بشأن اللائحة التنظيمية للتحويلات المرورية في إمارة أبوظبي
رئيس دائرة البلديات والنقل
بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له،
وعلى القانون رقم (10) لسنة 1976 في شأن المحافظة على سلامة الكوابل والخطوط الهوائية والقوانين المعدلة له،
وعلى القانون رقم (19) لسنة 2006 في شأن تنظيم النقل بسيارات الأجرة بإمارة أبوظبي والقوانين المعدلة له،
وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،
وعلى المرسوم الأميري رقم (1) لسنة 2019 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي،
وبناء على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه،
قرر ما يلي:
المادة (1)
في تطبيق أحكام هذا القرار، يكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها، ما لم يدل سياق النص على خلاف ذلك:

| الطريق |
أراض مخصصة للمرور العام والسير سواء كانت معبدة أو غير معبدة، وتشمل جميع أنواع الطرق كالطرق الرئيسية والفرعية بما في ذلك طرق الصيانة والطوارئ والتحويلات والسكك وممرات المشاة والدراجات والميادين العامة والجسور والأنفاق والتقاطعات والجزر الوسطية والأرصفة ومعابر المشاة والمواقف العمومية وأثاث الطرق كالإشارات الضوئية واللوحات المرورية والإرشادية ومحطات وقوف الحافلات، وسياجات الحماية بأنواعها المختلفة ومعابر الحيوانات وإنارة الطرق وكافة أصول البنية التحتية الواقعة ضمن نطاق اختصاص الجهة المختصة. |
| حرم الطريق |
المسافة بين خطي البناء طبقاً للرسومات المعتمدة من الجهات المختصة في الإمارة، وكذلك المساحات الأرضية المخصصة لإنشاء الطرق وتوسعتها وخطوط الخدمات والبنية التحتية ومناطق المسطحات الخضراء وأرصفة الطرق والمواقف. |
| التحويلات المرورية |
تغيير خط سير الحركة المرورية على الطريق أو حجز حارة أو كتف طريق أو مواقف أو أي أعمال ضمن حرم الطريق لفترة زمنية مؤقتة. |
| التصريح المروري |
الإذن الصادر من المركز والذي يسمح بالبدء بتنفيذ أعمال التحويلات المرورية ضمن حرم الطريق. |
| الأعمال المصرح بها |
تشمل كافة أعمال التحويلات المرورية التي يقوم بها المصرح لهم والتي يصدر التصريح المروري بشأنها والمحددة في الدليل. |
| الدليل |
دليل أبوظبي للتحويلات المرورية لعام 2014 - مناطق العمل. |
| شهادة عدم الممانعة |
وثيقة تصدرها الجهات المختصة تفيد بعدم ممانعة هذه الجهات من قيام المصرح لهم الحائزين على الشهادة بتنفيذ أية أعمال مقررة ضمن حرم الطريق. |
| موقع العمل |
الأماكن التي تباشر فيها أية أعمال من قبل المصرح لهم بموجب التصريح المروري الصادر بشأنها. |
| المصرح لهم |
الجهة أو الشركة المصرح لها العمل ضمن حرم الطريق وتشمل الجهات المختصة والمقاول والاستشاري والمطور وأية جهات أخرى. |
| الحالات الطارئة |
الأعمال الضرورية الواجب تنفيذها من المصرح لهم لاستمرارية الخدمات الواقعة ضمن حرم الطريق خلال المدة الزمنية التي تحددها الجهات المختصة، وأية أعمال أخرى يقيمها المركز على أنها حالات طارئة تطبيقاً لأحكام هذه اللائحة. |
المادة (2)
تسري أحكام هذه اللائحة على كافة الأعمال التي تنفذ ضمن حرم الطريق في الإمارة.
المادة (3)
يقوم المركز بإصدار التصاريح المرورية اللازمة لأعمال الطرق والخدمات ضمن حرم الطريق طبقا للدليل والإجراءات المتبعة والشروط والأحكام الواجب الالتزام بها والمبينة في التصريح المروري.
المادة (4)
- يحظر على أي شخص طبيعي أو اعتباري أو أي جهة القيام بأي عمل يؤثر على السلامة والحركة المرورية ضمن حرم الطريق بما فيها عمل تحويلة مرورية، دون الحصول على تصريح مروري من المركز بعد استيفاء موافقات الجهات المختصة.
- لا يجوز التنازل عن التصريح المروري أو إحالته إلى أي شخص أو جهة أخرى دون الحصول على موافقة مسبقة من المركز.
المادة (5)
تستثنى من المادة رقم (4) الحالات الطارئة والتي يجوز فيها للمصرح لهم القيام بالأعمال ضمن حرم الطريق دون الحصول على تصريح مروري شريطة الالتزام بالدليل ومتطلبات السلامة المرورية أثناء تنفيذ الأعمال وإبلاغ المركز فور المباشرة بتنفيذ هذه الأعمال وتقديم طلب للحصول على التصريح المروري خلال مدة لا تتجاوز 24 ساعة من بدء تنفيذ الأعمال.
المادة (6)
تلتزم الجهات المصرح لهم بما يلي:
- الشروط والأحكام المبينة في التصريح والنقاط الواردة في المخططات المعتمدة.
- العمل بمقتضى الأدلة المعتمدة في مناطق العمل ضمن حرم الطريق ومنها دليل التدقيق على السلامة المرورية في الإمارة ودليل تصميم جوانب الطرق أو أي أدلة أخرى ذات الصلة.
- أي اشتراطات أخرى يصدر بها قرار من المركز مستقبلاً.
المادة (7)
يقوم مفتشو المركز بالرقابة والإشراف على تطبيق هذه اللائحة، ولهم في سبيل ذلك ضبط المخالفات وتحديد المدة الزمنية المناسبة لتصويب الأوضاع في الإنذار وطلب إبراز أصل الوثائق الواجب الاحتفاظ بها في موقع العمل وفقا لأحكام هذه اللائحة، كما يجوز لهم الاستعانة بالشرطة أو أي جهة أخرى ذات الاختصاص متى تطلب الأمر ذلك.
المادة (8)
يطبق جدول المخالفات والغرامات المقررة لها المرفق بهذا القرار وكذلك إجراءات التصالح المعمول بها في المركز، وفي جميع الأحوال يلتزم المخالف بإزالة آثار المخالفة في الموعد المحدد، وفي حال عدم الالتزام يتولى المركز إزالتها على نفقة المخالف.
المادة (9)
ينشر هذا القرار في الجريدة الرسمية، ويعمل به من تاريخ نشره.

