بشأن تنظيم الاستخدام المدني للطائرات بدون طيار والأنشطة المرتبطة بها في إمارة أبوظبي
رئيس دائرة البلديات والنقل
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،
- وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،
- وعلى القانون الاتحادي رقم (20) لسنة 1991 بإصدار قانون الطيران المدني،
- وعلى القانون الاتحادي رقم (4) لسنة 1996 في شأن الهيئة العامة للطيران المدني وتعديلاته،
- وعلى المرسوم بقانون اتحادي رقم (26) لسنة 2022 بشأن تنظيم الاستخدام المدني للطائرات بدون طيار والأنشطة المرتبطة بها،
- وعلى قرار رئيس المجلس التنفيذي رقم (21) لسنة 2018 بشأن اختصاصات إضافية لدائرة النقل،
- وعلى قرار مجلس الوزراء رقم (110) لسنة 2023 بشأن النظام الإماراتي لمنتجات وأنظمة الطائرات بدون طيار
- وعلى قرار مجلس إدارة الهيئة العامة للطيران المدني رقم (2) لسنة 2015 بشأن نظام ممارسة الرياضات الجوية الخفيفة،
- وعلى المرسوم الأميري رقم (11) لسنة 2023 بشأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي،
- وبناء على ما عُرض على مكتب أبوظبي التنفيذي وموافقة المكتب عليه،
تقرر ما يلي:
المادة (1)
التعريفات
في تطبيق أحكام هذا القرار، يكون للكلمات والعبارات التالية المعاني المبينة قرين كل منها، ما لم يدل سياق النص على خلاف ذلك:

: أي آلة أو مركبة أو ما يماثلها من الأجسام تستطيع الطيران بدون وجود قائد لها على متنها ويتم التحكم فيها عن بعد أو بشكل ذاتي، وتعتبر أنظمة التحكم بها جزءاً منها وتستخدم للأغراض المدنية. |

: الإقلاع عن سطح الأرض والبقاء في الجو من خلال ردود فعل الهواء غير المنعكسة من سطح الأرض ولغاية ملامسة سطحها مرة أخرى. |
| المجال الجوي |
: أجواء الإمارة في امتدادها الأفقي والعمودي |
| البنية التحتية |
: كافة المنشآت والمرافق والبرمجيات اللازمة لتشغيل الطائرة بدون طيار على اختلاف أنظمة التحكم فيها، وتشمل على سبيل المثال لا الحصر مطارات الطائرات بدون طيار، ومحطات التزويد بالوقود والطاقة وإدارة حركة نظام الطائرات بدون طيار وكافة المرافق الأخرى ذات الصلة. |
| مطارات الطائرات بدون طيار |
: مساحة محددة على سطح الأرض أو الماء أو المنشآت، تتوفر فيها كافة المعايير والمتطلبات الدولية المعتمدة في هذا الشأن، وتكون مخصصة لهبوط الطائرة بدون طيار وإقلاعها ومبيتها وصيانتها، وتشمل المباني والأبراج والمدارج والأجهزة والمعدات والأنظمة وغيرها الملحقة بها. |
| مهابط الطائرات بدون طيار |
: مساحة معلومة الإحداثيات، تكون محددة بعلامات موجودة على سطح الأرض أو مرفوعة أعلى المنشآت أو المنصات البحرية أو السفن، مخصصة لإقلاع وهبوط الطائرات بدون طيار بشكل آمن والتي تعتمدها الدائرة بالتنسيق مع الهيئة. |
| التسجيل |
: قيد جميع الطائرات بدون طيار في السجل، والتصرفات التي ترد عليها من نقل الملكية وحيازة وتأجير واستغلال وغيرها من التصرفات وفقاً للتشريعات السارية. |
| السجل |
: السجل الموحد المنشأ بموجب المادة ( 4 ) من المرسوم بقانون اتحادي رقم ( 26 ) لسنة 2022 المشار إليه، والذي تقيد فيه بيانات الطائرات بدون طيار على مستوى الدولة وبيانات التصاريح والشهادات الصادرة بشأنها، والتصرفات التي ترد عليها. |

