Administrative Decision No. (139) of 2018
Regarding the Issuance of the Executive Regulations for Law No. (2) of 2012
General Appearance "Health and Safety of Drinking Water Coolers"

- Having reviewed Law No. (1) of 1974 on the reorganization of the governmental apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (10) of 2006 concerning the establishment of the Western Region Municipality and Municipal Council and its amendments,
- And Law No. (10) of 2007 concerning the establishment of the Abu Dhabi City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (11) of 2007 concerning the establishment of the Al Ain City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (2) of 2012 concerning the preservation of the general appearance, public health, and tranquility, and its executive regulations,
- And Law No. (5) of 2018 concerning the establishment of the Department of Urban Planning and Municipalities,
- And Emiri Decree No. (13) of 2017 on the restructuring of the Executive Council of the Emirate of Abu Dhabi,
- And based on the public interest,
Has decided the following:
Article (1)
In the application of the provisions of this Decision, the following words and phrases shall have the meanings assigned to each, unless the context indicates otherwise:

| The Concerned Municipality |
: Abu Dhabi City Municipality, Al Ain City Municipality, Al Dhafra Region Municipality, or any municipality that may be established in the Emirate in the future. |
| The Concerned Authority |
: The relevant federal or local authority. |
| The Competent Department |
: The Public Health Department in the Municipality. |
| The Owner |
: The natural or legal person, or their representative, licensed to install the water cooler. |
| Water Cooler Installation Approval |
: The permit granted by the Concerned Municipality to the Owner to install a drinking water cooler in a public place. |
Article (2)
The provisions of this Decision shall apply to drinking water coolers installed in public places.
Article (3)
Installing a drinking water cooler in public places is prohibited without obtaining the approval of the Concerned Municipality.
Article (4)
The requirements for obtaining approval to install a water cooler are as follows:
- Contracting with a company specialized in the installation and maintenance of water coolers.
- Submitting a water and electricity bill issued by the Concerned Authority.
- Adhering to the occupancy rules for sidewalks and service areas.
Article (5)
Requirements for the installation and operation of a drinking water cooler:
- The water cooler must be installed on a concrete base with a thickness of (10 cm) from the ground surface to prevent it from falling.
- The water cooler shall be placed inside a designated room, and the cold water taps shall be extended outside the room or house.
- All electrical connections must be in good condition, secured, and placed inside insulating conduits according to the requirements of the Concerned Authority to ensure user safety.
- The water cooler must be equipped with approved filters, which must be cleaned and replaced as needed and according to the manufacturer's instructions.
- Ensure the water taps are functional to prevent water wastage.
- It is preferable for the water taps to be in the form of a small fountain to ensure no mouth contact.
- A sticker, as decided by the Concerned Municipality, containing the operator's details and a complaint number, must be placed.
Article (6)
The Owner must comply with the following:
- Perform maintenance, cleaning, and disinfection of the water cooler by a licensed operator at least once every six months.
- Test at least one water sample annually at an accredited laboratory in the Emirate of Abu Dhabi.
- The microbiological contamination levels in any water sample must not exceed the limits approved by the Concerned Authority.
- Maintain records of cleaning, disinfection, and water sample test results in a file accessible to the inspector of the Concerned Municipality.
- In the event of contamination in any water sample, the Owner must immediately drain the water cooler, stop its operation, and take all necessary measures to eliminate the contamination.
- The contaminated water cooler shall not be put back into operation until a water sample is analyzed to confirm the elimination of the causes of contamination.
Article (7)
The Concerned Municipality has the right to suspend or cancel the approval for the installation of a water cooler in case of violation of the provisions of this Decision.
Article (8)
Persons subject to the provisions of this Decision must regularize their status within six (6) months from the date this Decision comes into effect.
Article (9)
This Decision shall be effective from the date of its issuance and shall be published in the Official Gazette.
