الرقابة على الحيوانات
رئيس دائرة البلديات والنقل
- بعد الاطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي في إمارة أبو ظبي وتعديلاته،
- وعلى القانون رقم (2) لسنة 2012 بشأن الحفاظ على المظهر العام والصحة والسكينة العامة في إمارة أبو ظبي،
- وعلى القانون رقم (30) لسنة 2019 بشأن إنشاء دائرة البلديات والنقل،
- وعلى قرار رئيس المجلس التنفيذي رقم (5) لسنة 2016 بشأن اللائحة التنفيذية للقانون رقم (2) لسنة 2012 بشأن الحفاظ على المظهر العام والصحة والسكينة العامة في إمارة أبو ظبي (الرقابة على الحيوانات)،
- وعلى القانون الاتحادي رقم (29) لسنة 2006 في شأن حقوق المعاقين وتعديلاته،
- وعلى القانون الاتحادي رقم (8) لسنة 2013 بشأن الوقاية من الأمراض الحيوانية المعدية والوبائية ومكافحتها وتعديلاته،
- وعلى القانون الاتحادي رقم (22) لسنة 2016 بشأن تنظيم حيازة الحيوانات الخطرة وتعديلاته،
- وعلى القرار الوزاري رقم (204) لسنة 2016 بشأن شروط تنظيم استيراد القطط والكلاب،
- وعلى قرار رئيس دائرة التخطيط العمراني والبلديات رقم (4) لسنة 2018 بإصدار اللائحة التنفيذية للقانون رقم (2) لسنة 2012 (الرقابة على الحيوانات)،
- وبناءً على ما عُرض على المجلس التنفيذي، وموافقة المجلس عليه،
تقرر ما يلي:
المادة (1)
يستبدل بتعريف "حيوانات الرفقة" الوارد في المادة رقم (1) من قرار رئيس الدائرة رقم (4) لسنة 2018 المشار إليه التعريف التالي:
"حيوانات الرفقة: الحيوانات الأليفة التي اعتاد الإنسان على تربيتها والاعتناء بها لمرافقته بما فيها حيوانات الخدمة".
تضاف التعريفات التالية إلى المادة رقم (1) من قرار رئيس الدائرة رقم (4) لسنة 2018 المشار إليه:
| الأماكن العامة المفتوحة: | المنتزهات والصحاري والشواطئ والطرقات، وما في حكمها وبغض النظر عن ما يفرض عليها من قيود. |
| الأماكن العامة المغلقة: | الأبنية المغلقة التي تستخدم من قبل أفراد المجتمع، ويكون حق استخدامها للجميع مثل مباني الجهات الحكومية، والمراكز التجارية، والأسواق المغلقة، والمراكز الثقافية، والمستشفيات، والمحلات التجارية، والبنوك والفنادق والمدارس وما في حكمها، وبغض النظر عن ما يفرض عليها من قيود. |
| حيوانات الخدمة: | الحيوانات المدربة للقيام بمهام خاصة لحائزها، على أن تكون هذه المهام التي تم تدريب حيوان الخدمة عليها مرتبطة بشكل مباشر بحالة حائزها. |
| حائز حيوان الخدمة: | الفرد من فئة ذوي الإعاقة، أو المصاب بأي نوع من أنواع الإصابة التي تتطلب حيازة حيوانات الخدمة، وفقًا لما تحدده الجهات المعنية في هذا الشأن. |
المادة (2)
تضاف المواد أرقام (4) مكررًا (1) و (4) مكررًا (2) إلى قرار رئيس الدائرة رقم (4) لسنة 2018 المشار إليها وفقاً للآتي:
المادة (4) مكررًا (1):
- يسمح بدخول حيوانات الخدمة بمرافقة حائزها، إلى الأماكن العامة المفتوحة والمغلقة، ووسائل النقل العامة، باستثناء دور العبادة.
- يجب أن يكون حائزي حيوانات الخدمة من ذوي الإعاقة أو المصابين بأي نوع من أنواع الإصابة الذين تتطلب حالتهم مرافقة هذه الحيوانات.
- لا تستوفى أية رسوم لدخول حيوانات الخدمة إلى الأماكن العامة في الإمارة.
المادة (4) مكررًا (2):
يلتزم حائز حيوان الخدمة عند دخول الأماكن العامة بالشروط الآتية:
- المحافظة على نظافة حيوان الخدمة وأدواته ومعداته.
- التأكد من خلو حيوان الخدمة من أي أعراض مرضية خارجية.
- تقييد حيوان الخدمة بواسطة رباط مرن قابل للطي الآلي على العنق أو الصدر.
- وضع سرج خاص لنوع الحيوان، يكتب عليها باللغتين العربية والانجليزية عبارة (حيوان خدمة، Service Animal).
- توفير قلادة حيوان الخدمة (ID Tag) وشهادة تسجيل حيوان صادرة عن البلدية المعنية.
- السيطرة التامة على حيوان الخدمة، وتجنب دخول الأماكن العامة في حال عدم القدرة على السيطرة عليه بشكل كامل.
- التخلص الفني والصحي من بقايا وفضلات حيوانات الخدمة.
المادة (3)
يضاف إلى جدول المخالفات والغرامات المرفق بقرار رئيس الدائرة رقم (4) لسنة 2018 المشار إليه المخالفات والغرامات المقررة لها وفقا للآتي:
المادة (4)
يُنشر هذا القرار في الجريدة الرسمية، ويُعمل به بعد ثلاثة أشهر من تاريخ نشره.

