بشأن تعديل دليل الشروط الخاصة لتنظيم أعمال
البناء الصادر بموجب القرار الإداري رقم (182) لسنة 2017

بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته،
- وعلى القانون رقم (4) لسنة 1983 بشأن تنظيم أعمال البناء والقوانين المعدلة له،
- وعلى القانون رقم (10) لسنة 2006 في شأن إنشاء بلدية ومجلس بلدي المنطقة الغربية بإمارة أبوظبي وتعديلاته،
- وعلى القانون رقم (10) لسنة 2007 في شأن إنشاء بلدية ومجلس بلدي مدينة أبو ظبي بإمارة أبو ظبي وتعديلاته،
- وعلى القانون رقم (11) لسنة 2007 في شأن إنشاء بلدية ومجلس بلدي مدينة العين بإمارة أبو ظبي وتعديلاته،
- وعلى القانون رقم (5) لسنة 2018 بشأن إنشاء دائرة التخطيط العمراني والبلديات،
- وعلى المرسوم الأميري رقم (13) لسنة 2017 في شأن إعادة تشكيل المجلس التنفيذي لإمارة أبو ظبي،
- وعلى القرار الإداري رقم (182) لسنة 2017 بشأن اللائحة التنفيذية للقانون رقم (4) لسنة 1983 في شأن تنظيم أعمال البناء في إمارة أبوظبي،
- وبناءً على ما تقتضيه مصلحة العمل،
تقرر ما يلي:
مادة (1)
تُلغى المادتان (5) و(6) من دليل الشروط الخاصة لتنظيم أعمال البناء الصادرة بموجب القرار الإداري رقم (182) لسنة 2017 بشأن اللائحة التنفيذية للقانون رقم (4) لسنة 1983 في شأن تنظيم أعمال البناء في إمارة أبوظبي.
مادة (2)
لا يُسمح بتقسيم الأراضي المعتمدة بمخططات الأساس، وللجهة الإدارية المعنية بالتخطيط العمراني إعادة تخطيط الأراضي بالتقسيم أو الدمج وفق الأنظمة والمعايير التخطيطية المعمول بها.
مادة (3)
يُنفذ هذا القرار اعتبارًا من تاريخ صدوره، ويُنشر في الجريدة الرسمية.

Regarding the amendment of the guide of special conditions for organizing construction works
issued under Administrative Decision No. (182) of 2017

Having reviewed Law No. (1) of 1974 regarding the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (4) of 1983 concerning the regulation of construction works and its amending laws,
- And Law No. (10) of 2006 regarding the establishment of the Western Region Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (10) of 2007 regarding the establishment of the Abu Dhabi City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (11) of 2007 regarding the establishment of the Al Ain City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (5) of 2018 regarding the establishment of the Department of Urban Planning and Municipalities,
- And Emiri Decree No. (13) of 2017 regarding the reconstitution of the Executive Council of the Emirate of Abu Dhabi,
- And Administrative Decision No. (182) of 2017 regarding the Executive Regulations of Law No. (4) of 1983 concerning the regulation of construction works in the Emirate of Abu Dhabi,
- And based on the requirements of the public interest,
The following has been decided:
Article (1)
Articles (5) and (6) of the guide of special conditions for organizing construction works issued under Administrative Decision No. (182) of 2017 regarding the Executive Regulations of Law No. (4) of 1983 concerning the regulation of construction works in the Emirate of Abu Dhabi shall be repealed.
Article (2)
The division of lands approved in the base plans is not permitted, and the administrative authority concerned with urban planning may re-plan lands by division or merger in accordance with the applicable planning regulations and standards.
Article (3)
This decision shall be implemented from the date of its issuance and shall be published in the Official Gazette.
