قانون رقم (10) لسنة 2016
بتعديل بعض أحكام القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي
نحن خليفة بن زايد آل نهيان، حاكم أبو ظبي.
- بعد الاطلاع على القانون رقم (1) لسنة 1974 في شأن إعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي والقوانين المعدلة له.
- وعلى القانون رقم (2) لسنة 1971 في شأن المجلس الاستشاري الوطني والقوانين المعدلة له.
- وعلى القانون رقم (10) لسنة 2006 في شأن بلدية ومجلس بلدي المنطقة الغربية بإمارة أبو ظبي.
- وعلى القانون رقم (23) لسنة 2007 بإنشاء مجلس أبوظبي للتخطيط العمراني.
- وبناء على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه.
أصدرنا القانون الآتي:
المادة الأولى
يضاف إلى المادة رقم (1) من القانون رقم (10) لسنة 2006 المشار إليه، التعريفان التاليان:
| المخطط العام |
: المستندات والخرائط لمواقع الأراضي بجميع استخداماتها ومعاييرها التطويرية وحرم الطريق مستندة على الأدلة والمعايير التخطيطية المعتمدة ويحتوي على جميع مستويات التخطيط التفصيلي. |
| التصميم التنفيذي |
: المستندات والخرائط التي تحدد الأعمال الهندسية التي من خلالها يتم تنفيذ المخطط العام المعتمد من مجلس أبوظبي للتخطيط العمراني. |
المادة الثانية
تضاف إلى القانون رقم (10) لسنة 2006 المشار إليه، مادة جديدة برقم (4 مكرراً) نصها الآتي: تهدف البلدية إلى تحقيق أهداف السياسة العامة لحكومة أبوظبي في تقديم المستوى اللائق من الخدمات وتهيئة الظروف المعيشية الكريمة لسكان المنطقة في إمارة أبو ظبي وتعنى بالقيام بالمهام الآتية:
- التنسيق مع الجهات ذات العلاقة فيما يتعلق بمخططات التطوير العمراني في المنطقة.
- تطبيق قوانين ونظم ولوائح مواصفات البناء الصادرة عن الجهات المختصة والمطبقة في الإمارة على جميع المشاريع المنفذة في المنطقة وإصدار تراخيص البناء ومراقبة تنفيذ المشاريع وفقا لتلك القوانين واللوائح.
- وضع اللوائح والتنظيمات المتعلقة بمظهر المنطقة والحفاظ على نظافتها وجمالها.
- تصميم وبناء وصيانة وتشغيل البنية التحتية من طرق وحدائق ومساحات خضراء ضمن صلاحيات البلدية والتنسيق مع الجهات المختصة في هذا الشأن.
- الحفاظ على النظافة العامة في المنطقة.
- تقديم خدمات التسجيل العقاري وفقا لمتطلبات دائرة الشؤون البلدية والنقل بالتنسيق مع الجهات المختصة.
- تصميم وبناء وصيانة وتشغيل المرافق العامة الخدمية في المنطقة.
- إعداد التصميم التنفيذي وفقاً للمخطط العام المعتمد من مجلس أبو ظبي للتخطيط العمراني.
المادة الثالثة
يُلغى كل نص أو حكم يُخالف أو يتعارض مع أحكام هذا القانون.
المادة الرابعة
يُنفذ هذا القانون من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

Law No. (10) of 2016
Amending Certain Provisions of Law No. (10) of 2006 concerning the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi
We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi.
- Having reviewed Law No. (1) of 1974 regarding the Reorganization of the Governmental Apparatus in the Emirate of Abu Dhabi and its amending laws.
- And Law No. (2) of 1971 concerning the National Consultative Council and its amending laws.
- And Law No. (10) of 2006 concerning the Municipality and Municipal Council of the Western Region in the Emirate of Abu Dhabi.
- And Law No. (23) of 2007 establishing the Abu Dhabi Urban Planning Council.
- And based on what was presented to the Executive Council and its approval thereof.
We have issued the following Law:
Article One
The following two definitions shall be added to Article (1) of the aforementioned Law No. (10) of 2006:
| The Master Plan |
: The documents and maps of land sites with all their uses, development standards, and road right-of-way, based on approved planning guides and standards, and containing all levels of detailed planning. |
| The Executive Design |
: The documents and maps that specify the engineering works through which the Master Plan approved by the Abu Dhabi Urban Planning Council is implemented. |
Article Two
A new article, numbered (4 bis), shall be added to the aforementioned Law No. (10) of 2006, with the following text: The Municipality aims to achieve the objectives of the Abu Dhabi Government's general policy in providing a decent level of services and creating dignified living conditions for the residents of the region in the Emirate of Abu Dhabi, and is concerned with undertaking the following tasks:
- Coordinating with the relevant authorities regarding urban development plans in the region.
- Applying building laws, regulations, and specifications issued by the competent authorities and applicable in the Emirate to all projects implemented in the region, issuing building permits, and monitoring the implementation of projects in accordance with those laws and regulations.
- Establishing regulations and rules related to the appearance of the region and maintaining its cleanliness and beauty.
- Designing, constructing, maintaining, and operating infrastructure such as roads, parks, and green spaces within the municipality's jurisdiction and coordinating with the competent authorities in this regard.
- Maintaining public hygiene in the region.
- Providing real estate registration services in accordance with the requirements of the Department of Municipal Affairs and Transport, in coordination with the competent authorities.
- Designing, constructing, maintaining, and operating public service facilities in the region.
- Preparing the Executive Design in accordance with the Master Plan approved by the Abu Dhabi Urban Planning Council.
Article Three
Any text or provision that contradicts or conflicts with the provisions of this Law is hereby repealed.
Article Four
This Law shall come into force from the date of its issuance and shall be published in the Official Gazette.
