بإصدار اللائحة التنفيذية للقانون رقم (2) لسنة 2012
(الرقابة على الحيوانات)
رئيس دائرة التخطيط العمراني والبلديات،
- بعد الاطلاع على القانون رقم (1) لسنة 1974 في شأن إعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له.
- وعلى القانون رقم (23) لسنة 2007 بشأن إنشاء مجلس أبوظبي للتخطيط العمراني والقانون المعدل له.
- وعلى القانون رقم (2) لسنة 2012 في شأن الحفاظ على المظهر العام والصحة والسكينة العامة في إمارة أبوظبي.
- وعلى القانون رقم (13) لسنة 2016 في شأن إنشاء دائرة الشؤون البلدية والنقل.
- وعلى قرار رئيس المجلس التنفيذي رقم (2) لسنة 2016 بشأن اللائحة التنفيذية للقانون رقم (2) لسنة 2012 بشأن الحفاظ على المظهر العام والصحة والسكينة العامة في إمارة أبوظبي (الرقابة على الحيوانات).
- وعلى المرسوم الأميري رقم (13) لسنة 2017 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي.
- وبناء على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه.
تقرر ما يلي:
مادة (1)
في تطبيق أحكام هذا القرار، تكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها، ما لم يدل السياق على خلاف ذلك:
| الإمارة | : إمارة أبوظبي. |
| الدائرة | : دائرة التخطيط العمراني والبلديات. |
| البلدية المعنية | : بلدية مدينة أبوظبي أو بلدية مدينة العين أو بلدية منطقة الظفرة أو أية بلدية قد تنشأ مستقبلا في الإمارة. |
| الجهات المعنية | : السلطات الاتحادية والمحلية ذات الصلة. |
| القانون | : القانون رقم (2) لسنة 2012 بشأن الحفاظ على المظهر العام والصحة والسكينة العامة في إمارة أبوظبي. |
| الحيوان | : تشمل حيوانات وطيور الزينة، وحيوانات الرفقة، والحيوانات غير المألوفة، والحيوانات الخطرة، والحيوانات المحظورة. |
| حيوانات وطيور الزينة | : الحيوانات والطيور التي يقوم الإنسان بتربيتها والاعتناء بها لاستخدامها للزينة أو الترفيه. |
| حيوانات الرفقة | : الحيوانات الأليفة التي اعتاد الانسان على تربيتها والاعتناء بها لمرافقته كالكلاب والقطط وغيرها. |
| الحيوانات غير المألوفة | : الحيوانات التي لم يألفها الإنسان ولم يعتد على تربيتها. |
| الحيوانات الخطرة | : الحيوانات التي تشكل خطرًا على سلامة وسكينة الإنسان. |
| الحيوانات المحظورة | : الحيوانات التي يمنع اقتناؤها والتي تحدد من قبل الجهات المعنية. |
| الحيوان السائب | : الحيوان الذي يتواجد في موقع ليس من الطبيعي وجوده فيه معتمدا على ذاته وغير خاضع لسيطرة ورعاية الإنسان. |
| الحيوان الضال | : الحيوان المملوك والمعرف ويتجول بحريته بدون إشراف من مالكه أو حائزه ولو كان يملك معرفة الرجوع إلى مكان حيازته أو مالكه. |
| محل بيع الحيوانات | : المحل المرخص الذي يعرض فيه الحيوانات المصرح ببيعها ويشمل محل بيع حيوانات الزينة والرفقة وغير المألوفة. |
| مالك الحيوان | : الشخص الذي تظهر شهادة تسجيل الحيوان لدى البلدية المعنية بأنه المالك. |
| راعي الحيوان | : الشخص الذي يقوم برعاية الحيوان ومراقبته. |
| مكان إيواء الحيوانات | : المكان المخصص أو المرخص من قبل البلدية المعنية لإيواء وحجز الحيوانات السائبة والضالة التي يتم ضبطها من قبل البلدية المعنية. |
| شهادة تسجيل الحيوان | : الوثيقة الصادرة من البلدية لمالك الحيوان بعد التأكد من استيفائه لكافة الاشتراطات الفنية والصحية والبيئية التي تصدرها الدائرة. |
| الموافقة الصحية | : الموافقة التي تمنحها البلدية المعنية للمنشأة لإثبات استيفائها للمتطلبات والشروط الصحية والفنية لممارسة نشاط تجاري خاضع للرقابة البيطرية وفقًا لأحكام هذه اللائحة. |
مادة (2)
تطبق أحكام هذا القرار على كافة الحيوانات المتواجدة في الإمارة وتشمل:
1. حيوانات وطيور الزينة.
