بشأن اللائحة التنظيمية لنشاط تأجير المركبات بالساعات في إمارة أبوظبي

رئيس دائرة البلديات والنقل:

- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.

- وعلى القانون رقم (19) لسنة 2006 في شأن تنظيم النقل بسيارات الأجرة بإمارة أبوظبي وتعديلاته.

- وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل.

- وعلى القانون الاتحادي رقم (21) لسنة 1995 في شأن السير والمرور وتعديلاته.

- وبناءً على ما عرض على المجلس التنفيذي وموافقة المجلس عليه.

تقرر ما يلي:

مادة (1)

في تطبيق أحكام هذا القرار، تكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها ما لم يقض سياق النص بغير ذلك:

مادة (2)

نطاق السريان

تسري أحكام هذه اللائحة على المنشآت ومستخدمي خدمة تأجير المركبات بالساعات في الإمارة.

مادة (3)

اختصاصات المركز

يختص المركز بتطبيق أحكام هذه اللائحة والرقابة على الالتزام بها والتصريح بمزاولة النشاط وتشغيل المركبات في الإمارة.

مادة (4)

شروط إصدار تصريح مزاولة النشاط

يشترط لإصدار تصريح مزاولة النشاط ما يلي:

1. الحصول على رخصة اقتصادية صادرة من الجهات المختصة في الإمارة لمزاولة النشاط.
2. الحصول على إذن من سلطة الترخيص لمزاولة النشاط.
3. الحصول على الموافقة المبدئية المشروطة لمزاولة النشاط من المركز.
4. تحقيق التزامات المنشأة الواردة في المادة (5) من هذه اللائحة.

مادة (5)

التزامات المنشأة

على المنشأة المصرح لها بمزاولة النشاط الالتزام بالآتي:

1. الحصول على تصريح مزاولة النشاط وتصريح تشغيل المركبات والالتزام بحدود اشتراطات التصاريح الممنوحة لها قبل مزاولة النشاط.
2. توفير الحد الأدنى لعدد المركبات المحدد من المركز لمزاولة النشاط، على ألا يقل إجمالي عدد المركبات لمزاولة النشاط عن ثلاثين (30) مركبة، وعدم إضافة أي مركبة إلا بعد الحصول على موافقة المركز.
3. توفير أنظمة أو تطبيقات إلكترونية يتم من خلالها مزاولة النشاط، وإخطار المركز في حال طرأ أي عطل عليها.
4. وضع العلامات الخاصة بالخدمة بالأحجام والألوان والرموز والمواضع المحددة من قبل المركز.
5. أخذ موافقة المركز عند تحديد أو تغيير مقابل خدمة تأجير المركبة.
6. إنشاء السجلات والبيانات والوثائق والإحصائيات والتقارير والاحتفاظ بها التي تتعلق بالصيانة الدورية للمركبة للتأكد من سلامة سيرها على الطريق سواءً بشكل ورقي أو إلكتروني وإتاحتها للمركز للاطلاع عليها.
7. ربط المركبات بنظام مراقبة وتتبع إلكتروني يقرره المركز قبل عمليات مزاولة النشاط.
8. الاحتفاظ بالبيانات والمستندات الخاصة بحركة المركبات وأماكن تواجدها والتأكد من صحتها وشموليتها.
9. التأكد من توافق أنظمة النقل الذكية مع المعايير والمواصفات المعتمدة من المركز.
10. التأكد من تطابق عملية تسجيل بيانات المستخدم مع متطلبات واشتراطات المركز.
11. اتخاذ كافة الإجراءات اللازمة للحفاظ على سرية وخصوصية وأمن معلومات المستخدم.
12. إبلاغ المركز خطيًّا عن رغبة المنشأة للتوقف عن مزاولة النشاط قبل شهر على الأقل من التاريخ المحدد لذلك وسداد الغرامات إن وجدت.
13. الحصول على تصريح من المركز لتسجيل المركبات أو نقل ملكيتها أو شطبها لدى سلطة الترخيص.
14. توفير مركز اتصال لخدمة المتعاملين والدعم الفني، وتوفير آلية لتقديم الشكاوى والمقترحات والاحتفاظ بسجلات الشكاوى متضمنة تفاصيل الشكوى ومقدمها ووقتها وتاريخها وموقعها والإجراءات المتخذة حيالها.

