قانون رقم (30) لسنة 2019
بشأن إنشاء دائرة البلديات والنقل

- - بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.
- - وعلى القانون رقم (2) لسنة 1971 في شأن المجلس الاستشاري الوطني وتعديلاته.
- - وعلى القانون رقم (4) لسنة 1983 في شأن تنظيم أعمال البناء وتعديلاته.
- - وعلى القانون رقم (2) لسنة 2000 في شأن معاشات ومكافآت التقاعد المدنية لإمارة أبوظبي وتعديلاته.
- - وعلى القانون رقم (3) لسنة 2005 في شأن تنظيم التسجيل العقاري بإمارة أبوظبي.
- - وعلى القانون رقم (19) لسنة 2005 في الملكية العقارية وتعديلاته.
- - وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي وتعديلاته.

الباب الأول
تعريفات
مادة (1)
في تطبيق أحكام هذا القانون، يكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها، ما لم يدل سياق النص على خلاف ذلك:

| قطاع التخطيط العمراني والبلديات | القطاع المعني بكل ما يقام فوق الأرض وتحتها بشكل دائم أو مؤقت وكل ما يؤدي إلى إجراء تغيير فيها، ويشمل ذلك تحديد المواقع والمساحات والاستخدامات وما يقام عليها من المنشآت البرية والبحرية بكافة أنواعها ووضع معايير تطويرها وتصميمها والمواد المستخدمة فيها والأعمال التجميلية وكل ما يتعلق بمظهر المدينة وتحديد مسارات ومواقع البنية التحتية وأبعادها وأعمال الحفر والاستصلاح، وكافة الأعمال والبيانات المرتبطة بتخطيطه وتمليكه وتصميمه وترخيصه وتنفيذه والانتفاع به وصيانته وإجراء التعديل عليه وإزالته وتقديم الخدمات المرتبطة به، وكافة الجهات والشركات العاملة فيه بشكل مباشر والعاملين فيها، وكل ما يتعلق بعمل البلديات في الإمارة وفق الاختصاصات الممنوحة لها. |

| المطارات | المطارات المدنية القائمة في الإمارة، وما قد ينشأ منها مستقبلاً. |
| الموانئ | الموانئ القائمة في الإمارة وأية موانئ أخرى قد تنشأ مستقبلاً عدا الموانئ البترولية وموانئ القوات المسلحة. |
| القطاع البحري | القطاع المعني بكافة الأنشطة والشؤون البحرية في مياه الإمارة، والسفن والمساعدات الملاحية والموانئ والممرات المائية والمرافق والأرصفة البحرية والبنية التحتية والتراخيص والتصاريح والموافقات والأنشطة التجارية والسلامة والأمن والبيئة المرتبطة بها. |
| قطاع الطيران المدني | القطاع المعني بجميع شؤون الطيران المدني وما يتعلق به من جوانب على سبيل المثال لا الحصر النقل الجوي (التجاري والخاص) والملاحة الجوية والعمليات الجوية والمطارات والتدريب وكافة الأنشطة المرتبطة بها. |
| مياه الإمارة | الممرات المائية والقنوات والمسطحات والمياه المحيطة بجزر الإمارة، وكذلك المياه الداخلية والسواحل الواقعة في حدود الإمارة. |
| الممرات المائية | المناطق المائية المحيطة بالجزر سواء كانت طبيعية أو صناعية، وكذلك السواحل القريبة من الشواطئ الواقعة في الإمارة. |
| السفينة | كل منشأة تعمل عادة أو تكون معدة للعمل في الملاحة البحرية دون اعتبار لقوتها أو حمولتها أو الغرض من ملاحتها، أيا كان نوعها أو شكلها سواء كانت بمحرك أو بدون محرك، والمخصصة لنقل الأشخاص أو البضائع أو لأي أغراض أخرى تجارية أو غير تجارية، أو رياضية أو سياحية أو للصيد أو للنزهة أو المستغلة في التجارة، وتشمل البيوت العائمة. |
| وسائل النقل البحري | أي قارب أو يخت أو مركب أو دراجة مائية أو أية آلية أو وسيلة نقل بحرية قابلة للحركة والقيادة أيا كان الغرض من استخدامها تسير في مياه الإمارة، ما عدا السفن التجارية المصنفة دوليا. |