2. حيوانات الرفقة.
3. الحيوانات غير المألوفة.
4. الحيوانات الخطرة.
5. الحيوانات المحظورة.
6. الحيوانات السائبة والضالة.
مادة (3)
تختص البلدية المعنية بما يلي:
1. تنظيم مراقبة وامتلاك وتداول الحيوانات والسيطرة عليها وفقًا لأحكام هذه اللائحة التنفيذية.
2. منح الموافقة الصحية اللازمة لمحلات بيع الحيوانات ولأماكن إيواء الحيوانات وفق الاشتراطات والإجراءات التي تصدرها الدائرة ومراقبة مدى التزامها بالاشتراطات ذات الصلة.
3. منح شهادة تسجيل الحيوان لامتلاك واقتناء وإيواء الحيوانات وفق الاشتراطات والإجراءات التي تحددها الدائرة.
4. تخصيص مساحات مناسبة داخل الأماكن العامة يسمح فيها بإدخال الحيوانات ويتم تحديد هذه المساحات بواسطة لافتات إرشادية.
5. إنشاء أماكن إيواء للحيوانات مجهزة بالمعدات والأدوات التي تساعد على تقديم الرعاية الصحية الكاملة للحيوانات.
6. منح وسائل التعريف للحيوانات بعد تسجيلها لدى البلدية المعنية أو الجهات التي يتم تخويلها.
7. جمع وحجز الحيوانات السائبة والضالة التي توجد في الأماكن العامة والإعلان عنها عبر الوسائل المتاحة لمدة 7 أيام عمل، وفي حال عدم ظهور المالك يتم التصرف في هذه الحيوانات خلال 7 أيام عمل.
8. إنشاء نظام (الضبط والتعقيم وإطلاق سراح الحيوان - Trap-neuter Return TNR) بحق الحيوانات الأليفة صغيرة السن السائبة والضالة الخالية من الأمراض والتي لم يظهر صاحبها أو يتم التنازل عنها لصالح مأوى الحيوانات.
9. إنشاء نظام يتيح للراغبين تبني حيوانات الرفقة.
10. التخلص من الحيوانات السائبة المصابة بمرض معدي والتي لا يمكن علاجها، وذلك بإعدامها وفقًا للطرق التي تحددها بالتنسيق مع الجهات المعنية.
11. إنشاء نظام الضبط والإبلاغ ثم البيع بالمزاد العلني على حيوانات المزرعة السائبة والضالة التي لم يظهر صاحبها أو يتم التنازل عنها.
12. إنشاء نظام الضبط والإطلاق في المحميات أو التسليم لحدائق الحيوان والهيئات العلمية والبيئية على الحيوانات البرية والخطرة والمحظورة والتي لم يظهر صاحبها أو يتم التنازل عنها أو التخلص منها وفقًا لطرق القتل الرحيم التي تحددها بالتنسيق مع الجهات المعنية.
مادة (4)
لغايات تطبيق أحكام هذا القرار، يعتبر مخالفًا القيام بالأعمال الآتية:
أولا: الأفراد
1. تربية الحيوانات (عدا حيوانات الرفقة) في الفلل والشقق السكنية دون تصريح من البلدية المعنية.
