Administrative Decision No. (137) of 2018
Regarding the Regulation of Works Outside the Boundaries of Non-Residential Plots
In the Emirate of Abu Dhabi
The Chairman of the Department of Urban Planning and Municipalities:
- Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (4) of 1983 concerning the Regulation of Construction Works in the Emirate of Abu Dhabi and its Executive Regulation, and Law No. (10) of 2006 on the Establishment of the Western Region Municipality and Municipal Council and its amendments,
- And Law No. (10) of 2007 on the Establishment of the Abu Dhabi City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (11) of 2007 on the Establishment of the Al Ain City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (2) of 2012 on Maintaining Public Appearance, Health, and Public Tranquility and its Executive Regulations,
- And Law No. (5) of 2018 on the Establishment of the Department of Urban Planning and Municipalities,
- And the Resolution of the Chairman of the Executive Council No. (4) of 2011 on the Rules and Procedures for Registering Lease Contracts in the Emirate of Abu Dhabi,
- And based on the requirements of the public interest,
Has decided as follows:
Article (1)
In the application of this Decision, the following words and phrases shall have the meanings assigned to them below, unless the context otherwise requires:

External Works: Works in the external areas located between the plot boundaries and the infrastructure project boundaries, which may include, but are not limited to, paving, car parking, landscaping and horticulture works, installation of shades, and others. |
| Non-residential Plots |
: |
Commercial, investment, industrial, recreational lands, public buildings, public areas, and public facilities. |
| Setback Distance between Buildings |
: |
The distance between the building line of one building and the building line of the adjacent building. |
Article (2)
This Decision aims to regulate the external areas surrounding non-residential plots in the Emirate of Abu Dhabi to contribute to providing a suitable environment for the public and improving the city's appearance.
Article (3)
The Department, in coordination with the Municipalities, shall determine the targeted basins and areas according to the approved implementation phases.
Article (4)
Plot owners shall commit to executing the external works through a design consultant or contractor and to implementing these works in accordance with the requirements attached to this Decision.
Article (5)
The Municipality shall review and license the external works during the architectural review stage of the building permitting process.
Article (6)
The Municipality shall notify plot owners of its requirements in the specified areas and basins, and grant a period of one month from the date of notification to approach the concerned Municipality and submit a permit application.
Article (7)
Renewal of the property attestation contract (Tawtheeq) for a building on plots located within the specified areas shall not be permitted unless there is compliance with the implementation of the external works according to the timeline approved between the Municipality and the property owner.
Article (8)
This Decision shall be implemented and effective from the date of its issuance and shall be published in the Official Gazette.

Special Requirements for Organizing Works
Outside the Boundaries of Non-Residential Plots
1. Planning Requirements:
1.1 The external works area shall be defined to include the space located between the plot boundaries and the boundaries below:
- Boundaries of the sidewalks surrounding the plot.
- 50% of the setback distance between adjacent plots.
- Boundaries of the road right-of-way plan for infrastructure and beautification projects.
- Plots overlooking open squares or wide sidewalks.
1.2 No-Objection Certificates (NOCs) must be obtained from service providers and asset-owning entities within the external works area if the specified area for these works is to be increased.
2. Design Requirements:
2.1 The contractor or consultant appointed by the owner shall prepare a design plan for the external works, taking into account the standards and requirements contained in the following manuals and any manuals that may be issued in the future:
- Abu Dhabi Emirate Paving Strategy.
- Abu Dhabi Paving Manual.
- Abu Dhabi Building Code.
- Public Realm Design Manual.
- Abu Dhabi Urban Street Design Manual.
2.2 The elements shown in the table below must be considered in the design process to be consistent and integrated with public spaces and surrounding service elements or structures, in compliance with the followed standards and specifications.

2.3 The owner must undertake to restore the site to its original condition after the completion of the works.
