Decision of the Chairman of the Department of Municipal Affairs
No. (119) of 2014
On the Issuance of the Executive Regulations of Law No. (2) of 2012
(Use of Satellite Dishes)

The Chairman of the Department of Municipal Affairs,

- Having reviewed Law No. (1) of 1974 on the Reorganization of the Government Apparatus in the Emirate of Abu Dhabi and its amending laws.

- And Law No. (9) of 2007 concerning the Establishment of the Department of Municipal Affairs.

- And Law No. (2) of 2012 concerning the Preservation of Public Appearance, Health, and Public Tranquility in the Emirate of Abu Dhabi.

- And based on what was presented to the Executive Council, and its approval.

Hereby decides the following:

Article (1)

For the purposes of implementing the provisions of this Decision, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:

Article (2)

- The owner is responsible for installing satellite dishes at their own expense.

- The installation of satellite dishes is prohibited except on the roofs and in the internal gardens of buildings, subject to the following conditions:

1. The number of satellite dishes on the building's roof shall not exceed (4).

2. The installation must be on the building's roof, away from the external sides and edges, and closer to the central area of the roof, in a manner that does not interfere with the use of shared services and facilities on the roof and complies with public safety and security rules and conditions.

- The installation of satellite dishes is prohibited in the following locations:

1. On top of water tanks, heating rooms, or air conditioning rooms.

2. On the sides of the building's roof or on balconies from all directions.

3. On top of elevator rooms or stairwells.

4. On rooftop fences or clotheslines.

5. On top of water pipes, sewage pipes, and public utility poles such as electricity and water.

- If satellite dishes are installed in the internal gardens of buildings, they must be enclosed by an external wall and installed at a distance of no less than (2.00 meters) from the garden wall, and their height must not exceed the height of the internal garden wall.

Article (3)

- Subject to the provisions of Article (2) of this Decision, the installation and fixing of satellite dish components and their accessories must comply with the following technical conditions:

1. The installation must be fixed to the structural frame of the building's roof in a way that resists wind effects according to approved building codes.

2. The metal parts must be resistant to rust and corrosion and painted with suitable, non-glossy colors that do not reflect sunlight.

3. All internal metal parts in the satellite dish installation, including mounts, converters, cables, and electrical connections, must be grounded according to electrical technical specifications.

4. Public safety and security conditions must be met in all work, tools, and electrical and electronic devices necessary for installing and fixing satellite dishes, and this includes the commitment to perform regular maintenance.

5. Wires and connections for the satellite dishes must not hang from the roofs down the sides of the buildings or through windows.

- Regarding the installation of satellite dishes in the internal gardens of buildings, the relevant clauses above must be met.

Article (4)

Without prejudice to the right of the judicial enforcement officer to issue an immediate violation report according to the nature of the violation, the violation shall be recorded according to the following procedures:

1. Issuing the necessary reports for it and offering a settlement to the violator in light of the provisions of the Law and this Decision.

2. Notifying the violator of the violation at their declared address through all legally prescribed means within seven days from the date of the decision's issuance by the concerned municipality.

Article (5)

1. The violator has the right to appeal the municipality's decision regarding the violation attributed to them to the Grievances Committee, whenever the nature of the violation warrants it, within two weeks from the date of being notified of the decision's content, by submitting a request to the Director-General.

2. The appellant must state in their request the reasons justifying their grievance and attach supporting documents.

3. The Grievances Committee must study the grievance and decide on it with rejection or acceptance within thirty days from the date of its receipt, through a reasoned decision.

Article (6)

The concerned municipality shall take the following actions:

1. Seek the assistance of the concerned authorities through the judicial enforcement officer to remove the violation after the period specified in Article (4) has expired, at the violator's expense.

2. Prepare an account of the expenses along with a due date for payment and inform the violator, in case the removal was carried out by the concerned municipality. This shall be considered a fixed debt owed by the violator, which may be collected through all legally prescribed means.

Article (7)

1. Anyone who violates the provisions of Articles (2) and (3) of this Decision shall be punished with a fine of (2000) Dirhams.

2. In all cases, the violator is obliged to remove the causes of the violation.

3. The fine shall be doubled in case of repetition.

Article (8)

All persons subject to the provisions of this Decision must regularize their status within a period of six months from the date this Decision comes into force.

Article (9)

This Decision shall be published in the Official Gazette and shall come into force on the day following its publication.