2. اصطحاب الحيوانات دون طوق أو رباط عنق أو أية وسيلة مناسبة للسيطرة عليها.
3. اصطحاب الكلاب الكبيرة أو الشرسة دون كمامة تغطي المخطم.
4. اصطحاب الحيوان من قبل أفراد ليس لديهم القدرة على السيطرة عليه.
5. عدم وضع لافته تحذيرية على مدخل المسكن أو المزرعة في حال وجود كلب في الداخل.
6. اصطحاب الحيوانات إلى مراكز التسوق والمطاعم.
7. عدم وضع ملاك البنايات والمجمعات السكنية لافتة أو ملصق يوضح السماح بدخول الحيوانات من عدمه.
8. تملك أو اقتناء أو إيواء الحيوانات دون تسجيل من البلدية المعنية.
9. اصطحاب أو ترك الحيوانات الخطرة أو المحظورة أو غير المألوفة في الأماكن العامة.
10. عدم توفر شهادات تثبت فحص الحيوانات بواسطة طبيب بيطري مرخص بشكل دوري وتقديم الخدمات البيطرية الوقائية والعلاجية اللازمة للتأكد من خلو الحيوان من الأمراض الحيوانية المشتركة.
11. عدم تحصين الحيوانات سنويًا ضد الأمراض الشائعة وعدم تقديم العلاجات الدورية لها في العيادات البيطرية المرخصة.
12. ممارسة بيع أو شراء الحيوانات دون الحصول على التراخيص والموافقات اللازمة من البلدية المعنية.
13. السماح للحيوان بالتواجد في الأماكن غير المسموح بها.
14. السماح للحيوان بتهديد سلامة الأشخاص في الأماكن العامة.
15. إطلاق سراح الحيوان بقصد التخلص منه.
ثانيًا: محلات بيع الحيوانات
1. إدارة محل لبيع وتداول وتكاثر الحيوان دون تصريح من البلدية المعنية.
2. عدم التعاقد مع عيادة بيطرية مرخصة لتقديم الخدمات البيطرية والوقائية اللازمة للحيوانات بشكل دوري.
3. عدم تحصين حيوانات الرفقة المعروضة للبيع ضد الأمراض الشائعة أو إجراء العلاجات الدورية لها.
4. عدم الإبلاغ عن الأمراض الوبائية الواجب الإبلاغ عنها والمحددة وفقًا للتشريعات السارية.
5. عدم عزل الحيوان المريض في مأوى خاص للعلاج.
6. عدم نظافة مأوى الحيوان.
7. عرض حيوان مريض للبيع، أو بدون شهادة تحصين سارية المفعول، تثبت خلوه من الأمراض الوبائية والمعدية.
8. عدم توفير تعليمات إرشادية توضح متطلبات العناية بالحيوان عند البيع.
9. عدم توفير مستلزمات الحماية والسلامة الخاصة كالألبسة الواقية للعاملين والإسعافات الأولية للمتواجدين في محلات البيع.
10. نشر إعلانات بيع وشراء الحيوان بأي طريقة من طرق النشر بدون الحصول على رخصة من البلدية المعنية.
11. بيع الحيوان لمن تقل أعمارهم عن 18 سنة.
12. بيع أو عرض الحيوانات أو طيور الزينة في الأسواق المفتوحة أو على الأرصفة والطرقات.
13. بيع وتداول الحيوان الخطر أو المحظور.
14. تنظيم مزادات أو معارض أو منافسات أو عروض تخص الحيوانات سواءً لأغراض تجارية أو أية أغراض أخرى بما في ذلك الإعلانات أو أغراض الديكور، دون تصريح من البلدية المعنية.
15. إطلاق سراح الحيوان بقصد التخلص منه.
16. بيع الحيوان غير المسجل وفقًا للتشريعات السارية.