| قطاع النقل البري | القطاع المعني بكافة أنماط المواصلات والنقل البريين، بما في ذلك المرور والنقل العام ووسائل النقل البري والمائي ونقل الركاب ونقل البضائع وتنظيم مواقف المركبات ومحطات الأوزان المحورية وأنظمة النقل الذكية والأنشطة والبنى التحتية والمرافق والخدمات واللوجستيات والأصول، وخدمات الحجز والتوزيع المرتبطة بالقطاع، ويشمل النقل المدرسي ونقل العمال والنقل السياحي، ومسارات الدراجات والمشاة وإدارة الازدحام وحركة التنقل والسلامة والصحة والبيئة المرتبطة بالقطاع. |
| وسائل النقل البري | أي وسيلة معدة لنقل الأشخاص والبضائع، سواء كانت مركبة أو حافلة أو شاحنة أو قاطرة ومقطورة أو أي آلية ميكانيكية أو دراجة هوائية أو نارية أو عربة أو أي جهاز آخر يسير على الطريق بقوة ميكانيكية أو بأي وسيلة أخرى أو تلك التي تعمل بشكل مشترك بين البر والبحر (البرمائية) أو ذاتية القيادة، ويشمل ذلك المركبات الخفيفة والثقيلة والجرارات والأجهزة الميكانيكية بأنواعها والمركبات الكهربائية والمتصلة والذاتية القيادة. |
| النقل العام | النقل المخصص للأفراد وأمتعتهم بوسائل نقل مختلفة ومصنفة كوسائل للنقل العام سواء كانت وسائل نقل برية أو مائية داخل الإمارة ومنها إلى الخارج وبالعكس، ويشمل النقل بالحافلات والقطارات والمترو والترام ومركبات الأجرة، كما يشمل البنية التحتية المساندة كالمحطات المخصصة للركاب ولإيواء المركبات ومظلات الانتظار ومراكز التحكم وأرصفة التحميل وورش وخطوط السكك والمسارات اللازمة لها. |
| وسائل النقل المائي العام | أية وسيلة مخصصة للنقل العام للأشخاص والبضائع داخل مياه الإمارة، وتشمل على سبيل المثال لا الحصر ما يصطلح على تسميته بالباص المائي أو التاكسي المائي. |
| نقل البضائع | يشمل نقل المواد والحيوانات الحية بواسطة وسائل النقل المختلفة المعدة لكل نوع من البضائع. |
| الطرق | أراضٍ مخصصة للمرور والسير سواء كانت معبدة أو غير معبدة، وتشمل جميع أنواع الطرق بما في ذلك طرق الصيانة والطوارئ والتحويلات والجسور والشوارع والأنفاق والممرات وما يرتبط بها من أكتاف وخنادق ومجار وأرصفة وجزر سلامة ودوارات وميادين وساحات ولوحات إرشادية وأجهزة إنارة، وإشارات ضوئية وأجهزة تحكم ومعدات ملحقة بها، بالإضافة إلى الجدران الإسنادية والحواجز المثبتة لها. |
| محطة الأوزان المحورية | المحطات المخصصة لمراقبة أوزان حمولات مركبات نقل البضائع. |
| أنظمة النقل الذكية | أنظمة وأجهزة إلكترونية وكهربائية وميكانيكية يتم تركيبها في الطرق ووسائل النقل مرتبطة عبر شبكة اتصالات سلكية ولاسلكية بحواسيب مركزية تحتوي برمجيات تدار من مراكز تحكم مخصصة، تقوم برصد وبتحليل معطيات حركة النقل والمرور وإجراء التغييرات اللازمة عليها بشكل آلي لضمان استمرارية عملها، وتشمل مراقبة الحركة المرورية وشبكة النقل وإدارة الحوادث وضمان انسيابية الحركة المرورية ورفع مستويات السلامة على شبكة الطرق ووسائل النقل، وتشمل كذلك أنظمة الدفع والتحصيل الإلكترونية لرسوم وسائل النقل والمواقف واستخدام الطرق وتقنيات المركبات الكهربائية والمتصلة والذاتية القيادة. |
الباب الثاني
إنشاء الدائرة وأهدافها واختصاصاتها
مادة (2)
- • تنشأ بموجب أحكام هذا القانون دائرة تسمى "دائرة البلديات والنقل" وتحل محل دائرة التخطيط العمراني والبلديات ودائرة النقل.