Concerning the Amendment of Some Provisions of the Chairman of the Department's Decision No. (4) of 2018
Regarding the Issuance of the Executive Regulations of Law No. (2) of 2012
Animal Control
Chairman of the Department of Municipalities and Transport
- Having reviewed Law No. (1) of 1974 regarding the reorganization of the governmental apparatus in the Emirate of Abu Dhabi and its amendments,
- And Law No. (2) of 2012 concerning the preservation of public appearance, health, and tranquility in the Emirate of Abu Dhabi,
- And Law No. (30) of 2019 concerning the establishment of the Department of Municipalities and Transport,
- And the Chairman of the Executive Council's Decision No. (5) of 2016 concerning the Executive Regulations of Law No. (2) of 2012 regarding the preservation of public appearance, health, and tranquility in the Emirate of Abu Dhabi (Animal Control),
- And Federal Law No. (29) of 2006 concerning the rights of persons with disabilities and its amendments,
- And Federal Law No. (8) of 2013 concerning the prevention and control of contagious and epidemic animal diseases and its amendments,
- And Federal Law No. (22) of 2016 concerning the regulation of possession of dangerous animals and its amendments,
- And Ministerial Decision No. (204) of 2016 concerning the conditions for regulating the import of cats and dogs,
- And the Chairman of the Department of Urban Planning and Municipalities' Decision No. (4) of 2018 issuing the Executive Regulations of Law No. (2) of 2012 (Animal Control),
- And based on what was presented to the Executive Council, and its approval,
It is decided as follows:
Article (1)
The definition of "Companion Animals" mentioned in Article (1) of the Chairman of the Department's Decision No. (4) of 2018 referred to above shall be replaced with the following definition:
"Companion Animals: Domestic animals that humans are accustomed to raising and caring for as companions, including service animals."
The following definitions shall be added to Article (1) of the Chairman of the Department's Decision No. (4) of 2018 referred to above:
| Open Public Places: | Parks, deserts, beaches, roads, and the like, regardless of any restrictions imposed on them. |
| Closed Public Places: | Closed buildings used by members of the community, where the right of use is for everyone, such as government buildings, shopping centers, indoor markets, cultural centers, hospitals, shops, banks, hotels, schools, and the like, regardless of any restrictions imposed on them. |
| Service Animals: | Animals trained to perform specific tasks for their handler, provided that these tasks for which the service animal was trained are directly related to the handler's condition. |
| Service Animal Handler: | An individual with a disability, or who suffers from any type of injury that requires possession of a service animal, as determined by the concerned authorities in this regard. |
Article (2)
Articles (4) bis (1) and (4) bis (2) shall be added to the Chairman of the Department's Decision No. (4) of 2018 referred to above, as follows:
Article (4) bis (1):
- Service animals are permitted to enter open and closed public places, and public transportation, accompanied by their handler, with the exception of places of worship.
- Service animal handlers must be persons with disabilities or individuals with any type of injury whose condition requires the accompaniment of these animals.
- No fees shall be collected for the entry of service animals into public places in the Emirate.
Article (4) bis (2):
A service animal handler must adhere to the following conditions when entering public places:
- Maintain the cleanliness of the service animal and its tools and equipment.
- Ensure the service animal is free from any external symptoms of disease.
- Restrain the service animal with a flexible, automatically retractable leash on the neck or chest.
- Place a special harness on the animal, with the phrase "حيوان خدمة, Service Animal" written on it in both Arabic and English.
- Provide the service animal's ID tag and an animal registration certificate issued by the concerned municipality.
- Maintain complete control over the service animal, and avoid entering public places if unable to control it completely.
- Dispose of the remains and waste of service animals in a technical and sanitary manner.
Article (3)
The following violations and their prescribed fines shall be added to the table of violations and fines attached to the Chairman of the Department's Decision No. (4) of 2018 referred to above:
Article (4)
This decision shall be published in the Official Gazette and shall come into effect three months after the date of its publication.

| 27 | Failure to place a warning sign at the entrance of a residence or farm if a dog is present inside. | 2000 |
| 28 | Taking animals to shopping malls and restaurants. | 2000 |
| 29 | Failure of building and residential complex owners to post a sign or sticker indicating whether animals are allowed or not. | 3000 |
| 30 | Bringing or leaving dangerous, prohibited, or unusual animals in public places. | 5000 |
| 31 | Failure to provide certificates proving that the animals have been periodically examined by a licensed veterinarian and have received necessary preventive and therapeutic veterinary services to ensure the animal is free from common animal diseases. | 1000 |
| 32 | Failure to vaccinate animals against common diseases and provide periodic treatments. | 1000 |
| 33 | Engaging in the sale or purchase of animals without obtaining the necessary licenses and approvals from the concerned municipality. | 10000 |

| 36 | Failure to contract with a licensed veterinary clinic to provide necessary veterinary and preventive services for the animals periodically. | 1000 |

| 38 | Failure to provide instructional guidelines explaining the animal care requirements at the time of sale. | 1000 |
| 39 | Failure to provide special safety and protection equipment such as protective clothing for workers and first aid for those present in sales shops. | 1000 |
| 40 | Mistreating an animal and failing to provide it with the necessary care and a suitable environment. | 3000 |
