متطلبات الترخيص

2. كتاب تكليف من الجهة المختصة (PDF) أو مالك القسيمة.
3. مخطط حديث للأرض لا تزيد مدته عن شهرين.
4. نسخة عن جواز السفر أو الهوية للمالك أو المالكين.
5. خلاصة قيد الأسرة (للفيلات السكنية).
6. كتاب الموافقة الصادر عن الجهة المختصة على النواحي الفنية والهندسية للمخططات التنفيذية (PDF).
7. المخططات الهندسية التنفيذية المختومة والمعتمدة من الجهة المختصة (PDF).
8. مخطط عام للمنطقة موضح عليه موقع المشروع على خريطة حديثة للتصوير الجوي بحسب معايير إدارة البيانات المكانية (DWG).
9. المخططات التصميمية المرخصة أو المعتمدة من إدارة تراخيص البناء أو إدارة التخطيط الحضري موضحاً عليه المداخل (PDF).
10. المخططات التنفيذية المطلوب اعتمادها للأعمال عليها المداخل والإحداثيات والأبعاد عن القسائم ومحاور الطرق بحسب معايير إدارة البيانات المكانية (DWG) وبحسب الواقع.
11. المدة الزمنية للمشروع موضحاً تاريخ بدء وانتهاء الأعمال.
12. خطة البيئة والصحة والسلامة أثناء التنفيذ بحسب متطلبات إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي (PDF).
13. عدم ممانعة من الجهات المعنية الأخرى علماً بأنه لا حاجة لعدم ممانعة من الجهة المختصة:
    • أ. شركة أبوظبي للتوزيع - مياه.
    • ب. شركة أبوظبي للتوزيع – كهرباء.
    • ج. إدارة الحدائق والمتنزهات الترفيهية - قطاع البنية التحتية وأصول البلدية - بلدية مدينة أبوظبي.
    • د. إدارة الطرق الداخلية والبنية التحتية - قطاع البنية التحتية وأصول البلدية - بلدية مدينة أبوظبي.
    • ه. دائرة النقل.
    • و. مؤسسة الإمارات للاتصالات (اتصالات).
    • ز. شركة الإمارات للاتصالات المتكاملة (دو du).
    • ح. الشركة الوطنية للتبريد المركزي (تبريد).
    • ط. شركة أبوظبي لخدمات الصرف الصحي.
    • ي. شركة بترول أبوظبي الوطنية للتوزيع (أدنوك فود).
    • ك. مديرية إدارة المرور.

أعمال الصيانة

ه - أعمال الصيانة

تشمل تراخيص أعمال الصيانة ما يلي:

٥,١ أعمال صيانة خطوط الخدمات والبنية التحتية

٥,٢ أعمال صيانة الطرق

٥,٣ أعمال صيانة المجال العام

• لا يشمل ترخيص الصيانة أي أعمال استبدال أو تغيير مسار لخطوط الخدمات والبنية التحتية القائمة أو غرف التفتيش والمحابس والمانهولات والتي يتوجب إصدار الرخصة المناسبة لها من تراخيص خطوط الخدمات.
• في الوقت الراهن (يناير ٢٠١٢ وحتى إشعار آخر لاحاجة إلى استصدار رخصة لأعمال الصيانة إلا تلك التي تقتضي الحصول على عدم ممانعة من أي جهة كانت.
• وفيما يلي متطلبات كل رخصة.

٥.١ أعمال صيانة خطوط الخدمات والبنية التحتية

• الجهة المختصة - الجهة المعنية بالخدمات والبنية التحتية.

• تصنيف الإجراء : (۳)
• متطلبات مرحلة الاعتماد النهائي:

1. كتاب لإجراء الاعمال من الجهة المختصة (PDF).
2. مخطط عام للمنطقة موضح عليه أماكن العمل المطلوب ترخيصها بحسب المخططات التنفيذية على خريطة حديثة للتصوير الجوي بحسب معايير إدارة البيانات المكانية (DWG).
3. المخططات التنفيذية المعتمدة والمختومة من الجهة المختصة (PDF).
4. طريقة العمل Method Statement.
5. المخططات التنفيذية المطلوب اعتمادها بحسب معايير إدارة البيانات المكانية (DWG).
6. المدة الزمنية للتنفيذ وبداية ونهاية المشروع (PDF) موضحاً عليه المراحل الأساسية في التنفيذ (Milestones) بنظام PRIMAVERA أو ما يعادله.
7. خطة البيئة والصحة والسلامة أثناء التنفيذ بحسب متطلبات إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي (PDF).
8. عدم ممانعة من الجهات المعنية الأخرى بحسب المشروع وطريقة العمل (ملاحظة ١):
   • أ. إدارة الطرق الداخلية والبنية التحتية - قطاع البنية التحتية وأصول البلدية - بلدية مدينة أبوظبي.
   • ب. إدارة الحدائق والمتنزهات الترفيهية - قطاع البنية التحتية وأصول البلدية - بلدية مدينة أبوظبي.
   • ج. إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي.
   • د. شركة أبوظبي للتوزيع – كهرباء.
   • ه. شركة أبوظبي للنقل والتحكم.
   • و. مؤسسة الإمارات للاتصالات (اتصالات).
   • ز. شركة الإمارات للاتصالات المتكاملة (دو du).
   • ح. شركة أبوظبي للصرف الصحي.
   • ط. مديرية إدارة المرور ( في حالة التأثير على سير حركة المركبات).
   • ي. دائرة النقل.
   • ك. جهات أخرى حسب موقع ونوع المشروع (ملاحظة ٢).

ملاحظة (١) : لا حاجة للحصول على عدم ممانعة من الجهة المختصة عن كل نوع خط خدمة.

ملاحظة (٢): قد تتطلب بعض المشاريع الحصول على عدم ممانعة من جهات غير مسجلة بالنظام الالكتروني لبلدية مدينة أبوظبي. في هذه الحالة يتم تقديم الطلب مباشرة إلى تلك الجهة على أن يتم تحميل عدم الممانعة المصدقة من تلك الجهة قبل الحصول على الاعتماد المبدئي.

٥.٢ أعمال صيانة الطرق

• الجهة المختصة - إدارة البنية التحتية والطرق الداخلية.
• تصنيف الإجراء : (۳)
• متطلبات مرحلة الاعتماد النهائي:

1. كتاب لإجراء الاعمال من الجهة المختصة (PDF) أو المالكة للأصول.
2. مخطط عام للمنطقة موضح عليه أماكن العمل المطلوب ترخيصها بحسب المخططات التنفيذية على خريطة حديثة للتصوير الجوي بحسب معايير إدارة البيانات المكانية (DWG).
3. المخططات التنفيذية المعتمدة والمختومة من الجهة المختصة (PDF).
4. طريقة العمل Method Statement.
5. المخططات التنفيذية المطلوب اعتمادها بحسب معايير إدارة البيانات المكانية (DWG).
6. المدة الزمنية للتنفيذ وبداية و نهاية المشروع (PDF) موضحاً عليه المراحل الهامة في التنفيذ (Milestones) بنظام PRIMAVERA أو ما يعادله.
7. خطة البيئة والصحة والسلامة أثناء التنفيذ بحسب متطلبات إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي (PDF).
8. عدم ممانعة من الجهات المعنية الأخرى بحسب المشروع وطريقة العمل ( ملاحظة ا):
   • أ. إدارة الحدائق والمتنزهات الترفيهية - قطاع البنية التحتية وأصول البلدية - بلدية مدينة أبوظبي.
   • ب. إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي.
   • ج. شركة أبوظبي للتوزيع – كهرباء.
   • د. شركة أبوظبي للنقل والتحكم.
   • ه. مؤسسة الإمارات للاتصالات (اتصالات).
   • و. شركة الإمارات للاتصالات المتكاملة (دو du).
   • ز. شركة أبوظبي للصرف الصحي.
   • ح. مديرية إدارة المرور ( في حالة التأثير على سير حركة المركبات).
   • ط. دائرة النقل.
   • ي. جهات أخرى حسب موقع ونوع المشروع ( ملاحظة ا).

