في شأن تعديل بعض أحكام القرار الإداري رقم (120)
بشأن تعديل شروط وقواعد تنظيم أعمال البناء
للمباني السكنية
رئيس دائرة الشؤون البلدية:
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.
- وعلى القانون رقم (9) لسنة 2007 في شأن دائرة الشؤون البلدية.
- وعلى القانون رقم (4) لسنة 1983م في شأن تنظيم أعمال البناء والقوانين المعدلة له.
- وعلى القرار الإداري رقم (108) لسنة 2010م في شأن شروط وقواعد تنظيم أعمال البناء للمباني السكنية في إمارة أبوظبي.
- وعلى القانون رقم (23) لسنة 2007م في شأن مجلس أبو ظبي للتخطيط العمراني.
- وعلى القرار الإداري رقم (120) لسنة 2010م في شأن تعديل شروط وقواعد تنظيم أعمال البناء للمباني السكنية.
- وعلى كتاب مجلس التخطيط العمراني رقم (1306 UPC /PP/AAZ) بتاريخ 2010/10/24 بشأن المعايير التخطيطية للأراضي السكنية والمساكن الشعبية في إمارة أبوظبي.
- وبموجب الصلاحيات والاختصاصات المقررة لرئيس الدائرة، وطبقاً لمقتضيات الصالح العام.
قررنا ما يلي:
مادة (1)
تعدل المادة الأولى من القرار الإداري رقم (120) لسنة 2010م المشار إليه لتقرأ على النحو التالي:
«يمنع تقسيم الأراضي المخصصة للسكن الخاص، ويستثنى من ذلك:
- التقسيم بناء على أمر المحكمة.
- التقسيم للأرض المدمجة.
- التقسيم للأرض المخصصة لأكثر من شخص.
شريطة أن يكون التقسيم في الحالة الاستثنائية المذكورة مستوفيا للشروط والمعايير الفنية والتخطيطية حسب اللوائح والنظم المعمول بها.»
مادة (2)
ينشر هذا القرار في الجريدة الرسمية ويعمل به من تاريخ نشره.

Regarding the Amendment of Some Provisions of Administrative Decision No. (120)
Concerning the Amendment of the Conditions and Rules for Regulating Construction Works
for Residential Buildings
The Chairman of the Department of Municipal Affairs:
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Body in the Emirate of Abu Dhabi and its amendments.
- And Law No. (9) of 2007 concerning the Department of Municipal Affairs.
- And Law No. (4) of 1983 concerning the Regulation of Construction Works and its amending laws.
- And Administrative Decision No. (108) of 2010 concerning the Conditions and Rules for Regulating Construction Works for Residential Buildings in the Emirate of Abu Dhabi.
- And Law No. (23) of 2007 concerning the Abu Dhabi Urban Planning Council.
- And Administrative Decision No. (120) of 2010 concerning the Amendment of the Conditions and Rules for Regulating Construction Works for Residential Buildings.
- And the letter of the Urban Planning Council No. (1306 UPC /PP/AAZ) dated 24/10/2010 regarding the planning standards for residential lands and popular housing in the Emirate of Abu Dhabi.
- And in accordance with the powers and competencies vested in the Chairman of the Department, and as required by the public interest.
We have decided the following:
Article (1)
The first article of the aforementioned Administrative Decision No. (120) of 2010 is amended to read as follows:
«The division of lands designated for private housing is prohibited, with the exception of:
- Division by court order.
- Division of consolidated land.
- Division of land allocated to more than one person.
Provided that the division in the aforementioned exceptional case meets the technical and planning conditions and standards according to the applicable regulations and systems.»
Article (2)
This decision shall be published in the Official Gazette and shall come into force from the date of its publication.
