بشأن تعديل القرار الإداري رقم (52/1) لسنة 2008 بإصدار
اللائحة التنفيذية للقانون رقم (3) لسنة 2005
في شأن تنظيم التسجيل العقاري بإمارة أبوظبي
رئيس دائرة التخطيط العمراني والبلديات:
بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (3) لسنة 2005 في شأن تنظيم التسجيل العقاري بإمارة أبوظبي،
- وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون الاتحادي رقم (1) لسنة 2006 في شأن المعاملات والتجارة الإلكترونية وعلى القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (11) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي والقوانين المعدلة له،
- وعلى القانون رقم (5) لسنة 2018 بشأن إنشاء دائرة التخطيط العمراني والبلديات.
- وعلى القرار الإداري رقم (52/1) لسنة 2008 بإصدار اللائحة التنفيذية للقانون رقم (3) لسنة 2005 في شأن تنظيم التسجيل العقاري بإمارة أبوظبي،
- وبناء على ما تقتضيه مصلحة العمل،
تقرر ما يلي:
المادة (1)
يضاف بند جديد برقم (6) و(7) إلى المادة رقم (23) من القرار الإداري رقم (1/52) لسنة 2008 بإصدار اللائحة التنفيذية للقانون رقم (3) لسنة 2005 في شأن تنظيم التسجيل العقاري بإمارة أبوظبي، وذلك على النحو الآتي:
- يستثنى من الحضور أمام المسجل طرفي العقد أو من ينوب عنهما قانونًا في حالة التوقيع الالكتروني لمعاملات رهن العقارات السكنية والخاصة بقروض إسكان المواطنين والممولة من حكومة أبوظبي.
- إذا كان أحد الملاك قاصرًا يجب إرفاق موافقة المحكمة المختصة على الرهن.
المادة (2)
يُنفذ هذا القرار اعتبارًا من تاريخ صدوره، ويعمم على جميع الجهات المعنية، وذلك للعمل بموجبه كل فيما يخصه.

Administrative Decision No. (173) of 2018
Concerning the amendment of Administrative Decision No. (52/1) of 2008 issuing
the Executive Regulations of Law No. (3) of 2005
regarding the regulation of Real Estate Registration in the Emirate of Abu Dhabi
The Chairman of the Department of Urban Planning and Municipalities:
Having reviewed Law No. (1) of 1974 reorganizing the Governmental Body in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (3) of 2005 regarding the regulation of Real Estate Registration in the Emirate of Abu Dhabi,
- And Law No. (10) of 2006 concerning the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi and its amending laws,
- And Federal Law No. (1) of 2006 concerning Electronic Transactions and Commerce, and Law No. (10) of 2007 concerning the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (11) of 2007 concerning the Municipality and Municipal Council of Al Ain City in the Emirate of Abu Dhabi and its amending laws,
- And Law No. (5) of 2018 regarding the establishment of the Department of Urban Planning and Municipalities.
- And Administrative Decision No. (52/1) of 2008 issuing the Executive Regulations of Law No. (3) of 2005 regarding the regulation of Real Estate Registration in the Emirate of Abu Dhabi,
- And based on the requirements of the public interest,
It is decided as follows:
Article (1)
A new clause numbered (6) and (7) shall be added to Article (23) of Administrative Decision No. (52/1) of 2008 issuing the Executive Regulations of Law No. (3) of 2005 regarding the regulation of Real Estate Registration in the Emirate of Abu Dhabi, as follows:
- The parties to the contract or their legal representatives are exempted from appearing before the registrar in the case of electronic signatures for residential real estate mortgage transactions related to citizen housing loans funded by the Abu Dhabi government.
- If one of the owners is a minor, the approval of the competent court for the mortgage must be attached.
Article (2)
This decision shall be effective from the date of its issuance and shall be circulated to all concerned authorities to act upon it, each within its jurisdiction.
