أمر محلي رقم (1) لسنة 1977م
في شأن المناطق الصناعية والمعارض ودور الصحافة

رئيس دائرة بلدية أبوظبي:

- بعد الاطلاع على القانون رقم (1) لسنة 1974 في شأن إعادة تنظيم الجهاز الحكومي في إمارة أبوظبي،

- وعلى قانون الأوامر المحلية رقم (8) لسنة 1969.

قرر:

مادة (1)

تخصص مناطق الأراضي الصناعية للأغراض الآتية:

1. المصانع.
2. أعمال المقاولين.
3. صيانة السيارات والورش.
4. سكن العمال.
5. المعارض.
6. دور الصحافة.

ويجوز لرئيس دائرة بلدية أبوظبي تخصيص أراض في نفس المناطق لأغراض أخرى متى رأى ذلك ضروريًا.

مادة (2)

توقع دائرة بلدية أبوظبي عقد ايجار الأرض المشار إليها في المادة السابقة، نيابة عن حكومة أبوظبي، مع المستأجر لمدة تتراوح من 10 (عشر) إلى 15 (خمس عشرة) سنة ويحصل من المستأجر مقابل الإيجار السنوي وفقا لجدول فئات الأجرة الملحق بهذا الأمر.

مادة (3)

يبين في عقد الايجار الغرض الذي استؤجرت الأرض من أجله وعلى المستأجر الحصول على ترخيص للبناء وفقا لشروط التعاقد.

مادة (4)

يقدم طلب الترخيص بالبناء من نسختين على الاستمارة المقررة لذلك، ويكون موقعا من المستأجر والمهندس الاستشاري الذي قام بالتصميم.

ويرفق بالطلب المستندات الآتية:

1. مخطط قسيمة الأرض المعتمد من تخطيط المدن بدائرة بلدية أبوظبي.
2. ثلاث نسخ من الرسومات المعمارية والإنشائية والصحية والكهربائية.

ويجب أن تكون جميع الرسومات والخرائط المقدمة بمقياس رسم 100/1 ما عدا الموقع العام الذي يجب أن يكون بمقياس رسم 200/1 ويجب ذكر اسم مستأجر القسيمة على كل مخطط من المخططات وبيان سهم الشمال.

مادة (5)

يرفق بطلب الترخيص بالإضافة إلى المستندات المشار إليها في المادة السابقة، بيان تفصيلي باستخدامات الموقع موضحا به ما يلي:

مواقع الورش - التخزين المغطى - التخزين المكشوف - المباني الإدارية - مواقف السيارات المغطاة والمكشوفة - الممرات الداخلية - غرف الحراس - دورات المياه الخاصة بالعمال والموظفين - مواقع تجميع المخلفات والقمامة - المداخل والمخارج المؤدية من وإلى القسيمة - سهم الشمال.

مادة (6)

يقدم الطلب مع المستندات المشار إليها في المادتين السابقتين إلى دائرة بلدية أبوظبي لاستيفاء اجراءات الترخيص.

مادة (7)

لا يجوز بأي حال من الأحوال:

1. دمج قسيمتين معا، وفي حالة اشتراك قسيمتين في حد بينهما يلزم أن تبعد المباني في أيهما بمقدار مترين عن الحد المشترك بينهما.
2. تجزئة القسيمة الواحدة إلى أجزاء صغيرة.
3. إنشاء مباني سكنية للموظفين والعمال في المناطق الصناعية.
4. القيام بأي عمل أو تخزين أي مواد أو إلقاء أي مخلفات أو مهملات خارج حدود القسيمة.
5. استعمال القسيمة في أي غرض آخر غير الغرض الذي استؤجرت من أجله الأرض.
6. استعمال مواقف السيارات خارج القسائم للتخزين أو وقوف الشاحنات أو إصلاح السيارات بها.

مادة (8)

لا يجوز استعمال الأراضي المخصصة لدور الصحف لغير الغرض الذي استؤجرت الأرض من أجله، وفي حالة المخالفة يفسخ عقد الايجار وتؤول ملكية المباني للحكومة ولا يصرف للمستأجر إلا قيمة المباني فقط.

