قرار إداري رقم (5) لسنة 2006
بشأن ترخيص مظلات سيارات مؤقتة خارج حدود القسائم السكنية
رئيس دائرة البلديات والزراعة:
- بعد الاطلاع على القانون رقم (1) لسنة 1974م بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.
- وعلى القانون رقم (5) لسنة 1998 بشأن تنظيم إصدار التراخيص في إمارة أبوظبي.
- وعلى قرار المجلس التنفيذي رقم (67) جـ 1 / 2004 بشأن رسوم الخدمات.
قرر:
مادة (1)
يرخص بإنشاء مظلة أو أكثر في المساحات الخالية خارج حدود القسائم وفق الشروط التالية:
- يقدم الطلب مرفق به المخططات والمواصفات إلى إدارة تراخيص البناء.
- أن لا تشكل عائقًا لحركة السيارات والمشاة.
- تكون المواد المستخدمة والتصاميم من شركات متخصصة تعكس الوجه الحضاري للمدينة.
- يقوم صاحب الترخيص بتنظيف وصيانة المظلات.
- تكون التغطية من مادة تيفلون أو يو بي في سي (Teflon Or UPVC) والهيكل معدني مطلي باللون الأبيض ومحمي من الصدأ.
- أن يكون العدد المصرح به لا يشكل حرمانًا للآخرين وحسب ما تراه الدائرة مناسبًا.
- عدم تأجير المظلات لطرف ثالث.
- أن يقتصر الاستخدام كموقف للسيارات.
- مراجعة الجهات المعنية بالخدمات لاستيفاء متطلباتها.
مادة (2)
يتم تحصيل رسوم قدرها (2000) درهم ألفان درهم عند إصدار الترخيص لكل مظلة لا تتجاوز أبعادها (3 م × 6 م).
مادة (3)
يتم تجديد الترخيص سنويًا برسوم قدرها (500) درهم.
مادة (4)
يتم إزالة المظلة أو المظلات فورًا من طرف المرخص له في حال طلبت الدائرة ذلك أو عند تعارضها مع خطوط الخدمات المستقبلية.
يعمل بهذا القرار اعتبارًا من تاريخه ويعمم على كافة الجهات المعنية وذلك للعمل به كلا فيما يخصه.

Administrative Decision No. (5) of 2006
Regarding the Licensing of Temporary Car Canopies Outside Residential Plot Boundaries
The Chairman of the Department of Municipalities and Agriculture:
- Having reviewed Law No. (1) of 1974 regarding the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amendments.
- And Law No. (5) of 1998 regarding the regulation of issuing licenses in the Emirate of Abu Dhabi.
- And Executive Council Resolution No. (67) Part 1 / 2004 regarding service fees.
Has decided:
Article (1)
The construction of one or more canopies in the vacant areas outside the plot boundaries is licensed according to the following conditions:
- The application, along with the plans and specifications, shall be submitted to the Building Permits Department.
- It shall not obstruct the movement of vehicles and pedestrians.
- The materials used and the designs shall be from specialized companies that reflect the civilized image of the city.
- The license holder shall clean and maintain the canopies.
- The covering shall be made of Teflon or UPVC material, and the structure shall be metal, painted white, and protected from rust.
- The permitted number shall not deprive others and shall be as deemed appropriate by the Department.
- The canopies shall not be leased to a third party.
- The use shall be limited to car parking.
- The relevant service authorities must be consulted to meet their requirements.
Article (2)
A fee of (2000) AED (Two Thousand Dirhams) shall be collected upon issuing the license for each canopy whose dimensions do not exceed (3 m x 6 m).
Article (3)
The license shall be renewed annually for a fee of (500) AED.
Article (4)
The canopy or canopies shall be immediately removed by the licensee if requested by the Department or if they conflict with future service lines.
This decision shall be effective from its date and shall be circulated to all concerned authorities to act upon, each within its jurisdiction.