مادة (6)

المحظورات

يحظر على المنشأة ما يلي:

1. تأجير المركبة لأي شخص لا يحمل رخصة قيادة معترف بها من قبل سلطة الترخيص.
2. التنازل عن تصريح مزاولة النشاط للغير أو تعديله دون الحصول على موافقة المركز.
3. تشغيل أي مركبة دون الحصول على تصريح تشغيل المركبة.
4. استخدام أي مركبة غير مرخصة لدى سلطة الترخيص.
5. تأجير المركبة مع السائق.

مادة (7)

التزامات المستخدم

يجب على المستخدم الالتزام بما يلي:

1. استخدام المركبة وفقًا للعقد المبرم بينه وبين المنشأة.
2. إبلاغ القيادة العامة لشرطة أبوظبي عن المقتنيات والممتلكات التي يعثر عليها في المركبة.
3. عدم السماح للغير بقيادة المركبة.

مادة (8)

صلاحية تصاريح مزاولة النشاط

1. تكون مدة سريان التصريح سنة قابلة للتجديد لمدد مماثلة، حسب الشروط والإجراءات المعتمدة من المركز.
2. يتوجب على المنشأة تجديد التصريح خلال شهر من تاريخ انتهائه، ويعتبر التصريح لاغيا بمضي شهرين من تاريخ انتهائه.
3. يجوز للمركز إيقاف العمل بتصريح مزاولة النشاط أو إلغاؤه عند مخالفة أو انتفاء أي من المتطلبات والشروط المقررة بموجب هذه اللائحة، وكذلك في حال ثبوت عدم صحة البيانات المقدمة للحصول على التصريح، أو في حال تراكم غرامات إدارية لمدة 6 شهور من تاريخ ارتكاب المخالفة.
4. لا يجوز تجديد تصاريح مزاولة النشاط دون سداد الغرامات المقررة.

مادة (9)

تصريح تشغيل المركبة

يشترط لإصدار تصريح تشغيل المركبة ما يلي:

1. ألا يتجاوز تاريخ صنع المركبة سنة واحدة عند تقديم طلب الحصول على التصريح.
2. تأمين المركبة تأمينًا شاملاً ضد جميع المخاطر، على أن تغطي وثيقة التأمين السائق والركاب، وأن تغطي فترة سريان وثيقة التأمين على المركبة مدة ترخيصها من قبل سلطة الترخيص وحتى نهاية الثلاثين يومًا التالية لهذه المدة.
3. تكون مدة سريان التصريح سنة قابلة للتجديد لمدد مماثلة، وفق الشروط والضوابط التي يحددها المركز، على ألا تتجاوز أربع سنوات من تاريخ الحصول على أول تصريح تشغيل لها.

مادة (10)

إلغاء تصريح تشغيل المركبة

يجوز للمركز الموافقة على طلب المنشأة بإلغاء تصريح تشغيل المركبة في أي من الحالات التالية:

1. وجود عطل أو حادث جسيم في المركبة يعيق استخدامها من قبل المستخدم.
2. مرور أربع سنوات على تشغيل المركبة وإخراجها من الخدمة.
3. دخول المركبة للصيانة لمدة تزيد على ثلاثة أشهر.

مادة (11)

إضافة مركبات للمنشأة

يجوز تسجيل المركبات التالية للمنشأة، شريطة ألا تكون بنفس علامات الخدمة وألوان المركبات المعدة لمزاولة النشاط:

1. مركبات لأغراض نقل وقطر المركبات المعطلة والتابعة لها فقط.
2. مركبات إدارية وتشمل مركبات الصيانة ومركبات خاصة بالإدارة.