: كافة عمليات استخدام وتشغيل الطائرات بدون طيار والتجارب التشغيلية لها والأنشطة المرتبطة بها، وتشمل عمليات التشغيل للأغراض الترفيهية والتجارية والخدمية والبحثية. |
| الأنشطة المرتبطة |
: الأنشطة المتعلقة بالطائرات بدون طيار مثل التصميم والتصنيع والتجميع والتعديل أو الفحص أو الصيانة أو تطوير أنظمة المحاكاة والتدريب والتأهيل وإنشاء البنية التحتية ومطارات الطائرات بدون طيار ومحطات التزويد بالوقود والطاقة، أو غيرها من الأنشطة ذات الصلة بالطائرات بدون طيار التي يتم تحديدها وفق التشريعات السارية. |
| التصريح |
: الموافقة الصادرة من الدائرة بالسماح للمالك أو المشغل باستخدام أو تشغيل الطائرة بدون طيار أو القيام بأي من عمليات التشغيل في الإمارة. |
| المصرح له |
: الشخص الحاصل على تصريح من الدائرة لممارسة أي من أنشطة الطائرات بدون طيار في الإمارة. |
| الشهادة |
: مستند رسمي يثبت استيفاء الشروط والمتطلبات والإجراءات المعتمدة المتعلقة بالطائرات بدون طيار، وتصدر عن الدائرة. |
| خارطة معلومات الطائرة بدون طيار |
: خارطة تُحدد فيها المناطق المعتمدة والمقيدة والمحظورة في الإمارة لعمليات تشغيل الطائرة بدون طيار، وتحتوي على معلومات نطاق الطيران وقيوده. |
| المشغل |
: الشخص المصرح له بالقيام بأي عملية من عمليات التشغيل وفقاً للتشريعات السارية. |
| المالك |
: الشخص الذي يملك الطائرة بدون طيار أو أنظمتها أو مطاراتها أو البنية التحتية أو محطات التزويد. |
| شهادة السلامة |
: الوثيقة الصادرة عن الدائرة والتي يسمح بموجبها للمشغل القيام بعمليات التشغيل في الإمارة. |
| مقيم السلامة المستقل |
: الشخص المصرح له وفقاً للتشريعات السارية بالتحقق من مدى استيفاء المالك أو المشغل لشروط ومتطلبات وإجراءات السلامة المعتمدة لدى الدائرة. |
| إدارة حركة نظام الطائرات بدون طيار |
: نظام إدارة عمليات تشغيل الطائرات بدون طيار بشكل آمن وفعال. |
المادة (2)
نطاق التطبيق
تسري أحكام هذا القرار على كافة أنواع الطائرات بدون طيار والأنشطة المرتبطة بها في الإمارة بما في ذلك المناطق الحرة، ما عدا الطائرات بدون طيار المستثناة وفقاً لأحكام المرسوم بقانون اتحادي رقم (26) لسنة 2022 المشار إليه.
المادة (3)
اختصاصات الدائرة
تباشر الدائرة الاختصاصات الآتية وفق التشريعات السارية:
1. الرقابة على عمليات تشغيل الطائرات بدون طيار في الإمارة، وإصدار التصاريح والشهادات اللازمة.
2. تلقي طلبات تسجيل الطائرات بدون طيار في الإمارة وقيدها في السجل.
3. وضع القواعد المتعلقة بشروط تحليق الطائرات بدون طيار فوق إقليم الإمارة والهبوط في مطاراتها والإقلاع منها وكذلك معايير وشروط إنشاء المهابط الخاصة بها في الإمارة بالتنسيق مع الهيئة والجهات ذات العلاقة.
4. إتاحة المعلومات الخاصة بالمناطق الجغرافية للطائرات بدون طيار المحددة ضمن المجال الجوي للإمارة وفقاً لخارطة معلومات الطائرات بدون طيار، وذلك بالتنسيق مع الهيئة.
