قرار رئيس المجلس التنفيذي رقم (20) لسنة 2018
بشأن اختصاصات إضافية لدائرة التخطيط العمراني والبلديات
نحن محمد بن زايد آل نهيان، ولي العهد رئيس المجلس التنفيذي.
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.
- وعلى القانون رقم (5) لسنة 2018 بشأن إنشاء دائرة التخطيط العمراني والبلديات.
- وبناء على ما عُرض على المجلس التنفيذي، وموافقة المجلس عليه.
أصدرنا القرار الآتي:
المادة الأولى
في تطبيق أحكام هذا القرار، يكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها، ما لم يدل سياق النص على خلاف ذلك:
| المخطط العمراني الاستراتيجي |
: المستندات والخرائط التي تحدد الاستخدامات العامة للأراضي، والكثافات والارتفاعات، والطرق الرئيسية ومسارات خطوط البنية التحتية الرئيسية. |
| المخطط العام |
: المستندات والخرائط لمواقع وأبعاد الأراضي بجميع استخداماتها ومعاييرها التطويرية وأبعاد المسارات المخصصة لشبكات النقل والبنية التحتية والمساحات العامة، ويشمل جميع مستويات التخطيط التفصيلي. |
| الطرق |
: أراض مخصصة للمرور والسير سواء كانت معبدة أو غير معبدة، وتشمل جميع أنواع الطرق بما في ذلك طرق الصيانة والطوارئ والتحويلات والجسور والشوارع والأنفاق والممرات.
وما يرتبط بها من أكتاف وخنادق ومجار وأرصفة وجزر سلامة ودوارات وميادين وساحات ولوحات إرشادية وأجهزة إنارة، وإشارات ضوئية وأجهزة تحكم ومعدات ملحقة بها، بالإضافة إلى الجدران الاستنادية والحواجز المثبتة لها. |
| حرم الطريق |
: المسافة بين خطي البناء طبقاً للرسومات المعتمدة من الجهات المعنية في الإمارة، وكذلك المساحات الأرضية المخصصة لإنشاء الطرق وتوسعتها وخطوط الخدمات والبنية التحتية ومناطق المسطحات الخضراء وأرصفة الطرق والمواقف. |
المادة الثانية
تباشر الدائرة في سبيل تحقيق أهدافها الاختصاصات الإضافية الآتية:
- إعداد المخطط العمراني الاستراتيجي ورفعه للمجلس التنفيذي للاعتماد.
- اعتماد مخططات الطرق وحرم الطريق في الإمارة.
- إقرار المخطط العام وسياسات ونظم التطوير العمراني في الإمارة المتعلقة به، ويشمل ذلك المدن والأحياء والأراضي بجميع أنواعها والمرافق الخدمية، والبنية التحتية وأعمال الردم والاستصلاح.
- العمل على تسهيل إجراءات تنفيذ مخططات وسياسات التطوير العمراني، ومراقبة تنفيذها والالتزام ببنودها.
- إعداد الضوابط والتوجيهات العامة المنظمة لاستخدامات الأراضي المختلفة في الإمارة.
- إعداد وتطبيق وتعديل إجراءات تقديم الطلبات المتعلقة بكافة مشاريع التطوير العمراني في الإمارة وفقاً للمخطط العام، والسياسات واللوائح والأنظمة الموضوعة في هذا الشأن، ومراقبة تنفيذ تلك الإجراءات.
- إعداد اللوائح المتعلقة باشتراطات ومواصفات البناء في الإمارة ووضع الأنظمة والإجراءات المتعلقة بها بالتنسيق مع الجهات ذات الصلة.
- إعداد اللوائح المتعلقة بالقطاع العقاري ووضع الأنظمة والإجراءات المتعلقة بها.
- التحقق من توافق السياسات المتبعة في البلديات والمجالس البلدية مع السياسة العامة لحكومة أبو ظبي.
- تلقي التقارير السنوية عن إنجازات البلديات وأعمال المجالس البلدية ورفعها إلى مكتب أبو ظبي التنفيذي مشفوعة بتقييم من رئيس وأعضاء المجلس البلدي حول هذه الإنجازات.
- وضع إطار عام للتفاعل بين البلديات والمجالس البلدية والجهات الحكومية الأخرى في الإمارة.
- التنسيق مع الجهات الحكومية الأخرى على المستوى المحلي والاتحادي فيما يتعلق بالعمل البلدي.
- التنسيق بين بلديات الإمارة فيما يتعلق بالمشروعات التي تدخل في اختصاص بعض أو جميع هذه البلديات لأغراض تحديد الأسلوب الأمثل للإشراف على هذه المشروعات.
- إقرار مقترحات الخطط الاستراتيجية ومقترحات الموازنات المقدمة من قبل البلديات والمجالس البلدية في الإمارة ورفعها إلى المجلس التنفيذي لاعتمادها.
