قرار إداري رقم (37) لسنة 2021
بشأن إصدار اشتراطات عمليات المراسى البحرية في إمارة أبوظبي
رئيس دائرة البلديات والنقل
بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي والقوانين المعدلة له،
- - وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،
- - وعلى قرار رئيس المجلس التنفيذي رقم (21) لسنة 2018 بشان اختصاصات إضافية لدائرة النقل،
- - وعلى المرسوم الأميري رقم (1) لسنة 2019 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي وتعديلاته،
- - وبناءً على ما تقتضيه مصلحة العمل،
قرر ما يلي:
المادة (1)
لغايات تنظيم اشتراطات عمليات المراسي البحرية في إمارة أبوظبي، يعتمد المرفقين في هذا القرار وفقًا للآتي:
- * نموذج عقد إيجار موقف المرسى البحري في إمارة أبوظبي.
- * اشتراطات عمليات المراسي البحرية في إمارة أبوظبي.
المادة (2)
يجب على جميع المشغلين التأكد من تصديق عقد إيجار موقف المرسى البحري الخاص بهم من قبل دائرة البلديات والنقل في موعد لا يتجاوز ستة أشهر من تاريخ صدور هذا القرار أو في وقت التجديد التالي للعقد، أيهما يأتي أولاً.
المادة (3)
ينشر هذا القرار في الجريدة الرسمية، ويعمل به من تاريخ نشره.

Regarding the Issuance of Requirements for Marina Operations in the Emirate of Abu Dhabi
The Chairman of the Department of Municipalities and Transport
Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amending laws,
- - And Law No. (10) of 2006 regarding the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi and its amending laws,
- - And Law No. (10) of 2007 regarding the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi and its amending laws,
- - And Law No. (30) of 2019 regarding the establishment of the Department of Municipalities and Transport,
- - And the decision of the Chairman of the Executive Council No. (21) of 2018 regarding additional competencies for the Department of Transport,
- - And Emiri Decree No. (1) of 2019 regarding the restructuring of the Executive Council of the Emirate of Abu Dhabi and its amendments,
- - And based on the requirements of the public interest,
Has decided the following:
Article (1)
For the purposes of regulating the requirements for marina operations in the Emirate of Abu Dhabi, the two annexes to this decision are adopted as follows:
- * The Marina Berth Lease Agreement Template in the Emirate of Abu Dhabi.
- * The Requirements for Marina Operations in the Emirate of Abu Dhabi.
Article (2)
All operators must ensure that their marina berth lease agreement is attested by the Department of Municipalities and Transport no later than six months from the date of issuance of this decision or at the time of the next renewal of the contract, whichever comes first.
Article (3)
This decision shall be published in the Official Gazette and shall come into effect from the date of its publication.
