بشأن تسجيل عقود إيجار الأراضي الزراعية في إمارة أبو ظبي
رئيس دائرة البلديات والنقل،
- - بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،
- - وعلى القانون رقم (3) لسنة 2005 في شأن تنظيم التسجيل العقاري بإمارة أبوظبي، ولائحته التنفيذية وتعديلاته،
- - وعلى القانون رقم (19) لسنة 2005 في الملكية العقارية وتعديلاته،
- - وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي وتعديلاته،
- - وعلى القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي وتعديلاته،
- - وعلى القانون رقم (11) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي وتعديلاته،
- - وعلى القانون رقم (3) لسنة 2015 في شأن تنظيم القطاع العقاري في إمارة أبوظبي،
- - وعلى القانون رقم (7) لسنة 2019 بإنشاء هيئة أبوظبي للزراعة والسلامة الغذائية،
- - وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،
- - وعلى المرسوم الأميري رقم (1) لسنة 2019 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي وتعديلاته،
- - وعلى قرار رئيس المجلس التنفيذي رقم (4) لسنة 2011 بشأن قواعد وإجراءات تسجيل عقود الإيجار في إمارة أبوظبي،
- - وعلى قرار رئيس المجلس التنفيذي رقم (49) لسنة 2018 بشأن رسوم خدمات البلدية بإمارة أبوظبي،
- - وعلى قرار المجلس التنفيذي رقم (336) لسنة 2018 بشأن تخفيض وإلغاء بعض رسوم خدمات البلدية في إمارة أبوظبي،
- - وعلى القرار الإداري رقم (43) لسنة 2020 بشأن السماح ببيع وتداول الأراضي الزراعية بإمارة أبوظبي،
- - وعلى قرار رئيس مجلس إدارة هيئة أبوظبي للزراعة والسلامة الغذائية رقم (3) لسنة 2020 بإصدار نظام المتطلبات الزراعية لمزارع إمارة أبوظبي،
- - وبناءً على ما تقتضيه مصلحة العمل،
تقرر ما يلي:
المادة (1)
على جميع ملاك الأراضي الزراعية تسجيل عقود إيجار هذه الأراضي لدى البلدية المختصة وفقًا للإجراءات والضوابط المتبعة بهذا الشأن، مع استيفاء الشروط الآتية:
- أن يكون المستأجر شخصية اعتبارية سواء شركة أو مؤسسة.
- أن يكون استخدام الأرض الزراعية للأغراض المخصصة لها.
- حصول طرفي العلاقة الإيجارية على الموافقة المسبقة من هيئة أبوظبي للزراعة والسلامة الغذائية.
- ممارسة أحد الأنشطة الزراعية (النباتية و/أو الحيوانية) التي تحددها هيئة أبوظبي للزراعة والسلامة الغذائية وفقًا للشروط والمتطلبات المعتمدة بهذا الشأن.
- سداد الرسوم المقررة.
المادة (2)
يُنشر هذا القرار في الجريدة الرسمية، ويُعمل به من اليوم التالي لتاريخ نشره.

Regarding the Registration of Agricultural Land Lease Contracts in the Emirate of Abu Dhabi
The Chairman of the Department of Municipalities and Transport,
- - Having reviewed Law No. (1) of 1974 on the Reorganization of the Government Apparatus in the Emirate of Abu Dhabi and its amendments,
- - And Law No. (3) of 2005 Concerning the Regulation of Real Estate Registration in the Emirate of Abu Dhabi, its executive regulations, and its amendments,
- - And Law No. (19) of 2005 on Real Estate Ownership and its amendments,
- - And Law No. (10) of 2006 Concerning the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi and its amendments,
- - And Law No. (10) of 2007 Concerning the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi and its amendments,
- - And Law No. (11) of 2007 Concerning the Municipality and Municipal Council of Al Ain City in the Emirate of Abu Dhabi and its amendments,
- - And Law No. (3) of 2015 Concerning the Regulation of the Real Estate Sector in the Emirate of Abu Dhabi,
- - And Law No. (7) of 2019 on the Establishment of the Abu Dhabi Agriculture and Food Safety Authority,
- - And Law No. (30) of 2019 on the Establishment of the Department of Municipalities and Transport,
- - And Emiri Decree No. (1) of 2019 on the Restructuring of the Executive Council of the Emirate of Abu Dhabi and its amendments,
- - And Chairman of the Executive Council Resolution No. (4) of 2011 Concerning the Rules and Procedures for Registering Lease Contracts in the Emirate of Abu Dhabi,
- - And Chairman of the Executive Council Resolution No. (49) of 2018 Concerning Municipal Service Fees in the Emirate of Abu Dhabi,
- - And Executive Council Resolution No. (336) of 2018 Concerning the Reduction and Cancellation of Some Municipal Service Fees in the Emirate of Abu Dhabi,
- - And Administrative Decision No. (43) of 2020 on Permitting the Sale and Trading of Agricultural Lands in the Emirate of Abu Dhabi,
- - And the Chairman of the Board of Directors of the Abu Dhabi Agriculture and Food Safety Authority Resolution No. (3) of 2020 Issuing the System of Agricultural Requirements for Farms in the Emirate of Abu Dhabi,
- - And based on the requirements of the public interest,
Has decided the following:
Article (1)
All owners of agricultural land must register the lease contracts for these lands with the competent municipality in accordance with the procedures and controls in this regard, while fulfilling the following conditions:
- The lessee must be a legal entity, whether a company or an establishment.
- The agricultural land must be used for its designated purposes.
- Both parties to the lease relationship must obtain prior approval from the Abu Dhabi Agriculture and Food Safety Authority.
- Engaging in one of the agricultural activities (plant and/or animal) specified by the Abu Dhabi Agriculture and Food Safety Authority in accordance with the approved conditions and requirements in this regard.
- Payment of the prescribed fees.
Article (2)
This decision shall be published in the Official Gazette and shall come into effect from the day following the date of its publication.
