following responsible persons:
- - One of the parents of the deceased.
- - Any adult person residing in the same dwelling with the deceased.
- - Any adult relative who was present at the time of death.
- - The employer or the person in charge of management, or the responsible manager in a hotel, correctional facility, or any other establishment if the death occurred therein.
- - The physician or health representative who confirmed the death.
- The responsibility for notification shall be in the aforementioned order, and notification from persons other than those specified will not be accepted.
Article (17)
In the event of the death of a citizen of the Emirate while traveling abroad, the consular mission in the country where the death occurred shall be notified within a period not exceeding sixty days from the date of death, or by mail if the location of death does not fall within the jurisdiction of the consular mission. The notification must have the notifier's signature authenticated by an official authority or be accompanied by a death certificate or an official extract thereof from the competent authority in the location where the death occurred.
Article (18)
All deceased bodies shall be transferred to the central morgue within whose jurisdiction the death occurred or to places designated by the Authority for this purpose.
Article (19)
The notification of death shall be in writing or orally, and shall include the following data:
- The day of death, and its Hijri and Gregorian date in numbers and letters, along with the time and place of death.
- The sex of the deceased, their full name, surname, nationality, religion, age, profession, and place of residence.
- The names of the deceased's parents if known, their surnames, nationalities, religions, and places of residence.
- The cause of death.
- The name of the notifier, their surname, age, nationality, profession, capacity, and signature.
- The number of gestational months if the notification is for a stillborn baby.
The notification shall be made using the forms prepared by the Authority for this purpose.
Chapter Five
Determining Causes of Death and Burial Permits
Article (20)
The Authority shall establish a mechanism for registering deaths and the related documents and forms.
Article (21)
No deceased body may be buried until a medical examination has been performed by the Authority's physicians to determine the cause of death for cases of natural death. For cases of criminal death, accidents, and unidentified persons, the medical examination shall be performed by the entity determined by the police or the Public Prosecution, according to jurisdiction. The medical examination of the body shall be conducted in the morgue within whose jurisdiction the death occurred or in places designated for this purpose by the Authority.
Article (22)
The Authority shall issue burial permits in cases of natural death. In cases of criminal death, accidents, or if the deceased is unidentified, a burial permit shall not be issued except with the written approval of the police or the Public Prosecution, according to jurisdiction. The Authority shall also issue an embalming certificate for the body.
Article (23)
The Authority or one of its branches shall issue a death certificate within one week from the date of the death notification, to be delivered to the deceased's family. Any interested party may obtain an additional copy at any time.
Chapter Seven
Procedures for Burying the Deceased
Article (24)
It is prohibited to bury, transport, or cremate the body of a deceased person within the Emirate, except after obtaining a permit from the Authority and the Competent Department, and in accordance with the provisions of this Resolution.
Article (25)
A permit may be issued for the burial or cremation of the body of any deceased non-resident of the Emirate in the following cases:
- a. If the deceased holds a visit visa or mission visa issued by the Emirate.
- b. If the deceased was found on an aircraft that made an emergency landing in the Emirate and its departure was delayed.
- c. If the deceased's residency or visit period has expired.
- d. If the deceased is unidentified or does not carry identification documents.
- e. If it is impossible to transport the deceased's body outside the Emirate for public health reasons.
- f. Any other case in which the Authority and the director of the Competent Department deem it appropriate to bury the deceased in the Emirate's cemeteries.
Article (26)
Deceased Muslims shall be washed, shrouded, and prepared in accordance with the provisions of Islamic Sharia in the places designated by the Authority within three days from the date of completing the procedures and the body being ready for burial. With the approval of the Authority and the Competent Department, and upon the request of the family, the deceased may be prepared at home and the funeral prayer performed there or in a mosque.
Article (27)
The family of a non-Muslim deceased shall be responsible for preparing, burying, or cremating the body according to their specific rites within one week from the date of completing the procedures and the body being ready, under the supervision of the Authority and the competent entity.
Article (28)
No body shall be held or kept in the morgue for any reason except with permission from the Public Prosecution.
Article (29)
The body shall be embalmed in accordance with the medical and preventive procedures prescribed for that purpose, which are determined by the Authority.
Article (30)
The body of the deceased may be transported to another emirate after obtaining the approval of the competent authority in the emirate to which the body will be transported. If the transport is outside the country, the approval of the embassy of the country or the competent authority in the country to which the body will be transported is required, provided that the embassy of this country participates in the preparation, processing, and transportation of the deceased according to its approved procedures.
Chapter Eight
Fees
Article (31)
The Authority shall collect the following fees:
- - Fifty dirhams for issuing a death certificate, a replacement for a lost one, or an additional copy.
- - One thousand dirhams for preparing the body for travel (embalming/shrouding/coffin).
- - Fifty dirhams for each day of delay in receiving the body after the decision to release it has been issued by the competent authority, provided that the family is notified in writing.
- - One hundred dirhams for the use of an ambulance to transport the body of the deceased from the hospital to the cemetery or to the airport.
- - The Chairman of the Authority may, by a decision, grant exemption from some fees or reduce them in humanitarian cases.
Chapter Nine
General Provisions
Article (32)
Old cemeteries located within residential areas shall be closed, and no burials shall take place in them. They shall be enclosed with uniformly designed walls, planted with trees, guarded, and secured from vandalism.
Article (33)
The family of the deceased, sponsors, or the embassy to which the deceased belongs, in that order, are obligated to receive the body of their deceased after the decision to release it is issued by the competent authorities. If no one comes forward to receive the deceased's body from its storage place, despite being notified in writing of the body's readiness for burial for a period exceeding (30) days, the Competent Department, in coordination with the Authority, shall take measures to bury it in accordance with the provisions of this Resolution.
Article (34)
No buried body may be exhumed for transfer to any other location, whether inside or outside the country, until six months have passed since the burial, and with a permit from the committee formed under Article (37), unless the death was due to a communicable disease, in which case exhumation of the body is absolutely not permitted except with permission from both the Authority and the committee and in accordance with the prescribed preventive and quarantine procedures.
Article (35)
In cases of death resulting from the execution of judicial rulings, all prescribed procedures for washing, shrouding, transporting, and repatriating the body shall be carried out in coordination with the police.
Article (36)
An independent department shall be established in both the Authority and the competent municipality to be concerned with the application of the provisions of this Resolution, provided that they coordinate in the exercise of their duties, as well as coordinate with all concerned entities in the Emirate.
Article (37)
A committee shall be formed in the Emirate of Abu Dhabi by a decision of the Judicial Department, with representatives from:
- Judicial Department - Abu Dhabi.
- Health Authority - Abu Dhabi.
- Abu Dhabi Police.
- Abu Dhabi Municipality.
The committee shall be responsible for issuing permits for the transfer of bodies after burial and for correcting or adding any data to previously issued death certificates.
Article (38)
The competent authorities in the Emirate shall specify the ports for the repatriation of bodies out of the country, and no body may be repatriated except through these ports.
Article (39)
The police shall patrol the cemeteries, monitor the existing guards, and report any violations that occur therein.
Article (40)
The forms, certificates, and records related to the provisions contained in this Resolution shall be standardized.