Regarding the Regulatory Bylaw for Traffic Detours in the Emirate of Abu Dhabi
Chairman of the Department of Municipalities and Transport
Having reviewed Law No. (1) of 1974 on the Reorganization of the Government Apparatus in the Emirate of Abu Dhabi and its amending laws,
And Law No. (10) of 1976 on Maintaining the Safety of Cables and Overhead Lines and its amending laws,
And Law No. (19) of 2006 on the Regulation of Taxi Transport in the Emirate of Abu Dhabi and its amending laws,
And Law No. (30) of 2019 on the Establishment of the Department of Municipalities and Transport,
And Amiri Decree No. (1) of 2019 on the Reshuffling of the Executive Council of the Emirate of Abu Dhabi,
And based on what was presented to the Executive Council, and its approval,
Has decided the following:
Article (1)
In the application of the provisions of this Decision, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:

| Competent Authorities |
All federal and local authorities and government companies concerned with issuing No-Objection Certificates (NOCs), permits, and any necessary approvals for the authorized works within the right-of-way in the Emirate. |
| The Road |
Land designated for public traffic and passage, whether paved or unpaved, including all types of roads such as main and secondary roads, maintenance and emergency roads, detours, railways, pedestrian and bicycle paths, public squares, bridges, tunnels, intersections, medians, sidewalks, pedestrian crossings, public parking, and road furniture such as traffic lights, traffic and guide signs, bus stops, various types of protective fences, animal crossings, road lighting, and all infrastructure assets located within the jurisdiction of the competent authority. |
| Right-of-Way |
The distance between the building lines according to the drawings approved by the competent authorities in the Emirate, as well as the land areas designated for the construction and expansion of roads, service lines, infrastructure, green areas, sidewalks, and parking. |
| Traffic Detours |
A temporary change in the course of traffic on the road, or the closure of a lane, shoulder, parking, or any works within the right-of-way for a temporary period. |
| Traffic Permit |
The authorization issued by the Center that allows the commencement of traffic detour works within the right-of-way. |
| Authorized Works |
Includes all traffic detour works carried out by the permittees for which the Traffic Permit is issued and which are specified in the Manual. |

Abu Dhabi Traffic Detour Manual for 2014 - Work Zones. |
| No-Objection Certificate (NOC) |
A document issued by the competent authorities stating their non-objection to the permittees holding the certificate carrying out any planned works within the right-of-way. |
| Work Site |
The locations where any works are carried out by the permittees under the issued Traffic Permit. |
| Permittees |
The entity or company authorized to work within the right-of-way, including competent authorities, contractors, consultants, developers, and any other entities. |
| Emergency Cases |
Necessary works that must be carried out by the permittees for the continuity of services located within the right-of-way during the period specified by the competent authorities, and any other works that the Center deems to be emergency cases in application of the provisions of this bylaw. |
Article (2)
The provisions of this bylaw shall apply to all works carried out within the right-of-way in the Emirate.
Article (3)
The Center shall issue the necessary traffic permits for road and service works within the right-of-way in accordance with the Manual, the followed procedures, and the terms and conditions that must be adhered to as stated in the Traffic Permit.
Article (4)
- It is prohibited for any natural or legal person or any entity to carry out any work that affects safety and traffic flow within the right-of-way, including creating a traffic detour, without obtaining a traffic permit from the Center after securing the approvals of the competent authorities.
- The Traffic Permit may not be assigned or transferred to any other person or entity without obtaining prior approval from the Center.
Article (5)
Emergency cases are exempted from Article (4), in which permittees may carry out works within the right-of-way without obtaining a traffic permit, provided they adhere to the Manual and traffic safety requirements during the execution of the works, inform the Center immediately upon commencing these works, and submit an application for a Traffic Permit within a period not exceeding 24 hours from the start of the works.
Article (6)
The permittees shall comply with the following:
- The terms and conditions stated in the permit and the points mentioned in the approved plans.
- Work in accordance with the approved manuals for work zones within the right-of-way, including the Road Safety Audit Manual for the Emirate, the Roadside Design Guide, or any other relevant manuals.
- Any other requirements for which a decision is issued by the Center in the future.
Article (7)
The Center's inspectors shall monitor and supervise the application of this bylaw. In doing so, they have the authority to record violations, specify an appropriate timeframe in the warning for rectifying the situation, and request the presentation of the original documents that must be kept at the work site in accordance with the provisions of this bylaw. They may also seek assistance from the police or any other competent authority when necessary.
Article (8)
The schedule of violations and their prescribed fines attached to this Decision shall be applied, as well as the reconciliation procedures in effect at the Center. In all cases, the violator is obligated to remove the effects of the violation by the specified deadline. In case of non-compliance, the Center will undertake the removal at the violator's expense.
Article (9)
This Decision shall be published in the Official Gazette and shall come into effect from the date of its publication.
