الموضوع: تمديد الإعفاء من رسم دائرة البلديات والنقل على مشغلي دور السينما في إمارة أبوظبي
تحية طيبة وبعد،
بالإشارة إلى الموضوع أعلاه واستناداً إلى القانون رقم (8) لسنة 2018 بشأن إنشاء دائرة الثقافة والسياحة - أبوظبي وما نص عليه بشأن المهام والاختصاصات لتحقيق التنمية السياحية لإمارة أبوظبي، وذلك من خلال القيام بالمهام الموكلة للدائرة، وكذلك قرار المجلس التنفيذي رقم (88) لسنة 2018 بشأن الطلب الوارد من دائرة الثقافة والسياحة باقتراح فرض رسوم جديدة (وتعديلاته). وبناء على توجيهات المجلس التنفيذي لدعم القطاع السياحي في التعافي من الآثار الاقتصادية لجائحة كوفيد-19، والقرار 70 لسنة 2020 وقرار رقم 33 لسنة 2021، وقرار رقم 187 لسنة 2021، ولمزيد من التحفيز لبيئة الاستثمار في إمارة أبوظبي فقد تقرر الآتي:
- تمديد إعفاء دور السينما من رسم دائرة البلديات والنقل على التذاكر المباعة.
- التزام دور السينما بالتصريح عن إيراداتها الشهرية، وتقديم البيانات المالية المؤيدة لها، وتعاون مدققي الإيرادات أو المكلفين من قبل الدائرة للتحقق من صحة الإقرارات والرسوم التي تم سدادها عن الفترات السابقة.
- يبدأ تطبيق الإعفاء على الرسم المذكور أعلاه اعتباراً من 2021/07/01 وحتى 31 /12/ 2021.
- من أجل دعم قطاع السياحة والترفيه قررت الدائرة في حال تحصيل أية رسوم من العملاء فيما بعد 1 يوليو 2021 وحتى تاريخ هذا التعميم،
أ- في حال سداد دور السينما لتلك الرسوم على الدائرة إرجاعها للمنشأة بشرط عدم وجود مستحقات على المنشأة قبل 1 يوليو 2021.
ب- في حال عدم سداد دور السينما لهذه الرسوم للدائرة يجوز للمنشأة اعتبارها إيراداً فعلياً لها وذلك لدعم القطاع السياحي والترفيهي.
يرجى العلم بأنه سيتم التدقيق على إيرادات دور السينما من قبل مدققي دائرة الثقافة والسياحة - أبوظبي للتحقق من الالتزام بهذه التعليمات.

Extension of the Exemption from the Department of Municipalities and Transport Fee for Cinema Operators
in the Emirate of Abu Dhabi

Subject: Extension of the Exemption from the Department of Municipalities and Transport Fee for Cinema Operators in the Emirate of Abu Dhabi
Greetings,
With reference to the above subject and based on Law No. (8) of 2018 concerning the establishment of the Department of Culture and Tourism - Abu Dhabi and its provisions regarding the tasks and competencies to achieve tourism development for the Emirate of Abu Dhabi, through carrying out the tasks assigned to the Department, as well as the Executive Council Resolution No. (88) of 2018 regarding the request received from the Department of Culture and Tourism to propose the imposition of new fees (and its amendments). Based on the directives of the Executive Council to support the tourism sector in recovering from the economic effects of the COVID-19 pandemic, and Resolution 70 of 2020, Resolution No. 33 of 2021, and Resolution No. 187 of 2021, and to further stimulate the investment environment in the Emirate of Abu Dhabi, the following has been decided:
- Extend the exemption for cinemas from the Department of Municipalities and Transport fee on tickets sold.
- Cinemas must declare their monthly revenues, submit supporting financial statements, and cooperate with revenue auditors or those assigned by the Department to verify the accuracy of declarations and fees paid for previous periods.
- The application of the exemption on the aforementioned fee will start from 01/07/2021 until 31/12/2021.
- In order to support the tourism and entertainment sector, the Department has decided that in the event any fees were collected from customers after July 1, 2021, until the date of this circular,
a- If the cinema has paid these fees to the Department, the Department shall refund them to the establishment, provided there are no outstanding dues on the establishment before July 1, 2021.
b- If the cinema has not paid these fees to the Department, the establishment may consider them as actual revenue to support the tourism and entertainment sector.
Please be aware that cinema revenues will be audited by the auditors of the Department of Culture and Tourism - Abu Dhabi to verify compliance with these instructions.