مادة (12)

العقوبات

1. يطبق جدول المخالفات والغرامات الإدارية الملحق بهذا القرار.
2. تطبق إجراءات التظلم والتصالح على المخالفات والغرامات الإدارية المعمول بها لدى الدائرة.
3. على المركز إبلاغ سلطة الترخيص المختصة في الإمارة بكافة المخالفات التي لم تسدد غراماتها والتنسيق معها لتحصيل قيمة الغرامات.

مادة (13)

على جميع المنشآت الممارسة لنشاط تأجير المركبات بالساعات في الإمارة توفيق أوضاعها بما يتوافق مع أحكام هذا القرار خلال مدة ثلاثة أشهر من تاريخ العمل به.

مادة (14)

يصدر رئيس الدائرة القرارات اللازمة لتنفيذ أحكام هذه اللائحة.

مادة (15)

ينشر هذا القرار في الجريدة الرسمية ويعمل به من تاريخ نشره.

* مع إعطاء المخالف مهلة 5 أيام عمل لتصويب الوضع قبل ضبط المخالفة مرة أخرى.

** مع إعطاء المخالف مهلة 20 يوم عمل لتصويب الوضع قبل ضبط المخالفة مرة أخرى.

Administrative Decision No. (75) of 2021

Concerning the Regulation of Hourly Vehicle Rental Activity in the Emirate of Abu Dhabi

The Chairman of the Department of Municipalities and Transport:

- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments.

- And Law No. (19) of 2006 regarding Taxi Transport Regulation in the Emirate of Abu Dhabi and its amendments.

- And Law No. (30) of 2019 on the Establishment of the Department of Municipalities and Transport.

- And Federal Law No. (21) of 1995 concerning Traffic and its amendments.

- And based on what was presented to the Executive Council and its approval.

Hereby decides as follows:

Article (1)

In the application of the provisions of this Decision, the following words and phrases shall have the meanings assigned to each of them, unless the context requires otherwise:

Article (2)

Scope of Application

The provisions of this Regulation shall apply to establishments and users of the hourly vehicle rental service in the Emirate.

Article (3)

Competencies of the Center

The Center is responsible for implementing the provisions of this Regulation, monitoring compliance with it, and authorizing the practice of the Activity and the operation of vehicles in the Emirate.

Article (4)

Conditions for Issuing an Activity Permit

The issuance of an Activity Permit is subject to the following conditions:

1. Obtaining an economic license issued by the competent authorities in the Emirate to practice the Activity.
2. Obtaining permission from the Licensing Authority to practice the Activity.
3. Obtaining a conditional initial approval to practice the Activity from the Center.
4. Fulfilling the obligations of the Establishment stated in Article (5) of this Regulation.

Article (5)

Obligations of the Establishment

The Establishment authorized to practice the Activity must comply with the following:

1. Obtaining an Activity Permit and a Vehicle Operation Permit and adhering to the limits and conditions of the granted permits before practicing the Activity.
2. Providing the minimum number of vehicles specified by the Center to practice the Activity, provided that the total number of vehicles for practicing the Activity is not less than thirty (30) vehicles, and not adding any vehicle without obtaining the Center's approval.
3. Providing electronic systems or applications through which the Activity is practiced, and notifying the Center in case of any malfunction.
4. Placing the service markings with the sizes, colors, symbols, and locations specified by the Center.
5. Obtaining the Center's approval when setting or changing the fee for the vehicle rental service.
6. Creating and maintaining records, data, documents, statistics, and reports related to the periodic maintenance of the vehicle to ensure its road safety, whether in paper or electronic form, and making them available to the Center for review.
7. Connecting the vehicles to an electronic monitoring and tracking system decided by the Center before practicing the Activity.
8. Maintaining data and documents related to vehicle movement and locations and ensuring their accuracy and completeness.
9. Ensuring that intelligent transport systems comply with the standards and specifications approved by the Center.
10. Ensuring that the user data registration process complies with the Center's requirements and conditions.
11. Taking all necessary measures to maintain the confidentiality, privacy, and security of user information.
12. Notifying the Center in writing of the Establishment's desire to cease practicing the Activity at least one month before the specified date and settling any outstanding fines.
13. Obtaining a permit from the Center to register, transfer ownership of, or deregister vehicles with the Licensing Authority.
14. Providing a call center for customer service and technical support, and providing a mechanism for submitting complaints and suggestions, and maintaining complaint records including details of the complaint, the complainant, its time, date, location, and the actions taken.

