Administrative Decision No. (147) of 2011
Regarding the Prohibition of Land and Real Estate Allocation
Chairman of the Department of Municipal Affairs
- Having reviewed Law No. (1) of 1974 regarding the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amendments.
- And Law No. (9) of 2007 concerning the establishment of the Department of Municipal Affairs.
- And Law No. (19) of 2005 on Real Estate Property and its amendments.
- And with reference to Administrative Decision No. (95) of 2010 concerning the prohibition of land and real estate allocation.
- And pursuant to the powers and competencies vested in the Chairman of the Department and as required by the public interest.
It is decided as follows:
Article (1)
All municipalities are prohibited from allocating or leasing any lands or real estate of any kind, including industrial lands, agricultural plots (Ezbas), and marine rest houses, except by virtue of decrees or written directives from the Ministry of Presidential Affairs or the Court of His Highness the Crown Prince.
Article (2)
The following are exempted from the provision of Article (1) above:
- Renewal of lease contracts for industrial lands and real estate concluded before the effective date of this decision.
- Leasing of commercial properties and residential apartments.
- Allocation of land to government entities for the purposes of services, utilities, and infrastructure in accordance with the planning standards set by the Abu Dhabi Urban Planning Council and relevant service entities.
Article (3)
This decision shall be effective from its date of issuance, and any provision that contradicts it is hereby repealed. All concerned authorities must adhere to its provisions, each within its own jurisdiction.
