قانون رقم (11) لسنة 2016
بتعديل بعض أحكام القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي
مدينة أبوظبي بإمارة أبوظبي
نحن خليفة بن زايد آل نهيان، حاكم أبوظبي
- بعد الاطلاع على القانون رقم (1) لسنة 1974 في شأن إعادة تنظيم الجهاز الحكومي في إمارة أبوظبي والقوانين المعدلة له.
- وعلى القانون رقم (3) لسنة 1971 في شأن المجلس الاستشاري الوطني والقوانين المعدلة له.
- وعلى القانون رقم (10) لسنة 2007 في شأن بلدية ومجلس بلدي مدينة أبو ظبي بإمارة أبوظبي.
- وعلى القانون رقم (23) لسنة 2007 بإنشاء مجلس أبوظبي للتخطيط العمراني.
- وبناء على ما عرض على المجلس التنفيذي، وموافقة المجلس عليه.
أصدرنا القانون الآتي:
المادة الأولى
يضاف إلى المادة رقم (1) من القانون رقم (10) لسنة 2007 المشار إليه، التعريفان التاليان.
| المخطط العام |
: المستندات والخرائط لمواقع الأراضي بجميع استخداماتها ومعاييرها التطويرية وحرم الطريق مستندة على الأدلة والمعايير التخطيطية المعتمدة ويحتوي على جميع مستويات التخطيط التفصيلي. |
| التصميم التنفيذي |
: المستندات والخرائط التي تحدد الأعمال الهندسية التي من خلالها يتم تنفيذ المخطط العام المعتمد من مجلس أبوظبي للتخطيط العمراني. |
المادة الثانية
- يعدل البندان رقما (4) و(7) من المادة رقم (5) من القانون رقم (10) لسنة 2007 المشار إليه، وذلك على النحو الآتي:
«4. تصميم وبناء وصيانة وتشغيل البنية التحتية من طرق وحدائق ومساحات خضراء ضمن صلاحيات البلدية والتنسيق مع الجهات المختصة في هذا الشأن».
«7. تصميم وبناء وصيانة وتشغيل المرافق العامة الخدمية بالمنطقة».
يضاف إلى المادة رقم (5) من القانون رقم (10) لسنة 2007 المشار إليه، بند جديد برقم (8) يكون نصه الآتي:
«إعداد التصميم التنفيذي وفقاً للمخطط العام المعتمد من مجلس أبو ظبي للتخطيط العمراني».
المادة الثالثة
يُلغى كل نص أو حكم يخالف أو يتعارض مع أحكام هذا القانون.
المادة الرابعة
يُنفذ هذا القانون من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

Amending Some Provisions of Law No. (10) of 2007 Concerning the Municipality and Municipal Council of
Abu Dhabi City in the Emirate of Abu Dhabi
We, Khalifa bin Zayed Al Nahyan, Ruler of Abu Dhabi,
- Having reviewed Law No. (1) of 1974 regarding the reorganization of the governmental apparatus in the Emirate of Abu Dhabi and its amending laws.
- And Law No. (3) of 1971 concerning the National Consultative Council and its amending laws.
- And Law No. (10) of 2007 concerning the Municipality and Municipal Council of Abu Dhabi City in the Emirate of Abu Dhabi.
- And Law No. (23) of 2007 establishing the Abu Dhabi Urban Planning Council.
- And based on what was presented to the Executive Council, and its approval.
We have issued the following law:
Article One
The following two definitions shall be added to Article No. (1) of the aforementioned Law No. (10) of 2007.
| The Master Plan |
: The documents and maps of land sites with all their uses, development standards, and road right-of-way, based on approved planning guides and standards, and containing all levels of detailed planning. |
| The Executive Design |
: The documents and maps that define the engineering works through which the master plan approved by the Abu Dhabi Urban Planning Council is implemented. |
Article Two
- Clauses (4) and (7) of Article No. (5) of the aforementioned Law No. (10) of 2007 shall be amended as follows:
"4. Designing, constructing, maintaining, and operating infrastructure, including roads, parks, and green spaces, within the municipality's powers and in coordination with the relevant authorities in this regard."
"7. Designing, constructing, maintaining, and operating public service facilities in the area."
A new clause numbered (8) shall be added to Article No. (5) of the aforementioned Law No. (10) of 2007, with the following text:
"Preparing the executive design in accordance with the master plan approved by the Abu Dhabi Urban Planning Council."
Article Three
Any text or provision that contravenes or conflicts with the provisions of this law shall be repealed.
Article Four
This law shall be effective from the date of its issuance and shall be published in the Official Gazette.