- • يُنقل إلى الدائرة موظفو ومستخدمو دائرة التخطيط العمراني والبلديات ودائرة النقل، وتؤول جميع أصولهما وموجوداتهما وحقوقهما والتزاماتهما إلى الدائرة، وتكون الدائرة الخلف القانوني لكل من دائرة التخطيط العمراني والبلديات ودائرة النقل.
مادة (3)
تهدف الدائرة إلى ما يأتي:
- • دعم النمو والتطور العمراني في الإمارة وتوجيه وتنظيم ومراقبة أعمال التطوير العمراني، والارتقاء بالعمل البلدي لتقديم المستوى اللائق من الخدمات وتهيئة الظروف المعيشية الكريمة لجميع سكان الإمارة من خلال الإشراف والرقابة على البلديات والمجالس البلدية.
- • تحقيق أعلى مستوى من النمو الاقتصادي والخدمة ومعايير السلامة والأمن والحماية البيئية والتطور التكنولوجي في قطاع النقل بالإمارة.
- • تحقيق المستوى الأمثل في مجالات خدمات السفن وتداول البضائع وتخزينها ومسايرة التطورات في مجال النقل البحري، وفقاً للتشريعات السارية وبالتعاون مع الجهات المختصة في الدولة.
مادة (4)
تباشر الدائرة في سبيل تحقيق أهدافها الاختصاصات الآتية:
- اقتراح الخطط الاستراتيجية والتنفيذية لقطاع التخطيط العمراني والبلديات والنقل في الإمارة واعتمادها من المجلس التنفيذي والإشراف على تنفيذها.
- متابعة التزام الجهات التابعة بتنفيذ الخطط الاستراتيجية والتنفيذية لقطاع التخطيط العمراني والبلديات والنقل.
- الرقابة والإشراف على كافة الجهات التابعة كالصرف من ميزانياتها والعوائد التي تحققها والتزامها بواجباتها واختصاصاتها وإقرار خططها الاستراتيجية والتنفيذية.
- تنظيم قطاع التخطيط العمراني والبلديات والنقل من كافة النواحي من خلال وضع السياسات والمعايير والأنظمة والقرارات والتعاميم التنفيذية والتشغيلية المنظمة للقطاع.
- الرقابة على قطاع التخطيط العمراني والبلديات والنقل والإشراف عليه وفقاً للتشريعات والاتفاقيات والمعاهدات المعنية المعمول بها محلياً ودولياً في القطاع وبالتنسيق مع الجهات ذات الصلة في الدولة وخارجها.
- ترخيص كافة الجهات والشركات والأشخاص العاملة في قطاع التخطيط العمراني والبلديات والنقل ومراقبة مدى التزامها بتوفير المستوى الأمثل في جودة الخدمات التي تقدمها وفقاً للتشريعات السارية وبالتنسيق مع الجهات ذات الصلة.
- اقتراح الرسوم والتعرفات والأثمان المتعلقة باختصاصاتها ورفعها للمجلس التنفيذي للاعتماد وفق النظم المتبعة.
- رفع التقارير الدورية والدراسات التحليلية لمكتب أبوظبي التنفيذي فيما يتعلق باختصاصات الدائرة.
- تشجيع الاستثمار والشراكة مع القطاع الخاص للمشاريع المتعلقة باختصاصات الدائرة بالتنسيق مع الجهات ذات العلاقة.
- الاختصاصات الواردة في قراري رئيس المجلس التنفيذي رقمي (20) و(21) لسنة 2018 المشار إليهما.
- أي اختصاصات أو مهام أخرى تكلف بها من المجلس التنفيذي.
للدائرة تفويض بعض اختصاصاتها لأي جهة حكومية أخرى أو تعهيد بعضها للقطاع الخاص بعد موافقة المجلس التنفيذي.
- • للمجلس التنفيذي التعديل على اختصاصات الدائرة الواردة في هذا القانون أو أي تشريع آخر بالحذف أو الإضافة أو النقل.
المادة (5)
- • تتبع كل من بلدية مدينة أبوظبي وبلدية مدينة العين وبلدية منطقة الظفرة ومركز النقل المتكامل وأية بلدية تنشأ مستقبلاً للدائرة، وتتولى الدائرة الرقابة والإشراف عليها، ولها اقتراح التعديلات اللازمة على الهياكل التنظيمية الخاصة بها ورفعها للمجلس التنفيذي للاعتماد وفق التشريعات السارية، وللدائرة في سبيل ذلك إصدار النظم والقرارات اللازمة لضمان سير العمل فيها.