ملاحظة (۱): قد تتطلب بعض المشاريع الحصول على عدم ممانعة من جهات أخرى خاصة غير مرتبطة بالنظام الالكتروني لبلدية مدينة أبوظبي. في هذه الحالة يتم تقديم الطلب مباشرة إلى تلك الجهة على أن يتم تحميل عدم الممانعة المصدقة من تلك الجهة قبل الحصول على الاعتماد المبدئي أو النهائي.

٥.٣ أعمال صيانة المجال العام

تم تصنيف أعمال الصيانة في المجال العام بحسب توصيف مجلس أبوظبي للتخطيط العمراني كما يلي:

• المنتزهات
• الأماكن العامة
• مساحات الشوارع
• الواجهة البحرية

الجهة المختصة - إدارة الحدائق والمنتزهات الترفيهية.

• تصنيف الإجراء: (۳)
• متطلبات مرحلة الاعتماد النهائي:

1. كتاب لإجراء الاعمال من الجهة المختصة (PDF) أو المالكة للأصول.

ملاحظة (1): قد تتطلب بعض المشاريع الحصول على عدم ممانعة من جهات أخرى خاصة غير مرتبطة بالنظام الالكتروني لبلدية مدينة أبوظبي. في هذه الحالة يتم تقديم الطلب مباشرة إلى تلك الجهة على أن يتم تحميل عدم الممانعة المصدقة من تلك الجهة قبل الحصول على الاعتماد المبدئي أو النهائي.

يندرج تحت هذه الفئة التراخيص التالية:

٦,١,١ خط غاز بحري

٦,١,٢ خط ألياف بصرية

٦,١,٣ خط طاقة كهربائية بحري

٦,١,٤ خط ماء بحري

٦,١,٥ خط طاقة كهربائية هوائي في المياه الإقليمية

٦,١,٦ خط بترول خام

٦,١,٧ خط مشتقات بترولية

٦,١,٨ خط CO2 بحري

الجهة المختصة: الجهة المعنية بكل خط.

• تصنيف الإجراء : (١)

1. كتاب تكليف من الجهة المختصة (PDF).
2. كتاب الموافقة الصادر عن الجهة المختصة على النواحي الفنية والهندسية للمشروع (PDF).
3. المخططات الهندسية المختومة والمعتمدة من الجهة المختصة (PDF).
4. مخطط عام للمنطقة موضح عليه موقع المشروع على خريطة حديثة للتصوير الجوي بحسب معايير إدارة البيانات المكانية (DWG).
5. مخططات مساحية حسب الواقع لموقع المشروع موضحاً عليها على البر إن وجدت خطوط الخدمات القائمة و المانهولات وغرف التفتيش والمحابس وأية دلائل سطحية عن الخدمات إشارات تحذير او تعريف بالخطوط والإحداثيات والأبعاد عن محاور الطرق والقسائم بحسب معايير إدارة البيانات المكانية (DWG).
6. مخططات مساحية لقياس أعماق البحر Bathymetry لمنطقة المشروع والمناطق المتاخمة والمتأثرة بأعمال المشروع بحسب معايير إدارة البيانات المكانية (DWG).
7. موافقة هيئة البيئة على دراسات التأثير البيئي للمشروع و غيرها من الدراسات المطلوبة من الهيئة بحسب نطاق المشروع وموقعه.
8. المخططات التصميمية للخطوط المطلوب مراجعتها موضحاً عليها خطوط الخدمات القائمة والإحداثيات والأبعاد بحسب معايير إدارة البيانات المكانية (DWG).
9. تقرير الرفع المساحي لمنطقة المشروع و صور الحفر الاستكشافية لتوضيح خطوط الخدمات القائمة في موقع المشروع (على البر إن وجدت) (PDF).
10. تقرير فحص التربة (الدراسات الجيوتكنيكية والجيوفيزيائية لموقع المشروع (PDF) وأيضاً تسليم البيانات بحسب المعايير الجديدة لإدارة البيانات المكانية بخصوص تقديم البيانات الجيوتكنيكية.

ملاحظة (١): بعد تقديم المخططات والوثائق السابقة يمكن التقدم للحصول على عدم ممانعة الجهات المعنية للحصول على اعتماد المشروع من قبل إدارة التخطيط الحضري عن طريق النظام الإلكتروني لبلدية مدينة أبوظبي:

• أ. إدارة الطرق الداخلية والبنية التحتية - قطاع البنية التحتية وأصول البلدية - بلدية مدينة أبوظبي.
• ب. إدارة الحدائق والمتنزهات الترفيهية - قطاع البنية التحتية وأصول البلدية - بلدية مدينة أبوظبي.
• ج. القيادة العامة للقوات المسلحة - سلاح الإشارة.
• د. القيادة العامة للقوات المسلحة - القوات البحرية.
• ه. هيئة البيئة.
• و. مديرية إدارة المرور.
• ز. مجلس أبوظبي للتخطيط العمراني.
• ح. دائرة النقل.
• ط. شركة أبوظبي للتوزيع - مياه.
• ي. شركة أبوظبي للتوزيع – كهرباء.
• ك. شركة أبوظبي للنقل والتحكم.
• ل. مؤسسة الإمارات للاتصالات (اتصالات).
• م. شركة الإمارات للاتصالات المتكاملة (دو du).
• ن. الشركة الوطنية للتبريد المركزي (تبريد).
• س. شركة أبوظبي للصرف الصحي.