مادة (9)

يشترط في إقامة المباني والمنشآت بالمنطقة الصناعية ما يأتي:

1. أن يتوفر لكل مصنع أو مستودع أو أي نوع من المباني القائمة في القسيمة الصناعية وحدات لإطفاء الحريق.
2. في حالة استعمال القسيمة الصناعية لإقامة مباني لأعمال الضخ وتخزين أدوات التشحيم والمحروقات وما شابهها يجب أن تكون مستودعات الوقود من مادة غير قابلة للاشتعال وأن تبعد البعد الكافي عن أي مكان ينتج عنه أي مواد تساعد على الاشتعال.
3. أن يتم تحديد مواقع مضخات الوقود ومعدات التشحيم حسب المتطلبات التي تشترطها سلطات الإطفاء وغيرها من جهات الاختصاص وتمنح الترخيص اللازم بشأنها.
4. يجوز إقامة غرفة مع حمام تخص الحارس على أن لا تتعدى مساحتها 20 (عشرين) مترا مربعا.
5. أن تكون بيارات التصريف وجميع الخطوط الخاصة بالمجاري ضمن حدود الأرض.
6. يجب أن يتوفر للعاملين في المصنع أو الورشة دورات مياه صحية.
7. يجب أن يرتفع منسوب أرضية مباني الورشة أو المصنع عن منسوب الطريق العام بمقدار 40 (أربعين) سنتيمترا على الأقل.
8. يجب أن يرتفع منسوب أرضية مباني الإدارة عن منسوب الطريق العام بمقدار 60 (ستين) سنتيمترا على الأقل.
9. أقصى ارتفاع يسمح به لمباني الإدارة طابقان.
10. في حالة الاتجاه إلى إنشاء مصنع ينتج عنه أي نوع من أنواع الدخان أو البخار يجب الحصول على موافقة مسبقة من الجهات المختصة ولا يسمح بذلك إلا في المواقع المناسبة طبقا لاعتبارات التخطيط والأمن الصحي وسلامة حركة الطيران.

مادة (10)

تحدد منطقة خارج المنطقة الصناعية ومجاورة لها لسكن العمال وتخصص قسيمة أو أكثر لمستأجري المنطقة الصناعية بحسب الأحوال لبناء شبرات عليها لسكن هؤلاء العمال ويجب أن يلحق بها الخدمات اللازمة وتحدد هذه القسائم بواسطة لجنة تشكل لهذا الغرض للنظر فيمن تلزمهم هذه القسائم ولا يجوز بأي حال استخدام هذه القسائم في غير إقامة شبرات لسكن العمال كإقامة بيوت أو غير ذلك.

مادة (11)

مع عدم الإخلال بالعقوبات المنصوص عليها في المادة التالية، إذا خالف المستأجر أي شرط من شروط التعاقد، تقوم دائرة أبوظبي بإنذاره لإزالة المخالفة وذلك في مدة معقولة فإذا لم يقم المستأجر بإزالة المخالفة، أو عاد إليها مرة أخرى، كان للبلدية الحق في إزالتها إداريا دون أن يخل ذلك بحقها في فسخ عقد الايجار واسترداد القسيمة.

مادة (12)

كل مخالفة لأحكام هذا الأمر أو القرارات المنفذة له يعاقب مرتكبها بغرامة لا تقل عن 1000 (ألف) درهم ولا تتجاوز 2000 (ألفي) درهم - أو بالحبس لمدة لا تزيد على 6 (ستة) أشهر.

مادة (13)

ينشر هذا الأمر في الجريدة الرسمية، ويعمل به من تاريخ نشره.

Local Order No. (1) of 1977
Concerning Industrial Areas, Exhibitions, and Press Houses

The Head of Abu Dhabi Municipality Department:

- Having reviewed Law No. (1) of 1974 concerning the reorganization of the government apparatus in the Emirate of Abu Dhabi,

- And Local Orders Law No. (8) of 1969,

Has decided:

Article (1)

Industrial land areas are designated for the following purposes:

1. Factories.
2. Contractors' works.
3. Car maintenance and workshops.
4. Labor accommodation.
5. Exhibitions.
6. Press houses.

The Head of Abu Dhabi Municipality Department may allocate lands in the same areas for other purposes when deemed necessary.

Article (2)

The Abu Dhabi Municipality Department shall sign the lease contract for the land referred to in the preceding article, on behalf of the Government of Abu Dhabi, with the tenant for a period ranging from 10 (ten) to 15 (fifteen) years. The annual rent shall be collected from the tenant in accordance with the schedule of rent categories attached to this order.