- • يكون تعيين مدراء العموم في البلديات والمركز بقرار من رئيس المجلس التنفيذي، ويحدد القرار صلاحياتهم ومهامهم.
المادة (6)
يختص المجلس البلدي في البلديات بكل ما من شأنه الارتقاء بمستوى تقديم الخدمات في المنطقة، وتحديد أسلوب قيام البلدية بأعمالها ودعمها في ذلك، كما يعمل على تفعيل دور المجتمع المحلي في النهوض بخدمات المنطقة، وله على وجه الخصوص ما يلي:
- اقتراح التشريعات ذات الصلة باختصاصاته ورفعها إلى رئيس الدائرة.
- اقتراح تشكيل أي لجان دائمة أو مؤقتة يراها لازمة، وتحديد صلاحياتها ورفعها لرئيس الدائرة للاعتماد.
- مراقبة أعمال اللجان الدائمة والمؤقتة.
- أي اختصاصات أخرى يُكلف بها من رئيس الدائرة.
مادة (7)
يمارس رئيس الدائرة كافة الصلاحيات والاختصاصات المخولة للمجلس البلدي في البلديات في حال غيابه.
مادة (8)
على كافة الأشخاص والجهات والشركات الحكومية والخاصة تزويد الدائرة بالمستندات والمعلومات التي تطلبها لمباشرة أو تنفيذ اختصاصاتها.
مادة (9)
يصدر المجلس التنفيذي قراراً بتحديد الجهات التابعة التي تخضع لرقابة وإشراف الدائرة.
الباب الثالث
أحكام عامة
مادة (10)
يصدر رئيس دائرة القضاء - أبوظبي بالاتفاق مع رئيس الدائرة قراراً بتحديد موظفي الدائرة ممن لهم صفة مأموري الضبط القضائي بالنسبة للجرائم التي تقع في دائرة اختصاصاتهم، ويكون لهم حق التفتيش والرقابة على الجهات والشركات والأشخاص العاملة في قطاع التخطيط العمراني والبلديات والنقل، وذلك للتحقق من تنفيذ أحكام هذا القانون واللوائح والنظم والقرارات والتعاميم الصادرة تنفيذاً له.
مادة (11)
- • يحظر إقامة أي أعمال أو إنشاءات أو مشاريع أو مزاولة أي نشاط مرتبط باختصاصات الدائرة دون الحصول على تصريح بذلك من الدائرة وفقاً للنظم المتبعة.
- • على المصرح له بموجب الفقرة السابقة الالتزام بحدود التصريح الممنوح له من الدائرة وكذلك مراعاة التشريعات واللوائح والقرارات السارية في هذا الشأن.
- • يحظر استخدام أي وسيلة نقل لمزاولة أي من الأنشطة التي تنظمها الدائرة ما لم يتم ترخيصها أو منحها التصريح اللازم وفقاً للتشريعات السارية.
مادة (12)
- • مع عدم الإخلال بأي عقوبة أشد ينص عليها قانون آخر، تفرض غرامة إدارية لا تزيد على (10,000,000) عشرة ملايين درهم على كل من يخالف أحكام هذا القانون ولوائحه التنظيمية والتنفيذية والنظم والسياسات والقرارات والتعاميم المنفذة له.
- • تتولى الدائرة تحصيل الغرامات الإدارية، ويصدر رئيس الدائرة بعد موافقة المجلس التنفيذي جدولاً يحدد المخالفات والغرامات الإدارية المقررة لكل منها، وبما لا يتجاوز الغرامة المنصوص عليها في هذه المادة.
- • يجوز لرئيس الدائرة أو من يفوضه بذلك عرض التصالح على المخالف على أن يثبت ذلك في محضر الإجراءات، وعلى المخالف الذي يقبل التصالح أن يسدد غرامة تعادل (75%) من إجمالي الغرامة الإدارية المحددة للمخالفة في مهلة لا تتجاوز ستين يوماً من تاريخ عرض التصالح عليه.