5. مخططات مساحية حسب الواقع لموقع المشروع موضحاً عليها (على البر إن وجدت) خطوط الخدمات القائمة و المانهولات وغرف التفتيش والمحابس وأية دلائل سطحية عن الخدمات (إشارات تحذير او تعريف بالخطوط) والإحداثيات والأبعاد عن محاور الطرق والقسائم بحسب معايير إدارة البيانات المكانية (DWG).
6. مخططات مساحية لقياس أعماق البحر Bathymetry لمنطقة المشروع والمناطق المتاخمة والمتأثرة بأعمال المشروع بحسب معايير إدارة البيانات المكانية (DWG).
7. موافقة هيئة البيئة على دراسات التأثير البيئي أثناء تنفيذ المشروع و غيرها من الدراسات المطلوبة من الهيئة بحسب نطاق المشروع وموقعه.
8. المخططات التصميمية للخطوط المطلوب مراجعتها موضحاً عليها خطوط الخدمات القائمة والإحداثيات والأبعاد بحسب معايير إدارة البيانات المكانية (DWG).
9. تقرير الرفع المساحي لمنطقة المشروع و صور الحفر الاستكشافية لتوضيح خطوط الخدمات القائمة في موقع المشروع (على البر إن وجدت) (PDF).
10. تقرير فحص التربة (الدراسات الجيوتكنيكية والجيوفيزيائية لموقع المشروع) (PDF) وأيضاً تسليم البيانات بحسب المعايير الجديدة لإدارة البيانات المكانية بخصوص تقديم البيانات الجيوتكنيكية.
11. مخطط أفقي يبين موقع السور المؤقت وبوابات الدخول والخروج للموقع وأبعاد البوابات و الإحداثيات وأبعاد السور عن محاور الطرق والقسائم بحسب معايير إدارة البيانات المكانية (PDF و DWG).
12. تفاصيل رأسية توضح إرتفاع السور المؤقت وتفاصيل استناده و تفاصيل البوابات (PDF).
13. عدم ممانعة الجهات المعنية الأخرى المذكورة سابقاً بالإضافة إلى:
14. إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي.
15. الجدول الزمني لتنفيذ المشروع ومراحله الأساسية بنظام PRIMAVERA أو ما يعادله (PDF).
16. خطة البيئة والصحة والسلامة أثناء التنفيذ بحسب متطلبات إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي (للحصول على عدم الممانعة).

تصاريح العمل

.. تصاريح العمل الجزئي

بالإضافة إلى تراخيص البنية التحتية يمكن للسادة العملاء تقديم طلبات الحصول على تصاريح العمل التالية بما فيها تلك الصادرة عن قطاع البنية التحتية وأصول البلدية:

٧,١,١ تصريح قطع الأرصفة الإسفلتية وإعادة رصفها

٧,١,٢ تصريح حفر كشف عن الخدمات في مناطق أصول البلدية

٧,١,٣ تصريح أعمال الحفر بالأنفاق تحت أصول إدارة الطرق الداخلية والبنية التحتية

٧,١,٤ تصريح لإزالة وإعادة رصف بلاط ممرات المشاة ومواقف السيارات والطرق

٧,٢٠١ تصريح ضخ مياه جوفية في شبكة تصريف مياه الأمطار

٧,٢,٢ تصريح لقطع وإعادة المساحات الخضراء ضمن أصول إدارة الحدائق

وفيما يلي متطلبات وشروط كل تصريح علماً بأنه لاحاجة إلى أخذ عدم ممانعة للتصاريح السابق ذكرها من أية جهة أعطت موافقة حديثة للمشروع.

۷.۱.۱ تصريح قطع الأرصفة الإسفلتية وإعادة رصفها

• الجهة المعنية - إدارة البنية التحتية والطرق الداخلية.
• الإجراء:
  • تحميل المتطلبات على البوابة الإلكترونية
  • الحصول على موافقة إدارة التخطيط الحضري (إلكترونياً)
  • الحصول على موافقة الجهة المعنية واستشاري ومقاول صيانة الطرق بحسب مكان العمل (يدوياً و يتوقع أن يصبح إلكترونياً خلال سنة ٢٠١٢)
  • الحصول على عدم ممانعة الجهات الأخرى (إلكترونياً ويدوياً بحسب الجهة)
  • تقديم الضمان البنكي إلى خدمة العملاء (يدوياً).
  • الحصول على التصريح ( من قسم خدمة العملاء).
• متطلبات مرحلة الاعتماد النهائي:

  متطلبات إدارة التخطيط الحضري:

  1. كتاب لإجراء الاعمال من الجهة المالكة للأصول (PDF).
  2. مخطط عام للمنطقة موضح عليه أماكن العمل المطلوب ترخيصها بحسب المخططات التنفيذية على خريطة حديثة للتصوير الجوي بحسب معايير إدارة البيانات المكانية (PDF و DWG).
  3. المدة الزمنية للتنفيذ وبداية و نهاية المشروع (PDF) موضحاً عليه المراحل الهامة في التنفيذ (Milestones).
  4. خطة البيئة والصحة والسلامة أثناء التنفيذ بحسب متطلبات إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي (PDF).
  5. عدم ممانعة من الجهات المعنية الأخرى بحسب المشروع وطريقة العمل ( ملاحظة ١):
     • أ. إدارة الحدائق والمتنزهات الترفيهية - قطاع البنية التحتية وأصول البلدية - بلدية مدينة أبوظبي.
     • ب. إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي.
     • ج. شركة أبوظبي للتوزيع – كهرباء.
     • د. شركة أبوظبي للنقل والتحكم.
     • ه. مؤسسة الإمارات للاتصالات (اتصالات).
     • و. شركة الإمارات للاتصالات المتكاملة (دو du).
     • ز. شركة أبوظبي للصرف الصحي.
     • ح. إدارة هندسة المرور وسلامة الطرق في شرطة أبوظبي.
     • ط. دائرة النقل.
     • ي. جهات أخرى حسب موقع ونوع المشروع (ملاحظة١).

  ملاحظة (١): قد تتطلب بعض المشاريع الحصول على عدم ممانعة من جهات أخرى خاصة غير مرتبطة بالنظام الالكتروني لبلدية مدينة أبوظبي. في هذه الحالة يتم تقديم الطلب مباشرة إلى تلك الجهة على أن يتم تحميل عدم الممانعة المصدقة من تلك الجهة قبل الحصول على الاعتماد المبدئي أو النهائي.