5. تزويد مشغلي الطائرات بدون طيار في الإمارة بالمعلومات والإرشادات التي تعزز سلامة عمليات تشغيل الطائرات بدون طيار.
6. التفتيش على المصرح لهم وعلى الحاصلين على شهادات، للتأكد من التزامهم بالتشريعات السارية.
7. تنظيم البنية التحتية للطائرات بدون طيار في الإمارة، وإصدار الموافقات اللازمة لإنشاء المطارات الخاصة بالطائرات بدون طيار والتصاميم والمخططات الهندسية ومحطاتها والمرافق اللازمة لها أو لتشغيلها أو تعديلها.
8. أي اختصاصات أو صلاحيات أخرى تتعلق بالطائرات بدون طيار مقررة للدائرة وفقاً للتشريعات السارية.
المادة (4)
استخدامات الطائرات بدون طيار
1. يجوز استخدام وتشغيل الطائرات بدون طيار في الإمارة لممارسة أي مما يأتي:
أ. الأنشطة التجارية.
ب. الأنشطة الخدمية.
ج. الأنشطة العلمية والبحثية والتجريبية.
د. الأنشطة الخاصة بالترفيه وممارسة الهوايات والرياضات الجوية.
ه. تقديم بعض الخدمات العامة من قبل الجهات الحكومية الاتحادية والمحلية والقيام بعملية الرقابة والتفتيش والمتابعة أو غيرها من الأنشطة المرتبطة بالمجالات التي تدخل في اختصاصاتها.
و. أي أنشطة أخرى يتم تحديدها بموجب التشريعات السارية.
2. يجوز للدائرة إضافة أي شروط أخرى إلى شروط الاستخدام والتشغيل المحددة من الهيئة للأنشطة المنصوص عليها في البند (1) من هذه المادة.
المادة (5)
السلامة
1. تقوم الدائرة بإصدار شهادات السلامة للمشغلين واعتماد جهات تقييم السلامة ومقيمي السلامة المستقلين وفق التشريعات السارية.
2. يلتزم المشغل بالحصول على شهادة السلامة قبل استخدام الطائرات بدون طيار، أو أنظمتها، أو القيام بعمليات التشغيل، أو التجارب التشغيلية، أو تشغيل المطار الخاص بالطائرات بدون طيار أو محطات التزويد بالوقود أو الطاقة الخاص بها أو بعد الانتهاء من إنشاء البنية التحتية في الإمارة وفق التشريعات السارية.
المادة (6)
الامتثال
تضع الدائرة ضوابط ومعايير الامتثال اللازمة لتنفيذ أحكام هذا القرار والتشريعات ذات العلاقة، ويجوز للدائرة قبول معايير الامتثال البديلة بما لا يتعارض مع التشريعات السارية.
المادة (7)
التنسيق والتعاون مع الإمارات الأخرى
1. يجوز للدائرة توقيع مذكرات تفاهم مع الهيئة وسلطات الطيران المدني بالإمارات الأخرى وذلك لغرض عمليات التشغيل والأنشطة المرتبطة بها ضمن المجال الجوي للإمارة وتبادل الخبرات.
2. يلتزم المصرح له من الهيئة أو من إحدى السلطات المختصة في الإمارات الأخرى والذي يرغب في استخدام الطائرات بدون طيار أو القيام بعمليات التشغيل في الإمارة بتنفيذ أحكام هذا القرار والتشريعات السارية.
المادة (8)
القرارات التنفيذية
يصدر رئيس الدائرة القرارات والأدلة اللازمة لتنفيذ أحكام هذا القرار.
المادة (9)
إلغاء التشريعات
يُلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القرار.
المادة (10)
النشر
ينشر هذا القرار في الجريدة الرسمية، ويُعمل به من تاريخ نشره.