- • في جميع الأحوال إذا لم يلتزم المخالف بإزالة آثار المخالفة في الموعد المحدد، تقوم الدائرة بإزالتها على نفقة المخالف.
- • تحدد اللوائح التنظيمية والتنفيذية لهذا القانون إجراءات التصالح المشار إليه أعلاه بما في ذلك مدده الزمنية.
مادة (13)
للدائرة اتخاذ أي من الجزاءات الإدارية التالية:
- لفت نظر.
- الإنذار.
- وضع المنشأة تحت الإشراف المالي والإداري والفني.
- تعليق النشاط مؤقتاً.
- إلغاء أو وقف الترخيص.
- إغلاق المنشأة مؤقتاً أو نهائياً.
- الإبعاد الإداري للشخص الأجنبي الذي يرتكب المخالفة الإدارية بعد استيفاء أي جزاءات إدارية أخرى مفروضة.
- • يجوز التظلم من الجزاءات الإدارية أمام الدائرة خلال ستين يوماً من تاريخ تبليغ المتظلم بها، ويعتبر عدم البت في التظلم خلال تسعين يوماً من تاريخ تقديمه بمثابة قبول للتظلم.
- • تحدد اللوائح التنظيمية والتنفيذية لهذا القانون إجراءات وضوابط تطبيق الجزاءات الإدارية المشار إليها أعلاه.
مادة (14)
للدائرة التنسيق والربط الإلكتروني مع الجهات ذات الصلة، ولها اتخاذ كافة الإجراءات اللازمة بالتنسيق مع تلك الجهات إن اقتضى الأمر لإبعاد أي وسيلة من وسائل النقل المرتبطة بقطاعات النقل وسحبها وقطرها وحجزها احتياطياً في الحالات الموجبة لذلك قانوناً لحين صدور حكم قضائي بالحجز عليها وبيعها بالمزاد العلني بعد مرور ستة أشهر على حجزها، مع إلزام المخالف بالرسوم والغرامات والمخالفات المترتبة على ذلك وفقاً لأحكام التشريعات السارية.
مادة (15)
تتولى الدائرة اقتراح هيكلها التنظيمي ورفعه للمجلس التنفيذي للاعتماد وفق النظم المتبعة.
مادة (16)
- • تسري على الدائرة القوانين والنظم المالية المعمول بها في الإمارة.
- • تسري على موظفي الدائرة قوانين ونظم الموارد البشرية المعمول بها في الإمارة.
- • يسري على المواطنين منهم قانون معاشات ومكافآت التقاعد المدنية المعمول به في الإمارة.
مادة (17)
- • يصدر رئيس الدائرة بعد موافقة المجلس التنفيذي اللوائح التنظيمية والتنفيذية لهذا القانون.
- • يستمر العمل بالسياسات والأنظمة واللوائح والقرارات والتعاميم السارية بما لا يتعارض مع أحكام هذا القانون وذلك لحين صدور السياسات والأنظمة واللوائح والقرارات والتعاميم المنفذة لأحكامه.
- • يصدر رئيس الدائرة السياسات والقرارات والتعاميم التنفيذية والتشغيلية اللازمة لتنفيذ أحكام هذا القانون.
مادة (18)
- • يُلغى القانون رقم (5) لسنة 2018 والقانون رقم (6) لسنة 2018 المشار إليهما.
- • يُلغى من تشريعات إنشاء الجهات التابعة كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القانون.
- • يُلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القانون.
مادة (19)
يُنفذ هذا القانون من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

Regarding the Establishment of the Department of Municipalities and Transport

- - Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments.
- - And Law No. (2) of 1971 concerning the National Consultative Council and its amendments.
- - And Law No. (4) of 1983 concerning the Regulation of Construction Works and its amendments.
- - And Law No. (2) of 2000 concerning Civil Retirement Pensions and Benefits for the Emirate of Abu Dhabi and its amendments.
- - And Law No. (3) of 2005 concerning the Regulation of Real Estate Registration in the Emirate of Abu Dhabi.
- - And Law No. (19) of 2005 on Real Estate Property and its amendments.
- - And Law No. (10) of 2006 concerning the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi and its amendments.