الشروط والتفاصيل الخاصة بتصريح قطع الأرصفة الإسفلتية وإعادة رصفها

1. يجب الحصول على موافقة إدارة التخطيط الحضري في قطاع تخطيط المدن - بلدية مدينة أبوظبي على المسار والأعماق لتنفيذ هذه الأعمال.
2. على الجهة الطالبة أخذ جميع تصاريح عدم الممانعة اللازمة من الجهات المختصة والمعنية لتنفيذ الأعمال و إلا يعتبر التصريح لاغياً.
3. يجب عدم البدء بالأعمال إلا بعد إعداد (محضر استلام الموقع) معتمد ومختوم بحضور استشاري المشروع واستشاري صيانة إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي والمقاول الرئيسي ومقاول الطرق معزز بالصور الملونة للموقع وإرساله إلى قسم جودة المواد - بلدية مدينة أبوظبي.
4. يجب الأخذ بالاعتبار بأن تصريح عدم الممانعة يقتصر فقط على أماكن الحفر حسب التفاصيل المذكورة أعلاه، وعلى المقاول الالتزام بإجراء جميع الفحوصات المقررة وفقاً لطريقة العمل المعتمدة وتفاصيل فاتورة الاختبارات.
5. التنسيق مع استشاري إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي لمعاينة المنطقة قبل البدء بالعمل.
6. على جهاز الإشراف (استشاري المشروع / الجهة المالكة) التأكد من التزام المقاول الرئيسي ومقاول الباطن بطريقة العمل المقدمة بالشروط والمواصفات الخاصة بأعمال الطرق التابعة للدائرة عند تنفيذ طريقة العمل المتفق عليها.
7. على ( الجهة المنفذة / الجهة المشرفة / الجهة المالكة ) اتخاذ كافة الإجراءات التي تضمن بقاء مقدار الهبوط ضمن الحد (٦ ملم) المسموح به ، وفي حالة تجاوز الحد المسموح به فيترتب عليهم إبلاغ إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي، وإدارة هندسة المرور وسلامة الطرق بشرطة أبوظبي مباشرة وبدون أي تأخير.
8. إذا لزم الأمر لإجراء عمليات سحب مياه (Dewatering) فيجب اعتماد طريقة العمل من (استشاري المشروع) قبل تقديمها إلى بلدية مدينة أبوظبي لإصدار التصريح المناسب.
9. يجب مراعاة عمل نظام محكم لخفض منسوب المياه الجوفية داخل منطقة الحفر بحيث لا يسبب ذلك نزول منسوب المياه خارج نطاق القطع (الحفر) وعلى أن يتم التصميم والتنفيذ الدقيق للفلاتر بحيث لا تسمح مطلقاً بهجرة حبيبات التربة الناعمة.
10. يجب مراعاة التدقيق على تراكيب التربة لاختيار نظام خفض المياه الذي لا يسبب بأي حال من الأحوال ذوبان لأملاح التربة بما ينطوي على فقد كتلتها.
11. يجب أخذ جميع احتياطات الأمن والسلامة اللازمة ووضع العلامات التحذيرية المناسبة لضمان سلامة المشاة والمركبات ليلا ونهاراً.
12. بعد الانتهاء من العمل يجب إزالة جميع المخلفات من الموقع وإعادة الوضع كما كان عليه قبل بدء العمل وحسب طريقة العمل المعتمدة.
13. يجب على المقاول عند الإنتهاء من تنفيذ كافة الأعمال ( مباشرة) تقديم طلب لاستشارى إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي لإصدار شهادة إتمام أعمال (استلام ابتدائي) وذلك للتأكد من حسن التنفيذ وتحديد فترة الضمان.
14. يجب على المقاول بعد إنتهاء فترة الضمان تقديم طلب (استلام نهائي) لاستشارى إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي مرفقا به شهادة إتمام الأعمال (الاستلام الابتدائي).
15. يجب تسليم قسم جودة المواد - بلدية مدينة أبوظبي نسختين من المخططات للأعمال المنفذة فعليا (As-built) معتمدة ومرفقة بخطاب رسمي من استشاري المشروع.
16. على المقاول الالتزام بجميع ما تم ذكره من بيانات محددة بالتصريح وشروط التصريح وطريقة العمل وخلافاً لذلك سيعرض نفسه للمخالفة والمسائلة القانونية.

٧.١.٢ تصريح أعمال حفر الكشف

• يتم الحصول على هذا الترخيص خلال فترة دراسة المشروع أو قبل التنفيذ بغرض كشف خطوط الخدمات والتأكد من مسارها أو عدم تعارضها مع المسارات المقترحة للمشاريع بغرض الحصول على موافقة إدارة التخطيط الحضري والجهات المعنية الأخرى.
• في حال وقوع الحفر في أصول إدارتي الطرق او الحدائق يتوجب حينها الحصول أيضاً على التصاريح الأخرى المطلوبة.
• الجهة المعنية: إدارة التخطيط الحضري.
• تصنيف الإجراء: (۳)
• متطلبات مرحلة الاعتماد النهائي:

1. كتاب لإجراء الاعمال من الجهة المالكة للمشروع (PDF).
2. مخطط عام للمنطقة موضح عليه أماكن العمل المطلوب ترخيصها بحسب المخططات التنفيذية على خريطة حديثة للتصوير الجوي بحسب معايير إدارة البيانات المكانية (PDF و DWG).
3. المخططات التنفيذية المعتمدة والمختومة من المكتب الهندسي (PDF).
4. طريقة العمل Method statement للحفريات المطلوبة و إعادة الإصلاح والمتضمنة مخطط مقطع عرضي مفصل يبين طبقات الرصف.
5. المخططات التنفيذية المطلوب اعتمادها بحسب معايير إدارة البيانات المكانية (DWG).
6. المدة الزمنية للتنفيذ وبداية ونهاية المشروع (PDF) موضحاً عليه المراحل الهامة في التنفيذ (Milestones) بنظام PRIMAVERA أو ما يعادله.
7. خطة البيئة والصحة والسلامة أثناء التنفيذ بحسب متطلبات إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي (PDF).
8. عدم ممانعة من الجهات المعنية الأخرى بحسب المشروع وطريقة العمل ( ملاحظة ا):
   • أ. إدارة الحدائق والمتنزهات الترفيهية - قطاع البنية التحتية وأصول البلدية - بلدية مدينة أبوظبي.
   • ب. إدارة الطرق الداخلية والبنية التحتية.
   • ج. إدارة الصحة والسلامة والبيئة - قطاع تخطيط المدن - بلدية مدينة أبوظبي.
   • د. شركة أبوظبي للتوزيع - كهرباء.
   • ه. شركة أبوظبي للنقل والتحكم.
   • و. مؤسسة الإمارات للاتصالات (اتصالات).
   • ز. شركة الإمارات للاتصالات المتكاملة (دو du).
   • ح. شركة أبوظبي للصرف الصحي.
   • ط. إدارة هندسة المرور وسلامة الطرق في شرطة أبوظبي.
   • ي. دائرة النقل.
   • ك. جهات أخرى حسب موقع ونوع المشروع ( ملاحظة ١).

ملاحظة (١): قد تتطلب بعض المشاريع الحصول على عدم ممانعة من جهات أخرى خاصة غير مرتبطة بالنظام الالكتروني لبلدية مدينة أبوظبي. في هذه الحالة يتم تقديم الطلب مباشرة إلى تلك الجهة على أن يتم تحميل عدم الممانعة المصدقة من تلك الجهة قبل الحصول على الاعتماد المبدئي أو النهائي.

۷.۱.۳ تصريح أعمال الحفر بالأنفاق تحت أصول إدارة الطرق الداخلية والبنية التحتية

• الجهة المعنية - إدارة البنية التحتية والطرق الداخلية.
• الإجراء:
  • تحميل المتطلبات على البوابة الإلكترونية
  • الحصول على موافقة إدارة التخطيط الحضري (إلكترونياً)
  • الحصول على موافقة الجهة المعنية واستشاري ومقاول صيانة الطرق بحسب مكان العمل (يدوياً و يتوقع أن يصبح إلكترونياً خلال سنة ٢٠١٢)
  • الحصول على عدم ممانعة الجهات الأخرى (إلكترونياً ويدوياً بحسب الجهة)
  • تقديم الضمان البنكي إلى خدمة العملاء (يدوياً).
  • الحصول على التصريح ( من قسم خدمة العملاء).

2. على الجهة الطالبة أخذ جميع تصاريح عدم الممانعة اللازمة من الجهات المختصة والمعنية لتنفيذ الأعمال وإلا يعتبر التصريح لاغياً.