Regarding the Regulation of Civil Use of Unmanned Aircraft and Associated Activities in the Emirate of Abu Dhabi
Chairman of the Department of Municipalities and Transport
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Government Apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (30) of 2019 on the Establishment of the Department of Municipalities and Transport,
- And Federal Law No. (20) of 1991 issuing the Civil Aviation Law,
- And Federal Law No. (4) of 1996 concerning the General Civil Aviation Authority and its amendments,
- And Federal Decree-Law No. (26) of 2022 on the Regulation of the Civil Use of Unmanned Aircraft and Associated Activities,
- And the Decision of the Chairman of the Executive Council No. (21) of 2018 regarding Additional Competencies for the Department of Transport,
- And Cabinet Decision No. (110) of 2023 concerning the UAE System for Unmanned Aircraft Products and Systems,
- And the Decision of the Board of Directors of the General Civil Aviation Authority No. (2) of 2015 concerning the System for Practicing Light Air Sports,
- And Emiri Decree No. (11) of 2023 regarding the Reshaping of the Executive Council of the Emirate of Abu Dhabi,
- And based on what was presented to and approved by the Abu Dhabi Executive Office,
The following has been decided:
Article (1)
Definitions
In the application of the provisions of this Decision, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:

| The Authority |
: The General Civil Aviation Authority. |
| The Department |
: The Department of Municipalities and Transport. |
| Person |
: A natural or legal person. |
| Unmanned Aircraft |
: Any machine, vehicle, or similar body capable of flying without a pilot on board, controlled remotely or autonomously, with its control systems considered part of it, and used for civil purposes. |
| Flight |
: Taking off from the Earth's surface and remaining in the air through aerodynamic reactions not reflected from the Earth's surface, until touching the surface again. |
| Airspace |
: The airspace of the Emirate in its horizontal and vertical extent. |
| Infrastructure |
: All facilities, utilities, and software necessary for the operation of unmanned aircraft with their various control systems, including but not limited to, unmanned aircraft airports, fueling and power supply stations, unmanned aircraft system traffic management, and all other related facilities. |
| Unmanned Aircraft Airports |
: A defined area on land, water, or structures, meeting all approved international standards and requirements, designated for the landing, takeoff, parking, and maintenance of unmanned aircraft, including buildings, towers, runways, devices, equipment, systems, and other associated annexes. |
| Unmanned Aircraft Landing Sites |
: An area with known coordinates, marked on the ground or elevated on top of structures, offshore platforms, or ships, designated for the safe takeoff and landing of unmanned aircraft, approved by the Department in coordination with the Authority. |
| Registration |
: The entry of all unmanned aircraft in the Registry, and the transactions related to them such as transfer of ownership, possession, leasing, exploitation, and other transactions in accordance with the applicable legislation. |
| The Registry |
: The unified registry established under Article (4) of the aforementioned Federal Decree-Law No. (26) of 2022, in which data of unmanned aircraft at the state level, data of permits and certificates issued for them, and transactions related to them are recorded. |
| Operations |
: All operations of using and operating unmanned aircraft, their operational trials, and associated activities, including operations for recreational, commercial, service, and research purposes. |
| Associated Activities |
: Activities related to unmanned aircraft such as design, manufacturing, assembly, modification, inspection, maintenance, development of simulation systems, training, qualification, establishment of infrastructure, unmanned aircraft airports, and fueling and power supply stations, or other activities related to unmanned aircraft determined by applicable legislation. |
| Permit |
: The approval issued by the Department allowing the owner or operator to use or operate an unmanned aircraft or carry out any of the operations in the Emirate. |
| Permittee |
: The person who has obtained a permit from the Department to practice any of the unmanned aircraft activities in the Emirate. |
| Certificate |
: An official document proving the fulfillment of the approved conditions, requirements, and procedures related to unmanned aircraft, issued by the Department. |
| Unmanned Aircraft Information Map |
: A map that identifies the approved, restricted, and prohibited areas in the Emirate for unmanned aircraft operations, and contains information on flight zones and their restrictions. |
| Operator |
: The person permitted to carry out any of the operations in accordance with the applicable legislation. |
| Owner |
: The person who owns the unmanned aircraft, its systems, airports, infrastructure, or supply stations. |
| Safety Certificate |
: The document issued by the Department under which the operator is allowed to conduct operations in the Emirate. |
| Independent Safety Assessor |
: The person authorized in accordance with the applicable legislation to verify the extent to which the owner or operator complies with the approved safety conditions, requirements, and procedures of the Department. |
| Unmanned Aircraft System Traffic Management |
: A system for managing unmanned aircraft operations safely and efficiently. |
Article (2)
Scope of Application
The provisions of this Decision shall apply to all types of unmanned aircraft and their associated activities in the Emirate, including free zones, with the exception of unmanned aircraft exempted in accordance with the provisions of the aforementioned Federal Decree-Law No. (26) of 2022.
