• • بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي وتعديلاته.
• • وعلى القانون رقم (6) لسنة 2018 بشأن إنشاء دائرة النقل.
• • وبناءً على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه.

• أصدرنا القرار الآتي:

تباشر الدائرة في سبيل تحقيق أهدافها الاختصاصات الإضافية الآتية:

1. اقتراح مخططات الطرق ورفعها إلى دائرة التخطيط العمراني والبلديات للاعتماد.
2. تنظيم ومراقبة قطاعات الطيران المدني والنقل البري والبحري في الإمارة وتحقيق أعلى معايير السلامة والأمن وحماية البيئة والنمو الاقتصادي فيها والمشاركة بالتحقيقات في الحوادث، والعمل على النهوض بها بالتعاون مع الجهات المختصة داخل الدولة وخارجها، وذلك وفقًا للتشريعات السارية.
3. الإشراف على تطبيق القوانين والأنظمة واللوائح التي تصدرها منظمات الطيران المدني والنقل البحري الدولية والإقليمية، لمسايرة أوجه نشاط وتطور الطيران المدني والملاحة البحرية في دول العالم، تحقيقا لأعلى معايير الأمن والسلامة في تلك القطاعات.
4. الإشراف على تنفيذ الأحكام والقواعد المتعلقة بحقوق النقل الجوي والاتفاقيات الثنائية أو المتعددة الأطراف والخاصة بالملاحة الجوية والبحرية التي تعقد مع دول أو أطراف أخرى.
5. وضع القواعد المتعلقة بشروط التحليق فوق إقليم الإمارة والهبوط في مطاراتها والإقلاع منها وكذلك معايير وشروط إنشاء المهابط الخاصة بالطائرات بالتنسيق مع الجهات الاتحادية والمحلية ذات العلاقة.
6. مراقبة تنفيذ القواعد القياسية والتوصيات الدولية التي تتعلق بالتسهيلات، طبقًا لما جاء في الملحق التاسع لمعاهدة الطيران المدني الدولي، وكذلك التوصيات التي تتخذها لجنة التسهيلات في دوراتها المختلفة.
7. وضع الأنظمة والقرارات المتعلقة بحماية المستهلك وتشجيع المنافسة ومنع الاحتكار والرقابة على الأسعار ومستوى الخدمات في قطاع النقل، ورفعها للمجلس التنفيذي للاعتماد.
8. مراقبة مدى التزام المراكز والجهات والشركات التي يعهد إليها بمزاولة النقل العام وإدارة المطارات والموانئ ومواقف المركبات ومحطات النقل العام ومراكز التحكم المروري ومحطات الأوزان المحورية والمرافق اللوجستية المخصصة للنقل البري للبضائع وغيرها من الجهات والشركات العاملة في قطاع النقل بتوفير أعلى مستوى من الخدمات للمستفيدين منها، والتزود من تلك الجهات والشركات دوريًا بكافة المعلومات والبيانات والإحصاءات المتعلقة بالعمليات والأنشطة المرتبطة بقطاع النقل في الإمارة.
9. توقيع مذكرات التفاهم الثنائية المتعلقة بحقوق النقل الجوي عبر مطارات الإمارة حسب الإجراءات المتبعة.
10. منح الموافقات اللازمة للتصريح للمشغلين الجويين بتسيير رحلاتهم المنتظمة وغير المنتظمة من وإلى مطارات الإمارة مع مراعاة استيفاء الموافقات اللازمة من الجهات الاتحادية والمحلية ذات العلاقة.
11. تنظيم الممرات المائية والمياه الداخلية في الإمارة والإشراف على إدارتها، عدا المياه الخاضعة لسيطرة القوات المسلحة والمجلس الأعلى للبترول، وترسيم وتحديد وتعديل مساراتها وأعماقها، ومراقبة المسوحات البحرية وحركة وسائل النقل البحري فيها وتحديد السرعات المقررة لها وأوقات عبورها، والأماكن التي يحظر المرور فيها، وتحديد مناطق الاستخدام والإنزال والأنشطة التجارية والترفيهية - بما في ذلك استخدام الدراجات المائية التي يمكن القيام بها داخل تلك المناطق ومنح الموافقات اللازمة بشأنها.
12. مراقبة التزام السفن بأحكام الاتفاقيات الدولية التي انضمت إليها الدولة في شأن الأنظمة البحرية الدولية والإقليمية، وخاصة فيما يتعلق بسلامة الأرواح في البحار ومنع التلوث.
13. تحديد مواقع ومواصفات المراسي والأرصفة البحرية بالتنسيق مع الجهات المختصة.
14. وضع اللوائح المنظمة للملاحة البحرية في الإمارة ومواصفات وسائل الإرشاد الملاحية والإشراف على تطبيقها.
15. وضع الضوابط والشروط اللازمة لإصدار التراخيص الفردية والتجارية لوسائل النقل البحري وشروط منح رخص قيادتها ومواصفاتها الفنية، والتحقق من توافقها مع معايير واشتراطات الأمن والسلامة والأنظمة البيئية وصلاحيتها فنيًا للإبحار.
16. اتخاذ كافة الإجراءات اللازمة بالتنسيق مع الجهات الاتحادية والمحلية ذات العلاقة لإبعاد أية وسيلة نقل بحري والتحفظ عليها، حال تهديدها للأرواح أو الممتلكات أو الكائنات البحرية أو عرقلة الملاحة أو عدم صلاحيتها فنيًا أو تسببها في تلوث بيئي، وذلك وفق الإجراءات والضوابط التي تحددها الدائرة.
17. تمثيل الإمارة في المؤتمرات والمحافل والمفاوضات المتعلقة بأنشطتها بالتنسيق مع الجهات الاتحادية والمحلية ذات العلاقة.
18. أي اختصاصات أو مهام أخرى تكلف بها الدائرة من المجلس التنفيذي.

يلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القرار.

ينفذ هذا القرار من تاريخ صدوره، وينشر في الجريدة الرسمية.

We, Mohammed bin Zayed Al Nahyan, Crown Prince, Chairman of the Executive Council.

• • Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments.
• • And Law No. (6) of 2018 concerning the Establishment of the Department of Transport.
• • And based on what was presented to the Executive Council and the approval thereof.

• We have issued the following Resolution:

In pursuit of its objectives, the Department shall exercise the following additional competencies:

1. Proposing road plans and submitting them to the Department of Urban Planning and Municipalities for approval.
2. Regulating and monitoring the civil aviation, land, and maritime transport sectors in the Emirate, achieving the highest standards of safety, security, environmental protection, and economic growth therein, participating in accident investigations, and working to advance them in cooperation with competent authorities within and outside the country, in accordance with applicable legislation.
3. Supervising the implementation of laws, regulations, and bylaws issued by international and regional civil aviation and maritime transport organizations, to keep pace with the activities and developments of civil aviation and maritime navigation globally, to achieve the highest standards of security and safety in those sectors.
4. Supervising the implementation of the provisions and rules related to air transport rights and bilateral or multilateral agreements concerning air and maritime navigation concluded with other countries or parties.
5. Establishing the rules related to the conditions for flying over the Emirate's territory, landing at, and taking off from its airports, as well as the standards and conditions for establishing private airfields for aircraft, in coordination with the relevant federal and local authorities.
6. Monitoring the implementation of international standards and recommendations related to facilitation, in accordance with Annex 9 of the Convention on International Civil Aviation, as well as the recommendations adopted by the Facilitation Committee in its various sessions.
7. Establishing regulations and decisions related to consumer protection, encouraging competition, preventing monopoly, and monitoring prices and service levels in the transport sector, and submitting them to the Executive Council for approval.
8. Monitoring the compliance of centers, entities, and companies entrusted with operating public transport and managing airports, ports, vehicle parking, public transport stations, traffic control centers, weigh stations, and logistics facilities designated for land freight transport, and other entities and companies operating in the transport sector, with providing the highest level of services to its beneficiaries, and periodically obtaining from those entities and companies all information, data, and statistics related to operations and activities associated with the transport sector in the Emirate.
9. Signing bilateral memoranda of understanding related to air transport rights through the Emirate's airports according to established procedures.
10. Granting the necessary approvals to authorize air operators to operate their scheduled and non-scheduled flights to and from the Emirate's airports, taking into account obtaining the necessary approvals from relevant federal and local authorities.
11. Regulating waterways and internal waters in the Emirate and supervising their management, excluding waters under the control of the Armed Forces and the Supreme Petroleum Council, demarcating, defining, and modifying their routes and depths, monitoring marine surveys and the movement of maritime transport vessels within them, determining their prescribed speeds and transit times, and areas where passage is prohibited, and defining areas for use, landing, commercial, and recreational activities - including the use of jet skis that can be operated within those areas and granting the necessary approvals thereof.
12. Monitoring the compliance of ships with the provisions of international agreements to which the state has acceded concerning international and regional maritime regulations, especially regarding the safety of life at sea and the prevention of pollution.
13. Determining the locations and specifications of marinas and quays in coordination with the competent authorities.
14. Establishing regulations for maritime navigation in the Emirate and the specifications for navigational aids and supervising their implementation.
15. Establishing the necessary controls and conditions for issuing individual and commercial licenses for maritime transport vessels, the conditions for granting their operating licenses and their technical specifications, and verifying their compliance with security, safety, and environmental standards and requirements, and their technical seaworthiness.
16. Taking all necessary measures in coordination with the relevant federal and local authorities to remove and impound any maritime transport vessel if it threatens lives, property, or marine organisms, obstructs navigation, is not technically seaworthy, or causes environmental pollution, in accordance with the procedures and controls specified by the Department.
17. Representing the Emirate in conferences, forums, and negotiations related to its activities in coordination with the relevant federal and local authorities.
18. Any other competencies or tasks assigned to the Department by the Executive Council.

Any text or provision that violates or contradicts the provisions of this Resolution shall be repealed.

This Resolution shall be effective from the date of its issuance and shall be published in the Official Gazette.