12. على جهاز الإشراف (استشاري المشروع / الجهة المالكة) التأكد من التزام المقاول الرئيسي ومقاول الباطن بطريقة العمل المقدمة بالشروط والمواصفات الخاصة بأعمال الطرق التابعة للدائرة عند تنفيذ طريقة العمل المتفق عليها.
13. يجب أن لا تقل المسافة بين حافة كل من حفرة الدفع وحفرة الاستقبال وبين حافة الدفان السفلي للطريق عن (خمسة أمتار) كحد أدنى.
14. يجب أن لا تقل المسافة بين سطح الطريق و أعلى النفق عن ما تم ذكره في طريقة العمل المعتمدة.
15. يجب أن لا يزيد قطر النفق عن ما تم ذكره في طريقة العمل المعتمدة، وإلا يتوجب إعادة التقديم للاعتماد إن كان هناك ما يستدعي الزيادة في قطر النفق.
16. يجب تثبيت (نقاط مراقبة هبوط سطح الطريق) على سطح الأسفلت على شكل شبكة بأبعاد تساوي (١ متر)، ويجب أن تغطي هذه الشبكة كامل عرض الطريق على طول النفق وعلى كلا جانبيه بمسافة لا تقل عن المسافة بين مركز النفق وبين سطح الأسفلت، كما يجب أن يتم أخذ القراءات تحت إشراف (استشاري المشروع / الجهة المالكة) قبل البدء بتنفيذ هذه الأعمال وأثناء التنفيذ وبعد التنفيذ و حسب طريقة العمل المعتمدة، على أن تكون النقاط المرجعية (Benchmark) على مسافة لا تقل عن ٥٠ مترا من مكان النفق.
17. يجب تحديد جميع نقاط مراقبة هبوط سطح الطريق باللون (المحدد لكم) وذلك حفاظا على المظهر العام.
18. يجب على جهاز الإشراف (استشاري المشروع / الجهة المالكة) تقديم كافة السجلات الخاصة بقراءات نقاط مراقبة هبوط سطح الطريق والمخططات التنفيذية بشكل رسمي لقسم جودة المواد - إدارة الطرق الداخلية والبنية التحتية، مصدقة من استشاري إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي.
19. على ( الجهة المنفذة / الجهة المشرفة / الجهة المالكة ) اتخاذ كافة الإجراءات التي تضمن بقاء مقدار الهبوط ضمن الحد (٦ ملم) المسموح به ، وفي حالة تجاوز الحد المسموح به فيترتب عليهم إبلاغ إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي، وإدارة هندسة المرور وسلامة الطرق بشرطة أبوظبي مباشرة وبدون أي تأخير.
20. يجب إعادة دفان الحفرتين بعد الانتهاء من العمل على طبقات وحسب طريقة العمل المعتمدة وإزالة جميع المخلفات من الموقع وإعادة الوضع كما كان عليه قبل بدء العمل.
21. يجب على المقاول عند الإنتهاء من تنفيذ كافة الأعمال ( مباشرة ) تقديم طلب لاستشارى إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي لإصدار شهادة إتمام أعمال (استلام ابتدائي) وذلك للتأكد من حسن التنفيذ وتحديد فترة الضمان.
22. يجب تسليم قسم جودة المواد - بلدية مدينة أبوظبي نسختين من المخططات للأعمال المنفذة فعليا (As-built) معتمدة ومرفقة بخطاب رسمي من استشاري المشروع.
23. يجب على المقاول بعد إنتهاء فترة الضمان تقديم طلب (استلام نهائي) لاستشارى إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي مرفقا به شهادة إتمام الأعمال (الاستلام الابتدائي).

10. يجب مراعاة التدقيق على تراكيب التربة لاختيار نظام خفض المياه الذي لا يسبب بأي حال من الأحوال ذوبان لأملاح التربة بما ينطوي على فقد كتلتها.
11. يجب أخذ جميع احتياطات الأمن والسلامة اللازمة ووضع العلامات التحذيرية المناسبة لضمان سلامة المشاة والمركبات ليلا ونهاراً.
12. بعد الانتهاء من العمل يجب إزالة جميع المخلفات من الموقع وإعادة الوضع كما كان عليه قبل بدء العمل وحسب طريقة العمل المعتمدة.
13. يجب على المقاول عند الإنتهاء من تنفيذ كافة الأعمال ( مباشرة ) تقديم طلب لاستشارى إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي لإصدار شهادة إتمام أعمال (استلام ابتدائي) وذلك للتأكد من حسن التنفيذ وتحديد فترة الضمان.
14. يجب على المقاول بعد إنتهاء فترة الضمان تقديم طلب (استلام نهائي) لاستشارى إدارة الطرق الداخلية والبنية التحتية - بلدية مدينة أبوظبي مرفقا به شهادة إتمام الأعمال (الاستلام الابتدائي).
15. يجب تسليم قسم جودة المواد - بلدية مدينة أبوظبي نسختين من المخططات للأعمال المنفذة فعليا (As-built) معتمدة ومرفقة بخطاب رسمي من استشاري المشروع.
16. على المقاول الالتزام بجميع ما تم ذكره من بيانات محددة بالتصريح وشروط التصريح وطريقة العمل وخلافاً لذلك سيعرض نفسه للمخالفة والمسائلة القانونية.

٧.٢٠١ تصريح ضخ مياه جوفية في شبكة تصريف مياه الأمطار

• الجهة المعنية - إدارة الحدائق والمنتزهات الترفيهية.
• الإجراء:
  • تحميل المتطلبات على البوابة الإلكترونية
  • الحصول على موافقة إدارة التخطيط الحضري (إلكترونياً)
  • الحصول على موافقة إدارة تراخيص البناء على سحب المياه الجوفية (إلكترونياً)
  • الحصول على موافقات استشاري ومقاول الصيانة على النموذج المرفق (يدويا و يتوقع أن يصبح إلكترونيا خلال سنة ٢٠١٢)
  • تقديم الضمان البنكي إلى إدارة الحدائق والمنتزهات الترفيهية (يدوياً).
  • الحصول على التصريح ( من قسم خدمة العملاء).

  ملاحظة (١): قد تتطلب بعض المشاريع الحصول على عدم ممانعة من جهات أخرى خاصة غير مرتبطة بالنظام الالكتروني لبلدية مدينة أبوظبي. في هذه الحالة يتم تقديم الطلب مباشرة إلى تلك الجهة على أن يتم تحميل عدم الممانعة المصدقة من تلك الجهة قبل الحصول على الاعتماد المبدئي أو النهائي.

