Administrative Decision No. (138) of 2018
Regarding the Regulation of Works Outside the Boundaries of Residential Plots in the Emirate of Abu Dhabi
The Chairman of the Department of Urban Planning and Municipalities:
- Having reviewed Law No. (1) of 1974 on the reorganization of the government apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (4) of 1983 regarding the regulation of construction works in the Emirate of Abu Dhabi and its executive regulations,
- And Law No. (10) of 2006 regarding the establishment of the Western Region Municipality and Municipal Council and its amendments,
- And Law No. (10) of 2007 regarding the establishment of the Abu Dhabi City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (11) of 2007 regarding the establishment of the Al Ain City Municipality and Municipal Council in the Emirate of Abu Dhabi and its amendments,
- And Law No. (2) of 2012 concerning the preservation of public appearance, health, and public tranquility and its executive regulations,
- And Law No. (5) of 2018 concerning the establishment of the Department of Urban Planning and Municipalities, and based on the public interest,
The following has been decided:
Article (1)
In the application of this decision, the following words and phrases shall have the meanings assigned to each, unless the context indicates otherwise:
| The Emirate |
: The Emirate of Abu Dhabi. |
| The Government |
: The Government of Abu Dhabi. |
| The Municipality |
: Al Ain City Municipality, Al Dhafra Region Municipality, or any other municipality that may be established in the Emirate in the future. |
| External Areas |
: Public areas located outside the boundaries of residential plots, including the spaces between plots and the areas within the road right-of-way. |
| Infrastructure Project Boundaries |
: The boundaries of the detailed infrastructure master plan project being implemented by the Government. |
| External Works |
: Works in the external areas located between the plot boundaries and the infrastructure project boundaries, which may include, but are not limited to, paving, parking lots, landscaping, gardening, installation of shades, and others. |
| Residential Plots |
: Residential lands and public housing. |
Article (2)
This decision aims to regulate the external areas surrounding residential plots in the Emirate of Abu Dhabi in a way that contributes to providing a suitable environment for the public and improving the city's appearance, in accordance with the guidelines attached to this decision.
Article (3)
The implementation of external works for the residential plot shall be optional for the owner.
Article (4)
The Municipality shall be responsible for monitoring the application of this decision and taking the appropriate measures for its implementation.
Article (5)
This decision shall be implemented and effective from the date of its issuance and shall be published in the Official Gazette.