17. وضع أكثر من نوع من الحيوانات في نفس القفص.
18. إساءة معاملة الحيوان وعدم توفير الرعاية اللازمة والبيئة الملائمة له.
19. السماح لغير المخولين بالتعامل مع الحيوان من دون إشراف المسؤول في المحل.
مادة (5)
مع عدم الإخلال بأحقية مأمور الضبط القضائي في تحرير محضر ضبط فوري وفقًا لطبيعة المخالفة تتبع الإجراءات الآتية:
1. توجيه إنذار للمخالف بإزالة المخالفة خلال سبعة أيام قبل توقيع الجزاءات المنصوص عليها في المادة (7) من هذا القرار.
2. عرض التصالح على المخالف في ضوء أحكام القانون وهذا القرار وإثبات ذلك في محضر الضبط.
3. إعلان المخالف بقرار إزالة المخالفة على عنوانه المصرح به بكافة الطرق القانونية وذلك خلال سبعة أيام من تاريخ التصالح أو انتهاء مدته.
مادة (6)
تقوم البلدية المعنية بالإجراءات الآتية:
1. الاستعانة بالجهات المعنية من خلال مأمور الضبط القضائي لإزالة المخالفة وذلك بعد انتهاء المدة المحددة وفق البند الثالث من المادة السابقة وذلك على نفقة المخالف.
2. إعداد حساب بالنفقات وتحديد موعد الوفاء وإبلاغ المخالف بذلك.
مادة (7)
1. يعمل بجدول المخالفات والغرامات المرفق بهذا القرار.
2. ما لم يرد بجدول المخالفات والغرامات، يعاقب كل من يخالف أحكام المادة (4) من هذا القرار بغرامة لا تقل عن (200) درهم ولا تزيد على (10,000) درهم، وتضاعف الغرامة في حالة العود.
3. في جميع الأحوال يلتزم المخالف بإزالة أسباب المخالفة متى اقتضى الأمر ذلك.
مادة (8)
يُنشر هذا القرار في الجريدة الرسمية، ويُعمل به من تاريخ نشره.

Decision of the Chairman of the Department of Urban Planning and Municipalities
No. (4) of 2018
Regarding the Issuance of the Executive Regulations of Law No. (2) of 2012
(Animal Control)
The Chairman of the Department of Urban Planning and Municipalities,
- Having reviewed Law No. (1) of 1974 regarding the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amending laws.
- And Law No. (23) of 2007 regarding the establishment of the Abu Dhabi Urban Planning Council and its amending law.
- And Law No. (2) of 2012 regarding the preservation of public appearance, health, and tranquility in the Emirate of Abu Dhabi.
- And Law No. (13) of 2016 regarding the establishment of the Department of Municipal Affairs and Transport.
- And the Decision of the Chairman of the Executive Council No. (2) of 2016 regarding the Executive Regulations of Law No. (2) of 2012 on preserving public appearance, health, and tranquility in the Emirate of Abu Dhabi (Animal Control).
- And Emiri Decree No. (13) of 2017 regarding the restructuring of the Executive Council of the Emirate of Abu Dhabi.
- And based on what was presented to the Executive Council, and the approval of the Council thereof.
