بشأن وقف الخدمات والمعاملات للأشخاص الذين تترتب عليهم التزامات للدائرة والجهات التابعة لها

بعد الاطلاع على القانون رقم (1) لسنة 1974 بشأن إعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،

وعلى القانون رقم (10) لسنة 2006 بشأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي وتعديلاته،

وعلى القانون رقم (10) لسنة 2007 بشأن بلدية ومجلس بلدي مدينة أبوظبي بإمارة أبوظبي وتعديلاته،

وعلى القانون رقم (11) لسنة 2007 بشأن بلدية ومجلس بلدي مدينة العين بإمارة أبوظبي وتعديلاته،

وعلى القانون رقم (3) لسنة 2015 بشأن تنظيم القطاع العقاري في إمارة أبوظبي،

وعلى القانون رقم (1) لسنة 2017 بشأن النظام المالي لحكومة أبوظبي،

وعلى القانون رقم (17) لسنة 2017 بشأن التعرفة المرورية في إمارة أبوظبي،

وعلى القانون رقم (18) لسنة 2009 بشأن تنظيم مواقف المركبات في إمارة أبوظبي وتعديلاته،

وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،

وعلى المرسوم الأميري رقم (11) لسنة 2023 بشأن إعادة تشكيل المجلس التنفيذي لإمارة أبوظبي،

وعلى القانون رقم (16) لسنة 2022 بشأن ترخيص السائقين والمركبات،

وعلى قرار رئيس المجلس التنفيذي رقم (21) لسنة 2018 بشأن اختصاصات إضافية لدائرة النقل،

وعلى القرار الإداري رقم (26) لسنة 2021 بشأن وقف الخدمات والمعاملات للأشخاص الذين تترتب عليهم التزامات للدائرة والجهات التابعة لها وتعديلاته،

وبناء على ما تقتضيه مصلحة العمل،

تقرر ما يلي:

المادة (1)

وقف الخدمات والمعاملات

1. يتم وقف تقديم الخدمات والمعاملات والطلبات لدى دائرة البلديات والنقل والجهات التابعة لها لأي شخص طبيعي أو اعتباري في حال وجود أي التزام مترتب عليه أو مستحق الوفاء لصالح الدائرة أو أي من الجهات التابعة لها.

2. يشمل الوقف كافة الشركات والمؤسسات والأفراد، وعلى سبيل المثال لا الحصر: مزاولي المهن العقارية، والمهندسين، ومكاتب الاستشارات الهندسية، والمقاولين، والمساحين، والمقيمين العقاريين.

3. يتم إعادة تقديم الخدمات والمعاملات والطلبات الموقوفة بعد تنفيذ الالتزامات والوفاء بها.

المادة (2)

وضع القيد في الأنظمة الإلكترونية

يتم وضع القيد في الأنظمة الإلكترونية المعتمدة، وفقاً لما هو موضح في الجدول الآتي:

المادة (3)

الاستثناءات

يستثنى من أحكام المادة (1) من هذا القرار الخدمات والمعاملات والطلبات المشار إليها في الجدول الملحق بهذا القرار، وذلك وفقا للضوابط المحددة إزاء كل منها.

المادة (4)

التخويل

يُخول مدير عام شؤون العمليات في الدائرة بالصلاحيات التالية:

1. التحديث على الجدول المشار إليه في المادة (3) وفقا لمقتضيات المصلحة العامة.

2. رفع القيد بصورة مؤقتة.

3. تفويض أيا من موظفي الدائرة أو الجهات التابعة بصلاحية رفع القيد بصورة مؤقتة.

المادة (5)

الإلغاءات

يلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القرار.

المادة (6)

النشر

يُنشر هذا القرار في الجريدة الرسمية، ويعمل به من تاريخ نشره.

Regarding the Suspension of Services and Transactions for Persons with Obligations to the Department and its Affiliated Entities

Chairman of the Department of Municipalities and Transport

Having reviewed Law No. (1) of 1974 regarding the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amendments,

And Law No. (10) of 2006 regarding the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi and its amendments,

And Law No. (10) of 2007 regarding the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi and its amendments,

And Law No. (11) of 2007 regarding the Municipality and Municipal Council of Al Ain City in the Emirate of Abu Dhabi and its amendments,

And Law No. (3) of 2015 regarding the regulation of the real estate sector in the Emirate of Abu Dhabi,

And Law No. (1) of 2017 regarding the financial system of the Government of Abu Dhabi,

And Law No. (17) of 2017 regarding the traffic tariff in the Emirate of Abu Dhabi,

And Law No. (18) of 2009 regarding the regulation of vehicle parking in the Emirate of Abu Dhabi and its amendments,

And Law No. (30) of 2019 regarding the establishment of the Department of Municipalities and Transport,

And Emiri Decree No. (11) of 2023 regarding the restructuring of the Executive Council of the Emirate of Abu Dhabi,

And Law No. (16) of 2022 regarding the licensing of drivers and vehicles,

And the decision of the Chairman of the Executive Council No. (21) of 2018 regarding additional competencies for the Department of Transport,

And Administrative Decision No. (26) of 2021 regarding the suspension of services and transactions for persons with obligations to the Department and its affiliated entities and its amendments,

And based on the requirements of work interest,

The following has been decided:

Article (1)

Suspension of Services and Transactions

1. The provision of services, transactions, and requests at the Department of Municipalities and Transport and its affiliated entities shall be suspended for any natural or legal person in the event of any outstanding or due obligation owed to the Department or any of its affiliated entities.

2. The suspension includes all companies, institutions, and individuals, including but not limited to: real estate professionals, engineers, engineering consulting offices, contractors, surveyors, and real estate appraisers.

3. The suspended services, transactions, and requests will be reinstated after the obligations are fulfilled and met.

Article (2)

Placing a Restriction in Electronic Systems

A restriction shall be placed in the approved electronic systems, as detailed in the following table:

Article (3)

Exemptions

The services, transactions, and requests mentioned in the schedule attached to this decision are exempted from the provisions of Article (1) of this decision, in accordance with the specific controls set for each.

Article (4)

Authorization

The Director-General of Operations Affairs in the Department is authorized with the following powers:

1. To update the schedule referred to in Article (3) according to the requirements of the public interest.

2. To temporarily lift the restriction.

3. To delegate the authority to temporarily lift the restriction to any of the employees of the Department or its affiliated entities.

Article (5)

Repeals

Any text or provision that contradicts or conflicts with the provisions of this decision is hereby repealed.

Article (6)

Publication

This decision shall be published in the Official Gazette and shall come into effect from the date of its publication.