رخصة بنية تحتية

شروط الرخصة

1. يكون للكلمات والعبارات التالية المعاني الواردة أمام كل منها :-
   • أ. الدائرة: دائرة الشؤون البلدية – إمارة أبوظبي.
   • ب. البلدية المعنية : بلدية مدينة أبوظبي أو بلدية مدينة العين، أو بلدية المنطقة الغربية، بحسب الأحوال والتي أصدرت الرخصة.
   • ج. الجهات المعنية بالخدمات: أية جهة لديها خطوط خدمات في موقع العمل.
   • د. الجهة المعنية : الجهة المخول لها قانوناً الموافقة على أي تصريح مطلوب لتنفيذ وحسن سير الأعمال المؤقتة.
   • ه. الجهة المختصة : أية جهة مسئولة فنياً عن تصديق واعتماد المخططات التصميمية أو التنفيذية للأعمال.
   • و. المقاول : أي شخص طبيعي أو معنوي يتعهد بأن ينفذ أعمال البنية التحتية أو يؤدي عمل من الأعمال التي تنظمها القوانين النافذة .
   • ز. المكتب الهندسي: المكتب المرخص له بمزاولة المهنة في مجال البنية التحتية والطرق والمرافق والإنشاءات المدنية في إمارة أبوظبي، والذي يعهد إليه بإعداد التصميمات والرسومات لأعمال البنية التحتية أو أي عمل من الأعمال والقيام بالإشراف على تنفيذها ، أو يعهد إليه بإعداد التصميمات والرسومات فقط دون الإشراف على التنفيذ، أو يعهد إليه بالإشراف على تنفيذ الأعمال التي صممت بمعرفة غيره من المكاتب الهندسية.
2. يخضع إصدار هذه الرخصة إلى شروط وأحكام القانون رقم (٤) لسنة ١٩٨٣ في شأن تنظيم أعمال البناء وتعديلاته والقوانين الأخرى النافذة المتعلقة بأعمال البنية التحتية والقرارات الصادرة بهذا الشأن عن المجلس التنفيذي لإمارة أبوظبي.
3. يجب على المقاول والمكتب الهندسي المشرف توفير جميع متطلبات الأمن والسلامة والحماية للسكان والمارة بالقرب من مواقع العمل وذلك عن طريق وضع الأسيجة الآمنة والإضاءة والحراسة والعلامات التنبيهية والتحذيرية والإرشادية اللازمة حول مواقع العمل الدائمة والمؤقتة طوال فترة إنجاز الأعمال.
4. يجب على المقاول الإلتزام بجميع الشروط والأحكام الخاصة بتنفيذ تصاريح العمل والصادرة عن الجهة المعنية.
5. يتخذ المقاول والمكتب الهندسي المشرف كافة ما يلزم من احتياطات لحماية البنى التحتية والمباني والمنشآت المجاورة للأعمال الدائمة أو المؤقتة والمرخص بها أصولاً بما فيها أعمال الحفر وسحب المياه الجوفية مع تطبيق كافة الضوابط الفنية وكذلك المتعلقة بالبيئة والصحة والسلامة الإنشائية اللازمة والتأكد بصفة مستمرة من الإلتزام بها لحين الإنتهاء الرسمي لتلك الأعمال.
6. إذا رغب المرخص له إجراء أية تعديلات فنية على الأعمال المرخص بها، أو أية تعديلات على الحدود المكانية للأعمال فعليه الحصول على ترخيص جديد للتعديلات الفنية أو المكانية أو الأعمال الإضافية.
7. على المقاول حفظ صورة من الرخصة ومخطط توضيح الأعمال والمخططات التنفيذية المعتمدة من قبل إدارة التخطيط الحضري في البلدية المعنية والجهات المختصة في موقع العمل وإطلاع مهندسي ومراقبي البلدية المعنية عليها عند التفتيش على الموقع.
8. على المقاول نقل مواد الحفر تباعاً لمراحل العمل إلى المواقع المخصصة لذلك من البلدية المعنية أو الجهة المعنية ولا يجوز القيام بأعمال الحفر إلا بعد الحصول على التصاريح و الموافقات المطلوبة لنقل ناتج الحفر إلى المواقع المخصصة.
9. على المقاول إزالة السور المؤقت ومخلفاته وترك الموقع خالياً من المعدات والأنقاض ونظيفاً بعد الإنهاء تماماً من الأعمال.
10. لا يجوز إسكان العمال والفنيين في الموقع.
11. لا يجوز للمقاول تخزين أو تشوين أي مواد ترابية أو أي مواد بناء أخرى فوق خطوط الخدمات أو في أماكن العمل.
12. لا يجوز للمرخص له العمل خارج الحدود المرخص بها والمحددة من قبل إدارة البيانات المكانية التابعة للبلدية المعنية تحت طائلة المسؤولية القانونية.
13. لا يجوز للمقاول سحب المياه الجوفية من الموقع إلا بعد الحصول على الموافقة المطلوبة من البلدية المعنية بحسب القرار الإداري رقم (١) لسنة ٢٠١٢ والصادر عن دائرة الشؤون البلدية في إمارة أبو ظبي.
14. لا يجوز للمقاول ضخ المياه الجوفية على شبكة مياه الأمطار إلا بعد الحصول على التصريح المطلوب من البلدية المعنية.
15. لا يجوز للمقاول قطع الأرصفة الإسفلتية أو إزالة الأرصفة أو الزراعات التجميلية إلا بعد الحصول على التصاريح والموافقات المطلوبة من الجهة المعنية.
16. لا يجوز للمقاول بدء العمل إلا بعد الحصول على شهادة مطابقة علامات المشروع الصادرة عن قسم المساحة في البلدية المعنية وتستثنى أعمال توصيلات الخدمات للمقاسم المخصصة للمباني و الفيلات السكنية على أن تكون تلك الأعمال ضمن الجوار المباشر لهذه المقاسم.
17. لا يجوز دفن خطوط الخدمات والبنية التحتية إلا بعد موافقة قسم المساحة في البلدية المعنية والتأكد من أماكن ومناسيب الخطوط الجديدة ومطابقتها للمخططات التنفيذية المعتمدة من البلدية المعنية.
18. لا يجوز لأي مكتب هندسي مشرف أو جهة صاحبة مشروع حكومي أو خاص إصدار شهادات الإنجاز النهائية للأعمال المرخص بها أصولاً بما فيها أعمال الحفر وسحب المياه الجوفية إلا بعد التأكد من قيام المقاول من إعادة الطرق والأرصفة وخطوط الخدمات والبنية التحتية وغيرها من الممتلكات العامة أو الخاصة والمتأثرة بتلك الأعمال إلى حالتها الأصلية وفق الشروط والمواصفات التي تحددها الجهات المعنية والمختصة وصدور شهادة براءة الذمة من تلك الجهات على ذلك.
19. على المقاول المحافظة على خطوط الخدمات أثناء إجراء الأعمال وفقاً للقوانين النافذة.
20. لا تتحمل الدائرة أو البلدية المعنية أي مسئوليات ناتجة عن أية أضرار تحدث بالأرض أو المباني أو البنية التحتية أو الطرق أو مسارات الخدمات أو أية منشأة قائمة أو مؤقتة والمحيطة بموقع المشروع المرخص له وتكون المسئولية على المتسبب في الضرر.
21. يكون لمهندسي ومراقبي البلدية المعنية المنوط بهم مراقبة تنفيذ شروط هذه الرخصة توجيه إنذارات وفقاً للنماذج المعتمدة الخاصة بإنذارات المخالفات، على أن تعطى الجهة المخالفة مهلاً معقولة تتناسب مع نوع المخالفة لإزالتها وتصحيح الأوضاع وفقاً للقوانين النافذة.
22. في حال عدم قيام المقاول بإزالة المخالفة في الوقت المحدد يقوم مدير البلدية المعنية أو من يخوله بإحالة المخالفة إلى المحكمة المختصة وفق الإجراءات النافذة والخاص بطلب إقامة دعوى أمامها.
23. ويجوز لمدير البلدية المعنية أو من يخوله إصدار أمر كتابي مؤقت بوقف الأعمال المخالفة وذلك حتى البت في المخالفة من المحكمة المختصة.
24. تعتبر الشركة أو المقاول التي تقوم بالأعمال في الموقع تنوب عن المالك أو الجهة صاحبة المشروع وبالتالي يجوز إبلاغ وتسليم إنذار المخالفة وكذلك قرار الوقف إليها.
25. للبلدية المعنية أن توقف بالطريق الإداري تنفيذ الأعمال المخالفة لشروط هذه الرخصة ولأحكام القوانين النافذة مع التحفظ على الأدوات والمهمات المستخدمة في التنفيذ.
26. لا تتحمل الدائرة أو البلدية المعنية أي التزامات مادية أو أدبية لإلغاء الترخيص والممنوح نتيجة تقديم بيانات أو مستندات غير صحيحة.