We have issued the following law:
Part One
Definitions
Article (1)
In the application of the provisions of this law, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:

| Urban Planning and Municipalities Sector | The sector concerned with everything constructed above and below the ground, permanently or temporarily, and anything that leads to a change in it. This includes determining locations, areas, and uses, as well as land and marine facilities of all kinds, setting standards for their development, design, and the materials used in them, beautification works, and everything related to the city's appearance. It also includes determining the paths, locations, and dimensions of infrastructure, excavation and reclamation works, and all works and data related to its planning, ownership, design, licensing, implementation, use, maintenance, modification, and removal, and providing related services. It also includes all entities and companies operating directly in it and their employees, and everything related to the work of municipalities in the Emirate according to their granted competencies. |

| Ports | The existing ports in the Emirate and any other ports that may be established in the future, excluding petroleum ports and armed forces ports. |
| Maritime Sector | The sector concerned with all maritime activities and affairs in the Emirate's waters, ships, aids to navigation, ports, waterways, marine facilities and wharves, infrastructure, licenses, permits, approvals, commercial activities, and related safety, security, and environmental aspects. |
| The sector concerned with all civil aviation affairs and related aspects, including but not limited to, air transport (commercial and private), air navigation, air operations, airports, training, and all associated activities. | |
| Emirate's Waters | The waterways, channels, bodies of water surrounding the Emirate's islands, as well as the internal waters and coasts located within the Emirate's boundaries. |
| Waterways | The water areas surrounding the islands, whether natural or artificial, as well as the coasts near the shores located in the Emirate. |
| Ship | Any facility that normally operates or is intended to operate in maritime navigation, regardless of its power, tonnage, or purpose of navigation, of any type or form, whether motorized or not, intended for the transport of persons or goods or for any other commercial or non-commercial purposes, sports, tourism, fishing, or leisure, or used in commerce, including houseboats. |
| Marine Transport Means | Any boat, yacht, vessel, jet ski, or any other mobile and steerable marine transport mechanism or means, regardless of its purpose of use, that operates in the Emirate's waters, except for internationally classified commercial ships. |
| Land Transport Sector | The sector concerned with all modes of land transport and transportation, including traffic, public transport, land and water transport means, passenger transport, freight transport, regulation of vehicle parking, weigh stations, intelligent transport systems, activities, infrastructure, facilities, services, logistics, and assets, and booking and distribution services related to the sector. It includes school transport, labor transport, tourist transport, bicycle and pedestrian paths, and the management of congestion, mobility, safety, health, and environment related to the sector. |
| Land Transport Means | Any means intended for the transport of persons and goods, whether it is a vehicle, bus, truck, tractor and trailer, or any mechanical mechanism, bicycle, motorcycle, cart, or any other device that moves on the road by mechanical power or any other means, or those that operate jointly on land and sea (amphibious) or are self-driving. This includes light and heavy vehicles, tractors, mechanical devices of all kinds, electric, connected, and autonomous vehicles. |
| Public Transport | Transport intended for individuals and their luggage by various means classified as public transport, whether land or water transport means, within the Emirate and to and from outside it. It includes transport by buses, trains, metros, trams, and taxis, as well as supporting infrastructure such as stations for passengers and vehicle housing, waiting shelters, control centers, loading platforms, workshops, railway lines, and necessary tracks. |
| Public Water Transport Means | Any means intended for public transport of persons and goods within the Emirate's waters, including but not limited to what is termed as a water bus or water taxi. |
| Freight Transport | Includes the transport of materials and live animals by various means of transport designed for each type of freight. |
| Roads | Lands designated for traffic and passage, whether paved or unpaved, including all types of roads such as maintenance and emergency roads, diversions, bridges, streets, tunnels, and corridors, and their related shoulders, ditches, drains, sidewalks, safety islands, roundabouts, squares, plazas, signs, lighting fixtures, traffic signals, control devices, and attached equipment, in addition to retaining walls and their installed barriers. |
| Weigh Station | Stations designated for monitoring the axle weights of freight transport vehicles. |
| Intelligent Transport Systems | Electronic, electrical, and mechanical systems and devices installed on roads and in transport means, connected via a wired and wireless communication network to central computers containing software managed from dedicated control centers. They monitor and analyze traffic and transport data and make necessary changes automatically to ensure their continuous operation. This includes traffic flow monitoring, transport network management, incident management, ensuring smooth traffic flow, and raising safety levels on the road network and transport means. It also includes electronic payment and collection systems for transport fees, parking, road usage, and technologies for electric, connected, and autonomous vehicles. |
Part Two
Establishment, Objectives, and Competencies of the Department
Article (2)
- • A department named the "Department of Municipalities and Transport" is established by virtue of this law, replacing the Department of Urban Planning and Municipalities and the Department of Transport.