Article (3)
Competencies of the Department
The Department shall exercise the following competencies in accordance with the applicable legislation:
1. Supervise the operations of unmanned aircraft in the Emirate, and issue the necessary permits and certificates.
2. Receive applications for the registration of unmanned aircraft in the Emirate and enter them in the Registry.
3. Establish rules related to the conditions for flying unmanned aircraft over the territory of the Emirate, landing at its airports, and taking off from them, as well as the standards and conditions for establishing their own landing sites in the Emirate, in coordination with the Authority and relevant entities.
4. Provide information on the geographical areas for unmanned aircraft specified within the Emirate's airspace in accordance with the Unmanned Aircraft Information Map, in coordination with the Authority.
5. Provide unmanned aircraft operators in the Emirate with information and guidance that enhances the safety of unmanned aircraft operations.
6. Inspect permittees and certificate holders to ensure their compliance with the applicable legislation.
7. Regulate the infrastructure for unmanned aircraft in the Emirate, and issue the necessary approvals for the establishment of airports for unmanned aircraft, their designs, engineering plans, stations, and the facilities necessary for them or for their operation or modification.
8. Any other competencies or powers related to unmanned aircraft assigned to the Department in accordance with the applicable legislation.
Article (4)
Uses of Unmanned Aircraft
1. Unmanned aircraft may be used and operated in the Emirate for any of the following purposes:
a. Commercial activities.
b. Service activities.
c. Scientific, research, and experimental activities.
d. Activities related to entertainment, hobbies, and air sports.
e. Provision of some public services by federal and local government entities and carrying out supervision, inspection, follow-up, or other activities related to the areas within their competencies.
f. Any other activities determined by the applicable legislation.
2. The Department may add any other conditions to the conditions of use and operation specified by the Authority for the activities stipulated in Clause (1) of this Article.
Article (5)
Safety
1. The Department shall issue safety certificates to operators and accredit safety assessment bodies and independent safety assessors in accordance with the applicable legislation.
2. The operator is obligated to obtain a safety certificate before using unmanned aircraft or their systems, conducting operations or operational trials, operating an unmanned aircraft airport or its fueling or power supply stations, or after the completion of infrastructure construction in the Emirate, in accordance with the applicable legislation.
Article (6)
Compliance
The Department shall establish the necessary compliance controls and standards to implement the provisions of this Decision and related legislation. The Department may accept alternative compliance standards provided they do not conflict with the applicable legislation.
Article (7)
Coordination and Cooperation with Other Emirates
1. The Department may sign memorandums of understanding with the Authority and the civil aviation authorities of other Emirates for the purpose of operations and associated activities within the Emirate's airspace and the exchange of expertise.
2. A permittee from the Authority or from a competent authority in another Emirate who wishes to use unmanned aircraft or conduct operations in the Emirate must comply with the provisions of this Decision and the applicable legislation.
Article (8)
Executive Decisions
The Chairman of the Department shall issue the necessary decisions and manuals for the implementation of the provisions of this Decision.
Article (9)
Repeal of Legislation
Any text or provision that contradicts or conflicts with the provisions of this Decision is hereby repealed.
Article (10)
Publication
This Decision shall be published in the Official Gazette and shall come into effect from the date of its publication.
