قرار المجلس التنفيذي رقم (127) لسنة 2019
بشأن رسوم خدمات البلدية بإمارة أبو ظبي
قرر المجلس التنفيذي ما يأتي:
-
1. الموافقة على أن يكون مقابل الإيجار للأراضي المخصصة من الحكومة للمستفيد بطريقة مباشرة على النحو التالي:

- 2. لمستأجري الأراضي الصناعية والأراضي المؤجرة من الحكومة بطريقة مباشرة تأجيرها للغير شريطة الحصول على موافقة البلدية المعنية، على أن يتم تسجيل كافة العقود وفق التشريعات السارية.
- 3. تحصل البلدية المعنية رسم تسجيل من المستأجر على كافة عقود الإيجار للأراضي والعقارات الصناعية والأراضي والعقارات المؤجرة من الحكومة من قيمة كل عقد، وذلك بنسبة تحدد من قبل اللجنة التنفيذية على أن لا تقل عن (5%) ولا تزيد على (10%).
- 4. تصدر اللجنة التنفيذية قرارًا بتحديد المناطق الحيوية والمناطق النامية بناءً على اقتراح رئيس دائرة التخطيط العمراني والبلديات.
- 5. باستثناء الأراضي الصناعية المخصصة للمواطنين تقسط رسوم تسجيل عقد المساطحة على عدد سنوات العقد ابتداءً من تشغيل المشروع.
- 6. تعفى المدارس الخاصة التي يقل معدل رسومها الدراسية عن (20.000) درهم من رسوم تسجيل عقد المساطحة وفق البيانات المالية من دائرة التعليم والمعرفة.

7. يعدل البند (19) من جدول رسوم التسجيل العقاري الملحق بقرار رئيس المجلس التنفيذي رقم (49) لسنة 2018 بشأن رسوم خدمات البلدية بإمارة أبو ظبي، ويضاف إلى الجدول بندان جديدان بالأرقام (20، 21) ليصبح كالآتي:

- 8. ينفذ هذا القرار من تاريخ صدوره ويرفع تقرير خلال أسبوعين من تاريخه عن مستجدات التنفيذ إلى مكتب أبو ظبي التنفيذي ببريد إلكتروني (سري) على العنوان التالي: ADEO-Legislation@ecouncil.ae

Concerning Municipality Service Fees in the Emirate of Abu Dhabi
The Executive Council has decided the following:

1. Approval that the rent for lands allocated directly by the government to the beneficiary shall be as follows:

- 2. Tenants of industrial lands and lands leased directly from the government may sublease them to others, provided that the approval of the concerned municipality is obtained, and that all contracts are registered in accordance with the applicable legislation.
- 3. The concerned municipality shall collect a registration fee from the tenant on all lease contracts for industrial lands and properties and lands and properties leased from the government, based on the value of each contract, at a percentage to be determined by the Executive Committee, provided it is not less than (5%) and not more than (10%).
- 4. The Executive Committee shall issue a resolution identifying vital areas and developing areas based on a proposal from the Chairman of the Department of Urban Planning and Municipalities.
- 5. With the exception of industrial lands allocated to citizens, the registration fees for the Musataha contract shall be paid in installments over the number of years of the contract, starting from the project's operation date.
- 6. Private schools whose average tuition fees are less than (20,000) dirhams shall be exempt from Musataha contract registration fees, according to financial data from the Department of Education and Knowledge.

7. Clause (19) of the real estate registration fees schedule attached to the Chairman of the Executive Council's Resolution No. (49) of 2018 concerning municipality service fees in the Emirate of Abu Dhabi shall be amended, and two new clauses with numbers (20, 21) shall be added to the schedule to become as follows:
