Decision of the Chairman of the Department of Urban Planning and Municipalities

On Issuing the Executive Regulations of Law No. (2) of 2012
Concerning the Maintenance of Public Appearance, Health, and Public Tranquility in the Emirate of Abu Dhabi
(Maintenance of Walls and Fences)
The Chairman of the Department of Urban Planning and Municipalities:
- Having reviewed Law No. (1) of 1974 regarding the reorganization of the governmental apparatus of the Emirate of Abu Dhabi and its amendments,
- And Law No. (2) of 2012 concerning the Maintenance of Public Appearance, Health, and Public Tranquility in the Emirate of Abu Dhabi,
- And Law No. (5) of 2018 concerning the establishment of the Department of Urban Planning and Municipalities,
- And based on what was presented to the Executive Council, and the Council's approval thereof,
Hereby decides the following:
Article (1)
For the purposes of implementing the provisions of this Decision, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:

: Abu Dhabi City Municipality, Al Ain City Municipality, Al Dhafra Region Municipality, or any municipality that may be established in the Emirate in the future. |

: The relevant federal and local authorities. |
| The Law |
: Law No. (2) of 2012 concerning the Maintenance of Public Appearance, Health, and Public Tranquility in the Emirate of Abu Dhabi. |
| Walls |
: Partitions, walls, and fences |
| Graffiti |
: Placing drawings, inscriptions, writing phrases, or putting up posters on walls in a public place or road visible to the public, using paint, ink, chalk, dye, or any other material. |
| The Wall Beneficiary |
: Whoever holds the right to use the wall, whether as an owner, investor, tenant, or occupant. |
Article (2)
Writing on walls without a permit is prohibited.
Article (3)
Without prejudice to the right of the Concerned Municipality to immediately remove the violation by an administrative decision according to the nature of the violation, the wall beneficiary shall be obligated - in the event the violator is not identified - to remove the unauthorized writing on the walls.
Article (4)
Without prejudice to the right of the judicial officer to issue an immediate violation report according to the nature of the violation, the following procedures shall be followed:
1. The judicial officer must issue a warning to the violator or the wall beneficiary to remove the violation within seven days from the date the violation was recorded.
2. A settlement shall be offered to the violator or the wall beneficiary in light of the provisions of the Law and this Decision, and this shall be recorded in the violation report.
3. The violator or the wall beneficiary shall be notified of the decision to remove the violation at his own expense, at his declared address through all legal means, within seven days from the date of the settlement or its expiration.
4. Warning the wall beneficiary in accordance with this Article and imposing the penalty stipulated in Article (5) of this Decision is conditional upon seven days having passed since the violation report was issued and the violator not having been identified.
Article (5)
- Anyone who violates the provisions of Articles (2) and (3) of this Decision shall be punished with a fine of AED (2,000).
- The violator or the wall beneficiary, as the case may be, shall be obligated to remove the violation at his own expense.
Article (6)
The Concerned Municipality shall take the following measures:
1. Seek the assistance of the Concerned Authorities through the judicial officer to remove the violation, at the violator's expense.
2. Prepare an account of the expenses, set a payment deadline, and notify the violator thereof.
Article (7)
This Decision shall be published in the Official Gazette and shall come into effect from the date of its publication.