Article (3)

The lease contract shall state the purpose for which the land was leased, and the tenant must obtain a building permit in accordance with the terms of the contract.

Article (4)

The building permit application shall be submitted in duplicate on the prescribed form, signed by the tenant and the consulting engineer who carried out the design.

The following documents shall be attached to the application:

1. The land plot plan approved by the Town Planning section of the Abu Dhabi Municipality Department.
2. Three copies of the architectural, structural, sanitary, and electrical drawings.

All submitted drawings and maps must be at a scale of 1/100, except for the general site plan, which must be at a scale of 1/200. The name of the plot tenant must be mentioned on each plan, and the north arrow must be indicated.

Article (5)

In addition to the documents referred to in the preceding article, a detailed statement of the site's uses shall be attached to the permit application, clarifying the following:

Locations of workshops - covered storage - open storage - administrative buildings - covered and open car parks - internal pathways - guard rooms - toilets for workers and employees - waste and garbage collection points - entrances and exits to and from the plot - north arrow.

Article (6)

The application, along with the documents mentioned in the two preceding articles, shall be submitted to the Abu Dhabi Municipality Department to complete the licensing procedures.

Article (7)

Under no circumstances is it permissible to:

1. Merge two plots together. In the case of two plots sharing a boundary, the buildings on either plot must be set back two meters from their common boundary.
2. Subdivide a single plot into smaller parts.
3. Construct residential buildings for employees and workers in industrial areas.
4. Carry out any work, store any materials, or dump any waste or refuse outside the plot boundaries.
5. Use the plot for any purpose other than that for which the land was leased.
6. Use car parks outside the plots for storage, truck parking, or car repairs.

Article (8)

Lands allocated for press houses may not be used for any purpose other than that for which the land was leased. In case of violation, the lease contract shall be terminated, ownership of the buildings shall revert to the government, and the tenant shall only be compensated for the value of the buildings.

Article (9)

The establishment of buildings and facilities in the industrial area is subject to the following conditions:

1. Every factory, warehouse, or any type of building on the industrial plot must have fire extinguishing units.
2. If the industrial plot is used for establishing buildings for pumping operations and storing lubrication tools, fuels, and the like, the fuel depots must be made of non-flammable material and be sufficiently distant from any place that produces materials that could aid combustion.
3. The locations of fuel pumps and lubrication equipment must be determined according to the requirements stipulated by the fire authorities and other competent bodies, which shall grant the necessary license for them.
4. A room with a bathroom for the guard may be constructed, provided its area does not exceed 20 (twenty) square meters.
5. Drainage pits and all sewage lines must be within the land boundaries.
6. Sanitary toilets must be available for workers in the factory or workshop.
7. The floor level of the workshop or factory buildings must be at least 40 (forty) centimeters above the public road level.
8. The floor level of the administration buildings must be at least 60 (sixty) centimeters above the public road level.
9. The maximum permitted height for administration buildings is two stories.
10. In the case of establishing a factory that produces any type of smoke or steam, prior approval must be obtained from the competent authorities, and this will only be permitted in suitable locations according to planning considerations, health security, and aviation safety.

Article (10)

An area outside and adjacent to the industrial area shall be designated for labor accommodation. One or more plots shall be allocated to tenants of the industrial area, as the case may be, to build sheds for the accommodation of these workers. Necessary services must be attached. These plots shall be determined by a committee formed for this purpose to consider who requires them. Under no circumstances may these plots be used for purposes other than establishing sheds for labor accommodation, such as building houses or otherwise.

Article (11)

Without prejudice to the penalties stipulated in the following article, if the tenant violates any of the contract terms, the Abu Dhabi Municipality Department shall issue a warning to rectify the violation within a reasonable period. If the tenant fails to rectify the violation, or repeats it, the Municipality shall have the right to remove it administratively, without prejudice to its right to terminate the lease contract and reclaim the plot.

Article (12)

Any violation of the provisions of this order or the decisions implementing it shall be punishable by a fine of not less than 1,000 (one thousand) dirhams and not exceeding 2,000 (two thousand) dirhams, or by imprisonment for a period not exceeding 6 (six) months.

Article (13)

This order shall be published in the Official Gazette and shall come into force from the date of its publication.