- • The employees and staff of the Department of Urban Planning and Municipalities and the Department of Transport shall be transferred to the Department. All their assets, properties, rights, and obligations shall be transferred to the Department, and the Department shall be the legal successor to both the Department of Urban Planning and Municipalities and the Department of Transport.
Article (3)
The Department aims to achieve the following:
- • Support urban growth and development in the Emirate, direct, regulate, and monitor urban development works, and enhance municipal work to provide a decent level of services and create dignified living conditions for all residents of the Emirate through supervision and oversight of municipalities and municipal councils.
- • Achieve the highest level of economic growth, service, safety and security standards, environmental protection, and technological development in the transport sector of the Emirate.
- • Achieve the optimal level in the fields of ship services, cargo handling, and storage, and keep pace with developments in the field of maritime transport, in accordance with applicable legislation and in cooperation with the competent authorities in the State.
Article (4)
To achieve its objectives, the Department shall exercise the following competencies:
- Propose strategic and operational plans for the urban planning, municipalities, and transport sector in the Emirate, have them approved by the Executive Council, and supervise their implementation.
- Monitor the compliance of affiliated entities with the implementation of the strategic and operational plans for the urban planning, municipalities, and transport sector.
- Supervise and oversee all affiliated entities, such as expenditure from their budgets, the revenues they generate, their adherence to their duties and competencies, and the approval of their strategic and operational plans.
- Regulate the urban planning, municipalities, and transport sector in all aspects by setting policies, standards, regulations, decisions, and executive and operational circulars that govern the sector.
- Oversee and supervise the urban planning, municipalities, and transport sector in accordance with the relevant local and international legislation, agreements, and treaties in effect in the sector and in coordination with relevant authorities inside and outside the State.
- License all entities, companies, and individuals operating in the urban planning, municipalities, and transport sector and monitor their commitment to providing the optimal level of service quality in accordance with applicable legislation and in coordination with relevant authorities.
- Propose fees, tariffs, and prices related to its competencies and submit them to the Executive Council for approval in accordance with established procedures.
- Submit periodic reports and analytical studies to the Abu Dhabi Executive Office regarding the Department's competencies.
- Encourage investment and partnership with the private sector for projects related to the Department's competencies in coordination with relevant authorities.
- The competencies mentioned in the Executive Council Chairman's Decisions No. (20) and (21) of 2018 referred to above.
- Any other competencies or tasks assigned to it by the Executive Council.
The Department may delegate some of its competencies to any other government entity or outsource some of them to the private sector after the approval of the Executive Council.
- • The Executive Council may amend the Department's competencies stated in this law or any other legislation by deletion, addition, or transfer.
Article (5)
- • Abu Dhabi City Municipality, Al Ain City Municipality, Al Dhafra Region Municipality, the Integrated Transport Centre, and any municipality established in the future shall be affiliated with the Department, which shall supervise and oversee them. The Department may propose necessary amendments to their organizational structures and submit them to the Executive Council for approval in accordance with applicable legislation. The Department may issue the necessary regulations and decisions to ensure the proper functioning of their work.
- • The appointment of General Managers in the municipalities and the Centre shall be by a decision of the Chairman of the Executive Council, which shall specify their powers and duties.
Article (6)
The Municipal Council in the municipalities is responsible for everything that would raise the level of service delivery in the region, determining the method for the municipality to carry out its work and supporting it in doing so. It also works to activate the role of the local community in advancing the region's services, and it has, in particular, the following:
- Proposing legislation related to its competencies and submitting it to the Chairman of the Department.
- Proposing the formation of any permanent or temporary committees it deems necessary, defining their powers, and submitting them to the Chairman of the Department for approval.
- Monitoring the work of permanent and temporary committees.
- Any other competencies assigned to it by the Chairman of the Department.
Article (7)
The Chairman of the Department shall exercise all the powers and competencies vested in the Municipal Council in the municipalities in its absence.
Article (8)
All persons, government and private entities, and companies must provide the Department with the documents and information it requests to exercise or implement its competencies.
Article (9)
The Executive Council shall issue a decision specifying the affiliated entities that are subject to the supervision and oversight of the Department.