Hereby decides as follows:
Article (1)
For the purposes of implementing the provisions of this Decision, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:
| The Emirate | : The Emirate of Abu Dhabi. |
| The Department | : Department of Urban Planning and Municipalities. |
| The Concerned Municipality | : Abu Dhabi City Municipality, Al Ain City Municipality, Al Dhafra Region Municipality, or any municipality that may be established in the future in the Emirate. |
| The Concerned Authorities | : Relevant federal and local authorities. |
| The Law | : Law No. (2) of 2012 regarding the preservation of public appearance, health, and tranquility in the Emirate of Abu Dhabi. |
| The Animal | : Includes ornamental animals and birds, companion animals, unfamiliar animals, dangerous animals, and prohibited animals. |
| Ornamental Animals and Birds | : Animals and birds that humans raise and care for for ornamental or recreational purposes. |
| Companion Animals | : Domestic animals that humans are accustomed to raising and caring for as companions, such as dogs, cats, and others. |
| Unfamiliar Animals | : Animals that humans are not familiar with and are not accustomed to raising. |
| Dangerous Animals | : Animals that pose a danger to human safety and tranquility. |
| Prohibited Animals | : Animals whose possession is forbidden and which are specified by the concerned authorities. |
| Stray Animal | : An animal found in a location where it is not naturally supposed to be, relying on itself and not under human control or care. |
| Roaming Animal | : An owned and identified animal that roams freely without supervision from its owner or possessor, even if it knows how to return to its place of keeping or its owner. |
| Animal Sales Shop | : A licensed shop where authorized animals are displayed for sale, including shops for ornamental, companion, and unfamiliar animals. |
| Animal Owner | : The person who appears as the owner on the animal's registration certificate with the concerned municipality. |
| Animal Carer | : The person who cares for and supervises the animal. |
| Animal Shelter | : A place designated or licensed by the concerned municipality to house and impound stray and roaming animals captured by the concerned municipality. |
| Animal Registration Certificate | : The document issued by the municipality to the animal owner after ensuring compliance with all technical, health, and environmental requirements issued by the Department. |
| Health Approval | : The approval granted by the concerned municipality to an establishment to prove its fulfillment of the health and technical requirements and conditions for practicing a commercial activity subject to veterinary supervision in accordance with the provisions of these regulations. |
Article (2)
The provisions of this Decision shall apply to all animals present in the Emirate, including:
1. Ornamental animals and birds.
2. Companion animals.
3. Unfamiliar animals.
4. Dangerous animals.
5. Prohibited animals.
6. Stray and roaming animals.
Article (3)
The Concerned Municipality shall be responsible for the following:
1. Regulating the control, ownership, and trade of animals and their management in accordance with the provisions of these executive regulations.
2. Granting the necessary health approval for animal sales shops and animal shelters in accordance with the conditions and procedures issued by the Department, and monitoring their compliance with the relevant requirements.
3. Granting animal registration certificates for the ownership, keeping, and sheltering of animals in accordance with the conditions and procedures specified by the Department.
4. Designating suitable areas within public places where animals are allowed, with these areas being identified by signs.
5. Establishing animal shelters equipped with the necessary equipment and tools to provide comprehensive healthcare for animals.
6. Providing means of identification for animals after their registration with the concerned municipality or authorized bodies.
7. Collecting and impounding stray and roaming animals found in public places and announcing them through available means for a period of 7 working days. If the owner does not come forward, these animals will be dealt with within 7 working days.
8. Establishing a Trap-Neuter-Return (TNR) system for young, stray, and roaming domestic animals that are free from disease, whose owner has not appeared, or which have been surrendered to the animal shelter.
9. Establishing a system that allows interested individuals to adopt companion animals.
10. Disposing of stray animals infected with a contagious disease that cannot be treated by euthanizing them according to methods specified in coordination with the concerned authorities.
11. Establishing a system of capture, reporting, and then public auction for stray and roaming farm animals whose owner has not appeared or which have been surrendered.
12. Establishing a system of capture and release into reserves or handing over to zoos and scientific and environmental bodies for wild, dangerous, and prohibited animals whose owner has not appeared, or which have been surrendered, or disposing of them according to humane euthanasia methods specified in coordination with the concerned authorities.
Article (4)
For the purposes of implementing the provisions of this Decision, the following acts shall be considered violations:
First: Individuals
1. Keeping animals (other than companion animals) in villas and residential apartments without a permit from the concerned municipality.