- اقتراح الإطار التشغيلي لتعريف الأدوار والمسؤوليات المنوطة بالجهات الحكومية المشاركة في وضع نظام العنونة والأسماء الجغرافية وأسماء الشوارع والبيانات المكانية والأعمال المساحية في الإمارة ورفعها إلى المجلس التنفيذي للاعتماد.
- وضع المواصفات والآليات المتعلقة بنظام العنونة.
- إعداد وإدارة نظم تصنيف المقاولين وتصنيف المكاتب الاستشارية الهندسية وقيد المهندسين.
- أي اختصاصات أو مهام أخرى تكلف بها الدائرة من المجلس التنفيذي.
المادة الثالثة
يُلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القرار.
المادة الرابعة
يُنفذ هذا القرار من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

Concerning Additional Competencies for the Department of Urban Planning and Municipalities
We, Mohamed bin Zayed Al Nahyan, Crown Prince, Chairman of the Executive Council.
- Having reviewed Law No. (1) of 1974 regarding the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amendments.
- And Law No. (5) of 2018 concerning the establishment of the Department of Urban Planning and Municipalities.
- And based on what was presented to the Executive Council, and the Council's approval thereof.
We have issued the following resolution:
Article One
For the purposes of implementing the provisions of this resolution, the following words and phrases shall have the meanings assigned to each of them, unless the context indicates otherwise:
| Strategic Urban Plan |
: The documents and maps that define the general land uses, densities, heights, main roads, and routes of major infrastructure lines. |
| Master Plan |
: The documents and maps of the locations and dimensions of lands with all their uses and development standards, and the dimensions of the routes designated for transport networks, infrastructure, and public spaces, and it includes all levels of detailed planning. |
| Roads |
: Lands designated for traffic and passage, whether paved or unpaved, and include all types of roads, including maintenance and emergency roads, diversions, bridges, streets, tunnels, and passageways.
And what is associated with them such as shoulders, ditches, drains, sidewalks, safety islands, roundabouts, squares, plazas, signs, lighting devices, traffic signals, control devices, and their attached equipment, in addition to retaining walls and their fixed barriers. |
| Road Right-of-Way |
: The distance between the two building lines according to the drawings approved by the concerned authorities in the Emirate, as well as the land areas designated for the construction and expansion of roads, service lines, infrastructure, green areas, sidewalks, and parking. |
Article Two
To achieve its objectives, the Department shall undertake the following additional competencies:
- Preparing the Strategic Urban Plan and submitting it to the Executive Council for approval.
- Approving road plans and road right-of-way in the Emirate.
- Adopting the Master Plan and related urban development policies and systems in the Emirate, including cities, neighborhoods, lands of all types, service facilities, infrastructure, and reclamation and landfill works.
- Working to facilitate the procedures for implementing urban development plans and policies, and monitoring their implementation and adherence to their provisions.
- Preparing general regulations and directives governing various land uses in the Emirate.
- Preparing, applying, and amending the procedures for submitting applications related to all urban development projects in the Emirate in accordance with the Master Plan, and the policies, regulations, and systems established in this regard, and monitoring the implementation of these procedures.
- Preparing regulations related to building requirements and specifications in the Emirate and establishing related systems and procedures in coordination with the relevant authorities.
- Preparing regulations related to the real estate sector and establishing related systems and procedures.
- Verifying the compatibility of policies followed in the municipalities and municipal councils with the general policy of the Abu Dhabi Government.
- Receiving annual reports on the achievements of municipalities and the work of municipal councils and submitting them to the Abu Dhabi Executive Office, accompanied by an evaluation from the chairman and members of the municipal council regarding these achievements.
- Establishing a general framework for interaction between municipalities, municipal councils, and other government entities in the Emirate.
- Coordinating with other government entities at the local and federal levels regarding municipal work.
- Coordinating among the Emirate's municipalities regarding projects that fall within the jurisdiction of some or all of these municipalities for the purpose of determining the optimal method of supervising these projects.
- Approving the proposed strategic plans and budget proposals submitted by the municipalities and municipal councils in the Emirate and submitting them to the Executive Council for approval.
- Proposing the operational framework to define the roles and responsibilities assigned to the government entities participating in establishing the addressing system, geographical names, street names, spatial data, and surveying works in the Emirate, and submitting it to the Executive Council for approval.
- Establishing the specifications and mechanisms related to the addressing system.
- Preparing and managing systems for the classification of contractors, classification of engineering consulting offices, and registration of engineers.
- Any other competencies or tasks assigned to the Department by the Executive Council.
Article Three
Any text or provision that violates or contradicts the provisions of this resolution shall be repealed.
Article Four
This resolution shall be implemented from the date of its issuance and shall be published in the Official Gazette.