Maintenance work licenses include the following:

• The maintenance license does not include any replacement or rerouting of existing service lines, infrastructure, inspection chambers, valves, or manholes, which require the appropriate license from the service lines licensing.
• Currently (January 2012 until further notice), a license is not required for maintenance works except for those that necessitate obtaining a No Objection Certificate (NOC) from any authority.
• The requirements for each license are as follows.

Terms and Conditions for the Permit to Cut and Re-pave Asphalt Pavements

1. Approval must be obtained from the Urban Planning Division in the Urban Planning Sector - Abu Dhabi City Municipality for the route and depths to carry out these works.
2. The applicant must obtain all necessary no-objection permits from the competent and concerned authorities to carry out the works, otherwise the permit is considered void.
3. Work must not commence until a (Site Handover Report) is prepared, approved, and stamped in the presence of the project consultant, the maintenance consultant of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality, the main contractor, and the roads contractor, supported by colored photos of the site, and sent to the Materials Quality Section - Abu Dhabi City Municipality.
4. It must be noted that the no-objection permit is limited only to the excavation areas as per the details mentioned above, and the contractor must commit to performing all required tests according to the approved work method and the details of the test invoice.
5. Coordinate with the consultant of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality to inspect the area before starting work.
6. The supervising body (project consultant / owner) must ensure that the main contractor and subcontractor comply with the submitted work method in accordance with the conditions and specifications for road works of the Department when implementing the agreed-upon work method.
7. The (executing party / supervising party / owner) must take all measures to ensure that the settlement remains within the permissible limit (6 mm). If the permissible limit is exceeded, they must inform the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality, and the Traffic Engineering and Road Safety Department of Abu Dhabi Police immediately and without any delay.
8. If dewatering operations are required, the work method must be approved by the (project consultant) before being submitted to Abu Dhabi City Municipality for the issuance of the appropriate permit.
9. A sealed system for lowering the groundwater level within the excavation area must be carefully implemented so that it does not cause a drop in the water level outside the cutting (excavation) area, and the filters must be designed and implemented accurately to absolutely prevent the migration of fine soil particles.
10. The soil composition must be carefully checked to select a water lowering system that does not, under any circumstances, cause the dissolution of soil salts, which would result in a loss of its mass.
11. All necessary safety and security precautions must be taken, and appropriate warning signs must be placed to ensure the safety of pedestrians and vehicles day and night.
12. After completing the work, all debris must be removed from the site and the situation restored to its original state before the work began, according to the approved work method.
13. Upon completion of all works, the contractor must (immediately) submit a request to the consultant of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality to issue a work completion certificate (initial handover) to ensure proper execution and determine the warranty period.
14. After the warranty period ends, the contractor must submit a request for (final handover) to the consultant of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality, attaching the work completion certificate (initial handover).
15. Two copies of the as-built drawings of the actually executed works must be delivered to the Materials Quality Section - Abu Dhabi City Municipality, certified and attached with an official letter from the project consultant.
16. The contractor must comply with all data specified in the permit, the permit conditions, and the work method; otherwise, they will be subject to fines and legal accountability.

The contractor and the tunneling subcontractor, or whoever is approved to carry out these works, must adhere to the approved work method without any breach, and they must also adhere to what is mentioned in the recommendations and requirements manual of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality for tunneling works.
12. The supervising body (project consultant / owner) must ensure that the main contractor and subcontractor comply with the submitted work method in accordance with the conditions and specifications for road works of the Department when implementing the agreed-upon work method.
13. The distance between the edge of both the thrust pit and the reception pit and the edge of the road subgrade must not be less than (five meters) as a minimum.
14. The distance between the road surface and the top of the tunnel must not be less than what is stated in the approved work method.
15. The diameter of the tunnel must not exceed what is stated in the approved work method; otherwise, a re-submission for approval is required if there is a need to increase the tunnel diameter.
16. (Road surface settlement monitoring points) must be installed on the asphalt surface in a grid with dimensions of (1 meter). This grid must cover the full width of the road along the tunnel and on both sides for a distance not less than the distance between the tunnel's center and the asphalt surface. Readings must be taken under the supervision of the (project consultant / owner) before, during, and after the execution of these works, as per the approved work method, with the benchmark points being at a distance of not less than 50 meters from the tunnel location.
17. All road surface settlement monitoring points must be marked with the (specified color for you) to maintain the general appearance.
18. The supervising body (project consultant / owner) must officially submit all records of the road surface settlement monitoring point readings and the executive drawings to the Materials Quality Section - Internal Roads and Infrastructure Department, certified by the consultant of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality.
19. The (executing party / supervising party / owner) must take all measures to ensure that the settlement remains within the permissible limit (6 mm). If the permissible limit is exceeded, they must inform the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality, and the Traffic Engineering and Road Safety Department of Abu Dhabi Police immediately and without any delay.
20. The two pits must be backfilled in layers after the work is completed, according to the approved work method, and all debris must be removed from the site, restoring the situation to its original state before the work began.

Terms and Conditions for the Permit to Remove and Re-pave Pedestrian Walkway Tiles