2. Taking animals out without a collar, leash, or any suitable means of control.
3. Taking large or fierce dogs out without a muzzle covering the snout.
4. Having an animal handled by individuals who are unable to control it.
5. Failing to place a warning sign at the entrance of the residence or farm if there is a dog inside.
6. Taking animals to shopping centers and restaurants.
7. Failure by owners of buildings and residential complexes to post a sign or sticker indicating whether animals are allowed or not.
8. Owning, possessing, or sheltering animals without registration from the concerned municipality.
9. Taking or leaving dangerous, prohibited, or unfamiliar animals in public places.
10. Lack of certificates proving that animals have been periodically examined by a licensed veterinarian and have received the necessary preventive and curative veterinary services to ensure the animal is free from zoonotic diseases.
11. Failure to vaccinate animals annually against common diseases and provide them with periodic treatments at licensed veterinary clinics.
12. Engaging in the sale or purchase of animals without obtaining the necessary licenses and approvals from the concerned municipality.
13. Allowing an animal to be in prohibited places.
14. Allowing an animal to threaten the safety of people in public places.
15. Releasing an animal with the intent of abandoning it.
Second: Animal Sales Shops
1. Operating a shop for the sale, trade, and breeding of animals without a permit from the concerned municipality.
2. Failure to contract with a licensed veterinary clinic to provide necessary veterinary and preventive services for the animals on a regular basis.
3. Failure to vaccinate companion animals for sale against common diseases or to provide them with periodic treatments.
4. Failure to report notifiable epidemic diseases as specified by applicable legislation.
5. Failure to isolate a sick animal in a special shelter for treatment.
6. Lack of cleanliness in the animal shelter.
7. Offering a sick animal for sale, or one without a valid vaccination certificate proving it is free from epidemic and contagious diseases.
8. Failure to provide instructional guidelines explaining the animal's care requirements at the time of sale.
9. Failure to provide special safety and protection equipment, such as protective clothing for workers and first aid for those present in the sales shops.
10. Publishing advertisements for the sale and purchase of animals through any means of publication without obtaining a license from the concerned municipality.
11. Selling animals to persons under 18 years of age.
12. Selling or displaying animals or ornamental birds in open markets or on sidewalks and roads.
13. Selling and trading dangerous or prohibited animals.
14. Organizing auctions, exhibitions, competitions, or shows for animals, whether for commercial or any other purposes, including for advertisements or decoration, without a permit from the concerned municipality.
15. Releasing an animal with the intent of abandoning it.
16. Selling an unregistered animal in accordance with applicable legislation.
17. Placing more than one type of animal in the same cage.
18. Mistreating an animal and failing to provide it with the necessary care and a suitable environment.
19. Allowing unauthorized persons to handle an animal without the supervision of the person in charge of the shop.
Article (5)
Without prejudice to the right of the judicial officer to issue an immediate violation report according to the nature of the violation, the following procedures shall be followed:
1. A warning shall be issued to the violator to rectify the violation within seven days before the penalties stipulated in Article (7) of this Decision are imposed.
2. A settlement shall be offered to the violator in light of the provisions of the Law and this Decision, and this shall be recorded in the violation report.
3. The violator shall be notified of the decision to remove the violation at his declared address by all legal means within seven days from the date of the settlement or the end of its period.
Article (6)
The concerned municipality shall take the following measures:
1. Seek the assistance of the concerned authorities through the judicial officer to remove the violation after the expiration of the period specified in the third clause of the preceding article, at the violator's expense.
2. Prepare an account of the expenses, set a due date for payment, and inform the violator thereof.
Article (7)
1. The schedule of violations and fines attached to this Decision shall be enforced.
2. Unless otherwise provided in the schedule of violations and fines, anyone who violates the provisions of Article (4) of this Decision shall be punished with a fine of not less than (200) AED and not more than (10,000) AED, and the fine shall be doubled in case of repetition.
3. In all cases, the violator is obliged to remove the causes of the violation whenever necessary.
Article (8)
This Decision shall be published in the Official Gazette and shall come into effect from the date of its publication.