Part Three
General Provisions
Article (10)
The Chairman of the Abu Dhabi Judicial Department, in agreement with the Chairman of the Department, shall issue a decision specifying the employees of the Department who have the capacity of judicial officers for crimes that fall within their jurisdiction. They shall have the right to inspect and monitor the entities, companies, and individuals operating in the urban planning, municipalities, and transport sector to verify the implementation of the provisions of this law and the regulations, rules, decisions, and circulars issued in its implementation.
Article (11)
- • It is prohibited to carry out any works, constructions, or projects, or to engage in any activity related to the Department's competencies without obtaining a permit from the Department in accordance with the established procedures.
- • The permit holder under the preceding paragraph must adhere to the limits of the permit granted by the Department and comply with the applicable legislation, regulations, and decisions in this regard.
- • It is prohibited to use any means of transport to carry out any of the activities regulated by the Department unless it is licensed or granted the necessary permit in accordance with applicable legislation.
Article (12)
- • Without prejudice to any more severe penalty stipulated by another law, an administrative fine not exceeding (10,000,000) ten million dirhams shall be imposed on anyone who violates the provisions of this law, its organizational and executive regulations, and the rules, policies, decisions, and circulars implementing it.
- • The Department shall collect the administrative fines. The Chairman of the Department, after the approval of the Executive Council, shall issue a table specifying the violations and the administrative fines prescribed for each, not to exceed the fine stipulated in this article.
- • The Chairman of the Department, or his authorized representative, may offer a settlement to the violator, which shall be recorded in the proceedings. A violator who accepts the settlement must pay a fine equivalent to (75%) of the total administrative fine specified for the violation within a period not exceeding sixty days from the date the settlement was offered.
- • In all cases, if the violator fails to remove the effects of the violation by the specified deadline, the Department shall remove them at the violator's expense.
- • The organizational and executive regulations of this law shall specify the procedures for the aforementioned settlement, including its timeframes.
Article (13)
The Department may take any of the following administrative penalties:
- Notice.
- Warning.
- Placing the establishment under financial, administrative, and technical supervision.
- Temporary suspension of activity.
- Cancellation or suspension of the license.
- Temporary or permanent closure of the establishment.
- Administrative deportation of a foreign person who commits an administrative violation after any other imposed administrative penalties have been fulfilled.
- • An appeal against administrative penalties may be submitted to the Department within sixty days from the date of notification. Failure to decide on the appeal within ninety days from the date of its submission shall be considered an acceptance of the appeal.
- • The organizational and executive regulations of this law shall specify the procedures and controls for applying the aforementioned administrative penalties.
Article (14)
The Department may coordinate and establish electronic links with relevant authorities. It may take all necessary measures in coordination with those authorities, if required, to remove, withdraw, tow, and preemptively impound any means of transport related to the transport sectors in cases legally warranting such action, pending a court judgment for its seizure and sale by public auction after six months from its impoundment, while obliging the violator to pay the fees, fines, and penalties incurred in accordance with the provisions of applicable legislation.
Article (15)
The Department shall propose its organizational structure and submit it to the Executive Council for approval in accordance with established procedures.
Article (16)
- • The financial laws and regulations in force in the Emirate shall apply to the Department.
- • The human resources laws and regulations in force in the Emirate shall apply to the employees of the Department.
- • The Civil Retirement Pensions and Benefits Law in force in the Emirate shall apply to citizen employees.
Article (17)
- • The Chairman of the Department, after the approval of the Executive Council, shall issue the organizational and executive regulations of this law.
- • The policies, regulations, rules, decisions, and circulars currently in force shall continue to apply, provided they do not conflict with the provisions of this law, until the policies, regulations, rules, decisions, and circulars implementing its provisions are issued.
- • The Chairman of the Department shall issue the executive and operational policies, decisions, and circulars necessary to implement the provisions of this law.
Article (18)
- • Law No. (5) of 2018 and Law No. (6) of 2018 referred to above are hereby repealed.
- • Any text or provision in the establishment legislation of affiliated entities that contradicts or conflicts with the provisions of this law is hereby repealed.
- • Any text or provision that contradicts or conflicts with the provisions of this law is hereby repealed.
Article (19)
This law shall be effective from the date of its issuance and shall be published in the Official Gazette.