1. Approval must be obtained from the Urban Planning Division in the Urban Planning Sector - Abu Dhabi City Municipality for the route and depths to carry out these works.
2. The applicant must obtain all necessary no-objection permits from the competent and concerned authorities to carry out the works, otherwise the permit is considered void.
3. Work must not commence until a (Site Handover Report) is prepared, approved, and stamped in the presence of the project consultant, the maintenance consultant of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality, the main contractor, and the roads contractor, supported by colored photos of the site, and sent to the Materials Quality Section - Abu Dhabi City Municipality.
4. It must be noted that the permit is limited only to the excavation areas as per the details mentioned above, and the contractor must commit to performing all required tests according to the approved work method and the details of the test invoice.
5. Coordinate with the consultant of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality to inspect the area before starting work.
6. The supervising body (project consultant / owner) must ensure that the main contractor and subcontractor comply with the submitted work method in accordance with the conditions and specifications for road works of the Department when implementing the agreed-upon work method.
7. The (executing party / supervising party / owner) must take all measures to ensure that the settlement remains within the permissible limit (6 mm). If the permissible limit is exceeded, they must inform the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality, and the Traffic Engineering and Road Safety Department of Abu Dhabi Police immediately and without any delay.
8. If dewatering operations are required, the work method must be approved by the (project consultant) before being submitted to Abu Dhabi City Municipality for the issuance of the appropriate permit.
9. A sealed system for lowering the groundwater level within the excavation area must be carefully implemented so that it does not cause a drop in the water level outside the cutting (excavation) area, and the filters must be designed and implemented accurately to absolutely prevent the migration of fine soil particles.
10. The soil composition must be carefully checked to select a water lowering system that does not, under any circumstances, cause the dissolution of soil salts, which would result in a loss of its mass.
11. All necessary safety and security precautions must be taken, and appropriate warning signs must be placed to ensure the safety of pedestrians and vehicles day and night.
12. After completing the work, all debris must be removed from the site and the situation restored to its original state before the work began, according to the approved work method.
13. Upon completion of all works, the contractor must (immediately) submit a request to the consultant of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality to issue a work completion certificate (initial handover) to ensure proper execution and determine the warranty period.
14. After the warranty period ends, the contractor must submit a request for (final handover) to the consultant of the Internal Roads and Infrastructure Department - Abu Dhabi City Municipality, attaching the work completion certificate (initial handover).
15. Two copies of the as-built drawings of the actually executed works must be delivered to the Materials Quality Section - Abu Dhabi City Municipality, certified and attached with an official letter from the project consultant.
16. The contractor must comply with all data specified in the permit, the permit conditions, and the work method; otherwise, they will be subject to fines and legal accountability.

7.201 Permit for Pumping Groundwater into the Stormwater Drainage Network

• Procedure:

Infrastructure License

License Conditions

1. The following words and phrases shall have the meanings assigned to each of them:
   • a. The Department: The Department of Municipal Affairs – Emirate of Abu Dhabi.
   • b. The Concerned Municipality: Abu Dhabi City Municipality, Al Ain City Municipality, or the Western Region Municipality, as the case may be, which issued the license.
   • c. Service-related authorities: Any entity that has service lines at the work site.
   • d. The Concerned Authority: The entity legally authorized to approve any permit required for the execution and proper progress of temporary works.
   • e. The Competent Authority: Any entity technically responsible for certifying and approving the design or executive plans for the works.
   • f. The Contractor: Any natural or legal person who undertakes to execute infrastructure works or perform any of the works regulated by the applicable laws.
   • g. The Engineering Office: The office licensed to practice the profession in the field of infrastructure, roads, utilities, and civil construction in the Emirate of Abu Dhabi, which is entrusted with preparing designs and drawings for infrastructure works or any works and supervising their implementation, or is entrusted with preparing designs and drawings only without supervising the implementation, or is entrusted with supervising the implementation of works designed by other engineering offices.
2. The issuance of this license is subject to the terms and conditions of Law No. (4) of 1983 concerning the regulation of construction works and its amendments, and other applicable laws related to infrastructure works and the decisions issued in this regard by the Executive Council of the Emirate of Abu Dhabi.
3. The contractor and the supervising engineering office must provide all safety and security requirements and protection for residents and passersby near the work sites by placing secure fences, lighting, guards, and necessary warning and guidance signs around permanent and temporary work sites throughout the duration of the works.
4. The contractor must comply with all terms and conditions for implementing work permits issued by the concerned authority.
5. The contractor and the supervising engineering office shall take all necessary precautions to protect the infrastructure, buildings, and adjacent facilities to the duly licensed permanent or temporary works, including excavation works and groundwater withdrawal, applying all technical controls as well as those related to environmental, health, and structural safety, and continuously ensuring compliance with them until the official completion of those works.
6. If the licensee wishes to make any technical modifications to the licensed works, or any modifications to the spatial boundaries of the works, they must obtain a new license for the technical or spatial modifications or additional works.
7. The contractor must keep a copy of the license, a work clarification plan, and the executive plans approved by the Urban Planning Division in the concerned municipality and the competent authorities at the work site and show them to the engineers and inspectors of the concerned municipality upon site inspection.
8. The contractor must transport excavation materials sequentially with the work stages to the sites designated for this purpose by the concerned municipality or the concerned authority, and excavation works may not be carried out until after obtaining the required permits and approvals to transport the excavation output to the designated sites.
9. The contractor must remove the temporary fence and its debris and leave the site free of equipment and rubble and clean after the works are completely finished.
10. Housing for workers and technicians on the site is not permitted.
11. The contractor is not permitted to store or stack any soil materials or any other building materials over service lines or in work areas.
12. The licensee is not permitted to work outside the licensed boundaries specified by the Spatial Data Administration of the concerned municipality, under penalty of legal liability.
13. The contractor is not permitted to withdraw groundwater from the site except after obtaining the required approval from the concerned municipality according to Administrative Decision No. (1) of 2012 issued by the Department of Municipal Affairs in the Emirate of Abu Dhabi.
14. The contractor is not permitted to pump groundwater into the stormwater network except after obtaining the required permit from the concerned municipality.
15. The contractor is not permitted to cut asphalt pavements or remove sidewalks or landscaping except after obtaining the required permits and approvals from the concerned authority.
16. The contractor is not permitted to start work until after obtaining the project markers conformity certificate issued by the Survey Section in the concerned municipality, with the exception of service connections for plots designated for buildings and residential villas, provided that such works are within the immediate vicinity of these plots.
17. Service and infrastructure lines may not be buried until after the approval of the Survey Section in the concerned municipality and verification of the locations and levels of the new lines and their conformity with the executive plans approved by the concerned municipality.
18. No supervising engineering office or governmental or private project owner may issue final completion certificates for duly licensed works, including excavation and groundwater withdrawal, until it is confirmed that the contractor has restored the roads, sidewalks, service lines, infrastructure, and other public or private properties affected by those works to their original condition according to the conditions and specifications determined by the concerned and competent authorities, and a clearance certificate is issued from those authorities to that effect.
19. The contractor must protect the service lines during the execution of works in accordance with the applicable laws.
20. The Department or the concerned municipality shall not bear any responsibility arising from any damage to the land, buildings, infrastructure, roads, service routes, or any existing or temporary facility surrounding the licensed project site, and the responsibility shall be on the party that caused the damage.
21. The engineers and inspectors of the concerned municipality entrusted with monitoring the implementation of the conditions of this license shall issue warnings according to the approved forms for violation notices, giving the violating party a reasonable period, proportional to the type of violation, to remove it and correct the situation in accordance with the applicable laws.
22. If the contractor fails to remove the violation within the specified time, the director of the concerned municipality or their delegate shall refer the violation to the competent court in accordance with the applicable procedures for filing a lawsuit before it.
23. The director of the concerned municipality or their delegate may issue a temporary written order to stop the violating works until the violation is decided by the competent court.
24. The company or contractor carrying out the works at the site is considered to be acting on behalf of the owner or the project owner, and therefore, the violation notice and the stop-work order may be communicated and delivered to them.
25. The concerned municipality may, by administrative means, stop the execution of works that violate the conditions of this license and the provisions of the applicable laws, with the confiscation of the tools and equipment used in the execution.
26. The Department or the concerned municipality shall not bear any financial or moral obligations for the cancellation of the license granted as a result of providing incorrect data or documents.