Article (6)

Prohibitions

The Establishment is prohibited from the following:

1. Renting a vehicle to any person who does not hold a driver's license recognized by the Licensing Authority.
2. Assigning the Activity Permit to a third party or modifying it without obtaining the Center's approval.
3. Operating any vehicle without obtaining a Vehicle Operation Permit.
4. Using any vehicle not licensed by the Licensing Authority.
5. Renting a vehicle with a driver.

Article (7)

Obligations of the User

The User must comply with the following:

1. Using the vehicle in accordance with the contract concluded between them and the Establishment.
2. Reporting any found items and belongings in the vehicle to the Abu Dhabi Police General Headquarters.
3. Not allowing others to drive the vehicle.

Article (8)

Validity of Activity Permits

1. The permit shall be valid for one year, renewable for similar periods, according to the conditions and procedures approved by the Center.
2. The Establishment must renew the permit within one month of its expiry date. The permit will be considered void after two months from its expiry date.
3. The Center may suspend or cancel the Activity Permit in case of violation or non-fulfillment of any of the requirements and conditions stipulated in this Regulation, as well as if the data provided to obtain the permit is proven to be incorrect, or if administrative fines accumulate for a period of 6 months from the date of the violation.
4. Activity Permits may not be renewed without payment of the prescribed fines.

Article (9)

Vehicle Operation Permit

The issuance of a Vehicle Operation Permit is subject to the following conditions:

1. The vehicle's manufacturing date shall not exceed one year when applying for the permit.
2. The vehicle must be comprehensively insured against all risks, with the insurance policy covering the driver and passengers, and the insurance policy's validity period must cover the vehicle's licensing period by the Licensing Authority until the end of the thirtieth day following this period.
3. The permit shall be valid for one year, renewable for similar periods, according to the conditions and controls specified by the Center, provided that it does not exceed four years from the date of obtaining the first operation permit for it.

Article (10)

Cancellation of a Vehicle Operation Permit

The Center may approve the Establishment's request to cancel a Vehicle Operation Permit in any of the following cases:

1. A major breakdown or accident in the vehicle that prevents its use by the User.
2. Four years have passed since the vehicle was put into operation and it is being decommissioned.
3. The vehicle is undergoing maintenance for a period exceeding three months.

Article (11)

Adding Vehicles to the Establishment

The following vehicles may be registered for the Establishment, provided they do not have the same service markings and colors as the vehicles designated for the Activity:

1. Vehicles for the purpose of transporting and towing its own broken-down vehicles only.
2. Administrative vehicles, including maintenance vehicles and vehicles for management use.

Article (12)

Penalties

1. The table of violations and administrative fines attached to this Decision shall be applied.
2. The procedures for grievance and reconciliation for violations and administrative fines in effect at the Department shall apply.
3. The Center must inform the competent Licensing Authority in the Emirate of all violations for which fines have not been paid and coordinate with it to collect the value of the fines.

Article (13)

All establishments practicing the hourly vehicle rental activity in the Emirate must regularize their status in accordance with the provisions of this Decision within three months from the date it comes into force.

Article (14)

The Chairman of the Department shall issue the necessary decisions to implement the provisions of this Regulation.

Article (15)

This Decision shall be published in the Official Gazette and shall come into force from the date of its publication.
