بإصدار اللائحة التنفيذية بشأن اعتماد الرسوم وفقًا

للقانون رقم (3) لسنة 2015 في شأن تنظيم القطاع العقاري في إمارة أبوظبي

- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له.

- وعلى القانون رقم (3) لسنة 2005 في شأن تنظيم التسجيل العقاري بإمارة أبوظبي.

- وعلى القانون رقم (19) لسنة 2005 في الملكية العقارية والقوانين المعدلة له.

- وعلى القانون رقم (9) لسنة 2007 في شأن إنشاء دائرة الشؤون البلدية.

- وعلى القانون رقم (3) لسنة 2015 في شأن تنظيم القطاع العقاري في إمارة أبوظبي.

- وبناءً على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه.

تقرر ما يلي:

مادة (1)

مع عدم الإخلال بجدول الرسوم الملحق بالقانون رقم (3) لسنة 2005 المشار إليه، تستوفى الرسوم المبينة في الجدول التالي مقابل الخدمات التي تقدمها الدائرة والبلديات المعنية وفقًا للقانون رقم (3) لسنة 2015 المشار إليه واللوائح التنفيذية الصادرة بموجبه.

21	تصريح مشاركة في معرض تطوير عقاري محلي داخل الدولة لترويج بيع وحدات عقارية على المخطط.	1000 عن كل مشاركة
22	تصريح المشاركة في معرض تطوير عقاري أجنبي داخل أو خارج الدولة لترويج بيع وحدات عقارية على المخطط.	2000 عن كل مشاركة
23	ترخيص إقامة حفل إطلاق مشروع عقاري لترويج بيع وحدات عقارية على المخطط.	5000 عن كل حفل
24	تسجيل عقد الوساطة العقارية بين الوسيط والموكل في سجل التطوير العقاري (ويشمل عقد الوكالة الرئيسي أو الفرعي).	500 عن كل عقد
25	تسجيل عقد الوساطة العقارية لتسويق مشروع التطوير العقاري المبرم بين المطور والوسيط العقاري في سجل التطوير العقاري.	1000 عن كل عقد
26	تسجيل الرهن التأميني في السجل العقاري الأولي أو السجل العقاري.	1 من ألف من قيمة الرهن وبحد أقصى مقداره مليوني درهم لكل معاملة.
27	تسجيل طلب حوالة حقوق سند الرهن التأميني في السجل العقاري الأولي أو السجل العقاري.	200
28	تسجيل سند التنازل عن مرتبة الرهن التأميني في السجل العقاري الأولي أو السجل العقاري.	200
29	تسجيل سند فك الرهن التأميني في السجل العقاري الأولي أو السجل العقاري.	1000

33	تسجيل سند تصحيح قيود الرهن التأميني أو الرهون الخاصة بـ (المساطحة والانتفاع والايجار طويل الأمد).	200
34	تسجيل التصرفات الواردة على الوحدات العقارية على المخطط في السجل العقاري الأولي.	- في حالة البيع: 2% من قيمة العقار مناصفة بين البائع والمشتري وبحد أقصى مقداره مليوني درهم لكل معاملة. - في حالة الهبة: 2000 درهم إذا كانت الهبة بين الأصول والفروع والأزواج والأشخاص الاعتبارية المملوكة لهم بالكامل، وفيما عدا ذلك تعامل الهبة معاملة البيع فيما يتعلق بالرسوم. - في حالة الوصية: 2000 درهم
35	تسجيل ونقل التصرفات الواردة على الوحدات العقارية على المخطط من السجل العقاري الأولي إلى السجل العقاري.	- في حال البيع (1000) - في حال الهبة (200) - في حال الوصية (100)
36	تسجيل اتحاد الملاك في السجل العقاري.	1000 عن كل اتحاد ملاك
37	إصدار شهادة المطالبة بالأموال المودعة في حساب ضمان المشروع.	500 عن كل شهادة
38	طلب التصحيح الصادر وفقًا لأحكام اللائحة التنفيذية بشأن حساب ضمان المشروع.	500 عن كل طلب تصحيح

يُنشر هذا القرار في الجريدة الرسمية ويُعمل به من تاريخ العمل بأحكام القانون رقم (3) لسنة 2015 المشار إليه.

Issuing the Executive Regulations regarding the Approval of Fees in Accordance with

Law No. (3) of 2015 Concerning the Regulation of the Real Estate Sector in the Emirate of Abu Dhabi

- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Body in the Emirate of Abu Dhabi and its amending laws.

- And Law No. (3) of 2005 Concerning the Regulation of Real Estate Registration in the Emirate of Abu Dhabi.

- And Law No. (19) of 2005 on Real Estate Property and its amending laws.

- And Law No. (9) of 2007 Concerning the Establishment of the Department of Municipal Affairs.

- And Law No. (3) of 2015 Concerning the Regulation of the Real Estate Sector in the Emirate of Abu Dhabi.

- And based on what was presented to the Executive Council, and its approval.

It is decided as follows:

Article (1)

Without prejudice to the schedule of fees annexed to the aforementioned Law No. (3) of 2005, the fees shown in the following table shall be collected for the services provided by the Department and the concerned municipalities in accordance with the aforementioned Law No. (3) of 2015 and the executive regulations issued thereunder.

28	Registering a deed of waiver of mortgage priority in the Initial Real Estate Register or the Real Estate Register.	200
29	Registering a mortgage release deed in the Initial Real Estate Register or the Real Estate Register.	1000
30	Registering a mortgage deed for a Musataha contract.	1 per thousand of the mortgage value, with a maximum of two million dirhams per transaction.

34	Registering dispositions of off-plan real estate units in the Initial Real Estate Register.	- In the case of a sale: 2% of the property value, shared equally between the seller and the buyer, with a maximum of two million dirhams per transaction. - In the case of a gift: 2000 dirhams if the gift is between ascendants, descendants, spouses, and legal persons wholly owned by them. Otherwise, the gift is treated as a sale with regard to fees. - In the case of a will: 2000 dirhams
35	Registering and transferring dispositions of off-plan real estate units from the Initial Real Estate Register to the Real Estate Register.	- In case of sale (1000) - In case of gift (200) - In case of will (100)
36	Registering an Owners' Association in the Real Estate Register.	1000 for each Owners' Association
37	Issuing a certificate to claim funds deposited in the project escrow account.	500 for each certificate

Article (2)

This decision shall be published in the Official Gazette and shall come into force from the date of the implementation of the provisions of the aforementioned Law No. (3) of 2015.
